1. संक्षिप्त नाम.-इन नियमों का संक्षिप्त नाम सेन्ट्रल सेल्ज टैक्स (हिमाचल प्रदेश) थर्ड अमैंडमैंट रूल्ज, 2012 है ।

2. रूल 6-B का अन्तःस्थापन.-सेन्ट्रल सेल्ज टैक्स (हिमाचल प्रदेश) रूल्ज, 1970 के नियम 6-ए के पश्चात्‌ निम्नलिखित नया नियम 6-बी अन्तःस्थापित किया जाएगा, अर्थात्‌ः-

"6-B.- Notwithstanding anything contained in these rules, the registered dealers shall obtain the Declaration Forms specified under rule 12 of the Central Sales Tax (Registration and Turnover) Rules, 1957, in electronic form through the official website of Excise and Taxation Department, issued after receipt of request and utilization details from the concerned dealer online in the manner and subject to the conditions as the Excise and Taxation Commissioner may direct from time to time.

Provided that no fee shall be payable by the dealer on such Forms, so downloaded. ".

No. EXN-F(1)-3/2012.—In exercise of the powers conferred by sub-section (3) of section 13 of the Central Sales Tax Act, 1956 (Act No. 74 of 1956), the Governor of Himachal Pradesh is pleased to make the following rules further to amend the Central Sales Tax (Himachal Pradesh) Rules, 1970, namely:-

1. Short title.—These rules may be called the Central Sales Tax (Himachal Pradesh) 3rd Amendment Rules, 2012.

2. Insertion of rule 6-B.—After rule 6-A of the Central Sales Tax (Himachal Pradesh) Rules, 1970, the following new rule 6-B shall be inserted, namely:-

"6-B.- Notwithstanding anything contained in these rules, the registered dealers shall obtain the Declaration Forms specified under rule 12 of the Central Sales Tax (Registration and Turnover) Rules, 1957, in electronic form through the official website of Excise and Taxation Department, issued after receipt of request and utilization details from the concerned dealer online in the manner and subject to the conditions as the Excise and Taxation Commissioner may direct from time to time.

NOTIFICATION

Shimla-2, the 29-05-2012

No. Ind-II(F)6-5/2006.—The Governor, Himachal Pradesh, is pleased to make the following further amendments in the "Policy Guidelines for Registration, Location, Installation and Working of Stone Crushers in Himachal Pradesh" notified vide this Department Notification of even number dated 11th August, 2004 and published in the Rajpatra, Himachal Pradesh dated 24-8- 2004, namely:-

AMENDMENTS

Amendment of Para 2.— In the Policy Guidelines for Registration, Location, Installation and Working of Stone Crushers in Himachal Pradesh, (hereinafter referred to as the "said Policy1706 राजपत्र, हिमाचल प्रदेश, 8 जून, 2012/18 ज्येष्ठ, 1934 Guidelines") for the provisions against sub-paras 2.1., 2.2. and 2.3, the following shall be substituted, namely:-

"2.1 No person shall install or run any stone crusher in any area within the State of Himachal Pradesh unless he obtains a Provisional Registration from the Geological Wing, Department of Industries. For this purpose an application in Form-"C" shall be submitted by the applicant for Joint Inspection of the proposed stone crusher site and it shall be accompanied by :-

(a) A fee of Rs. 2500/- (Two thousand and five hundred) only.

(b) A stone crusher shall have a minimum working area ranging between 2 to 5 Bighas, depending upon the size of the stone crusher, for raising machinery/plant and its ancillary activities like stacking of raw material/finished product, parking of vehicles, office, labour huts, etc., in private land or in Govt. land after obtaining land lease from competent authority. As far as possible, this area should be a compact area at a single location:

Provided that in case the required land is not available at one location, the total land requirement can be met at different locations subject to the following conditions, namely:-

(i) The main component of the stone crusher i.e. machinery/plant and provision for stacking of finished product should be at one location from where the siting parameters are to be measured in terms of Notifications number STE-E(4)- 1/2003 dated 29.4.2003 and 10.9.2004 of the Department of Environment, Science and Technology.

(ii) For other ancillary activities, like stacking raw material, parking of vehicles, office, labour huts etc., the land requirement at different locations can be considered; provided the distance of such location from the proposed stone crusher site under sub-clause (i) above is within 500 metres.

(c) In case of private land, consent of land owner where the stone crusher is to be installed.

(d) An application for mining lease from where the minor mineral shall be used as raw material for feeding/running the stone crusher. This area should be within 5 Kms. radius of the stone crusher."

2.2 Based on these documents, the case shall be sent to the Joint Inspection Committee constituted under sub-para 3.1 (a) of the said Policy Guidelines for joint inspection of stone crusher site. Provisional Registration' shall be issued on Form-D by the Geological Wing, Department of Industries only after submission of approved Working-cum-Environment Management Plan which shall form the basis for obtaining pre-production clearance from other Government Departments for which the applicant shall apply on Form-A.

2.3 After the conduction of joint inspection and granting of provisional registration, the consent to establish the Stone Crusher from the Himachal Pradesh State Pollution Control Board shall be obtained.".

Amendment of Para 3.— In Para 3 of the said Policy Guidelines, sub-para 3.3 shall be deleted.

Amendment of Para 4.— In the said Policy Guidelines, in para 4, for the provisions against clause (a), the following shall be substituted, namely:-

"(a) After obtaining consent to operate the Stone Crusher from the Pollution Control Board, Permanent Registration shall be issued to the owner of the stone crusher on Form–B by the Geological Wing, Department of Industries, Himachal Pradesh which shall be valid for a period of two years."

Amendment of Form-A.— In Form-A appended to the said Policy Guidelines, for the provision against Serial No. 13, the following shall be substituted, namely:-

"13. The approximate annual production of mineral."

Addition of Form-C.—In the said Policy Guidelines, after the existing Form-B, the following Form-C shall be added, namely:-

Substitution of Provisional Registration Form.— For the Provisional Registration Form appended to the said Policy Guidelines, the following shall be substituted namely:-

2. The applicant shall operate his stone crusher unit only after obtaining the consent to operate (COP) from Himachal Pradesh State Pollution Control Board and Permanent Registration from Geological Wing, Department of Industries.

3. Based on mineral potential determined in the approved Working-cum-Environment Management Plan, the crusher owner shall install the crusher machinery of appropriate capacity and shall furnish the undertaking to this effect.

उपरोक्त प्रार्थी ने अधोहस्ताक्षरी के न्यायालय में प्रार्थना-पत्र मय व्यान हल्फी इस आशय से प्रस्तुत किया है कि उसकी माता श्रीमती व्यासां देवी की मृत्यु तिथि दिनांक 26-10-2011 है जोकि ग्राम पंचायत नाहलियां के रिकार्ड में दर्ज न है। जिसे अब दर्ज किया जावे।1715 राजपत्र, हिमाचल प्रदेश, 8 जून, 2012/18 ज्येष्ठ, 1934 अतः इस सम्बन्ध में सर्वसाधारण जनता को बजरिया इश्तहार द्वारा सूचित किया जाता है कि प्रार्थी सन्तोष कुमार की माता श्रीमती व्यासां देवी की मृत्यु तिथि ग्राम पंचायत नाहलियां के रिकार्ड में दर्ज करने बारे यदि किसी को कोई आपत्ति या एतराज हो तो वह दिनांक 29-6-2012 को असालतन या वकालतन न्यायालय अधोहस्ताक्षरी आकर अपना एतराज दर्ज करवा सकता है। कोई एतराज दर्ज न होने की सूरत में एकतरफा कार्यवाही अमल में लाई जा करके मृत्यु तिथि दर्ज करने के आदेश पारित कर दिए जाएंगे। आज दिनांक 30-5-2012 को मेरे हस्ताक्षर व मोहर अदालत से जारी हुआ।

श्री लोवजंग छेरिंग सुपुत्र श्री टाशी राम, निवासी गांव शेलिंग, डाकघर चिमरट, उप-तहसील उदयपुर, जिला लाहौल-स्पिति, हिमाचल प्रदेश ने आवेदन-पत्र शपथ-पत्र सहित इस अदालत में प्रस्तुत किया है। जिसमें उसने उल्लेख किया है कि मेरे परिवार रजिस्टर ग्राम पंचायत चिमरट, उप-तहसील उदयपुर, जिला लाहौल-स्पिति में बहू तन्डूप डोलमा पत्नी श्री तेनजिन थुचेन तथा तन्जिन वांगदन पोता व छेरिंग यगंचन पोती का नाम दर्ज नहीं है जोकि अब मैं उपरोक्त सदस्य श्रीमती तन्डूप डोलमा की जन्म पैदाईश तिथि 15-1-1985 तथा तेनजिन वांगदन की जन्म पैदाईश तिथि 8-6-2004 व छेरिंग यगंचन की जन्म पैदाईश तिथि 9-8-2006 है, को ग्राम पंचायत चिमरट, उप-तहसील उदयपुर, जिला लाहौल-स्पिति में दर्ज करवाना चाहता है।

अतः इस नोटिस द्वारा आम जनता एवं सम्बन्धित रिश्तेदारों को सूचित किया जाता है कि यदि किसी को उपरोक्त प्रार्थी की बहू, पोता व पोती के नाम तथा जन्म तिथि को ग्राम पंचायत चिमरट के पैदाईश तथा परिवार रजिस्टर में दर्ज करवाने में कोई एतराज हो तो वह इस अदालत में दिनांक 22-6-2012 को असालतन व वकालतन हाजिर आकर अपना एतराज पेश कर सकता है अन्यथा मुताबिक शपथ-पत्र उपरोक्त प्रार्थी की बहू, पोता व पोती के नाम तथा जन्म तिथि को ग्राम पंचायत चिमरट के पैदाईश तथा परिवार रजिस्टर में दर्ज करवाने के आदेश पारित कर दिए जाएंगे।
