No. HHC/Admn.6 (20)/77-XVII.—It is hereby notified for general information that the High Court of Himachal Pradesh shall remain closed for the winter vacation from January 16, 2012 to February 25, 2012 and for summer vacation from June 4, 2012 to June 8, 2012. The High Court will resume its sitting from Monday the 27th February, 2012 and Monday the 11th June, 2012, after observing winter vacation/gazetted holiday and summer vacation/gazetted holidays, respectively.

The Office of the High Court will remain open during the winter andsummer vacations and will receive from parties and persons such petitions and other documents as they may choose to present. All petitions and applications falling under the civil jurisdiction of the Court, which are not of an urgent nature, will be listed after the reopening of the Court.

Urgent Criminal and Civil matters shall continue to be heard during the Vacations by the Vacation Judges.

Limitation will be regulated as per Section 4 of the Limitation Act, 1963 during the acations/ holidays.

अतः हिमाचल प्रदेश के राज्यपाल, नोटरी नियम, 1956 के नियम 13 (12)(इ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राकेश कुमार, नोटरी पब्लिक, उप-मण्डल़ अम्ब, जिला ऊना को नोटरी का कार्य करने से तुरन्त प्रभाव से निलम्बित करने का आदेश देती हैं जब तक कि उनके विरूध दर्ज उपरोक्त एफ0 आई0 आर0 का परिणाम नहीं आ जाता।

No. LLR-E(9)- 6/2003-Leg.—WHEREAS Shri Rakesh Kumar, Advocate was appointed as Public Notary vide Government Notification No.LLR-E(9)-50/2005-Leg. dated 22-07-2011 and authorised to practice as such within the territorial limits of Sub-Division Amb of District Una and his name was entered at serial No.359 in the Register of Notaries;

AND WHEREAS Shri R.K. Dhanotia, Advocate Amb has made a complaint against the appointment of Shri Rakesh Kumar, Advocate as Notary Public on the ground that he has consealed the facts that two FIR's are registered against him while making application for Notary;

AND WHEREAS District Magistrate Una was directed to enquire into the matter and send report to the Govt. The District Magistrate Una has intimated vide letter No.1092/LA/Civil/2011 dated 24-10-2011 has informed that two FIR Nos. 136/09 under sections 353, 332, 147, 148, 149, 323, 504, 506 IPC and 14/11 under sections 147, 148, 149, 325, 295A, 307, 120B IPC are pending against Shri Rakesh Kumar, Advocate in Police Station Amb and he has two Rashan Cards and casts his votes from Gram Panchayat Takrala and Gram Panchat Amb and he has consealed all these facts while making application for appointment as Notary, which is a serious crime;

NOW, therefore, the Governor, Himachal Pradesh in exercise of the powers conferred by rule 13(12)(b)(ii) of the Notaries Rules, 1956 is please to order the suspension of Shri Rakesh Kumar, Notary Public, Sub-Division Amb of District Una from practice as Notary with immediate effect till the final outcome of above two FIRs.

संसंसंसं.... पब-ए (3)पब-ए (3)पब-ए (3)पब-ए (3) 27/9927/9927/9927/99....----हिमाचल प्रदेश की राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, इस विभाग की समसंख्यक अधिसूचना संख्या : पब-ए (3)5/94 तारीख 29-01-1997 द्वारा अधिसूचित हिमाचल प्रदेश सूचना एवं जन सम्पर्क विभाग, अधीक्षक ग्रेड-I (वर्ग-I राजपत्रित) भर्ती एवं प्रोन्नति नियम, 1997 का और संशोधन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थातः-

1111.... संक्षिप्त नाम और प्रारम्भसंक्षिप्त नाम और प्रारम्भसंक्षिप्त नाम और प्रारम्भसंक्षिप्त नाम और प्रारम्भ....----(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश सूचना एवं जन सम्पर्क विभाग, अधीक्षक ग्रेड-I, वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति नियमए 2011 है।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2222.... उपाबन्धउपाबन्धउपाबन्धउपाबन्ध ''अ'' ''अ'' ''अ'' ''अ'' का संशोधनका संशोधनका संशोधनका संशोधन....----हिमाचल प्रदेश सूचना एवं जन सम्पर्क विभाग, अधीक्षक ग्रेड-I वर्ग-I (राजपत्रित) भर्ती एवं प्रोन्नति नियम, 1997 के उपाबन्ध ''अ'' में ;-

(क) स्तम्भ संख्या : 4 के सामने विद्यमान उपबन्ध के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः- "` 10300-34800 जमा ` 5000/- ग्रेड पे।''

(ख) स्तम्भ संख्या ः 10 के सामने विद्यमान शीर्षक के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''भर्ती की पद्धति-भर्ती सीधी होगी या प्रोन्नति, प्रतिनियुक्ति, स्थानान्तरण द्वारा और विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता।''

(ग) स्तम्भ संख्या ः 11 के सामने विद्यमान उपबन्ध के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''अधीक्षक ग्रेड-II/निजि सहायक में से प्रोन्नति द्वारा जिनका तीन वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा, यदि कोई हो को सम्मिलित करके तीन वर्ष का नियमित सेवाकाल हो, 4282 राजपत्र, हिमाचल प्रदेश, 25 नवम्बर, 2011/4 अग्रहायण, 1933 ऐसा न होने पर अधीक्षक ग्रेड-II/निजि सहायक में से प्रोन्नति द्वारा जिनका अधीक्षक ग्रेड-II/निजी सहायक और वरिष्ठ सहायक/वरिष्ठ वेतनमान आशुलिपिक के रूप में, उनके अपने-अपने ग्रेड में नौ वर्ष का नियमित सेवाकाल या की गई लागातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके नौ वर्ष संयुक्त नियमित सेवाकाल हो :

परन्तु प्रोन्नति के प्रयोजन के लिए पात्र कर्मचारियों की उनके अपने-अपने संवर्ग में कुल सेवाकाल के आधार पर उनकी पारस्परिक वरिष्ठता को छेड़े बिना एक संयुक्त वरिष्ठता सूचि तैयार की जाएगी । (1) प्रोन्नति के सभी मामलों में पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद में की गई लगातार तदर्थ सेवा, यदि कोई हो, प्रोन्नति के लिए इन नियमों में यथाविहित सेवा काल के लिए, इस शर्त के अधीन रहते हुए गणना में ली जाएगी कि सम्भरक प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात्‌ की गई थी परन्तु यह कि उन सभी मामलों में जिन में कोई कनिष्ठ व्यक्ति सम्भरक पद में अपने कुल सेवा काल (तदर्थ आधार पर की गई तदर्थ सेवा सहित जो नियमित सेवा/नियुक्ति के अनुसरण में हो) आधार पर उर्पयुक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहां अपने-अपने प्रवर्ग/पद/कॉडर में उस से वरिष्ठ सभी व्यक्ति विचार किए जाने के पात्र समझे जाएंगे और विचार करते समय कनिष्ठ व्यक्ति से ऊपर रखे जाएंगे :

परन्तु यह और कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, कम से कम तीन वर्ष की न्यूनतम अहर्ता सेवा या पद के भर्ती एवं प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगी ।

परन्तु यह और भी कि जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहां उस से कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जाएंगे।

स्पष्टीकरस्पष्टीकरस्पष्टीकरस्पष्टीकरणणणण....----अन्तिम परन्तुक के अन्तर्गत कनिष्ठ पदाधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा। यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है जिसे डिमोब्लाईज्ड आरमज फोरसिज परसोनल (रिर्जवेशन ऑफ वैकेन्सीज इन हिमाचल स्टेट नॉन टैक्निकल सर्विसिज) रूल्ज, 1972 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो या जिसे एक्स-सर्विसमैन (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल प्रदेश टैक्निकल सर्विसिज) रूल्ज, 1985 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया हो व इनकेे अन्तर्गत वरियता लाभ दिए गए हों।

(2) इसी प्रकार स्थाईकरण के सभी मामलों में ऐसे पद पर नियुक्ति/प्रोन्नति से पूर्व तक की गई तदर्थ सेवा, यदि कोई हो, सेवा काल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति, भर्ती और प्रोन्नति नियमों के उपबन्धेां के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात्‌ की गई थी :

परन्तु की गई उपरोक्त निर्दिष्ट तदर्थ सेवा को गणना में लेने के पश्चात्‌ जो स्थाईकरण होगा, उस के फलस्वरूप पारस्परिक वरीयता अपरिवर्तित रहेगी ।''

(घ) स्तम्भ संख्या ः 17 के सामने विद्यमान उपबन्ध के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''सेवा में प्रत्येक सदस्य को समय-समय पर यथा संशोधित विभागीय परीक्षा नियम, 1997 में यथा विहित विभागीय परीक्षा पास करनी होगी।

A-(3)27/99.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following rules further to amend the Himachal Pradesh, Information & Public Relations Department, Superintendent Grade-I (Class-I-Gazetted) Recruitment and Promotion Rules, 1997 notified vide this Department notification No.Pub- A(3)5/94 dated 29-01-1997, namely:-

1. Short title and Commencement.—(1) These rules may be called the Himachal Pradesh, Information & Public Relations Department, Superintendent Grade-I (Class-IGazetted) Recruitment and Promotion (Second amendment) Rules, 2011.

(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Annexure "A".—In Annexure "A" to the Himachal Pradesh Information and Public Relations Department, Superintendent Grade-I (Class-I-Gazetted) Recruitment and Promotion Rules, 1997:-

a) In the existing provision of Column No. 4, the following shall be substituted, namely:

"Rs.10300-34800+Rs.5000 G.P. "

b) For the existing title of Column No. 10 following shall be substituted, namely :- "Method of recruitment, whether by direct recruitment or by promotion transfer and percentage of posts to be filled in by various methods"

c) For the existing provision of Column No. 11, the following shall be substituted, namely:

"By promotion from amongst the superintendent Grade-II/Personal Assistant who possess 3years regular or regular combined with continuous adhoc service render, if any, in the grade, failing which by promotion from amongst the superintendent Grade-II/Personal Assistant who possess 9 years regular or regular combined with continuous adhoc service render, if any as Superintendent Grade-II/ Personal Assistant and Sr.Assistant /Sr.Scale Stenographer combined in their respective grade.

Provided that for the purpose of promotion a Joint seniority list of eligible officials on the basis of their length of their service in respective cadre shall be prepared without disturbing their inter-seseniority.

1. In all cases of promotion, the continuous adhoc service rendered in the feeder post if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these rules for promotion subject to the condition that the adhoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R&P Rules, provided that.

(i) In all cases where a junior person becomes eligible for consideration by virtue of his total length of service including the service rendered on adhoc basis, followed by regular service/appointment) in the feeder post in view of the provisions referred to above, all persons senior to him in the respective category/post/cadre shall deemed to be eligible for consideration and place in the field of consideration.

Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of at least three years or that prescribed in the recruitment and promotions rules for the post, whichever is less,

Provided further that where a person become ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him shall also be deemed to be ineligible for consideration for such promotion.

Explanation.—The last proviso shall not render the junior incumbents ineligible for consideration for promotion if the senior ineligible persons happened to be ex-servicemen recruited under the provisions of rule 3 of Demobilized Armed Forces Personnel (Reservation of Vacancies in Himachal State Non-Technical Services) Rules, 1972 and having been given the benefit of seniority there under or recruited under the provisions of rule-3 of ex-servicemen(Reservation of Vacancies in the Himachal Pradesh Technical Service) Rules,1985 and having been given the benefit of Seniority thereunder.

(2) Similarly, in all cases of confirmation continuous adhoc Service rendered on the feeder post, if any, prior to the regular appointment/promotion had shall be taken into account towards the length of service, if the adhoc appointment promotion had been made after proper selection and in accordance with the provisions of the R&P Rules.

Provided that inter-se-seniority as a result of confirmation after taking into account adhoc service rendered as referred to above shall remain unchanged.

(d) In the existing provision of Column No. 17 following shall be substituted, namely :-

"Every member of the service shall pass a Department Examination as prescribed in the Departmental Examination Rules, 1997, as amended form time to time.

सं0ः 3/4/आईसं0ः 3/4/आईसं0ः 3/4/आईसं0ः 3/4/आई.... डीडीडीडी..../2011/एस0डी0आर/2011/एस0डी0आर/2011/एस0डी0आर/2011/एस0डी0आर0 0 0 0 (हि0प्र0)(हि0प्र0)(हि0प्र0)(हि0प्र0)....----यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 61 में यह प्रावधान है कि निर्वाचकों के प्रतिरूपण को रोकने की दृष्टि से, ताकि उक्त अधिनियम की धारा 62 के अधीन असली निर्वाचकों के मताधिकार को और अधिक प्रभावी बनाया जा सके, मतदान के समय निर्वाचकों के लिए अपनी पहचान को सिद्ध करने के उपाय के रूप में निर्वाचक पहचान-पत्र के प्रयोग के लिए उस अधिनियम के अधीन नियमों द्वारा प्रावधान किया जाए ; और 4290 राजपत्र, हिमाचल प्रदेश, 25 नवम्बर, 2011/4 अग्रहायण, 1933 2. यतः, निर्वाचक रजिस्ट्रीकरण नियम, 1960 का नियम 28 निर्वाचन आयोग को मतदान के समय निर्वाचकाें के प्रतिरूपण को रोकने और उनकी पहचान सुगम बनाने के लिए राज्य की लागत पर उनके फोटो सहित निर्वाचक फोटो-पहचान पत्र जारी करने का निदेश देने का अधिकार देता है ; और

3. यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 49 ज (3) और 49 ट (2) (ख) में यह अनुबंध है कि जिन निर्वाचन-क्षेत्र के निर्वाचकों को निर्वाचक रजिस्ट्रीकरण नियम, 1960 के नियम 28 के उक्त उपबंधों के अधीन निर्वाचक फोटो पहचान-पत्र जारी किये गये है उन निर्वाचकों को मतदान केन्द्र में अपना निर्वाचक फोटो पहचान-पत्र प्रस्तुत करना होगा और उनकी ओर से निर्वाचक पहचान-पत्र प्रस्तुत करने में असफल रहने या मना करने पर मत डालने से उन्हें मना किया जा सकता है ; और

4. यतः, उक्त अधिनियम और नियमों के उपर्युक्त उपबंधाें के सामंजस्यपूर्ण और संयुक्त पठन से यह स्पष्ट हो जाता है कि यद्यपि मत देने का अधिकार निर्वाचक नामावली में नाम होने से ही होता है, तथापि यह निर्वाचक फोटो पहचान-पत्र के प्रयोग पर भी निर्भर करता है, जहाँ राज्य की लागत पर निर्वाचन आयोग द्वारा निर्वाचक फोटो पहचान-पत्र जारी किया गया है, वहाँ दोनो को ही साथ-साथ प्रयोग में लाया जाना है ; और 5. यतः, निर्वाचन आयोग ने एक समयबद्ध कार्यक्रम के अनुसार सभी निर्वाचको को निर्वाचक फोटो पहचान-पत्र जारी करने का निदेश देते हुए 28 अगस्त, 1993 को एक आदेश दिया था ; और 6. यतः, आयोग ने यह पाया है कि पिछले कुछ वर्षाें से जब से निर्वाचक फोटो पहचान-पत्र जारी करने के लिए कार्यक्रम का कार्यान्वयन शुरू किया गया था, हिमाचल प्रदेश के निर्वाचन-तन्त्र ने सभी संभव प्रयत्नों द्वारा छूटे हुए निर्वाचको, को ध्यान में रखते हुए पहचान-पत्र जारी करने के लिए निर्वाचन-क्षेत्रों और इलाकों मे अनेक चक्राें को दोहराते हुए पर्याप्त संख्या में निर्वाचकों को फोटो पहचान-पत्र जारी किए है ; और

7. यतः, जनवरी-मार्च, 2000 में हुए हरियाणा विधान सभा के साधारण निर्वाचन, और तब से अब तक हुए सभी साधारण और उप निर्वाचनों में आयोग ने यह निदेश दिया था कि उक्त निर्वाचनों में सभी निर्वाचक जिन्हें निर्वाचक फोटो पहचान-पत्र जारी किए जा चुके है, अपने मताधिकार का प्रयोग करते समय अपने पहचान-पत्र प्रस्तुत करें और उक्त निर्वाचन में उन छूटे हुए निर्वाचकों जिन्होंने निर्वाचक फोटो पहचान-पत्र प्राप्त नहीं किए है, उन्हें मतदान करने की अनुमति दी जाएगी बशर्ते कि आयोग द्वारा निर्धारित किसी वैकल्पिक दस्तावेजों में से कोई एक दस्तावेज प्रस्तुत करने पर उनकी पहचान स्थापित की जा सके । 8. अतः, अब, सभी संबद्ध बातों और विधिक तथा तथ्यात्मक स्थिति को ध्यान में रखते हुए निर्वाचन आयोग एतद्‌द्वारा यह निदेश देता है कि हिमाचल प्रदेश में 12-नालागढ़ एवं 16-रेणका(अ0जा0) विधान सभा निर्वाचन क्षेत्रों के उप निर्वाचन, जो दिनांक 5 नवम्बर, 2011 को अधिसूचित हुआ था, के लिए मतदान केन्द्रों पर मत डालने और अपने मताधिकार का प्रयोग करने से पहले अपनी पहचान स्थापित करने के लिए, अपने निर्वाचक फोटो पहचान पत्र को प्रस्तुत करना होगा । यदि कोई निर्वाचक अपना निर्वाचक फोटो पहचान पत्र प्रस्तुत करने में असफल रहता है तो ऐसे निर्वाचक को अपनी पहचान स्थापित करने के लिए निम्नलिखित वैकल्पिक फोटो दस्तावेजों में से कोई एक प्रस्तुत करना होगा :

(i) पासपोर्ट। (ii) ड्राइविंग लाइसेन्स । (iii) आयकर पहचान-पत्र (पैन कार्ड) । (iv) राज्य/केन्द्र सरकार, सार्वजनिक क्षेत्र के उपक्रम, स्थानीय निकाय या पब्लिक लिमिटेड कम्पनियों द्वारा उनके कर्मचारियों को जारी किए जाने वाले फोटोयुक्त सेवा पहचान-पत्र । (v) सार्वजनिक क्षेत्र के बैंकों/डाकघरों द्वारा 31.10.2011 तक खोले गए खातो के लिए फोटोयुक्त पासबुक ।

(vi) फोटोयुक्त स्वतंत्रता सेनानी पहचान-पत्र । (vii) सक्षम प्राधिकारी द्वारा 31.10.2011 तक जारी फोटोयुक्त अ.जा./अ.ज.जा./अन्य पिछड़ा वर्ग प्रमाण-पत्र ।4291 राजपत्र, हिमाचल प्रदेश, 25 नवम्बर, 2011/4 अग्रहायण, 1933 (viii) सक्षम प्राधिकारी द्वारा 31.10.2011 तक जारी फोटोयुक्त शारीरिक विक्लांगता प्रमाण-पत्र । (ix) 31.10.2011 तक जारी फोटो-युक्त शस्त्र लाइसेंस । (x) राष्ट्रीय ग्रामीण रोजगार गांरटी योजना के अधीन 31.10.2011 तक जारी फोटोयुक्त जॉब कार्ड।

(xi) फोटोयुक्त सम्पत्ति दस्तावेज जैसे कि पट्‌टा, रजिस्ट्रीकृत विलेख आदि । (xii) फोटोयुक्त पेंशन दस्तावेज जैसे कि भूतपूर्व सैनिक पेंशन बुक/पेंशन अदायगी आदेश/भूतपूर्व सैनिक की विधवा/आश्रित प्रमाण-पत्र/वृद्धावस्था पेंशन आदेश/विधवा पेंशन आदेश (31.10. 2011 तक जारी)।

(xiii) फोटोयुक्त स्वास्थ्य बीमा योजना स्मार्ट कार्ड (श्रम मंत्रालय की योजना, 31.10.2011 तक जारी)।

9. उपर्युक्त में से कोई भी दस्तावेज जो केवल परिवार के मुखिया के पास ही उपलब्ध हो, का प्रयोग उस परिवार के अन्य सदस्यों की पहचान करने के लिए किया जा सकता है, बशर्ते सभी सदस्य एक साथ आएं तथा परिवार के मुखिया द्वारा उनकी पहचान की जाए ।

10. उक्त पैरा 8 में किसी भी बात के होते हुए भी प्रवासी निर्वाचक जो लोक प्रतिनिधित्व अधिनियम, 1950 की धारा 20क के अधीन अपने पासपोर्ट में दिए गए विवरणानुसार, निर्वाचक नामावली में पंजीकृत है, मतदान केन्द्र में उनकी पहचान केवल उनके मूल पासपोर्ट के आधार पर ही की जाएगी (किसी अन्य पहचान दस्तावेज के आधार पर नहीं)।

Whereas, Section 61 of the Representation of the People Act, 1951 provides that with a view to preventing impersonation of electors, so as to make the right of genuine electors to vote under section 62 of that Act more effective, provisions may be made by rules under that Act for use of Electors Photo Identity Card for electors as the means of establishing their identity at the time of polling; and

2. Whereas, Rule 28 of the Registration of Electors Rules, 1960, empowers the Election Commission to direct, with a view to preventing impersonation of electors and facilitating their identification at the time of poll, the issue of Electors Photo Identity Card to electors bearing their photographs at State cost; and

3. Whereas, Rules 49H (3) and 49K (2) (b) of the Conduct of Elections Rules, 1961, stipulate that where the electors of a constituency have been supplied with Electors Photo Identity Card under the said provisions of Rule 28 of the Registration of Electors Rules, 1960, the electors shall produce their Electors Photo Identity Card at the polling station and failure or refusal on their part to produce those Electors Photo Identity Card may result in the denial of permission to vote; and4292 राजपत्र, हिमाचल प्रदेश, 25 नवम्बर, 2011/4 अग्रहायण, 1933 4. Whereas, a combined and harmonious reading of the aforesaid provisions of the said Act and the Rules, makes it clear that although the right to vote arises by the existence of the name in the electoral roll, it is also dependent upon the use of the Electors Photo Identity Cards where provided by the Election Commission at State cost, and that both are to be used together; and 5. Whereas, the Election Commission made an Order on the 28th August, 1993, directing the issue of Electors Photo Identity Card (EPIC) to all electors, according to a time bound programme; and

6. Whereas, the Commission has taken note of the fact that over the last few years since the implementation of the programme of issue of Electors Photo Identity Card was taken up, the election machinery of Himachal Pradesh, has issued these cards to a substantially high number of electors and made all possible efforts, by way of repeated rounds of the constituencies and areas, with a view to issuing cards to the left-out electors; and

7. Whereas, at the general election to the Legislative Assembly of Haryana held in January–March, 2000, and at all general and bye-elections held since then, the Commission had directed that all electors who were issued with Electors Photo Identity Card should produce those cards to exercise their franchise at the said election, and that it would permit those electors who have not obtained their EPIC to vote at the said election, provided their identity is otherwise established by production of one of the alternative documents prescribed by the Commission; and.

8. Now, therefore, after taking into account all relevant factors and the legal and factual position, the Election Commission hereby directs that all electors in 12-Nalagarh & 16-Rainka(SC) Assembly Constituencies in Himachal Pradesh, for the byeelection notified on 5th November, 2011, shall produce their EPIC for establishing their identity before casting their votes. If any elector fails to produce his/her EPIC, such elector shall have to produce any of the following alternative photo documents for establishing his/her identity.

I. Passport,

II. Driving License,

III. Income Tax Identity (PAN) Card,

IV. Service Identity Cards with photograph issued to its employees by State/Central Government, Public Sector Undertakings, Local Bodies or Public Limited Companies,

V. Passbooks with photograph issued by Public Sector Banks/Post Office and Kisan Passbook(Accounts opened on or before 31-10-2011),

VI. Freedom Fighter Identity Cards with photograph,

VII. SC/ST/OBC Certificates with photograph issued by competent authority on or before 31-10-2011,

VIII. Certificate of Physical Handicap having photograph issued by the Competent Authority on or before 31-10-2011,

IX. Arms Licenses having photograph issued on or before 31-10- 2011, X. Notwithstanding anything mentioned in Para 8 above, Overseas electors who are registered in the electoral rolls under Section 20A of the Representation of the People Act, 1950 based on the particulars in their passport, shall be identified on the basis of their original passport only (and no other identity document) in the polling station.

दरख्वास्त जेर धारा 13 (3) जन्म एवं मृत्यु पंजीकरण अधिनियम, 1969 हरगाह प्रकाश पुत्र श्री बांका राम, निवासी पेखा (घरटनू), तहसील चड़गांव, जिला शिमला, हिमाचल प्रदेश ने दरख्वास्त गुजारी है कि मेरी4297 राजपत्र, हिमाचल प्रदेश, 25 नवम्बर, 2011/4 अग्रहायण, 1933 शादी श्रीमती हिरा मणी के साथ हुई है उसके वतन व मेरे नुथप से मेरे पुत्र आशू का जन्म हुआ है उसकी वास्तविक जन्म तिथि 5 अक्तूबर, 2010 है जो सही है। परन्तु प्रार्थी अज्ञानतावश अपने पुत्र आशु की जन्म तिथि ग्राम पंचायत कार्यालय परिवार रजिस्टर पेखा में दर्ज नहीं करवा सका। जिसे प्रार्थी अब ग्राम पंचायत पेखा के परिवार रजिस्टर में दर्ज करवाना चाहता है।

अतः सर्व साधारण को इस इश्तहार द्वारा सूचित किया जाता है कि इस बारे यदि किसी व्यक्ति या रिश्तेदार को कोई उजर या एतराज हो तो वह अपना एतराज दिनांक 19 दिसम्बर, 2011 को प्रातः 10.00 बजे इस अदालत में हाजिर आकर पेश कर सकता है अन्यथा एकतरफा कार्यवाही अमल में लाई जाकर आशु का नाम दर्ज करने के आदेश ग्राम पंचायत पेखा को पारित किए जावेंगे।

आज दिनांक 18-11-2011 को मेरे हस्ताक्षर व मोहर सहित जारी किया गया।
