भारत गणराज्य के इकसठवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित होः-

1111.... संक्षिप्त नाम और प्रारम्भसंक्षिप्त नाम और प्रारम्भसंक्षिप्त नाम और प्रारम्भसंक्षिप्त नाम और प्रारम्भ....--------(1) इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश नगरपालिका (संशोधन) अधिनियम, 2010 है।

(2) यह 16 नवम्बर, 2010 को प्रवृत्त हुआ समझा जाएगा।

2222.... धारा 11 का धारा 11 का धारा 11 का धारा 11 का संशोधनसंशोधनसंशोधनसंशोधन....--------हिमाचल प्रदेश नगरपालिका अधिनियम, 1994 (जिसे इसमें इसके पश्चात्‌ "मूल अधिनियम" कहा गया है) की धारा 11 की उपधारा (1) के प्रथम परन्तुक में "और उपाध्यक्ष" शब्दों का लोप किया जाएगा।

3333.... धारा 22 का संशोधनधारा 22 का संशोधनधारा 22 का संशोधनधारा 22 का संशोधन....--------मूल अधिनियम की धारा 22 के प्रथम परन्तुक में "और उपाध्यक्ष" शब्दों का लोप किया जाएगा।

4444.... 2010 के अध्यादेश संख्यांक 9 का निरसन और व्यावृत्तियां 2010 के अध्यादेश संख्यांक 9 का निरसन और व्यावृत्तियां....--------(1) हिमाचल प्रदेश नगरपालिका 2010 के अध्यादेश संख्यांक 9 का निरसन और व्यावृत्तियां 2010 के अध्यादेश संख्यांक 9 का निरसन और व्यावृत्तियां (संशोधन) अध्यादेश, 2010 का एतद्‌द्वारा निरसन किया जाता है।

(2) ऐसे निरसन के होते हुए भी इस प्रकार निरसित अध्यादेश के अधीन की गई कोई कार्रवाई या की गई कोई बात इस अधिनियम के तत्स्थानी उपबन्धों के अधीन की गई समझी जाएगी।

THE HIMACHAL PRADESH MUNICIPAL (SECOND AMENDMENT) ACT, 2010

(AS ASSENTED TO BY THE GOVERNOR ON 13TH JANUARY, 2011)

ACT

further to amend the Himachal Pradesh Municipal Act, 1994 (Act No. 13 of 1994).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-first Year of the Republic of India as follows:—

1. Short title and commencement.—(1) This Act may be called the Himachal Pradesh Municipal (Amendment) Act, 2010.

(2) It shall be deemed to have come into force on the 16th day of November, 2010.

2. Amendment of section 11.—In section 11 of the Himachal Pradesh Municipal Act, 1994, (hereinafter referred to as the "principal Act"), in sub-section(1), in first proviso, the words and sign "and Vice-President" shall be omitted.

3. Amendment of section 22.—In section 22 of the principal Act, in first proviso, the words and sign "and Vice-President" shall be omitted.

4. Repeal of H.P. Ordinance No. 9 of 2010 and savings.—(1) The Himachal Pradesh Municipal (Amendment) Ordinance, 2010 is hereby repealed.

(2) Notwith standing such repeal, any action taken or any thing done under the Ordinance so repealed shall be deemed to have been taken or done under the corresponding provisions of this Act.

NOTIFICATION

Shimla-2, the 13th January 2011

No. EXN-F(10)-7/2010.—The Governor of Himachal Pradesh, in exercise of powers vested in her under clause (c) of section 6, sections 8 and 10, clause (b) of section 13, sections 14, 45, 46, 47, 49, 58 and 73 of the Punjab Excise Act, 1914 (1 of 1914), as applied to Himachal Pradesh and as applicable in the territories transferred to Himachal Pradesh under section 5 of the Punjab Re- Organisation Act, 1966 (31 of 1966), is pleased to direct that the Himachal Pradesh (Excise Powers and Appeal) Orders, 1965 notified vide notification No. 1-17/64-E & T dated 7th August, 1965, and as amended from time to time, shall be amended as follows, namely :-

AMENDMENTS

1. Amendment of Order 4.—In Order 4 of the Himachal Pradesh (Excise Powers and Appeal) Orders, 1965 (hereinafter called the "said Orders"), for the words "Excise and Taxation Officers", the sign and words ",Excise and Taxation Officers, Assistant Excise and Taxation Officers" shall be substituted.

2. Amendment of Order 5.—In GROUP "A" of Order 5 of the said Orders,- (i) at serial No. 4, for the words "and Excise and Taxation Officers", the sign and words ", Excise and Taxation Officers and Assistant Excise and Taxation Officers" shall be substituted; and8020 राजपत्र, हिमाचल प्रदेश, 14 जनवरी, 2010/24 पौष, 1932 (ii) after serial number 6., the following serial No. 6-A. shall be inserted, namely :-

"6-A. All Assistant Excise and Taxation Officers.".

3. Amendment of Order 10.—In Schedule appended below Order 10 of the said Orders, —

(i) at serial Nos. 3 in column No. 2, after the words and sign "Excise and Taxation Officer/", the words and sign "Assistant Excise and Taxation Officer/" shall be inserted;

(ii) at serial Nos. 4 in column No. 2, after the words and sign "Excise and Taxation Officer/", the words and sign "Assistant Excise and Taxation Officer/" shall be inserted;

(iii) at serial No. 5 in column No. 2, before the words "Excise and Taxation Inspector", the words "Assistant Excise and Taxation Officer or" shall be inserted;

(iv) at serial No. 7 in column No. 2, before the words "Excise and Taxation Inspector", the words "Assistant Excise and Taxation Officer or" shall be inserted;

(v) at serial No. 7 in column No. 3, before the words "Incharge of the Circle", appearing after the words "officer" the sign and the words "/Assistant Excise and Taxation Officer" shall be inserted;

(ख) क्रम संख्या 5 में, "य" चिन्ह के पश्चात्‌ आए "और" शब्द का लोप किया जाएगा और तत्पश्चात्‌ नई क्रम संख्या (5-A) अन्तःस्थापित की जाएगी, अर्थात्‌ः-

No. EXN-F(10)-7/2010(i).—The Governor of Himachal Pradesh, in exercise of the powers vested in her under sub-section (1) of Section 7 read with sub-section 2 of section 19 of the Himachal Pradesh Taxation (on Certain Goods Carried by Road Act, 1999 (Act No. 16 of 1999), is pleased to amend the notification No. EXN-F (1)2/91 dated 18th January, 1992 published in Rajpatra Himachal Pradesh dated 28th January, 1992 (hereinafter called the "said notification"), as follows, namely:-

AMENDMENTS

1. In para 2 of the said notification, --

(a) at serial No. (3), for the words "and Excise and Taxation Officers", the sign and the words ", Excise and Taxation Officers and the Assistant Excise and Taxation Officers" shall be substituted; and

(b) at serial No. (5), the word "and" occurring after the sign ";" shall be omitted and thereafter the following serial No. (5-A) shall be inserted namely:-

"(5-A) all Assistant Excise and Taxation Officers; and";

(i) in part (vii), for the words "and Excise and Taxation Officers", the sign and the words ", Excise and Taxation Officers and the Assistant Excise and Taxation Officers" shall be substituted ; and

(ii) in part (viii), after the words "All Excise and Taxation Officers" the words "and Assistant Excise and Taxation Officers" shall be substituted.

2. In para 3 of the said notification, --राजपत्र, हिमाचल प्रदेश, 14 जनवरी, 2010/24 पौष, 1932 8023 (a) at Sr. No. (iii), for the words "and Excise and Taxation Officers", the sign and the words ", Excise and Taxation Officers and the Assistant Excise and Taxation Officers" shall be substituted ; and

(b) after serial No. (v), the following serial No. (v-a) shall be inserted namely :-

"(v-a). Assistant Excise and Taxation Officers.".

3. In para 4 of the said notification, --

3. हिमाचल प्रदेश की राज्यपाल, इसके अतिरिक्त उक्त अधिनियम की धारा 34 की उपधारा (7) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, सहायक आबकारी एवं कराधान अधिकारियों को इस अधिसूचना के पैरा 1 में यथाविनिर्दिष्ट उनकी अपनी-अपनी अधिकारिता में उक्त धारा के अन्तगर्त आने वाले मामलों में जांच का संचालन करने के लिए प्राधिकृत करती हैं।

No. EXN-F(10)-7/2010(ii).—The Governor of Himachal Pradesh, in exercise of the powers vested in her under sub-section (1) of Section 3 of the Himachal Pradesh Value Added Tax Act, 2005 (Act No. 12 of 2005) (hereinafter called the "said Act") is pleased to appoint all the Assistant Excise and Taxation Officers to assist the Commissioner in carrying out the purposes of the said Act within their territorial jurisdiction, that is, within the areas comprised in the Headquarters/ Zone/District/circle of their posting, as the case may be.

2. The Governor of Himachal Pradesh in exercise of the powers conferred by subsection (2) of section 3 of the said Act, is further pleased to appoint all the Assistant Excise and Taxation Officers to exercise the powers and to perform the duties and functions of the Assessing Authority subject to allocation of work / files / cases by Excise & Taxation Commissioner within the meaning of clause (b) of section 2 of the said Act.

3. The Governor of Himachal Pradesh in exercise of the powers conferred by subsection (7) of section 34 of the said Act, is further pleased to authorise the Assistant Excise and Taxation Officers to conduct the enquiry into the matter covered under the said section within their respective jurisdiction as specified in para 1 of this notification.

The Governor of Himachal Pradesh in exercise of the powers conferred by subsection (2) of section 3 read with section 2 (a) of the said Act, is further pleased to authorise all the Assistant Excise and Taxation Officers (other than those posted at the check-posts or barriers, Breweries & Distilleries) to exercise the powers and to perform the duties and functions of the Assessing Authority subject to allocation of work/files/cases by Excise & Taxation Commissioner within the meaning of clause (a) of section 2 of the said Act.

(ख) क्रम संख्या 5 में, ";" चिन्ह के पश्चात्‌ शब्द "और" का लोप किया जाएगा और तत्पश्चात्‌ निम्नलिखित नई क्रम संख्या (5- A) अन्तःस्थापित की जाएगी, अर्थातः्‌ -

"(5- A) सहायक आबकारी एवं कराधान अधिकारी; और";

No. EXN-F(10)-7/2010(vi).—The Governor of Himachal Pradesh, in exercise of the powers vested in her under subsection (1) of Section 7 of the Himachal Pradesh Passengers and Goods Taxation Act, 1955 (Act No. 15 of 1955), is pleased to amend the notification No. EXN- F(18)1/96 dated 1st October, 1996 published in Rajpatra Himachal Pradesh dated 1st October, 1996 (hereinafter called the "said notification", as follows, namely :-

AMENDMENTS

1. In para 2 of the said notification,—

(a) at Sr. No. 3, for the words "and Excise and Taxation Officers", the sign and the words ", Excise and Taxation Officers and the Assistant Excise and Taxation Officers" shall be substituted ; and

(b) at serial No. 5, the word "and" occurring after the sign ";" shall be omitted and thereafter the following serial No. (5-A) shall be inserted namely :-

"(5-A) Assistant Excise and Taxation Officers; and" ;

(i) in part (vii), for the words "and Excise and Taxation Officers", the sign and the words ", Excise and Taxation Officers and the Assistant Excise and Taxation Officers" shall be substituted ; and

(ii) in part (viii), after the words "All Excise and Taxation Officers" the words "and Assistant Excise and Taxation Officers" shall be inserted.

2. In para 3 of the said notification, --

(b) after serial No. (v), the following serial No. (v-a) shall be inserted namely:-
