((((एएएएफफफफ) ) ) ) 1-9/94-540-1-9/94-540-1-9/94-540-1-9/94-540-VIII.—यतः राज्यपाल, हिमाचल प्रदेश को प्रतीत होता है कि केन्द्रीय सरकार रेलवे विभाग के द्वारा अपने व्यय पर सार्वजनिक प्रयोजन हेतू नामतः गांव नलोटी, तहसील अम्ब, जिला ऊना में नंगल-तलवाड़ा रेल लाईन (अम्ब-अन्दौरा से दौलतपुर तक) के निर्माण के लिए भूमि अर्जित करनी अपेक्षित है । अतएव एतद्‌द्वारा यह घोषित किया जाता है कि निम्नलिखित विस्तृत विवरणी में वर्णित भूमि उपर्युक्त प्रयोजन के लिए अपेक्षित है ।

1111.... ससससंक्षिप्त नाम और प्रारम्भ ंक्षिप्त नाम और प्रारम्भ....----(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश स्वास्थ्य एवं परिवार ंक्षिप्त नाम और प्रारम्भ ंक्षिप्त नाम और प्रारम्भ कल्याण विभाग मुख्य प्रयोगशाला तकनीशियन, वर्ग-III (अराजपत्रित) भर्ती और प्रोन्नति नियम, 2011 है। (2) ये नियम राजपत्र, हिमाचल प्रदेश मेें प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2222.... निरसन और व्यावृत्तिया निरसन और व्यावृत्तियांंंं....----(i) इस विभाग की अधिसूचना संख्या स्वास्थ्य-ए-ए(3)-29/94 निरसन और व्यावृत्तिया निरसन और व्यावृत्तिया तारीख 29-7-1997 द्वारा अधिसूचित हिमाचल प्रदेश स्वास्थ्य एवं परिवार कल्याण विभाग मुख्य प्रयोगशाला तकनीशियन, वर्ग-III (अराजपत्रित) भर्ती और प्रोन्नति नियम, 1997 का एतद्‌द्वारा निरसन किया जाता है । (ii) ऐसे निरसन के होते हुए भी उपर्युक्त उप-नियम (i) के अधीन इस प्रकार निरसित नियमों के अधीन की गई कोई नियुक्ति, बात या कार्रवाई इन नियमों के अधीन विधिमान्य रूप में की गई समझी जाएगी।

परन्तु प्रोन्नति के प्रयोजन के लिए प्रत्येक कर्मचारी को, जनजातीय/दुर्गम क्षेत्रों में पद (पदों) की ऐसे क्षेत्रों में पर्याप्त संख्या की उपलब्धता के अध्यधीन, कम से कम एक कार्यकाल तक सेवा करनी होगी :

परन्तु यह और कि उपर्युक्त परन्तुक (1) उन कर्मचारियों के मामले में लागू नहीं होगा जिनकी अधिवर्षिता के लिए पांच वर्ष या उससे कम की सेवा शेष रही हों :

परन्तु यह और भी कि उन अधिकरियों/कर्मचारियों को, जिन्होंने जनजातीय/दुर्गम क्षेत्र में कम से कम एक कार्यकाल तक सेवा नहीं की है, ऐसे क्षेत्र में उसके अपने संवर्ग (काडर) में सर्वथा वरिष्ठता के अनुसार स्थानान्तरण किया जाएगा ।

स्पष्टीकरण-I....-उपर्युक्त परन्तुक के प्रयोजन के लिए जनजातीय/दुर्गम क्षेत्रों में "कार्यकाल" से साधारणतया तीन वर्ष की अवधि या प्रशासनिक अपेक्षाओं और कर्मचारी द्वारा किए गए कार्य को ध्यान में रखते हुए ऐसे क्षेत्रों में तैनाती की इससे कम अवधि अभिप्रेत होगी ।

सपष्टीकरण-II.-उपर्युक्त परन्तुक के प्रयोजन के लिए जनजातीय/दुर्गम क्षेत्र निम्न प्रकार से होंगेः- राजपत्र, हिमाचल प्रदेश, 18 मई, 2011/28 वैशाख, 1933 733 1 जिला लाहौल एवं स्पिति । 2 चम्बा जिला का पांगी और भरमौर उप मण्डल । 3 रोहडू उप मण्डल का डोडरा क्वार क्षेत्र । 4 जिला शिमला की रामपुर तहसील का पन्द्रह बीस परगना, मुनीष दरकाली और ग्राम पंचायत काशापट ।

5 कुल्लू जिला का पन्द्रह बीस परगना । 6 कांगडा़ जिला के बैजनाथ उप मण्डल का बड़ा भंगाल क्षेत्र । 7 जिला किन्नौर । 8 सिरमोर जिला में उप तहसील कमराउ के काठवाड़ और कोरगा पटवार वृत्त, रेणुकाजी तहसील के भलाड़-भलौना और सांगना पटवार वृत्त और शिलाई तहसील के कोटा पाब पटवार वृत्त । 9 मण्डी जिला में करसोग तहसील का खन्योल-बगड़ा पटवार वृत्त, बाली चौकी उप तहसील के गाडा गोसाइर्,ं मठयानी, घनयाड,़ थाची, बागी, सोमगाड़ और खोलानाल, पद्धर तहसील के झारवाड,़ कुटगढ,़ ग्रामन, देवगढ,़ टै्रला, रोपा, कथोग, सिल्ह-भडवानी, हस्तपुर, घमरेड और भटेढ़ पटवार वृत्त, थुनाग तहसील के चियूणी, कालीपार, मानगढ,़ थाच-बगड़ा, उत्तरी मगरू और दक्षिणी मगरू पटवार वत्ृत और सुन्दरनगर तहसील का बटवाड़ा पटवार वृत्त ।

(1) प्रोन्नति के सभी मामलों में, पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद में की गई लगातार तदर्थ सेवा, यदि कोई हो, प्रोन्नति के लिए इन नियमों में यथाविहित सेवाकाल के लिए, इस शर्त के अधीन रहते हुए गणना में ली जाएगी, कि सम्भरक प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति, भर्ती एवं प्रोन्नति नियमों के उपबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात की गई थीः

परन्तु उन सभी मामलों, में जिनमें कोई कनिष्ठ व्यक्ति सम्भरक पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गई तदर्थ सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्युक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहां अपने-अपने प्रवर्ग/पद/काडर में उससे वरिष्ठ सभी व्यक्ति विचार किए जाने के पात्र समझे जाएंगे और विचार करते समय कनिष्ठ व्यक्तियों से ऊपर रखे जाएंगे :

परन्तु यह और कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, कम से कम तीन वर्ष की न्यूनतम अहर्ता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगीः

परन्तु यह और भी कि जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के लिए अपात्र समझा जाएगा/समझे जाएंगे।

No. Health-A -A(3)- 15 /2010.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the Recruitment & Promotion Rules for the post of Chief Laboratory Technician, Class III (Non-Gazetted), in the Department of Health & Family Welfare, Himachal Pradesh as per Annexure–A attached to this notification, namely :-

1. Short title and commencement.—(1) These Rules may be called the Himachal Pradesh, Department of Health & Family Welfare, Chief Laboratory Technicians, Class III (Non- Gazetted), Recruitment and Promotion Rules, 2011.

(2) These Rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Repeal & Savings.—(i) The Himachal Pradesh, Department of Health & Family Welfare, Chief Laboratory Technician, Class III (Non-Gazetted) R ecruitment & Promotion Rules, 1997 notified vide this Department notification No. Health-A-A(3)-29/94 dated 29-07-1997 are hereby repealed.

(ii) Notwithstanding such repeal, any appointment made or any thing done or any action taken under the rules, so repealed under sub-rule(i) supra shall be deemed to have been validly made or done or taken under these rules.

RECRUITMENT AND PROMOTION RULES FOR THE POST OF CHIEF

LABORATORY TECHNICIAN (NON-GAZETTED) CLASS-III, IN THE HEALTH &

FAMILY WELFARE DEPARTMENT, HIMACHAL PRADESH

1. Name of the posts.—Chief Laboratory Technician

2. Number of posts.—40 (Forty)

3. Classification.—Class-III (Non-Gazetted)

4. Scale of Pay.—Pay Band ` 10300-34800+ ` 3600 Grade Pay

5. Whether Selection Post or Non- Selection Post.—Non-Selection.

6. Age for direct Recruitment.—Not Applicable

7. Minimum Educational and other qualifications required for direct recruit(s).— (a) Essential Qualification(s): Not applicable. (b) Desirable Qualification(s) : Not applicable 8. Whether age and educational qualification(s) prescribed for direct recruit(s) will apply in the case of the promotee(s) .—(a) Age: Not applicable. (b) Educational Qualification : Not applicable

9. Period of probation, if any.—Two Years' subject to such further extension for a period not exceeding one year as may be ordered by the competent authority in special circumstances and reasons to be recorded in writing.

In case of recruitment by promotion, deputation, transfer, grade from which promotion/deputation/transfer is to be made.—By promotion from amongst the Senior Laboratory Technicians who possess ten years regular service or regular combined with continuous adhoc service rendered, if any, in the grade.

Provided that for the purpose of promotion every employee shall have to serve at least one term in the Tribal/Difficult areas subject to adequate number of post(s) available in such area:

Provided further that the proviso(I) supra shall not be applicable in the case of those employees who have five years or less service, left for superannuation.

Provided further that Officers/Officials who have not served atleast one tenure in Tribal/difficult area shall be transferred to such area strictly in accordance with his/her seniority in the respective cadre.

Explanation I.—For the purpose of proviso I supra the "term" in Tribal/Difficult areas shall mean normally three years or less period of posting in such areas keeping in view the administrative requirements and performance of the employee.

Explanation II.—For the purpose of proviso I supra the Tribal/Difficult Areas shall be as under :

1. District Lahaul Spiti 2. Pangi and Bharmour Sub Division of Chamba District. 3. Dodra Kawar Area of Rohru Sub-Division. 4. Pandrah Bis Pargana, Munish Darkali and Gram Panchayat Kashapat, Gram Panchayats of Rampur Tehsil of District Shimla.

Kathwar and Karga Patwar Circles of Kamrau Sub Tehsil, Bhaladh Bhalona and Sangna Patwar Circles of Renukaji Tehsil and Kota Pab Patwar Circle of Shillai Tehsil, in Sirmour District.

9. Khanyol-Bagra Patwar Circle of Karsog Tehsil, Gada Gussaini, Mathyani, Ghanyar, Thachi, Baggi, Somgad and Kholanal of Bali Chowki Sub Tehsil, Jharwar, Kutgarh, Graman, Devgarh, Trailla, Ropa, Kathog, Silla-Badhwani, Hastpur, Ghamrehar and Bhatehar Patwar Circle of Padhar Tehsil, Chiuni, Kalipar, Mangarh, Thach-Bagra, North Magru and South Magru Patwar Circles of Thunag Tehsil and Batwara Patwar Circle of Sunder Nagar Tehsil in Mandi District.

(1) In all cases of promotion, the continuous adhoc service rendered in the feeder post, if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these Rules for promotion subject to the condition that the adhoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R&P Rules;

Provided that in all cases where a junior person becomes eligible for consideration by virtue of his/her total length of service (including the service rendered on adhoc basis, followed by regular service/appointment) in the feeder post in view of the provision referred to above, all persons senior to him/her in the respective category/post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration;

Provided further that all incumbents to be considered for promotion shall possess the minimum qualifying service of at least three years or that prescribed in the R&P Rules for the post, whichever is less;

Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him/ her shall also be deemed to be ineligible for consideration for such promotion;

Explanation.—The last proviso shall not render the junior incumbent(s) ineligible for consideration for promotion if the senior ineligible person(s) happened to be Ex-Serviceman recruited under the provisions of Rule-3 of the Demobilized Armed Forces Personnel (Reservation of vacancies in the Himachal State Non-Technical Service) Rules, 1972 and having been given the benefit of seniority there-under or recruited under the provisions of Rule-3 of the Ex-Serviceman (Reservation of vacancies in Himachal Pradesh Technical Services) Rules, 1985 and having given the benefit of seniority there-under.

(2) Similarly, in all cases of confirmation adhoc service rendered on the feeder post, if any, prior to the regular appointment/promotion against such post shall be taken into account towards the length of service, if the adhoc appointment/promotion had been made after proper selection and in accordance with the provision of the R&P Rules.

Provided that inter-se-seniority as a result of confirmation after taking into account, adhoc service rendered as referred to above shall remain unchanged.

12. If a Departmental Promotion Committee exists, what is its composition.—As may be constituted by the Government from time to time.

13. Circumstances under which the HP Public Service Commission is to be consulted

in making recruitment.—: As required under the law.

14. Essential requirement for direct recruitment.—Not Applicable

16. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Caste/Scheduled Tribes/Other Backwards Classes/ other categories of persons issued by the Himachal Pradesh Government from time to time.

18. Power to Relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with the H.P. प्रस्तावित प्रारुप नियमों द्वारा संभाव्यतः प्रभावित होने वाला कोई व्यक्ति यदि उक्त नियमों की बाबत कोई आक्षेप करना चाहे या सुझाव देना चाहे तो वह उसे प्रधान सचिव (खाद्य, नागरिक आपूर्ति एवं उपभोक्ता मामले), हिमाचल प्रदेश सरकार के समक्ष इन प्रारुप नियमों के राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से 15 दिनाेंं की अवधि के भीतर दाखिल कर सकेगा;

उपरोक्त नियत अवधि के भीतर प्राप्त आक्षेप (पों) या सुझाव (वों), यदि कोई है/ंहों, पर उक्त नियमों को अन्तिम रूप देने से पूर्व विचार किया जाएगा, अर्थात्‌ः-

(क) ''अधिनियम'' से विधिक माप विज्ञान अधिनियम, 2009 अभिप्रेत है; (ख) ''प्ररूप '' से अनुसूचियों में विनिर्दिष्ट समुचित प्ररूप अभिप्रेत है; (ग) ''सरकार'' से हिमाचल प्रदेश सरकार अभिप्रेत है; और (घ) ''अनुसूची'' से इन नियमों से संलग्न अनुसूची अभिप्रेत है। (2) उन शब्दों और पदों के, जो इन नियमों में प्रयुक्त हैं किन्तु परिभाषित नहीं हैंः वही अर्थ होंगे जो अधिनियम में क्रमशः उनके हैंं।

(2) नियन्त्रक उप नियम (1) के अधीन अनुज्ञप्ति के लिए आवेदन की प्राप्ति पर, अपना यह समाधान हो जाने के पश्चात्‌ कि आवेदक अनुज्ञप्ति जारी करने हेतु समस्त शर्ताें को पूरा करता है, कैलेण्डर वर्ष के लिए अनुसूची 4 में विर्निदिष्ट फीस की प्राप्ति के पश्चात्‌, अनुसूची-3 में प्ररूप पर अनुज्ञप्ति जारी करेगा, जिसे दो वर्षों की अवधि के लिए एक समय पर नवीकृत किया जा सकेगा ।

(3) उप नियम (1) के अधीन अपनी अनुज्ञप्ति को नवीकृत करवाने का इच्छुक प्रत्येक अनुज्ञप्तिधारी, अनुज्ञप्ति की विधिमान्यता के अवसान से पूर्व, तीस दिन के भीतर अनुज्ञप्ति प्राधिकारी को अनुसूची-2 ख में प्ररुप पर आवेदन करेगा । अनुज्ञप्ति प्राधिकारी, अनुसूची-4 में विनिर्दिष्ट फीस की प्राप्ति पर अनुज्ञप्ति को नवीकृत कर सकेगा :

740 राजपत्र, हिमाचल प्रदेश, 18 मई, 2011/28 वैशाख, 1933 परन्तु आवेदक द्वारा अनुसूची-4 में विनिदिर्ष्ट दरों पर दुगुनी फीस तभी संदेय होगी यदि उसे अनुज्ञप्ति की विधिमान्यता की अवधि के अवसान के पश्चात्‌ तीस दिन की अवधि के भीतर, अनुज्ञप्ति प्राधिकारी द्वारा नवीकरण हेतू आवेदन करने के लिए अनुज्ञात किया जाता है ।

(4) अनुज्ञप्ति में फेरबदल/या अनुज्ञप्ति की दूसरी प्रति जारी करने के लिए संदेय फीस वही होगी, जो अनुसूची-4 में विनिर्दिष्ट है ।

(5) अनुज्ञप्ति प्राधिकारी, अनुज्ञप्ति प्राप्त विनिर्माताओं, व्यौहारियों और मरम्मतकर्ताओं का एक रजिस्टर अनुसूची-5 में प्ररुप पर बनाए रखेगा ।

(6) इन नियमों के अधीन अनुज्ञप्ति प्राप्त प्रत्येक विनिर्माता, व्यौहारी या मरम्मतकर्ता, अनुज्ञप्ति के निबन्धनों और शर्तों के अनुसार कार्यशाला, उपस्करों, औजारों और रजिस्टर को बनाए रखेगा ।

(7) इन नियमों के अधीन अनुज्ञप्ति प्राप्त प्रत्येक-मरम्मतकर्ता, प्रत्येक अनुज्ञप्ति के लिए सरकार को अनुसूची -6 में यथाविनिदिर्ष्ट नियत जमा (रसीद/प्राप्ति)(सावधि जमा रसीद/प्राप्ति) या मांग पर जमा रसीद के रुप में प्रतिभूति निक्षेप करेगा ।

(8) इन नियमों के अधीन जारी या नवीकृत की गई प्रत्येक अनुज्ञप्ति उस परिसर के सहजदृश्य स्थान पर प्रदर्शित की जाएगी, जहां पर अनुज्ञप्तिधारी अपना व्यवसाय चलाता है ।

(9) इन नियमों के अधीन जारी या नवीकृत की गई अनुज्ञप्ति का न तो विक्रय हो सकेगा और न ही अन्तरण हो सकेगा ।

4444.... अनुश्रअिनुश्रअिनुश्रअिनुश्रप्तिधारी द्वारा अभिलेखों का रखा जाना प्तधारी द्वारा अभिलेखों का रखा जाना....-इन नियमों के अधीन प्रत्येक अनुज्ञप्तिधारी प्तधारी द्वारा अभिलेखों का रखा जाना प्तधारी द्वारा अभिलेखों का रखा जाना अनुसूची-7 में प्ररुप पर अभिलेखों और रजिस्टरों को बनाए रखेगा और ऐसी कालिक रिपोर्ट/विवरणी भी प्रस्तुत करेगा, जैसी नियन्त्रक द्वारा विनिर्दिष्ट की जाए ।

5555.... प्रदान की गई अनुज्ञप्ति प्रदान की गई अनुज्ञप्ति प्रदान की गई अनुज्ञप्ति प्रदान की गई अनुज्ञप्ति का निलम्बन और रद्‌दकरणका निलम्बन और रद्‌दकरणका निलम्बन और रद्‌दकरणका निलम्बन और रद्‌दकरण....-(1) यदि अनुज्ञप्ति प्राधिकारी के पास यह विश्वास करने का कोई कारण है कि अनुज्ञप्तिधारी में अनुज्ञप्ति को जारी करने के लिए या नवीकरण के लिए आवेदन में कोई मिथ्या कथन किया है, जो अशुद्ध या मिथ्या है या जिसमें अधिनियम या किन्हीं नियमों या तद्‌धीन बनाए गए आदेश के किसी उपबन्ध का उल्लंघन किया है, तो वह ऐसी अनुज्ञप्ति को जांच पूरी होने तक निलंबित रख सकेगा :

परन्तु अनुज्ञप्ति को तब तक निलंबित नहीं किया जाएगा, जब तक अनुज्ञप्तिधारी को सुनवाई का युक्तियुक्त अवसर न दे दिया गया हो :

परन्तु यह और कि जहां अनुज्ञप्ति के निलंबन से तीन मास की अवधि के भीतर जांच पूरी नहीं की गई है, तो ऐसा निलम्बन प्रतिसंहृत समझा जाएगा ।

(2) प्रत्येक अनुज्ञप्तिधारी, जिसकी अनुज्ञप्ति को निलंबित किया गया है, ऐसे निलंबन के ठीक पश्चात, ऐसे अनुज्ञप्तिधारी के रुप में कार्य करना बन्द कर देगा और तब तक व्यवसाय जारी नहीं करेगा, जब तक ऐसे निलम्बन का आदेश प्रतिसंहृत नहीं कर दिया गया हो ।

(3) उप-नियम (1) के अधीन जांच पूर्ण हो जाने पर, यदि नियन्त्रक का समाधान हो गया है कि अनुज्ञप्तिधारी दोषी है, तो वह उसकी अनुज्ञप्ति को रद्‌द कर देगा और अनुज्ञप्तिधारी तत्काल अपनी अनुज्ञप्ति को नियन्त्रक को सौंप देगा ।

(4) प्रत्येक अनुज्ञप्तिधारी जिसकी अनुज्ञप्ति को उप नियम (3) के अधीन रद्‌द किया गया है, ऐसे रद्‌दकरण की तारीख से तीस दिन के भीतर या ऐसी तारीख से तीन मास से अनधिक ऐसी और बढ़ाई गई राजपत्र, हिमाचल प्रदेश, 18 मई, 2011/28 वैशाख, 1933 741 अवधि के भीतर, जैसी नियन्त्रक समुचित कारण दर्शाने पर अनुज्ञात करे, सभी बाटों या मापों का जो ऐसे रद्‌दकरण की तारीख को उसके कब्जे, अभिरक्षा या नियन्त्रण में थे, व्ययन (निपटारा) अनुज्ञात करवा सकेगा और उसके ऐसा करने में असफल रहने की दशा में, नियंत्रक उसी रीति में अभिग्रहण तथा व्ययन (निपटारा) करवा सकेगा, जैसी नियन्त्रक द्वारा विनिर्दिष्ट की जाए ।

(6) (6) (6) (6) कतिपय मामलों में बाटों या मापों या संख्यांक (संख्या) का उपयोग कतिपय मामलों में बाटों या मापों या संख्यांक (संख्या) का उपयोग....-अनुसूची-1 में विनिदिर्ष्ट कतिपय मामलों में बाटों या मापों या संख्यांक (संख्या) का उपयोग कतिपय मामलों में बाटों या मापों या संख्यांक (संख्या) का उपयोग वस्तुओं के मामले के सिवाय, प्रत्येक संव्यवहार, व्यौहार या संविदा में, या संरक्षण के लिए मात्रा की घोषणा.- (क) यदि वस्तु ठोस, अर्ध-ठोस, चिपचिपा या ठोस तथा द्रव्य का मिश्रण है, तो वजन की इकाई के रुप में होगी;

(ख) यदि वस्तु का रेखीय माप द्वारा विक्रय किया जाता है, तो लम्बाई की इकाई के रुप में होगी;

(ग) यदि वस्तु का क्षेत्रीय माप द्वारा विक्रय किया जाता है, तो क्षेत्र की इकाई के रुप में होगी;

(घ) यदि वस्तु द्रव्य है या उसका विक्रय घनीय माप द्वारा किया जाता है तो आयतन की इकाई के रुप में होगी; या

(ड.) यदि वस्तु का विक्रय संख्या में किया जाता है, तो संख्यांक (संख्या) इकाई के रुप में होगी । 7777.... बाटों या मापों के सत्यापन के लिए कालिक अन्तराल बाटों या मापों के सत्यापन के लिए कालिक अन्तराल....-बाटों या मापों के सत्यापन के लिए बाटों या मापों के सत्यापन के लिए कालिक अन्तराल बाटों या मापों के सत्यापन के लिए कालिक अन्तराल कालिक अन्तराल, विधिक माप विज्ञान (साधारण) नियम, 2011 में यथाविनिर्दिष्ट के अनुसार होगा । 8888.... बाटों और मापों का सत्यापन और निरीक्षण बाटों और मापों का सत्यापन और निरीक्षण....----(1) प्रत्येक व्यक्ति जो किसी बाट या माप का बाटों और मापों का सत्यापन और निरीक्षण बाटों और मापों का सत्यापन और निरीक्षण किसी संव्यवहार में या संरक्षण हेतु उपयोग कर रहा है, ऐसे बाट या माप को सत्यापन के लिए, विधिक माप विज्ञान अधिकारी के कार्यालय में या ऐसे किसी अन्य स्थान पर, जिसे विधिक माप विज्ञान अधिकारी इस निमित्त सत्यापन के लिए विनिर्दिष्ट करे, उस तारीख को या उससे पहले, प्रस्तुत करेगा जिसको सत्यापन अपेक्षित है :

परन्तु जहां कोई बाट या माप ऐसा है जिसे उसकी अति संवेदनशीलता के कारण उसके स्थान से हटाया नहीं जा सकता या हटाया नहीं जाना चाहिए, वहां वह व्यक्ति जो ऐसे बाट या माप का उपयोग कर रहा है, उस तारीख से जिसको पुनः सत्यापन अपेक्षित है, कम से कम तीस दिन पूर्व, विधिक माप विज्ञान अधिकारी को रिपोर्ट करेगा ।

(2) जहां कोई बाट या माप ऐसा है जिसका सत्यापन/पुनःसत्यापन यथास्थान किया जाना अपेक्षित है या उसकी अति संवेदनशीलता के कारण, उसके स्थान से हटाया नहीं जाना चाहिए, तो विधिक माप विज्ञान अधिकारी ऐसे बाट या माप की अवस्थिति के स्थान पर उसके सत्यापन के लिए आवश्यक कदम उठाएगा । (3) उप-नियम (2) में निदिर्ष्ट बाट या माप के सत्यापन के लिए उपयोक्ता ऐसी सुविधाएं उपलब्ध कराएगा, जैसी नियन्त्रक द्वारा इस निमित्त विनिर्दिष्ट की जाएं ।

(4) सत्यापन के लिए प्रस्तुत किया गया प्रत्येक बाट या माप अपने आप में ही पूर्ण होगा । (5) प्रत्येक बाट या माप, साफ-सुथरी हालत में सत्यापित किया जाएगा, और यदि आवश्यक हुआ तो विधिक माप विज्ञान अधिकारी, स्वामी या उपयोक्ता से इस प्रयोजन के लिए आवश्यक व्यवस्था करने की अपेक्षा करेगा ।

(6) विधिक माप विज्ञान अधिकारी, किसी ऐसे बाट या माप का, जिसका किसी संव्यवहार में या संरक्षण के लिए उपयोग किया जा रहा है या किया जाना आशयित या संभाव्य है, निरीक्षण या परीक्षण करने 742 राजपत्र, हिमाचल प्रदेश, 18 मई, 2011/28 वैशाख, 1933 के लिए अपनी अधिकारिता की स्थानीय सीमाओं के भीतर प्रत्येक परिसर का, नियम 7 में विनिदिर्ष्ट अवधि के दौरान प्रायः यथासम्भव निरीक्षण कर सकेगा ।

(7) विधिक माप विज्ञान अधिकारी किसी बाट या माप पर स्टाम्प को मिटा देगा, यदि निरीक्षण के दौरान यह पाया जाता है कि --

(क) किसी बाट या माप को, जो पुनः सत्यापन के लिए देय होते हुए भी ऐसे पुनः सत्यापन हेतु प्रस्तुत नहीं किया गया है;

(ख) कोई बाट या माप, जो अधिनियम द्वारा या के अधीन स्थापित मानकों के अनुरुप नहीं है :

परन्तु जहां विधिक माप विज्ञान अधिकारी की यह राय है कि ऐसे बाट या माप में खराबी या त्रुटि ऐसी नहीं है जिससे स्टाम्प को तत्काल मिटाना अपेक्षित हो, तो वह बाट या माप में पाई गई खराबी या त्रुटि से उपयोक्ता को सूचित करेगा तथा उपयोक्ता से आठ दिन की अवधि से अनधिक ऐसे समय के भीतर, खराबी या त्रुटि को हटाने के लिए कहेगा और --

(i) यदि उपयोकता उस अवधि के भीतर खराबी या त्रुटि को हटाने में असफल रहता है, तो स्टाम्प को मिटा देगा; या

(ii) यदि खराबी या त्रुटि को इस प्रकार हटा दिया है कि बाट या माप अधिनियम द्वारा अथवा के अधीन स्थापित मानकों के अनुरुप बन गए हैं, तो अनुसूची-9 में यथाविनिर्दिष्ट फीस को प्रभारित करने के पश्चात ऐसे बाट या माप को सत्यापित और स्टाम्पित कर देगा । स्पष्टीकरणस्पष्टीकरणस्पष्टीकरणस्पष्टीकरण....----किसी बाट या माप पर से स्टाम्प को मिटाने से, विधिक माप विज्ञान अधिकारी की ऐसे बाट या माप को अधिनियम के उपबन्धों के अनुसार संमयहृत करने की शक्ति को छीना या कम नहीं किया जाएगा ।

9999.... बाटों या मापों को स्टाम्पित करनाबाटों या मापों को स्टाम्पित करनाबाटों या मापों को स्टाम्पित करनाबाटों या मापों को स्टाम्पित करना....--(1) विधिक माप विज्ञान अधिकारी का परीक्षण और सत्यापन के पश्चात यदि यह समाधान हो जाता है कि ऐसा बाट या माप अधिनियम द्वारा या उसके अधीन और तदधीन बनाए गए नियमों मानकों के अनुरुप है, तो वह प्रत्येक बाट या माप को नियन्त्रक द्वारा जारी की गई एक ही प्रकार के डिजाइन की स्टाम्प से स्टाम्पित करेगा, जिसमें प्रशासनिक प्रयोजन के लिए, उस विधिक माप विज्ञान अधिकारी को जो उसे स्टाम्पित करता है, आबंटित संख्यांक उपदर्शित किया हुआ होगा :

परन्तु यदि किसी बाट या माप के आकार या स्वरुप के कारण उस पर स्टाम्प लगाना वांछनीय या यथा साध्य नहीं है, तो विधिक माप विज्ञान अधिकारी ऐसी कार्रवाई करेगा जैसी नियन्त्रक द्वारा लिखित में साधारण या विशेष आदेश द्वारा निर्दिष्ट की जाए ।

(2) विधिक माप विज्ञान अधिकारी, प्रत्येक सत्यापित बाट या माप पर स्टाम्पन का वर्ष और उस वर्ष की तिमाही को, सिवाए उसके जब ऐसे बाट या माप के आकार या प्रकृति के कारण ऐसा करना अव्यावहारिक हो, तिमाही ''क'' या ''ख'' या ''ग'' या ''घ'' में रुप में चिन्हांकित करेगा ।

स्पष्टीकरणस्पष्टीकरणस्पष्टीकरणस्पष्टीकरण....-एक वर्ष चार तिमाहिओं से मिलकर बना समझा जाएगा, जिसमें से प्रथम तिमाही जनवरी, फरवरी और मार्च महीनों की होगी जिसे ''क'' के रुप में चिन्हांकित किया जाएगा, द्वितीय तिमाही अप्रैल, मई और जून महीनों की होगी जिसे ''ख'' के रुप में चिन्हांकित किया जाएगा, तृतीय तिमाही जुलाई, अगस्त व सितम्बर मास की होगी जिसे ''ग'' के रुप में चिन्हांकित किया जाएगा और चतुर्थ तिमाही अक्तूबर, नवम्बर और दिसम्बर मास की होगी, जिसे ''घ'' के रुप में चिन्हांकित किया जाएगा ।

(3) सत्यापन और स्टाम्पन पूर्ण होने पर विधिक माप विज्ञान अधिकारी, अनुसूची-8 में दिए गए प्ररुप में सत्यापन प्रमाण-पत्र जारी करेगा । राजपत्र, हिमाचल प्रदेश, 18 मई, 2011/28 वैशाख, 1933 743 (4) जहां कोई सत्यापन प्रमाण-पत्र खो जाए, या नष्ट हो जाए, वहां सत्यापन प्रमाण-पत्र धारक, सत्यापन प्रमाण-पत्र की द्वितीय प्रति जारी करने के लिये उस विधिक माप विज्ञान अधिकारी को तत्काल आवेदन करेगा जिसने प्रमाण-पत्र जारी किया था। प्रमाण-पत्र की द्वितीय प्रति जारी करने के लिए प्रत्येक ऐसे आवेदन के साथ 50/-रूपए की फीस संलग्न होगी ।

(5) उपनियम (4) के अधीन आवेदन प्राप्त होने पर विधिक माप विज्ञान अधिकारी, आवेदक को सत्यापन प्रमाण-पत्र की द्वितीय प्रति जारी करेगा, जिस पर ''द्वितीय प्रति'' चिन्हित होगा।

10101010.... सत्यापन के सत्यापन के सत्यापन के सत्यापन के लिए फीसलिए फीसलिए फीसलिए फीस....----(1) विधिक माप विज्ञान अधिकारी के कार्यालय या शिविर कार्यालय में बाट या माप के सत्यापन और स्टाम्पन के लिए देय फीस वह होगी, जो अनुसूची-9 में विनिर्दिष्ट है। (2) यदि बाट या माप के उपयोक्ता के अनुरोध पर सत्यापन, विधिक माप विज्ञान अधिकारी के कार्यालय या शिविर कार्यालय से भिन्न किसी परिसर पर किया जाता है, तो अनुसूची- 9 में विनिर्दिष्ट दर पर अतिरिक्त फीस प्रभारित की जाएगी और बाट या माप का उपयोक्ता, परिसर का निरीक्षण करने के लिए विधिक माप विज्ञान अधिकारी द्वारा किए गए व्यय का, जिसके अन्तर्गत कार्यकारी मानक और अन्य उपकरण के परिवहन और उसकी उठाई-धराई का व्यय भी है, संदत्त करेगा, जो कम से कम तीन सौ रूपए होगाः परन्तु उप नियम (2)ं में यथावर्णित परिवहन और उठाई-धराई प्रभारों की लागत के सिवाए, निम्नलिखित मूल अवस्था में बाट और माप के सत्यापन और स्टाम्पन के लिए कोई अतिरिक्त फीस प्रभारित नहीं की जाएगी,-

(i) पेट्रोलियम पदार्थों एवं अन्य द्रवों के लिए यान की टंकी (वेहिकिल टैंक), पानी से भिन्न अन्य द्रवाें के मीटर (फ्यूल डिस्पेन्सर, द्रवित पेट्रोलियम गैस, दूध डिस्पेन्सर), कम्प्रेस्ड प्राकृतिक गैस डिस्पेन्सर, गैर-स्वचालित तोल यंत्र जैसे वेब्रिजों, प्लेटफार्म मशीनें, के्रन स्केल, स्वचालित ग्रेविमेट्रिक फिलिंग यंत्र, स्वचालित रेल वेब्रिज, असतत्‌ योगीकरण स्वचालित तोल यंत्र, और ऐसे अन्य बाट या माप, जिन्हें उनके स्थान से हटाया नही जा सकता और हटाया नहीं जाना चाहिए; और

(ii)ं ऐसे बाट या माप के विनिर्माता या व्यौहारी के परिसर में के बाट या माप।

(3) यदि कोई बाट या माप, विधिमान्यता अवधि की समाप्ति के पश्चात्‌ पुनः सत्यापन के लिए विधिक माप विज्ञान अधिकारी को प्रस्तुत किया जाता है, तो अनुसूची-9 में विनिर्दिष्ट दरों की आधी दर पर अतिरिक्त फीस, वर्ष की प्रत्येक तिमाही या उसके भाग के लिए संदेय होगीः

परन्तु यदि विलम्ब प्रशासनिक कारणों से हो और नियंत्रक द्वारा माफ किया गया हो, तो कोई अतिरिक्त फीस प्रभारित नहीं की जाएगी ।

(4) किसी विनिर्माता या व्यौहारी के स्टॉक में के किसी बाट या माप के, उस तारीख से जब उस पर अन्तिम बार स्टाम्पन किया गया था, नियम-7 में विनिर्दिष्ट अवधि के भीतर पुनः स्टाम्पन के लिए पूर्ण फीस संदेय होगी; परन्तु यह तब जब मूल स्टाम्प मिटा न दी गई हो।

11111111.... फीस का संग्रहण और उसका खजाना में जमा किया जाना फीस का संग्रहण और उसका खजाना में जमा किया जाना....----(1) सत्यापन या पुनः सत्यापन का फीस का संग्रहण और उसका खजाना में जमा किया जाना फीस का संग्रहण और उसका खजाना में जमा किया जाना कार्य प्रारम्भ करने के पूर्व, विधिक माप विज्ञान अधिकारी, सम्बन्धित व्यक्ति को उसके द्वारा देय फीस की सूचना देगा और उसे नियंत्रक द्वारा यथाविनिदिर्ष्ट रीति में प्राप्त करेगा और नियंत्रक द्वारा विनिर्दिष्ट प्रपत्र में उसकी रसीद जारी करेगा, ऐसी रसीद की एक प्रति अभिलेख में रखी जाएगीः

परन्तु केन्द्रीय या राज्य सरकार के किसी विभाग द्वारा इन नियमों के अधीन देय फीस की वसूली, ऐसी रीति में आप्त की जा सकेगी, जैसी नियंत्रक द्वारा विनिर्दिष्ट की जाए ।

(2) विधिक माप विज्ञान अधिकारी, नियंत्रक द्वारा अनुमोदित प्ररुप में फीस और इन नियमों के अधीन अन्य प्रभारों की प्राप्ति के प्रयोजन के लिए एक रजिस्टर रखेगा, जिसे दिन प्रतिदिन भरा जाएगा । 744 राजपत्र, हिमाचल प्रदेश, 18 मई, 2011/28 वैशाख, 1933 (3) सप्ताह के दौरान विधिक माप विज्ञान अधिकारी द्वारा प्राप्त किए गए समस्त संदाय, सरकारी खजाना में समुचित ''लेखा शीर्ष'' के अधीन ऐसी तारीखों या दिनों को संदत्त किए जाएंगे, जैसी नियंत्रक द्वारा समय-समय पर विनिदिर्ष्ट की जाए तथा उनका सत्यापित मासिक विवरण अभिप्राप्त किया जाएगा और उस आशय की सूचना नियंत्रक या उसके द्वारा उसकी ओर से प्राधिकृत अन्य अधिकारी को भेजी जाएगी। 12121212.... अभिगृहित बाटों, मापों आदि का अिभिगृहित बाटों, मापों आदि का अिभिगृहित बाटों, मापों आदि का अिभिगृहित बाटों, मापों आदि का निपटाननपटाननपटाननपटान....----(1) अधिनियम की धारा 15 के अधीन अभिगृहित कोई असत्यापित बाट या माप, उस व्यक्ति को जिससे ऐसा बाट या माप अभिगृहित किया गया था, वापस कर दिया जाएगा, यदि वह व्यक्ति अभियोग शमन के पन्द्रह दिन के भीतर उसको, अनुसूची-9 में विनिर्दिष्ट फीस, जिसमें उसकी विधिमान्यता समाप्त होने के पश्चात्‌ की अतिरिक्त फीस भी सम्मिलित है, का संदाय करने पर पुनः सत्यापित व मोहरांकित करवा लेता है ।

(2) अधिनियम की धारा 15 के अधीन अभिगृहीत कोई ऐसा बाट या माप जो किसी न्यायालय की कार्यवाहियों का विषय है, विधिक माप विज्ञान अधिकारी द्वारा न्यायालय के समक्ष प्रस्तुत किया जाएगा तथा न्यायालय की कार्यवाहियां समाप्त होने के पश्चात्‌, वह उसे अपने कब्जे में ले लेगा और न्यायालय के आदेशानुसार कार्यवाही करेगाः

परन्तु न्यायालय के आदेशों के अभाव में, ऐसे बाट या माप का उस रीति में निपटान किया जाएगा, जैसा नियंत्रक विशेष आदेश द्वारा निदेश दे ।

13131313.... सम्यक्‌ रुप से स्टाम्पित बाट या माप की विधिमान्यता सम्यक्‌ रुप से स्टाम्पित बाट या माप की विधिमान्यता....----(1) कोई बाट या माप, जो अधिनियम सम्यक्‌ रुप से स्टाम्पित बाट या माप की विधिमान्यता सम्यक्‌ रुप से स्टाम्पित बाट या माप की विधिमान्यता या तदधीन बनाए गए नियमों के अधीन सम्यक्‌ रुप से सत्यापित और स्टाम्पित है, या ऐसा समझा जाता है, उस राज्य के भीतर जिस में यह स्टाम्पित किया गया है, प्रत्येक स्थान पर, तब तक अधिनियम द्वारा या उसके अधीन स्थापित मानकों, के अनुरुप समझा जाएगा, जब तक कि निरीक्षण या सत्यापन पर यह नहीं पाया जाता कि ऐसा बाट या माप अधिनियम द्वारा या उसके अधीन स्थापित मानकों के अनुरुप नहीं रह गया है। (2) किसी बाट या माप को, जो अधिनियम के अधीन सम्यक्‌ रुप से सत्यापित और स्टाम्पित है, या ऐसा समझा जाता है, मात्र इस कारण से पुनः स्टाम्पित किया जाना अपेक्षित नही होगा कि उसका उपयोग, राज्य के भीतर उस स्थान से भिन्न, जहाँ इसे मूल रुप से सत्यापित और स्टाम्पित किया गया था, किसी अन्य स्थान पर किया जा रहा है :

परन्तु जहाँ किसी सत्यापित बाट या माप को जो एक स्थान पर स्थापित है, खोलकर दूसरे स्थान पर पुनः स्थापित किया जाता है, तो ऐसे बाट या माप का इस बात के होते हुए भी कि ऐसा बाट या माप नियतकालिक पुनःसत्यापन हेतु देय नहीं हुआ है, तब तक उपयोग नहीं किया जाएगा, जब तक ऐसे बाट या माप का सम्यक्‌ रुप से पुनःसत्यापन और स्टाम्पन नहीं करा लिया गया है।

(3) जहाँ किसी सत्यापित बाट या माप की अनुज्ञप्तिधारी मरम्मतकर्ता द्वारा या उस व्यक्ति के द्वारा, जिसके स्वामित्व या अधिकार में यह है, मरम्मत की जाती है तो, ऐसे बाट या माप का इस बात के होते हुए भी कि ऐसा बाट या माप नियतकालिक पुनःसत्यापन हेतु देय नहीं हुआ है, तब तक उपयोग नहीं किया जाएगा जब तक ऐसे बाट या माप का सम्यक्‌ रुप से पुनःसत्यापन और स्टाम्पन नहीं करा लिया गया है। विज्ञान अधिकारी की शैक्षिक अर्हताएं....----विधिक माप विज्ञान अधिकारी की शैक्षिक 14141414.... विधिक माप विधिक माप विधिक माप विधिक माप विज्ञान अधिकारी की शैक्षिक अर्हताएं विज्ञान अधिकारी की शैक्षिक अर्हताएं विज्ञान अधिकारी की शैक्षिक अर्हताएं अर्हताएं ऐसी होगी जैसी विधिक माप विज्ञान (साधारण) नियम, 2011 में विनिदिर्ष्ट हैं ।

15151515.... विधिक माप विज्ञान अधिकारी के लिए कार्यकारण या द्वितीयिक मानक, उपस्कर आदि की विधिक माप विज्ञान अधिकारी के लिए कार्यकारण या द्वितीयिक मानक, उपस्कर आदि की विधिक माप विज्ञान अधिकारी के लिए कार्यकारण या द्वितीयिक मानक, उपस्कर आदि की विधिक माप विज्ञान अधिकारी के लिए कार्यकारण या द्वितीयिक मानक, उपस्कर आदि की आपूर्ति के उपबन्धआपूर्ति के उपबन्धआपूर्ति के उपबन्धआपूर्ति के उपबन्ध....----(1) प्रत्येक विधिक माप विज्ञान अधिकारी को कार्यकरण/द्वितीयिक मानक बाट, कार्यकरण द्वितीयिक मानक तुलाएं और ऐसे अन्य उपस्कर, जिसके अन्तर्गत तोल और माप के ऐसे यन्त्र भी हैं, जो नियंत्रक द्वारा समय-समय पर अनुमोदित किए जाएं, उपलब्ध करवाए जाएंगे । राजपत्र, हिमाचल प्रदेश, 18 मई, 2011/28 वैशाख, 1933 745 (2) प्रत्येक विधिक माप विज्ञान अधिकारी को ऐसे ठप्पे (डाइयां), पंच, पेपर सील या स्टिकर और ऐसे अन्य उपस्कर उपलब्ध करवाए जाएंगे जो सत्यापन स्टाम्प चिपकाने के लिए आवश्यक हों, जिनका डिजाइन और संख्या, नियंत्रक द्वारा अनुमोदित की जाएगी ।

(3) प्रत्येक विधिक माप विज्ञान अधिकारी को स्टाम्प मिटाने के लिए नीचे निर्दिष्ट आठ नोक वाले तारे का उपयुक्त आकार का पंच उपलब्ध करवाया जाएगा ।

16161616.... बाटों और मापों आदि के उपयोग से संबंंिधत उपबंध बाटों और मापों आदि के उपयोग से संबंंिधत उपबंध....----(1) अपने परिसर में किसी संव्यवहार में बाटों और मापों आदि के उपयोग से संबंंिधत उपबंध बाटों और मापों आदि के उपयोग से संबंंिधत उपबंध तुला दण्ड का उपयोग करने वाला प्रत्येक व्यक्ति, उस को स्टैण्ड पर या हुक द्वारा चेन पर लटकाएगा :

परन्तु यह उपनियम फेरी लगाकर सामान बेचने वालों पर लागू नहीं होगा।

(2) प्रत्येक बाट या माप का साफ सुथरी हालत में और रोशनी की समुचित व्यवस्था में उपयोग किया जाएगा।

(3) किसी ऐसे बाट या माप को, जो यथावत्‌ सत्यापित और स्टाम्पित किया गया है, नियंत्रक या उसके द्वारा इस निमित्त प्राधिकृत अन्य व्यक्ति को पूर्व सूचना दिए बिना, उसके मूल स्थान से उखाड़ा और हटाया नही जाएगा।

(4) किसी तोल उपकरण की यथार्थता की समुचित जांच पड़ताल सुनिश्चित करने के लिए उपयोक्ता, उपकरण की क्षमता के दसवें भाग या भार की अधिकतम एक टन क्षमता तक सम्यक्‌ रूप से सत्यापित और स्टाम्पित बाट प्रत्येक तोल उपकरण के स्थान पर उपयोक्तया को तोल उपकरण की यर्थाथता की जांच पड़ताल करने के लिए समर्थ बनाएगा :

परन्तु, नियंत्रक उस व्यापार परिसर में, जहां तोलने के एक से अधिक उपकरण हैं, बनाए रखे जाने वाले कुल सत्यापित और स्टाम्पित बाटों की संख्या विनिदिर्ष्ट कर सकेगा।

(5) पेट्रोल/डीजल पम्पों का सही वितरण सुनिश्चत करने के लिए पम्प का फुटकर व्यापारी, पाँच लिटर/दस लिटर का सत्यापित क्षमता माप, अपने परिसर में रखेगा और सही वितरण को सुनिश्चत करने के लिए प्रतिदिन पम्प से निकासी की जाँच करेगा । किसी कम वितरण की दशा में व्यौहारी तुरन्त पम्प के द्वारा वितरण रोक देगा और सम्बन्धित विधिक माप विज्ञान अधिकारी को पुनःअंशशोधन (रिकैलिबरेटन) के लिए सूचित करेगा।

परन्तु फेरी लगाकर सामान बेचने वाले की दशा में, विके्रता प्रमाण-पत्र अपने पास रखेगा :

अनुअनुअनुअनुज्ञप्ति की शर्तेंज्ञप्ति की शर्तेंज्ञप्ति की शर्तेंज्ञप्ति की शर्तें

1. वह व्यक्ति जिसके पक्ष में यह अनुज्ञप्ति जारी की जाती है, --

(क) अधिनियम और तत्समय प्रवृत्त नियमों के समस्त सुसंगत उपबन्धों का अनुपालन करेगा; (ख) समय-समय पर संशोधित अधिनियम या नियमों के उपबन्धों के किसी अतिलंघन को न तो प्रोत्साहित करेगा और न उत्प्रेरित करेगा--;

(ङ) कारबार के बन्द होने की दशा में और/या अनुज्ञप्ति के रद्‌द किए जाने पर अनुज्ञप्ति अभ्यर्पित करेगा।

(च) यथास्थिति, विनिर्मित और राज्य में प्रयोग के उद्‌देश्य के लिए बाटों, मापों या तोल या माप के उपकरणों को विक्रय से पूर्व सत्यापन और स्टाम्पन के लिए विधिक माप विज्ञान अधिकारी को प्रस्तुत करेगा।

(छ) नियमों के अधीन यथाअपेक्षित इस अनुज्ञप्ति के नवीकरण के लिए अनुज्ञप्ति की विधिमान्यता के अवसान के तीस दिन के भीतर आवेदन प्रस्तुत करेगा ।

अनुुज्ञप्ति की शर्र्तेंेअनुुज्ञप्ति की शर्र्तेंेअनुुज्ञप्ति की शर्र्तेंेअनुुज्ञप्ति की शर्र्तेंे

1. वह व्यक्ति जिसके पक्ष में यह अनुज्ञप्ति जारी की जाती है ,-

(क) अधिनियम और तत्समय प्रवृत्त नियमाें के समस्त सुसंगत उपबन्धों का अनुपालन करेगा-; (ख) अधिनियम या तत्समय प्रवृत्त नियमों के उपबन्धों के किसी अतिलंघन को न तो प्रोत्साहित करेगा और न उत्प्रेरित करेगा-;

(ग) इस अनुज्ञप्ति को उस परिसर के जिससे इसका सम्बन्ध हो, किसी सहजदृश्य भाग में प्रदर्शित करेगा-;

(घ) ऐसे किसी सामान्य या विशेष निर्देश का अनुपालन करेगा जो विधिक माप विज्ञान नियंत्रक द्वारा दिया जाए -;

(ङ) कारबार के बन्द होने की स्थिति में और/या अनुज्ञप्ति के रद्‌द किए जाने पर अनुज्ञप्ति अभ्यर्पित करेगा।

(च) (i) सम्यक्‌ रूप से मरम्मत किए गए, यथास्थिति, बाटों, मापों या तोल या माप के उपकरणों को उपयोक्ता को परिदत्त करने से पूर्व नियम 14 (1) मे विनिर्दिष्ट सत्यापन ओर स्टाम्पन के लिए विधिक माप विज्ञान अधिकारी को प्रस्तुत करेगा।

(ii) बाटों, मापों या तोल या माप के उपकरणों को, यदि उनका सत्यापन देय होने की तारीख से पूर्व ठीक/मरम्मत करने की दशा में और जहाँ इस प्रक्रिया के दौरान और विधिक माप विज्ञान अधिकारी की सत्यापन स्टाम्प मिट जाती है, अलग हो जाती है या टूट जाती है, तो उसे उपयोक्ता को देने के पूर्व सम्यक्‌ रुप से मरम्मत करते हुए पुनःसत्यापन और स्टाम्पन के लिए विधिक माप विज्ञान अधिकारी को प्रस्तुत करेगा। राजपत्र, हिमाचल प्रदेश, 18 मई, 2011/28 वैशाख, 1933 759 (छ) नियमों की अधीन यथा अपेक्षित इस अनुज्ञप्ति के नवीकरण के लिए अनुज्ञप्ति की विधिमान्यता के अवसान के तीस दिन के भीतर आवेदन प्रस्तुत करेगा ।

1- वह व्यक्ति जिसक े पक्ष म ें यह अनुज्ञप्ति जारी की जाती है ;-

(क) अधिनियम और तत्समय प्रवृत्त नियमों के समस्त सुसंगत उपबन्धों का अनुपालन करेगा-; (ख) अधिनियम या तत्समय प्रवृत्त, नियमों के उपबन्धों के किसी अतिलंघन को न तो प्रोत्साहित करेगा और न ही उत्प्रेरित करेगा-;

(ग) इस अनुज्ञप्ति को उस परिसर के, जिससे इसका सम्बन्ध है, किसी सहजदृश्य भाग में प्रदर्शित करेगा-;

(घ) ऐसे किसी सामान्य या विशेष निर्देश का अनुपालन करेगा जो विधिक माप विज्ञान नियंत्रक द्वारा दिया जाए -;

(ङ) कारबार के बन्द होने की स्थिति में और/या अनुज्ञप्ति के रद्‌द किए जाने पर अनुज्ञप्ति अभ्यर्पित करेगा।

(च) नियमों के अधीन यथा अपेक्षित इस अनुज्ञप्ति के नवीकरण के लिए अनुज्ञप्ति की विधिमान्यता के अवसान के तीस दिन के भीतर आवेदन प्रस्तुत करेगा ।

(छ) किसी अमानक बाट या माप को न तो बेचेगा, न बिक्री के लिए प्रस्तुत करेगा, न प्रदर्शित करेगा, और न ही कब्जे में रखेगा।

2- इस अनुज्ञप्ति के जारी करने के पश्चात्‌ विहित प्रत्यके शर्त, यदि राजपत्र में अधिसूचित की जाए तो उन व्यक्तियों पर आबद्धकर होगी जिन्हें अनुज्ञप्ति प्रदान की गई है।

NOTIFICATION

Shimla-2, the 13th May, 2011

No. FDS-A (3)-1/2004-Loose.—In exercise of the powers conferred by section 53 of the Legal Metrology Act, 2009 the Governor, Himachal Pradesh in consultation with the Central Government as required under sub-section (1) of section 53 of the Act ibid proposes to make the following rules to carry out the provisions of the said Act and the same are hereby published in the Rajpatra, Himachal Pradesh for information of the general public.

If any person likely to be affected by the proposed draft rules has any objection or suggestion to make with regard to the said rules, he may file the same before the Secretary (FCS&CA) to the Government of Himachal Pradesh within a period of 15 days from the date of publication of these draft rules in Rajpatra, Himachal Pradesh.

The objection (s) or suggestion (s), if any received within the above stipulated period shall be taken into consideration before finalizing the said rules, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Legal Metrology (Enforcement) Rules, 2011.

(2) They shall come into force from the date of publication of their final notification in the Rajpatra, Himachal Pradesh.

2. Definitions.—In these rules, unless the context otherwise requires, (a)"Act" means the Legal Metrology Act, 2009;

(b) "Form" means an appropriate Form specified in the Schedules; (c) "Government" means the Government of Himachal Pradesh; and (d)"Schedule" means a Schedule appended to these rules.

(2) Words and expressions used in these rules but not defined shall have the same meanings respectively assigned to them in the Act.

3. Licensing of manufacturer, repairer and dealer of Weights and Measures.—(1) Every person intending to carry on the business of a manufacturer of or repairer of or dealer in weights and measures, as the case may be, shall make an application for the issuance of a license to the Controller on the Form in Schedule II-A.

(2) The Controller on receipt of the application for license under sub-rule (1), shall after satisfying himself that the applicant fulfills all the conditions for the issue of license, shall issue license on Form in Schedule-III, after receipt of fee specified in Schedule–IV for the calendar year, which may be renewed for a period of two years at a time.

(3) Every licensee under sub-rule (1) desirous to renew his license shall make an application to the licensing authority within thirty days before the expiry of the validity of the license on Form in Schedule –II B. The licensing authority may renew the license on receipt of fee specified in Schedule-IV:

Provided that double fee at the rates specified in Schedule-IV shall be payable by the applicant if he is permitted by the licensing authority to make the application for renewal within a period of thirty days after the expiry of the validity of the license.

(4) The fee payable for the alteration of a license or for the issue of a duplicate license shall be as specified in Schedule-IV.

(5) The licensing authority shall maintain a register of licensed manufacturers, dealers and repairers on Form in Schedule-V.

(6) Every manufacturer, dealer or repairer licensed under these rules shall maintain workshop, equipments, tools, registers as per the terms and conditions of the license774 राजपत्र, हिमाचल प्रदेश, 18 मई, 2011/28 वैशाख, 1933 (7) Every repairer licensed under these rules shall furnish a security deposit in the form of Fixed Deposit Receipt or deposit at call for each licence, to the Government as specified in Schedule-VI.

(8) Every license issued or renewed under these rules shall be displayed at a conspicuous place in the premises where the licensee carries on business.

(9) A license issued or renewed under these rules shall neither be salable nor transferable.

4. Records to be maintained by the licensee.—Every licensee under these rules shall maintain records and registers on Form in Schedule-VII and also submit such periodical report/returns as may be specified by the Controller.

5. Suspension and cancellation of license granted.—(1)If the licensing authority has any reason to believe that licensee has made any false statement in the application for the issuance or renewal of license, which is incorrect or false or has contravened any provision of the Act or any rules or order made there-under, he may suspend such license, pending of an inquiry:

Provided that the license shall not be suspended unless the licensee has been given a reasonable opportunity of being heard:

Provided further that where the inquiry is not completed within a period of three months of the suspension of license, the suspension shall stand revoked.

(2) Every licensee whose license has been suspended shall, immediately after such suspension, stop functioning as such licensee and shall not resume business until the order of such suspension has been revoked.

(3) On completion of inquiry under sub-rule (1), if the Controller is satisfied that the licensee is guilty, he shall cancel his license and the licensee shall surrender his license to the Controller forthwith.

(4) Every licensee whose license has been cancelled under sub-rule (3) shall, within a period of thirty days from the date of such cancellation, or within such further period, not exceeding three months from such date, as the Controller may, on sufficient cause being shown, allow, dispose off the weights or measures which were in his possession, custody or control on the date of such cancellation and in the event of his failure to do so, the Controller may cause to be seized and dispose of the same in the manner as may be specified by the Controller.

6. Use of weights or measures or number in certain cases.—Except in the cases of commodities specified in Schedule I, the declaration of quantity in every transaction, dealing or contract, or for protection shall be in terms of the unit of -

(a) weight, if the commodity is solid, semi-solid, viscous or a mixture of solid and liquid ; (b) length, if the commodity is sold by linear measure; (c) area, if the commodity is sold by area measure; (d) volume, if the commodity is liquid or is sold by cubic measure; and (e) number, if the commodity is sold by number.

7. Periodical interval for the verification of weights or measures.—The periodical interval for the verification of weights or measures shall be as specified in the Legal Metrology(General) Rules, 2011.

8. Verification and inspection of weights and measures.—(1) Every person using any weight or measure in any transaction or for protection shall present such weight or measure for verification, at the office of the legal metrology officer or at such other place as the legal metrology officer may specify in this behalf for verification on or before the date on which the verification falls due:

Provided that where any weight or measure is such that it cannot, or should not be moved from its location due to its sensitivity, the person using such weight or measure shall report to the legal metrology officer at least thirty days in advance of the date on which the re-verification falls due.

(2) Where any weight or measure is such that it is required to be verified/reverified in situ or should not be moved from its location due to its sensitivity the legal metrology officer shall take necessary steps for the verification of such weight or measure at the place of its location.

(3) For the verification of weight or measure referred to in sub-rule (2), the user shall provide such facilities as may be specified by the Controller in this behalf.

(4) Every weight or measure presented for verification shall be complete in itself.

(5) Every weight or measure shall be verified in a clean condition, and if necessary, the legal metrology officer shall require the owner or the user to make necessary arrangement for the purpose.

(6) The legal metrology officer may visit, as frequently as possible during the period specified in rule 7, every premises within the local limits of his jurisdiction to inspect and test any weight or measure which is being or is intended or likely to be used in any transaction or for protection.

(7) The legal metrology officer shall obliterate the stamp on any weight or measure, if it is found during inspection that—

(a) any weight or measure which being due for re-verification has not been submitted for such re-verification;

(b) any weight or measure which does not conform to the Standards established by or under the Act.

Provided that where the legal metrology officer is of opinion that the defect or error in such weight or measure is not such as to require immediate obliteration of the stamp, he shall inform the user, of the defect or error found in the weight or measure and call upon the user to remove the defect or error within such time, not exceeding eight days and shall-

(i) if user fails to remove the defect or error within that period, obliterate the stamp, or (ii) if the defect or error is so removed as to make the weight or measure conform to the standards established by or under the Act, verify and stamp such weight or measure after charging the fee as specified in Schedule -IX.

Explanation:—The obliteration of the stamp on any weight or measure shall not take away or abridge the power of the legal metrology officer to seize such weight or measure in accordance with the provisions of the Act.

9. Stamping of weights or measures.—(1) The legal metrology officer shall stamp every weight or measure, if after testing and verification, he is satisfied that such weight or measure conforms to the standards established by or under the Act and the rule made there-under, with a stamp of uniform design, issued by the Controller, which shall indicate the number allotted for administrative purpose to the legal metrology officer by whom it is stamped:

Provided that if by reason of the size or nature of any weight or measure it is not desirable or practicable to put a stamp thereon, the legal metrology officer shall take such action as may be directed by the Controller by a general or a special order in writing.

(2) The legal metrology officer shall mark the year and its quarter numbered as quarter A or B or C or D of stamping on every verified weight or measure, except when the size or nature of such weight or measure makes it impracticable.

Explanation.—A year shall be deemed to consist of four quarters of which first quarter shall be of the months of January, February and March which shall be marked as A; second quarter shall be of the months of April, May and June which shall be marked as B, third quarter shall be of the months of July, August and September which shall be marked as C and fourth quarter shall be of the months of October, November and December which shall be marked as D.

(3) On completion of verification and stamping the legal metrology officer shall issue a certificate of verification on the Form in Schedule VIII.

(4) Where a certificate of verification is lost or destroyed, the holder of the certificate of verification shall forthwith apply to the legal metrology officer who had issued the certificate, for the issue of a duplicate certificate of verification. Every such application for the issue of a duplicate certificate shall be accompanied by a fee of rupees fifty.

(5) On receipt of an application under sub-rule (4), the legal metrology officer shall issue to the applicant a duplicate copy of the certificate of verification marked as 'DUPLICATE'.

10. Fee for verification - (1) Fees payable for verification and stamping of weight or measure at the office or camp office of the legal metrology officer shall be as specified in Schedule-IX.

(2) If, on the request of the user of weight or measure, verification is done at any premises other than the office or camp office of the legal metrology officer, an additional fee shall be charged at the rate specified in the Schedule-IX and the user of the weight or measure shall pay the expenses incurred by the legal metrology officer for visiting the premises including the cost of transporting and handling the Working Standard and other equipment subject to a minimum of rupees three hundred:

Provided that no additional fee, except the cost of transportation and handling charges as mentioned in sub-rule (2), shall be charged for verification and stamping of weights and measures in situ of,-

(i) vehicle tanks for petroleum products and other liquids, Meter for Liquids other than Water (Fuel Dispenser, Liquid Petroleum Gas, Milk Dispensers), Compressed Natural Gas Dispensers, Non-automatic Weighing Instruments like weighbridges, platform machines, crane scale, Automatic Gravimetric Filling Instruments, Automatic Rail- weighbridge, Discontinuous Totalizing Automatic Weighing Instruments, and such other weight or measure which cannot, and should not be moved from its location; andराजपत्र, हिमाचल प्रदेश, 18 मई, 2011/28 वैशाख, 1933 777 (ii) weight or measure in the premises of manufacturer or dealer of such weight or measure.

(3) If a weight or measure is presented to the legal metrology officer for reverification after expiry of the validity period, an additional fee at half the rates specified in Schedule-IX shall be payable for every quarter of the year or part thereof.

Provided that no additional fee shall be charged if the delay is due to administrative reasons and condoned by the Controller.

(4) Full fee shall be payable for re-stamping any weight or measure held in stock with manufacturer or dealer within the period specified in rule 7 from the date on which it was last stamped; provided the original stamp was not obliterated.

11. Collection of fees and deposit into the Treasury.—(1) Before commencing the work of verification or re-verification, the legal metrology officer shall inform the person concerned of the fees payable by him and shall receive the same in the manner as specified by the Controller and issue a receipt of the same on the form specified by the Controller, one copy of such receipt shall be kept on record:

Provided that fees payable by a department of the Central or State Government under these rules may be realized in such manner as may be specified by the Controller.

(2) The legal metrology officer shall maintain a register, in the form approved by the Controller for the purpose of receipt of fee and other charges under these rules, which shall be filled up on day-to-day basis.

(3) All payment received by the legal metrology officer during the week shall be paid into the Government Treasury under the appropriate Head of Account on such dates or days as may be specified by the Controller from time to time, and monthly verified statement thereof shall be obtained and an intimation to that effect be sent to the Controller or other officer authorized by him in this behalf.

12. Disposal of seized weights, measures, etc.—(1) Any un-verified weight or measure seized under section 15 of the Act shall be returned to the person from whom such weight or measure was seized if that person gets the same verified and stamped, within fifteen days from the composition of the offence, on payment of fee specified in Schedule-IX including the additional fee payable for re-verification after the expiry of the validity of the stamp.

(2) Any weight or measure seized under section 15 of the Act, which is the subject of proceedings in a court shall be produced by the legal metrology officer before the court and after conclusion of the proceedings, shall be taken in his possession and dealt with in accordance with the orders of the court:

Provided that in the absence of the orders of the court, weight or measure shall be dealt with in the manner as the Controller may by special order direct.

13. Validity of Weights or Measures duly stamped.—(1) A weight or measure which is, or is deemed to be, duly verified and stamped under the Act and rules made thereunder shall be deemed to conform to the standards established by or under the Act at every place within the State in which it is stamped unless it is found on inspection or verification that such weight or measure has ceased to conform to the standards established by or under the Act.

(2) No weight or measure which is, or is deemed to be, duly verified and stamped under the Act shall require to be re-stamped merely by reason of the fact that it is being used at any place within the State other than the place at which it was originally verified and stamped:

Provided that where a verified weight or measure, installed at one place is dismantled and re-installed at a different place, such weight or measure shall not be put into use unless it has been duly re-verified and stamped, notwithstanding that periodical re-verification of such weight or measure has not become due.

(3) Where a verified weight or measure has been repaired, whether by a licensed repairer or by the person owning and possessing the same, such weight or measure shall not be put into use unless it has been duly re-verified and stamped, notwithstanding that periodical re-verification of such weight or measure has not become due.

14. Qualifications of legal metrology officer.—(1) The qualification of the legal metrology officer shall be as specified in the Legal Metrology (General) Rules, 2011.

15. Provision of supply of Working or Secondary Standards, equipment, etc. to the legal metrology officer.—(1) Every legal metrology officer shall be provided with Working /Secondary Standard weights, Working/Secondary Standard balances, and such other equipments including weighing and measuring devices, as may be approved by the Controller from time to time.

(2) Every legal metrology officer shall be provided with such dies, punches, paper seal or sticker and such other equipments as may be necessary for affixing the verification stamp, the design and number of which are to be approved by the Controller.

(3) Every legal metrology officer shall be provided with punches of suitable sizes of eight- pointed star as shown below for obliterating stamps.

16. Provisions relating to use of weights and measure, etc.—(1) Every person using a beam scale in any transaction in his premises shall suspend the same to a stand or to a chain by a hook:

Provided that this sub-rule shall not apply to itinerant vendors.

(2) Every weight or measure shall be used in a clean condition and in proper lighting arrangement

(3) Any weight or measure, which has been verified and stamped in situ, shall not be dismantled and removed from its original site without prior intimation to the Controller or other person authorized by him in this behalf.

(4) To ensure a proper check of the accuracy of a weighing instrument the user shall keep at the site of each weighing instrument duly verified and stamped weights equal to one-tenth of the capacity of the instrument or maximum upto one tonne capacity of weight to enable the consumer to check the accuracy of the weighing instrument:

Provided that the Controller may specify the total number of verified and stamped weights to be maintained in trade premises where the number of weighing instruments are more than one.

(5) To ensure proper delivery of the petrol / diesel pumps, the retail dealer of the pump shall keep a verified 5 litre or10 litre capacity measure in his premises and check the out put from the pump every day to ensure its correct delivery. In case of any short delivery the dealer shall stop the delivery through the pump immediately and inform the legal metrology officer concerned to recalibrate the pump.

17. Certificate of verification to be exhibited.—The person to whom a certificate of verification has been issued under these rules shall exhibit the same in a conspicuous place in the premises where the weights, measures or weighing or measuring instruments to which the certificate relates are used:

Provided that in the case of itinerant vendor, the vender shall keep the certificate with him.

Provided further that in the case of vehicle tank, the certificate of verification shall be kept with the vehicle.

18. Penalty for contravention of rules.—Whoever contravenes any provisions of these rules, for the contravention of which no punishment has been separately provided in the Act, shall be punished with fine, which may extend to five thousand rupees.

19. Form of appeal and fee.—(1) Every appeal under the Act and these rules shall be preferred on the form set out in Schedule-X, and shall be accompanied by a copy of the order appealed against.

(2) An application for appeal to State Government shall be accompanied by fees of Rs. 500/- and for appeal to Contoller shall be accomplined by fee of Rs. 200/- paid either by cash or by affixing court fee stamp for the said value, as the case may be.

20. Fee for compounding of offences.—The fee for compounding of offences committed under the Act shall be as prescribed in Schedule-XI otherwise compounding may not be carried out under Section 48(1) of the Act.

21. Repeal and Savings.—(1) The Himachal Pradesh Standards of Weights and Measures (Enforcement) Rules, 2004 notified vide Government notification number FDS-A(3)-7/91-I, Dated 29th October, 2004 and published in the Rajpatra, Himachal Pradesh (Extra-Ordinary) dated 1st December, 2004 are hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under the rules so repealed shall be deemed to have been validly done or taken under these rules.
