और नियत अवधि के भीतर कोई भी आक्षेप या सुझाव प्राप्त नहीं हुए हैं;

2222.... नियम 10 कानियम 10 कानियम 10 कानियम 10 का संशोधन संशोधन संशोधन संशोधन....--------हिमाचल प्रदेश नगरपालिका (वार्ड का परिसीमन और, आरक्षण) नियम, 1994 (जिसे इसमें इसके पश्चात् "उक्त नियम" कहा गया है) के नियम 10 में,--
(क) उप नियम (4) और (5) में "एक-तिहाई" शब्दों और चिन्ह के स्थान पर "आधे" शब्द रखा जाएगा; और
(ख) उप नियम (9) के पश्चात् निम्नलिखित उप नियम (9-क) अन्तःस्थापित किया जाएगा, अर्थात्ः--
"(9-क) इन नियमों में अन्तर्विष्ट किसी बात के होते हुए भी, सीटों (स्थानों) के आरक्षण का रोस्टर हिमाचल प्रदेश नगरपालिका (वार्ड का परिसीमन और आरक्षण) संशोधन नियम, 2010 के प्रारम्भ राजपत्र, हिमाचल प्रदेश, 24 नवम्बर, 2010/3 अग्रहायण, 1932 6043 के पश्चात् होने वाले निर्वाचनों के लिए प्रथम चरण से प्रवर्तित होगा मानो उक्त निर्वाचन पूर्वोक्त नियमों के अधीन प्रथम बार संचालित किए जा रहे हैं और तत्पश्चात् सीटों (स्थानों) का आरक्षण इन नियमों के अधीन नगरपालिकाओं के विभिन्न वार्डों में दोहराया जाएगा।''।

No. UD-A (3)-8/2010.—Whereas the draft Himachal Pradesh Municipal Municipal (De- limitation and Reservation of Wards) (Amendment) Rules, 2010 were published in the Rajpatra, Himachal Pradesh (extra ordinary) dated 12-11-2010 vide this Department notification of even number dated 12-11-2010 for inviting objection(s) or suggestion(s) from the person(s) likely to be effected thereby as required under sub-section(5) of section 279 of the Himachal Pradesh Act, 1994 And whereas, no objection(s) or suggestion(s) were received within the stipulated period ;
Now therefore, in exercise of the powers conferred by section 279 of the Himachal Pradesh Municipal Act, 1994 (Act No. 13 of 1994), the Governor, Himachal Pradesh in consultation with the State Election Commission hereby makes the following rules, namely:—
1. Short title.—these rules may be called the Himachal Pradesh Municipal (De-limitation and Reservation of Wards) Amendment Rules, 2010.
2. Amendment of rule 10.—In rule 10 of the Himachal Pradesh Municipal (Delimitation and Reservation of Wards) Rules 1994 (hereinafter referred to as the 'said rules'),—
(a) in sub-rules (4) and (5) for the words and sign "one-third", the words and sign "one- half" shall be substituted; and
(b) after sub-rule (9) the following sub-rule(9-A) shall be inserted, namely :—
"(9-A) Notwithstanding anything contained in these rules, the roster of reservation of seats shall operate from the initial stage for the elections to be held after the commencement of the Himachal Pradesh Municipal (De-limitation and Reservation of Wards) Amendment Rules, 2010 as if the said elections are being conducted for the first time under the rules ibid and thereafter, the reservation of seats shall be rotated to different wards of municipalities under this rule".

1111.... सेक्षिप्त नाम सेक्षिप्त नाम सेक्षिप्त नाम सेक्षिप्त नाम....--------इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश नगरपालिका (अध्यक्ष और उपाध्यक्ष के पद के आरक्षण और निर्वाचन) संशोधन नियम, 2010 है।
2222.... नियम 2 कानियम 2 कानियम 2 कानियम 2 का ससससंंंंश्श्श्शोधनाोधनाोधनाोधन....--------हिमाचल प्रदेश नगरपालिका (अध्यक्ष और उपाध्यक्ष के पद के आरक्षण और निर्वाचन) नियम, 1995 (जिन्हें इसमें इसके पश्चात् ''उक्त नियम'' कहा गया है) के उप नियम (1) में खण्ड (ख) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्ः--
''(ख) ''अध्यक्ष'' से अधिनियम की धारा 22 के अधीन नगरपालिका के मतदाओं द्वारा अध्यक्ष के रूप में निर्वाचित व्यक्ति अभिप्रेत है।''
नियम 3 कानियम 3 कानियम 3 कानियम 3 का ससससंंंंश्श्श्शोधनाोधनाोधनाोधन....--------'उक्त नियमों' के नियम 3 में;--
(i) उप नियम (5) में, ''एक-तिहाई'' शब्दों और चिन्ह के स्थान पर ''आधे'' शब्द रखा जाएगा;
(ii) उप नियम (7) में, '0'एक-तिहाई'' शब्दों और चिन्ह के स्थान पर ''आधे'' शब्द रखा जाएगा;
( iii) उपनियम (8) के विद्यमान परन्तुक के पश्चात् निम्नलिखित परन्तुक अन्तःस्थापित किया जाएगा, अर्थात्ः--
''परन्तु यह और कि किसी विशेष प्रवर्ग के लिए आरक्षण को ऐसी नगरपालिका में चक्रानुक्रमित नहीं किया जाएगा जहां उस प्रवर्ग की जनसंख्या उस नगरपालिका की कुल जनसंख्या के पांच प्रतिशत से कम है।''।
( iv) उप नियम (8) के पश्चात् निम्नलिखित नया उप नियम अन्तःस्थापित किया जाएगा, अर्थात्ः-- ''(8-क) इन नियमोंं में अन्तर्विष्ट किसी बात के होते हुए भी, पदोें के आरक्षण का रोस्टर हिमाचल प्रदेश नगरपालिका (अध्यक्ष और उपाध्यक्ष के आरक्षण और निर्वाचन) संशोधन नियम, 2010 के प्रारम्भ के पश्चात् होने वाले निर्वाचनों के लिए प्रथम चरण से प्रवर्तित होगा मानों उक्त निर्वाचन पूर्वोक्त नियमों के अधीन प्रथम बार संचालित किए जा रहे हैं, और राजपत्र, हिमाचल प्रदेश, 24 नवम्बर, 2010/3 अग्रहायण, 1932 6045 तत्पश्चात् पदों का आरक्षण इन नियमों के अधीन विभिन्न नगरपालिकाओं में दोहराया जाएगा।''।

5555.... नियम 6 कानियम 6 कानियम 6 कानियम 6 का ससससंंंंश्श्श्शोधनाोधनाोधनाोधन....--------उक्त नियमों के नियम 6 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्ः--
''(6) अध्यक्ष/उपाध्यक्ष के निर्वाचन के लिए अभ्भर्थियों का नामांकन और उनके लिए मतपत्र-(1) नगरपालिका क्षेत्र में मतदाता के रूप में रजिस्ट्रीकृत कोई व्यक्ति, किसी अन्य व्यक्ति द्वारा, जो प्रारूप-III में उस नगरपालिका की निर्वाचक नामावली में मतदाता के रूप में भी रजिस्ट्रीकृत है, अध्यक्ष/उपाध्यक्ष के लिए अभ्यर्थी के रूप में नामांकित किया जा सकेगा।

Shimla-2, the 24th November, 2010
No. UD-A (3)-8/2010.—Whereas the draft Himachal Pradesh Municipal (Reservation and Election to the office of the President and Vice President) Amendment Rules, 2010 were publishedराजपत्र, हिमाचल प्रदेश, 24 नवम्बर, 2010/3 अग्रहायण, 1932 6047 in the Rajpatra, Himachal Pradesh (extra-ordinary) dated 12-11-2010 vide this Department notification of even number dated 12-11-2010 for inviting objection(s) or suggestion(s) from the person(s) likely to be effected thereby as required under sub-section(5) of section 279 of the Himachal Pradesh Act, 1994;
And whereas, the objections and suggestions received within the stipulated period has been duly considered.
Now therefore, in exercise of the powers conferred by section 279 of the Himachal Pradesh Municipal Act, 1994 (Act No. 13 of 1994), the Governor, Himachal Pradesh in consultation with the State Election Commission hereby makes the following rules, namely:—
1. Short title.—These rules may be called the Himachal Pradesh Municipal (Reservation and Election to the office of the President and Vice President) Amendment Rules, 2010.
2. Amendment of rule 2.—In rule 2 of the Himachal Pradesh Municipal (Reservation and Election to the office of the President and Vice President ) Rules 1995 (hereinafter referred to as the 'said rules'), in sub-rule(1) for clause (b), the following shall be substituted, namely :—
"(b) 'Chairperson' means the person elected as a President by the voters of a Municipality under section 22 of the Act."
3. Amendment of rule 3.—In rule 3 of the 'said rule',—
(i) in sub-rule (5), for the words and sign "onethird", the words and sign "one-half" shall be substituted;
(ii) in sub-rule (7), for the words and sign "one third", the words and sign, "one-half" shall be substituted;
(iii) in sub-rule (8), after the existing proviso, the following proviso shall be inserted, namely :—
"Provided further that the reservation for a particular category shall not be rotated in such a Municipality where the population of that category is less than 5% of the total population of that Municipality".
(iv) after sub-rule (8) the following new sub-rule shall be inserted, namely :—
"(8-A) Notwithstanding anything contained in these rules, the roster of reservation of offices shall operate from the initial stage for the elections to be held after the commencement of the Himachal Pradesh Municipal (Reservation and Election to the office of the President and vice President) Amendment Rules, 2010 as if the said elections are being conducted for the first time under the rules ibid and thereafter, the reservation of offices shall be rotated to different Municipalities under this rule".
4. Omission of rules 5, 7, 8, 8-A, and 8-B.—Rules 5, 7, 8, 8-A and 8-B of the 'said rules' shall be omitted.
5. Amendment of rule 6.—For rule 6 of the said rules the following shall be substituted, namely :—
"6. Nomination of candidates for the election of President/Vice President and ballot papers therefor—
6048 राजपत्र, हिमाचल प्रदेश, 24 नवम्बर, 2010/3 अग्रहायण, 1932(1) Any person registered a voter within the municipality may be nominated as a candidate for President/Vice President by another person, who is also a voter registered in the electoral roll of that Municipality in Form-III.
(2) The ballot paper in Form-I shall be used for election of President and Vice- President."
6. Addition of rule 11.—After rule 10 of the said rules, the following new rule shall be added, namely :—
"11. Application of Himachal Pradesh Municipal Election Rules – In addition to these rules, the procedure laid down in the Himachal Pradesh Municipal Election Rules, 1994 shall mutatis- mutandis apply for the purpose of these rules.
7. Substitution of Form-I.—For FORM-I appended to the said rules, the following shall be substituted, namely :—

No. SEC-16-21/97-I-3304-67.—Whereas the State Election Commission has framed The Himachal Pradesh Panchayats and Municipalities Elections (disclosure of Specified Information by the Candidates) Regulations, 2004 and notified the said Regulations vide Notification No. SEC-16-21/97-123 dated 17th February, 2004;
Whereas Section 36 of the HP Municipal Corporation Act, 1994 has been amended Act No. 11 of 2010 and it has been provided that there shall be direct election to Mayor and Deputy Mayor of the Municipal Corporation;
Whereas Section 22 of the HP Municipal Act, 1994 has also been amended vide Act No. 12 of 2010 and it has provided that there shall be direct election to President and Vice President of Municipal Councils and Nagar Panchayats;
6050 राजपत्र, हिमाचल प्रदेश, 24 नवम्बर, 2010/3 अग्रहायण, 1932Therefore, the State Election Commission in exercise of the powers vesting in it under Article 243-ZA of the Constitution of India, Section 9 of the Himachal Pradesh Municipal Corporation Act, 1994, Section 281 of the Himachal Pradesh Municipal Act 1994, and all other powers enabling it in this behalf hereby directs that these Regulations shall also be applicable to the candidates for the election of Mayor/Deputy Mayor of Municipal Corporation and President/Vice President of Municipal Councils, Nagar Panchayats. The candidates for the election of the said offices shall submit the specified information alongwith their nomination papers in accordance with the directive No. 4 read with clause (2) of regulation 5 of the Regulations ibid.
