ORDER

Shimla-2, the 11th June, 2011

No. SEC-16-49/2009-I-1958-62.—Whereas District Election Officer-cum-Resident Commissioner Pangi District Chamba has brought to the notice of the State Election Commission vide its letter No. PNG (Nirvachan)/2011-12-4160 dated 11.6.2011 that election for the post of Up- Pradhan Gram Panchayat Purthi, were scheduled to be held on 10.6.2011 and result for the same has already been declared by the Returning Officer;

And whereas polling for the office of Up Pradhan Gram Panchayat Killar and Karel are scheduled to be held on 12.6.2011;

Whereas the symbol "Wheel-Barrow" is allotted to the candidates appearing at the Sr. No. 7 of list of contesting candidates for the post of Up Pradhan for the said Gram Panchayats;

Whereas Symbol "Cart" is printed at Sr. No. 7 of ballot papers supplied to the contesting candidates for the office of UP-Pradhan for the said Gram Panchayats.

Whereas the State Election Commission vide its Notification No. SEC-16-22/99-3952-81 dated Ist December, 2010 had replaced the symbol "Wheel Barrow" with the symbol "Cart" and had ordered that henceforth symbol "Wheel Barrow" shall not be allotted;

Whereas the State Election Commission is of the considered view that irregularity in the elections process has been caused due to non-compliance of the said notification.

Therefore the Commission in exercises of the powers vested in it under Article 243-K of the Constitution of India, Section 160 of the HP Panchayati Raj Act, 1994 read with Sub-Rule (5) of1120 राजपत्र, हिमाचल प्रदेश, 13 जून, 2011/23 ज्येष्ठ, 1933 Rule 32 of the HP Panchayati Raj Election Rules, 1994 hereby invalidate the process of allotment of symbols for the office of Up-Pradhans of Gram Panchayat Killar and Karel;

Further the Commission hereby orders that polling for the post of Up-Pradhans of Gram Panchayat Killar and Karel shall not be held on 12th June 2011 as per scheduled fixed by the District Election officer-Cum-Resident Commissioner Pangi. The modified programme for the posts of Up-Pradhans of these Gram Panchayats shall be issued in due course.
