ससससंख्या टींख्या टींख्या टींख्या टी....पीपीपीपी....टीटीटीटी....-ए (3) 2/2010-ए (3) 2/2010-ए (3) 2/2010-ए (3) 2/2010....----हिमाचल प्रदेश की राज्यपाल, मोटरयान अधिनियम, 1988 (1988 का 59) की धारा 211,212, और 192 के साथ पठित धारा े41(13), 65 (2) (ट),111 (2)(ड.) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्याः 5-24/88-टी.पी.टी.-11, तारीख 12 जुलाई, 1999 द्वारा अधिसूचित और राजपत्र (असाधारण), हिमाचल प्रदेश में तारीख 27 जुलाई, 1999 को प्रकाशित हिमाचल प्रदेश मोटरयान नियम, 1999 का और संशोधन करने के लिए निम्नलिखित नियम बनाने का प्रस्ताव करती है, और इन्हें जनसाधारण के सूचना के लिए एतदद्वारा राजपत्र, हिमाचल प्रदेश में प्रकाशित किया जाता है और नोटिस दिया जाता है कि इन नियमों के राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से तीस (30) दिन के अवसान के पश्चात उक्त नियमों को अंतिम रूप दे दिया जाएगा;

184-राजपत्र/2011-12-12-2011 (4515) 4516 राजपत्र, हिमाचल प्रदेश, 12 दिसम्बर, 2011/21 अग्रहायण, 1933 2. इन नियमों द्वारा संभाव्य प्रभावित कोई व्यक्ति, यदि इन नियमों के संबन्ध में कोई आक्षेप या सुझाव देना चाहे तो वह उन्हें उपयुक्र्त नियत अवधि के भीतर प्रधान सचिव (परिवहन), हिमाचल प्रदेश सरकार, आर्मजडेल भवन, शिमला-2 को भेज सकेगा;

3. नियत अवधि के भीतर प्राप्त हुए आक्षेप (पाें) या सुझाव (वाें), यदि कोई हों, पर प्रारूप नियमों को अंतिम रूप देने से पूर्व, हिमाचल प्रदेश सरकार द्वारा विचार किया जाएगा, अर्थात्‌-

2222.... नियमनियमनियमनियम 47-क का47-क का47-क का47-क का अन्तःस्थापनअन्तःस्थापनअन्तःस्थापनअन्तःस्थापन....----हिमाचल प्रदेश मोटरयान नियम, 1999 (जिन्हें इसमें इसके पश्चात, 'उक्त नियम' कहा गया है) के विद्यमान नियम 47 के पश्चात निम्नलिखित नया नियम 47-क अन्तःस्थापित किया जाएगा, अर्थात :-

NOTIFICATION

Shimla-2, the 8th December, 2011

No.TPT-A(3)2/2010.—In exercise of the powers conferred by sections 41(13) , 65 (2) (K), 111 (2) (e) read with sections 211, 212 and 192 of the Motor Vehicles Act, 1988, (59 of 1988), the Governor, Himachal Pradesh proposes to make the following rules further to amend the Himachal Pradesh Motor Vehicles Rules, 1999, notified vide this department notification No: 5-24/88-TPT- II, dated 12th July, 1999 and published in Rajpatra, Himachal Pradesh (Extra Ordinary), dated 27th July, 1999 and the same are hereby published in the Rajpatra, Himachal Pradesh for general information of the public and a notice is hereby given that the said rules will be finalized after the expiry of 30 days from the date of publication of these rules in the Rajpatra, Himachal Pradesh;

2. If any person, likely to be affected by these rules has any objection (s) or suggestion (s) to make with regard to these rules he may send the same to Principal Secretary(Transport), to the Government of Himachal Pradesh , Armsdale Building, Shimla-2, within the above stipulated period;

3. Objection(s) or suggestion (s), if any, received within the stipulated period, shall be considered by the Government of Himachal Pradesh before finalising the draft rules, namely:-

DRAFT RULES

1. Short title.—These rules may be called the Himachal Pradesh Motor Vehicles (First Amendment) Rules, 2011.

2. Insertion of rule 47-A.—After the existing rule 47 of the Himachal Pradesh Motor Vehicles Rules, 1999 (herein after referred to as the "said rules"), the following new rule 47-A shall be inserted, namely:-

"47-A.-Late fee for submitting application for registration or renewal of vehicles after the due date.—if the owner of a motor vehicle fails to make an application under sub- section (1) of section 41 of the Motor Vehicles Act, 1988 , or , as the case may be, under sub-section (8) of the section-41 of the Motor Vehicles Act, 1988, within the period4518 राजपत्र, हिमाचल प्रदेश, 12 दिसम्बर, 2011/21 अग्रहायण, 1933 specified in rules 47 and 52 of the Central Motor Vehicles Rules, 1989, he shall be liable to pay the following amount of late fee in addition to the fee specified for registration of vehicles/renewal of registration certificate under rule 81 of the Central Motor Vehicles Rules, 1989, namely:—

3. Insertion of rule-139-A.—After the existing rule 139 of the said rules, the following new rule 139-A shall be inserted, namely:-

139-A. Form and manner of display of registration mark.—The owner of the motor vehicle shall not paint or exhibit any particular other than the registration mark in the Registration Plates of a vehicle.".

No. LLR-E (9)1/88-III (Loose).—The Governor, Himachal Pradesh is pleased to order that Sh. Vikrant Thakur, Advocate, will represent the State of Himachal Pradesh in the Hon'ble High Court of Punjab and Haryana at Chandigarh as panel advocate for service matters/civil and criminal cases and also as panel advocate for service matters in Central Administrative Tribunal at Chandigarh with immediate effect.

The fee for each case shall be settled by a senior functionary of the Administrative Department keeping in view of the nature of each case subject to the concurrence of the Law Department and approval of the Government in the concerned Administrative Department and the Finance Department.

No. SEC.16-1/2011—4326-53.—In exercise of the powers vested in it under Article 243K of Constitution of India, Sections 131 and 160 of the Himachal Pradesh Panchayati Raj Act, 1994 and Rule 32 of the Himachal Pradesh Panchayati Raj (Election) Rules, 1994, the State Election Commission Himachal Pradesh hereby notifies the election programme for the conduct of general election in four Gram Panchayats viz. Joban, Namhog of Development Block Ani and Karza, Soyal of Development Block Naggar District Kullu and bye-election of casual vacancies declared vacant upto 31.8.2011 in respect of Panchayati Raj Institutions of district Solan as under:

1. Nomination papers shall be presented: On 22nd 23rd and 24th December, 2011

(Between 11 am to 3 pm)Nomination papers for the offices of Gram Panchayat, shall be filed at the places and before the Officers appointed by the District Election Officers (Panchayat).

2. The nomination papers shall be scrutinized : On 26th Dec 2011 (From 10 am onwards) 3. A candidate may withdraw his candidature: On 28th Dec,2011 (Before 3pm) 4. List of contesting candidates Shall be

published:

On 28th Dec, 2011, immediately after the time of withdrawal is over. The list of contesting candidate will show the name of symbol allotted to them.

5. List of Polling stations shall be published: On or before 22th Dec, 2011 6. The Poll, if necessary, shall be held From On 8th Jan, 2012.

7. Counting of votes, in the event of Poll, shall

be done :

Counting of votes for Member, Up-Pradhan and Pradhan of Gram Panchayats shall be taken up on the date of Poll immediately after the close of the poll at the Gram Panchayat Headquarters. The counting once started shall continue (for a constituency) until it is completed.

8. Result of election shall be declared : The result of the election of Member, Up Pradhan & Pradhan of Gram Panchayat shall be declared on the day of the poll immediately after the counting is over.

The election process shall be completed by 10.01.2012.

No. 1-58/69-Fin. (L.A.)Part (2).—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in Consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following rules further to amend the Himachal Pradesh, Local Audit Department, Section Officer Class-II (Gazetted) Recruitment and Promotion Rules, 2009 notified vide this Department Notification No.1-58/69-Fin (LA) Part (2), dated 6-11-2009, namely:—

1. Short title and Commencement.—(1) These rules may be called the Himachal Pradesh, Local Audit Department, Section Officer Class-II (Gazetted) Recruitment and Promotion (First Amendment) Rules, 2011.

(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Amendment of column 4 of Annexure-'A'.—In Annexure-"A" to the Himachal Pradesh, Local Audit Department, Section Officer Class-II (Gazetted) Recruitment and Promotion Rules, 2009.

For the existing provisions against column No.4, the following shall be substituted, namely:—

" Pay Band +Grade Pay ` 10,300-34,800+4400''
