No. Rev-A(B)1-1/93-IX.—The Governor, Himachal Pradesh is pleased to promote the following Naib Tehsildars as Tehsildars (Class-I Gazetted) in the Pay scale of Rs.10,300- 34,800+Grade Pay Rs.4,400/- purely on adhoc basis for a period of three months or till "A" & "B" Class Tehsildars become available for appointment as Tehsildars. These adhoc promotions are subject to the reversion on becoming the "A" & "B" Class Tehsildar candidates ripe for appointment as Tehsildars or any vacancy ceases to exist:

1111.... संक्षिप्त नामसंक्षिप्त नामसंक्षिप्त नामसंक्षिप्त नाम....----इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश भवन और अन्य सन्निमार्ण कर्मकार (नियोजन तथा सेवा शर्त विनियमन) संशोधन नियम, 2011 है।

2222.... नियम 263 का संशोधननियम 263 का संशोधननियम 263 का संशोधननियम 263 का संशोधन....----हिमाचल प्रदेश भवन और अन्य सन्निमार्ण कर्मकार (नियोजन तथा सेवा शर्त विनियमन) नियम, 2008 ( जिन्हें इसमें इसके पश्चात्‌ "उक्त नियम" कहा गया है) के उप-नियम (1) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

" (1) बोर्ड सरकार की पूर्व सहमति से, हिमाचल प्रदेश के बोर्ड के सचिव के रूप में श्रम एवं रोजगार विभाग के किसी अधिकारी की, जो उप श्रमायुक्त की पंक्ति से नीचे का न हो, ऐसा न होने पर श्रम एवं रोजगार विभाग के किसी सेवानिवृत अधिकारी, जो उप-श्रमायुक्त की पंक्ति से नीचे का न हो, को पुनः नियोजित कर, दोनो के न होने पर हिमाचल प्रदेश सरकार के अन्य विभागों/बोर्डों/निगमों के उन अधिकारियों में से जिनका 5400/- रूपए न्यूनूतम ग्रेड पे सहित प्रदन्ह वर्ष का कार्य अनुभव हो और पी जी डी पी एम, डिप्लोमा या इसके समतुल्य हो सेकेंडमेंट आधार पर नियोजित करके नियुक्त करेगा।"

3333.... नियम नियम नियम नियम 266 का 266 का 266 का 266 का संशोधनसंशोधनसंशोधनसंशोधन....----उक्त नियमों के नियम 266 म,ें -4163 राजपत्र, हिमाचल प्रदेश, 18 नवम्बर, 2011/27 कार्तिक, 1933 (क) उप नियम (2)के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

"(2) निधि का सदस्य बनने के लिए आशायित प्रत्येक व्यक्ति सदस्यता के लिए आवेदन के साथ अपनी आयु सबूत के लिए निम्नलिखित दस्तावेजों में से एक प्रस्तुत करेगेा, अर्थात :-

(i) स्कूल छोड़ने का प्रमाण पत्र; या (ii) जन्म और मृत्यू के सम्बद्ध रजिस्ट्रार से प्रमाणपत्र; या (iii) चालन अनुज्ञप्ति; या (iv) निर्वाचक मतदाता कार्ड; या (v) अन्नय (यूनिक ) पहचान कार्ड; या (vi) परिवार रजिस्ट्रर की प्रति; या (vii) मनरेगा जॉब कार्ड; या (viii) नियोक्ता से आयु सबूत के रूप में प्रमाणपत्र; या (ix) श्रम अधिकारी द्वारा सत्यापित पहचान कार्ड की प्रति को आयु सबूत के रूप में विचार किया जा सकेगा; या

उपरोक्त (i) से (ix) मे दर्शित दस्तावेजों के न होने की दशा में, सरकारी सेवारत चिकित्सा अधिकारी द्वारा जारी किया गया प्रमाणपत्र; और

(ख) उप नियम (4) में, "15/- रूपए" के स्थान पर केवल पांच रूपए" शब्द रखे जाएगें। 4444.... नियम 267 का नियम 267 का नियम 267 का नियम 267 का संशोधनसंशोधनसंशोधनसंशोधन....----उक्त नियमों के नियम 267 के उप-नियम (1)के स्थान पर निम्नलिखित रखा जाएगाा,अर्थात्‌ ः- "(1) निधि का हिताधिकारी, निधि में 10/- रूपए प्रति मास अंशदान करेगाा यह अंशदान अग्रिम में त्रैमासिक/अर्धवाषिर्क/वार्षिक आधार पर उस जिले में, जिसमें सदस्य निवास करता है, बोर्ड द्वारा विनिर्दिष्ट बैंक (बैकों) में जमा किया जाएगा।"

5555.... नियम 271 का नियम 271 का नियम 271 का नियम 271 का प्रतिःस्प्रतिःस्प्रतिःस्प्रतिःस्थाथाथाथापनपनपनपन....----उक्त नियमों के नियम 271 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

" 271 " 271 " 271 " 271 मातृत्व/पमातृत्व/पमातृत्व/पमातृत्व/पैतैतैतैतृत्व प्रसुविद्याृत्व प्रसुविद्याृत्व प्रसुविद्याृत्व प्रसुविद्या....----महिला कर्मचारियों को, जो निधि की हिताधिकारी है; को प्रसूति की अवधि के दौरान प्रसूति प्रसुविद्या के रूप में केवल 10,000/- (दस हजार) रूपए दिए जाएगें पुरूष कर्मकारों जो निधि के हिताधिकारी है को भी पैतृत्व प्रसूविद्या के रूप में केवल 1000/- ( एक हजार ) रूपए के लिए हकदार होंगे। इस प्रसुविद्या के लिए आवेदन, आवेदक द्वारा, ऐसे अन्य दस्तावेजों सहित जो बोर्ड द्वारा विनिर्दिस्ट किए जाए प्ररूप 34 मे सचिव या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी को किया जाएगाः

परन्तु यह प्रसुविद्या दो बार से अधिक के लिए अनुज्ञात नहीं की जाएगी।

6666.... नियम 273 का नियम 273 का नियम 273 का नियम 273 का संशोधनसंशोधनसंशोधनसंशोधन....----उक्त नियमों के नियम 273 के उप-नियम (5)के स्थान पर निम्नलिखित रखा जाएगा, अर्थातः-

"(5) पेंश्ेान की राशि केवल 500/- (पांचं सौ) रूपए प्रतिमास होगी। केवल 20/- (बीस) रूपए की बढ़ौतरी पांच वर्ष से आगे की सेवा के प्रत्येक सम्पूर्ण वर्ष के लिए दी जाएगी। बोर्ड सरकार के पूर्व अनुमोदन से पेंशन पुनरीक्षित कर सकेगा।"

7777.... नियम 275 का नियम 275 का नियम 275 का नियम 275 का संशोधनसंशोधनसंशोधनसंशोधन....----उक्त नियमों के नियम 275 के उप-नियम (1) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात :-

"(1) बोर्ड केवल 500 (पांच सौ) रूपए प्रतिमास की दर से निःशक्तता पेंशन और यदि निःशक्तता पचास प्रतिशत या इससे अधिक है तो अनुग्रहपूर्वक (एक्सग्रेशिया) रक्म 10000/- (दस हजार) रूपए तथा अन्य मामलों में 5000/- पांच हजार) रूपए स्वीकृत कर सकेगा।"। 4164 राजपत्र, हिमाचल प्रदेश, 18 नवम्बर, 2011/27 कार्तिक, 1933 8888.... नियम 276 का नियम 276 का नियम 276 का नियम 276 का प्रतिःप्रतिःप्रतिःप्रतिःस्थास्थास्थास्थापनपनपनपन....----उक्त नियमों के नियम 276 के स्थान पर निम्नलिखित रखा जाएगा, अथार्त्‌ :-

"(1) निधि के उस सदस्य को औजारों को खरीदने के लिए ऋण के रूप् में केवल 6000/-(छह हजार) रूपए की राशि स्वीकृत की जाएगी। जिसने निधि की सदस्यता के रूप में एक वर्ष पूर्ण कर लिया हो और नियमित रूप से अंशदान भेज रहा है तथा जिसकी आयु 55 वर्ष से कम हो । ऋृण राशि की वसूली साठ से अधिक किश्तों में नही की जाएगी। ऋण के लिए आवेदन, ऐसे अन्य दस्तावेजों सहित जो बोर्ड द्वारा विनिर्दिष्ट किए जाए प्ररूप 40 में सचिव या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी को किया जाएगा।"

9999.... नियम 277 का नियम 277 का नियम 277 का नियम 277 का प्रतिःप्रतिःप्रतिःप्रतिःस्थास्थास्थास्थापनपनपनपन....----उक्त नियमों के नियम 277 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

"277"277"277"277.... अंअिंअिंअिंतिम संस्कार सहायता का सतम संस्कार सहायता का सतम संस्कार सहायता का सतम संस्कार सहायता का संदायंदायंदायंदाय....---- बोर्ड, मृतक सदस्य के नामर्निदेशित/आश्रितों को अंतिम संस्कार के खर्च हेतु केवल 5000/- (पांच हजार) रूपए की राशि स्वीकृत कर सकेगा। इस प्रसुविद्या के लिए आवेदन, नामनेर्दिशिति/विधिक वारिसों द्वारा प्ररूप 41में सचिव या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी को प्रस्तुत किया जाएगा।"ं

शिक्षा हेतु वित्तीय सहायता....----बोर्ड, निधि के सदस्यों के बच्चों की शिक्षा के लिए वितिय "281 "281 "281 "281 शिक्षा हेतु वित्तीय सहायता शिक्षा हेतु वित्तीय सहायता शिक्षा हेतु वित्तीय सहायता सहायता निम्नलिखित दरों पर उपलब्ध कर सकेगी :-

(2) आवेदक द्वारा अपने बच्चों की शिक्षा हेतु वितीय सहातया के लिए आवेदन प्ररूप 43 में, ऐसे दस्तावेजों सहित और ऐसे समय के भीतर जो बोर्ड द्वारा विनिर्दिष्ट किया जाए, सचिव या उसके द्वारा इस निमित्त किसी प्राधिकृत अधिकारी को दिया जाएगा।4165 राजपत्र, हिमाचल प्रदेश, 18 नवम्बर, 2011/27 कार्तिक, 1933 (3) वित्तीय सहायता निम्नलिखित शर्तों के अघ्यधीन प्रदान की जाएगी, अर्थात्‌ः-

(i) इस स्कीम के अधीन प्रसुविधा के लिए रजिस्ट्रीकृत हिताधिकारियों के पुत्र/पुत्री/पुत्रियां हकदार होगा/हाेंगे;

(ii) वे मान्यता प्राप्त संस्थानों में नियमित छात्र होगा/होंगे; (iii) यह प्रसुविधा हिताधिकारी के दो से अधिक बच्चों को नही दी जाएगी; और (iv) हिताधिकारी अपनी उस संस्था के प्रमुख से प्रमाणपत्र प्रस्तुत करेगा जहां उसके पुत्र या पुत्रियां अध्ययन कर रहा/रहें है।"

11111111.... नियम 282 का नियम 282 का नियम 282 का नियम 282 का प्रतिःस्प्रतिःस्प्रतिःस्प्रतिःस्थाथाथाथापनपनपनपन....----उक्त नियमों के नियम 282 के स्थान निम्नलिखित रखा जाएगा, अर्थात्‌ :-

" विवाह के "ि विवाह के "ि विवाह के "ि विवाह के लिए वितीय सहायतालए वितीय सहायतालए वितीय सहायतालए वितीय सहायता....----छह मास के लिए लगातार सदस्यता वाला सदस्य केवल अपने बच्चों के विवाह हेतु 11,000 (ग्यारह हजार) रूपए की वितीय सहायता प्राप्त करने के लिए पात्र होगा। इस निधि की महिला सदस्य भी उसके अपने विवाह हेतु सहायता के लिए पात्र होगी । यह सहायता सदस्य के दो बच्चों तक के विवाह के लिए मंजूर की जाएगी। आवेदक, द्वारा इस सहायता के लिए आवेदन, प्ररूप 44 में, ऐसे अन्य दस्तावेजों सहित, जो बोर्ड द्वारा विनिर्दिष्ट किए जाएं, सचिव या उसके द्वारा इस निमित्त प्राधिकृत किसी अधिकारी को प्रस्तुत किया जाएगा "।

" 283 (क) कम" 283 (क) कम" 283 (क) कम" 283 (क) कर्मकारर् कारर् कारर् कार ट्रट्रट्रट्रांािंािंािंजिट होस्टल का निर्माणजट होस्टल का निर्माणजट होस्टल का निर्माणजट होस्टल का निर्माण....---- बोर्ड, जहां बोर्ड के पास 300 से अधिक निर्माण कर्मकार हिताधिकारी के रूप में रजिस्ट्रीकृत है, वहां ऐसे निबंधनों और शर्तों पर, जैसी बोर्ड द्वारा विनिर्दिष्ट की जाएं, कर्मकार टां्रजिट होस्टल के निर्माण हेतु भवन र्निर्मित कर सकेगा या भाड़े पर ले सकेगा;

283 (ख) 283 (ख) 283 (ख) 283 (ख) महिला कर्मकारों कमहिला कर्मकारों कमहिला कर्मकारों कमहिला कर्मकारों के लिए साईकिले लिए साईकिले लिए साईकिले लिए साईकिल....---- महिला कर्मकारों, जो एक वर्ष के लिए निधि की सदस्य रही है, को उनके कर्तव्यों का निर्वहन करने के लिए साईकिल के क्रय हेतु केवल 2,000/- (दो हजार) रूपए वाहन सहायता के रूप में प्रदान किए जा सकेंगे "।

13131313.... नियम 285 का नियम 285 का नियम 285 का नियम 285 का संशोधनसंशोधनसंशोधनसंशोधन....----उक्त नियमों के नियम 285 के उप-नियम (2) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

" (2) इन नियमों के अधीन, दुर्घटनाओं की दशा में मृत्यु प्रसुविधा और चिकित्सा सहायता से अन्यथा समस्त वितीय प्रसुविधाएं किसी व्यक्ति के निधि का सदस्य बनने के केवल छह मास के पश्चात्‌ संदेय होगी। "

" 286 बीमा आरै स्वास्थ्य कवर (1) बोर्ड, स्वयं द्वारा अनुमोदित किसी भी बीमा स्कीम की प्रसुविधाओं को हिताधिकारियों को उपलब्ध करवाएगा और निधि से हिताधिकारियों की ओर से प्रीमियम का भागतः या पूर्णतः संदाय अनुज्ञात कर सकेगा।

(2) बोर्ड, हिताधिकारियों की प्रसुविधा के लिए किसी भी स्वास्थ्य बीमा योजना को अंगीकृत कर सकेगा और निधि से हिताधिकारियों की ओर से प्रीमीयम का भागतः या पूर्णतः संदाय अनुज्ञात कर सकेगा। "

NOTIFICATION

Shimla-171002, 17th November, 2011

No. Shram (A) 4-6/2010-BOCW Part-II(L).—In exercise of powers conferred by section 62 of the Building and Other Construction Workers (Regulation of Employment and Condition of Service) Act, 1996, the Governor of Himachal Pradesh, after consultation with the Expert Committee is pleased to make the following rules to amend the Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Condition of Service) Rules, 2008 notified vide Government notification No. Shram(A)4-6/2007-BOCW dated 4th December 2008 and published in Rajpatra, Himachal Pradesh, dated 8-12-2008 namely:-

1. Short title.—These rules may be called the Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Amendment Rules, 2011.

2. Amendment in rule 263.—In rule 263 of the Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 2008 (hereinafter referred to as the "said rules" for sub-rule (1), the following shall be substituted, namely:-

(1) The Board may with the prior concurrence of the Government, appoint an officer of the Labour and Employment Department, Himachal Pradesh not below the rank of Deputy Labour Commissioner, failing which re-employ a retired officer from the Labour and Employment Department not below the rank of Deputy Labour Commissioner, failing both, employ on secondment basis an officer from the Departments of the Himachal Pradesh Government/ Boards/Corporations possessing 15 years of working experience and diploma in PGDPM or its equivalent with minimum Grade Pay of Rs. 5400/-, as the Secretary of the Board.".

3. Amendment in rule 266.—In rule 266 of the said rules,-

(a) for sub-rule(2),the following shall be substituted, namely:-

" (2) Every person intending to become a member of the Fund shall furnish one of the following documents to prove his age alongwith the application for membership, namely:-

(i) School leaving certificate; or (ii) Certificate from the concerned Registrar of Births and Deaths; or (iii) Driving License; or (iv) Electoral Voter Card; or (v) Unique Identification Card; or (vi) Copy of Pariwar Register; or (vii) MNREGA Job Card; or (viii) Certificate of age proof from employer; (ix) Copy of I-Card attested by the Labour Officer may be considered as age proof.

issued by the Medical Officer in Government service."; and (b) in sub-rule (4) for the figure, words, signs and brackets "Rs.15/- (fifteen only)" the figure, words, signs and brackets "Rs. 5/- (five rupees) only" shall be substituted"..

4. Amendment of rule 267.—In rule 267 of the said rules, for sub-rule (1), the following shall be substituted, namely:-

" (1) A beneficiary of the Fund shall contribute to the Fund Rs.10/- (ten rupees)only per mensem. This contribution shall be remitted in advance on quarterly/half yearly/yearly basis in bank(s) specified by the Board in the district in which the member resides".

5. Substitution of rule 271.—For rule 271 of the said rules, the following shall be substituted, namely:-

" 271 Maternity/Paternity Benefit .- The women employees who are beneficiary of the Fund shall be provided Rs.10,000/- (Rupees ten thousand) only as maternity benefit during the period of maternity. The male worker who is beneficiary to the Fund shall also be entitled for Rs.1000/- (one thousand rupees) only as paternity benefit. The application for this benefit shall be made by the applicant to the Secretary or an officer authorized by him in this behalf in Form-XXXIV with such other documents as may be specified by the Board:

Provided that this benefit shall not be allowed more than twice".

6. Amendment of rule 273.—In rule 273 of the said rules, for sub-rule (5), the following shall be substituted, namely:-

"(5) The amount of pension shall be Rs. 500/- (five hundred rupees) only per mensem. An increase of Rs. 20/- (twenty rupees) only shall be given for every completed year of service beyond 5 years. The Board may, with the prior approval of the Government revise the pension."

7. Amendment of rule 275.—In rule 275 of the said rules, for sub-rule (1), the following shall be substituted, namely:-

"(1) The Board may sanction disability pension @ Rs. 500/- (five hundred rupees) only per mensem and an exgratia amount of Rs.10,000/- (ten thousand rupees) only if the disability is 50% or above and Rs. 5000/- in other cases."

8. Substitution of rule 276.—For rule 276 of the said rules, the following shall be substituted, namely:-

"An amount of Rs. 6000/- (six thousand rupees) only may be sanctioned as loan to such member of the Fund for the purchase of tools who has completed 1 year membership in the Fund and has been remitting contribution regularly and is less than 55 years of age. The loan amount shall be recovered in not more than sixty installments. An application for loan shall be made in Form-XL to the Secretary or an officer authorized by him in this behalf with such other documents as may be specified by the Board."4168 राजपत्र, हिमाचल प्रदेश, 18 नवम्बर, 2011/27 कार्तिक, 1933 9. Substitution of rule 277.—For rule 277 of the said rules, the following shall be substituted, namely:-

" 277 Payment of Funeral Assistance.-The Board may sanction an amount of Rs. 5000/- (five thousand rupees) only to the nominees/dependents of a deceased member, towards funeral expenses. An application for this benefit shall be submitted by the nominee/legal heirs in Form-XLI to the Secretary or the officer authorized by him in this behalf.".

10. Substitution of rule 281.—For rule 281 of the said rules, the following shall be substituted, namely:-

" 281. Financial Assistance for Education.-(1) The Board may provide financial assistance for education of the children of the members of the Fund at the following rates:-

7. Professional courses/Degrees 8,000.00 8. Ph. D, Research courses 10,000.00

(2) An application for the financial assistance for education of his children shall be made by the applicant in Form- XLIII to the Secretary or an officer authorized by him in this behalf with such documents and within such time as may be specified by the Board.

(3) The financial assistance shall be granted subject to the following conditions, namely:-

i) The son(s)/daughter(s) of the registered beneficiaries shall be entitled for the benefit under this scheme;

ii) They shall be regular student (s) in the recognized Institution; iii) This benefit shall not be allowed for more than two children of the beneficiary; and iv) The beneficiary shall produce a certificate from the head of the respective institution where his/her son(s) or daughter(s) is studying ".

11. Substitution of rule 282.—For rule 282 of said rules, the following shall be substituted, namely:-

" 282 Financial Assistance for the marriage.-The member having continuous membership for 6 months shall be eligible to get financial assistance of Rs. 11000/- (eleven thousand rupees) only for the marriage of his children. A female member of this Fund shall also be eligible for this assistance for her own marriage. This assistance shall be sanctioned for the marriage of upto two children of the member. An application for this assistance shall be submitted by the applicant in Form-XLIV to the Secretary or an officer authorized by him in this behalf along with such other documents as may be specified by the Board".

12. Insertion of rules 283 (A) and 283(B).—After rule 283 of the said rules, the following rules shall be inserted, namely:-

"283 (A). Construction of workers Transit Hostel.-The Board may construct or hire buildings for the construction workers transit hostel(s) where more than 300 construction workers are registered as beneficiaries with the Board on such terms and conditions as may be specified by the Board;

283 (B). Bicycle to the lady workers.-The female workers who have been members of the Fund for one year may be provided Rs. 2000/- (two thousand rupees) only as conveyance assistance for purchase of bicycle to discharge their duties"

13. Amendment of rule 285.—In rule 285 of the said rules, for sub-rule (2), the following shall be substituted, namely:-

" (2) All financial benefits under these rules other than death benefits and medical assistance in cases of accidents shall become payable only after six months of a person becoming member of the Fund".

14. Substitution of rule 286.—For rule 286 of the said rules, the following shall be substituted namely:-

" 286 Insurance and Health Cover.-(1) The Board may provide the benefits of any insurance scheme approved by it to the beneficiaries and allow the payment of insurance premium partly or fully on behalf of the beneficiaries from the Fund.

(2) The Board may adopt any health insurance scheme for the beneficiaries and allow the payment of insurance premium partly or fully on behalf of the beneficiaries from the Fund.".

Hence this proclamation is hereby issued for the information of general public that if any person has any objection for the registration of the above marriage can appear in this court on 30-11-2011 at 2.00 P. M. to object registration of above marriage personally or through an authorized agent failing which this marriage will be registered under this Act, 1954 accordingly.
