No. EDN-A-Ga(10)-3/2009.—The Governor, Himachal Pradesh is pleased to revise the scales of pay of Non-teaching personnel of the Govt. Aided Private Colleges on pattern of scales of pay issued vide Government Notification No. Fin-(PR)B(7)-1/2009 dated 26th August, 2009 & this Department Notification No. EDN-A-B(7)-2/2008 dated 15th October, 2009, w.e.f. 1.1.2006 as under:—

SCALES OF PAY OF NON-TEACHING PERSONNEL IN GOVERNMENT AIDED

PRIVATE COLLEGES:—

(i) The Fitment Tables (Table No. 1 to 8 ) for fixation of pay of the existing incumbents, who are in position as 1.1.2006, in various categories of posts as indicated in the Tables, are appended to this communication as Annexure-I.

(ii) The payment will be made after taking an undertaking from the existing incumbents to the effect that the excess amount, if any, made on account of incorrect fixation of pay in the pay band or GP/AGP, shall be adjusted against the future payments due.

(iii) The pay in the revised scale may be drawn from 1.6.2010 and the arrear from 1.1.2006 to 31.5.2010 will be regulated in accordance with the H.P. Grant-in-aid to non-Government Colleges Rules, 2008 and amended from time to time and will be paid in such manner at such time as may be decided by the Government in due course of time.

(iv) The Grant-in-aid will be released for these institutions as per existing rules for the salary component up to 31.3.2008 on revised scales with the conditions that any other financial burden have to be borne by the management of these colleges.

2. The revised pay scales are applicable to the personnel of H.P. Government Aided Private Colleges only.

3. Other terms and conditions of service of the employees shall be the same as may be notified by the State Government or specified by way of Regulations incorporating the approved pay scales and other related conditions by the State Govt. on the lines of existing scheme(s).

4. Pay Scales for Librarians:

(i) Librarian in the pre-revised scale of pay ` 8000-13500 shall be placed in the Pay Band of ` 15600-39100 with AGP of ` 6000.

(ii) All existing conditions of eligibility and academic qualifications laid down by the UGC shall continue to be applicable for direct recruitment of Librarian/College Librarian.

(iii) UGC scale to the post of Librarian shall be allowed only if the incumbent fulfills the UGC criteria of education qualification, experience and R&P Rules of the post.

5. The educational qualification and other relevant qualification relating to academic degree/NET/SET qualifications, years of service etc. relevant for the particular post as prescribed for similarly placed categories in the State Government, shall be adhered to by the respective management while releasing revised pay scales.

6. All other service conditions of the personnel will continue to be governed by the existing rules/instructions.

7. The State Government may change any of the above conditions of its own or on instructions issued by the F.D. from time to time.

8. The amount of Interim Relief, if released to the personnel of the Govt. Aided Private College shall be adjusted in the Revised Pay and the employees shall be entitled to draw only the additional amount on account of difference between Revised Pay and the emoluments being drawn by the employee on the corresponding date. In case emoluments in the Revised Pay Structure becomes lower than the emoluments being drawn on the corresponding date, due to payment of Interim Relief, the extra amount, if any, shall be adjusted against the Pay Arrears of the concerned employees.

9. This issues with the prior concurrence of the Finance Department vide their Dy. No. 51818624 dated 30.5.2011.

HIMACHAL PRADESH ELECTRICITY REGULATORY COMMISSION SHIMLA

NOTIFICATION

Shimla, the 25th June, 2011

No. HPERC/382.—WHEREAS regulation 6 of the Himachal Pradesh Electricity Regulatory Commission (Eligibility Conditions for being a Electricity Trader) Regulations, 2008, corresponds to regulation 6-A of the Central Electricity Regulatory Commission(Procedure, Terms and Conditions for Grant of Trading Licence and other related matters) Regulations, 2004. The Hon'ble Supreme Court vide its judgement dated 11.5.2009, rendered in Civil Appeal No.3457- 3458 of 2009,-Global Energy Ltd. V/s. Central Electricity Regulatory Commission has struck down the provisions of Clause (b) and Clause (f) of regulation 6-A of the said Central Electricity Regulatory Commission Regulations, and it has, therefore, become necessary to amend regulation 6 of this Commission's regulations of 2008.

NOW THEREFORE, the Himachal Pradesh Electricity Regulatory Commission, in exercise of powers conferred under section 52, read with section 181 of the Electricity Act, 2003 (36 of 2003), and all other powers enabling in this behalf, proposes to amend the Himachal Pradesh Electricity Regulatory Commission (Eligibility Conditions for being a Electricity Trader) Regulations, 2008, published in the Rajpatra, Himachal Pradesh, dated 23rd July, 2008 and the1256 राजपत्र, हिमाचल प्रदेश, 28 जून, 2011/7 आषाढ़, 1933 draft of the proposed amendment, as required by sub-section (3) of section 181 of the said Act read with rule 3 of the Electricity (Procedure for Previous Publication) Rules,2005, is hereby published for the information of all the persons likely to be affected thereby; and notice is hereby given that the said draft amendment will be taken into consideration after the expiry of thirty days form the date of its publication in the Rajpatra, Himachal Pradesh, together with any objections or suggestions which may within the aforesaid period be received in respect thereto.

The objections or suggestions in this behalf should be addressed to the Secretary, Himachal Pradesh Electricity Regulatory Commission, Keonthal Commercial Complex, Khalini, Shimla.

DRAFT REGULATIONS

1. Short title and commencement.—(1) These regulations shall be called the Himachal Pradesh Electricity Regulatory Commission (Eligibility Conditions for being a Electricity Trader) (First Amendment) Regulations, 2011.

(2) These regulations shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Regulation 6.—For the regulation 6 of the Himachal Pradesh Electricity Regulatory Commission (Eligibility Conditions for being a Electricity Trader) Regulations,2008, the following regulation 6 shall be substituted, namely.-

"6. Disqualifications.—The applicant shall not be qualified for grant of licence if- (a) the applicant, or any of his associates, or partners, or promoters, or Directors is an undischarged insolvent; or

(b) the applicant, or any of his associates, or partners, or promoters, or Directors has been convicted of an offence involving moral turpitude, fraud, or any economic offence during the year of making the application or three years immediately preceding that year and a period of six months has not elapsed since his release from imprisonment, if any, consequent to such conviction; or

(c) an order canceling the licence of the applicant, or any of his associates, or partners, or promoters, or Directors, has been passed by the Commission; or

(d) the applicant holds a licence for transmission of electricity; or

(e) the applicant, or any of his associates, or partners, or promoters, or Directors has in the past been –

(i) refused a licence on the grounds which continue to remain valid, or

(ii) found guilty in any proceedings for non-compliance of any of the provisions of the Act or the rules or the regulations made thereunder or an order made by the Appropriate Commission, during the year of making the application or five years immediately preceding that year".

यह दरख्वास्त हमारे समक्ष श्री जेठू राम पुत्र श्री जगी, निवासी गांव बाड़ा, डा0 करतोट, तहसील रामपुर बुशैहर, जिला शिमला, हिमाचल प्रदेश ने इस आशय के साथ प्रस्तुत की है कि अराजी खसरा नं0 509, खाता/खतौनी नं0 85 मिन/175, वाका चक सराहन, तहसील रामपुर बुशैहर, जिला शिमला, हिमाचल प्रदेश के खाना काश्त में प्रार्थी काश्तकार दर्ज है परन्तु प्रार्थी के पिता का नाम जगी के स्थान पर पोशू दर्ज है जो कि गलत है जबकि प्रार्थी के पिता का नाम जगी है जिसकी पुष्टि के लिए प्रार्थी ने नकल परिवार रजिस्टर संलग्न दरख्वास्त कर रखी है। प्रार्थी अपने पिता का नाम उक्त माल कागजात के खाना काश्त में पोशू के स्थान पर जगी उर्फ पोशू दरुस्त/दर्ज करवाना चाहता है।

श्री तंगड़ू राम पुत्र श्री माठू राम, निवासी गांव निननू, ग्राम पंचायत निरथ, तहसील रामपुर बुशैहर, जिला शिमला, हिमाचल प्रदेश ने इस अदालत में प्रार्थना-पत्र मय शपथ-पत्र गुजारा है कि प्रार्थी के पुत्र राज कुमार की जन्म तिथि मुताबिक स्कूल अभिलेख दिनांक 4-6-1980 की सही व दरुस्त है परन्तु स्थानीय ग्राम पंचायत निरथ में प्रार्थी के पुत्र की जन्म तिथि 3-3-1979 दर्शायी गई है जो कि गलत है। जिसकी दरुस्ती ग्राम पंचायत निरथ के परिवार रजिस्टर में करवाना चाहता है।

अतः इस इश्तहार द्वारा सर्वसाधारण को सूचित किया जाता है कि यदि किसी व्यक्ति को उपरोक्त प्रार्थी के पुत्र राज कुमार की जन्म तिथि पंचायत अभिलेख में दरुस्त करने बारा कोई उजर या एतराज हो तो वह दिनांक 20-7-2011 को या इससे पूर्व प्रातः 10.00 बजे हाजिर अदालत आकर अपनी आपत्ति दर्ज करवा सकता है। बाद गुजरने मियाद कोई भी उजर/एतराज काबिले समायत न होगा तथा नियमानुसार पंचायत अभिलेख में प्रार्थी के पुत्र राज कुमार की जन्म तिथि दरुस्त करने के आदेश पारित कर दिए जाएंगे। आज दिनांक 20-6-2011 को मेरे हस्ताक्षर व मोहर अदालत द्वारा जारी किया गया।

File No. EXN-F(5)-7/2005-Part.—In exercise of the powers conferred by section 10 of the Himachal Pradesh Value Added Tax Act, 2005 (Act No. 12 of 2005), the Governor, Himachal Pradesh proposes to make the following amendment in Schedule 'D' appended to the Act and the same is hereby published in the Rajpatra, Himachal Pradesh for the information of the general public;

If any interested person likely to be affected has any objection(s) or suggestion(s) with regard to these amendments, he may send the same to the Excise and Taxation Commissioner, Himachal Pradesh, Shimla-171009 within a period of ten days from the date of publication of this notification;

Objection(s)/suggestion(s), if any, received within the above stipulated period shall be taken into consideration by the Government before finalizing the same, namely:—

DRAFT AMENDMENT

"In the third Column at Serial No. 2 under the entry 1 for the figures and sign '14%', the figure and sign '9.70%' shall be substituted.".
