संख्याः एच0एच0सी0 नियम/अवकाश न्यायालयों (हॉलिडे कोर्टस)/2011.-हिमाचल प्रदेश की राज्यपाल, भारत के संविधान के अनुच्छेद 227, 234, और अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों तथा उन्हे समर्थ बनाने वाली समस्त अन्य शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश उच्च न्यायालय के परामर्श से, निम्नलिखित नियम बनाती हैः-

1. सक्षिप्त नाम और प्रारम्भः

(क) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश अवकाश न्यायालयों(हॉलिडे कोर्टस) नियम, 2011 है।1856 राजपत्र, हिमाचल प्रदेश, 18 जून, 2012/28 ज्येष्ठ, 1934 (ख) ये तुरन्त प्रवृत्त होंगे। 2. परिभाषाएं.-इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न होः-

(क) "अवकाश न्यायालयों (हॉलिडे कोर्ट)" से उच्च न्यायालय द्वारा इन नियमों के अधीन अधिसूचित कोई न्यायालय अभिप्रेत है;

(ख) "न्यायालयों" से समस्त जिलों में स्थापित जिला/अतिरिक्त जिला एवं सत्रा न्यायधीशों के न्यायालय और सिविल और सेशन डिवीजन की क्षेत्राीय अधिकारिता के भीतर अधीनस्थ न्यायालय अभिप्रेत है;

(ग) "सरकार" से हिमाचल प्रदेश सरकार अभिप्रेत है;

(घ) "उच्च न्यायालय" से हिमाचल प्रदेश उच्च न्यायालय अभिप्रेत है;

(ड़) "न्यायिक अधिकारी" से जिला न्यायाधीश/अतिरिक्त जिला न्यायाधीश और सिविल न्यायधीश सीनियर/जुनियर डिवीजन के संवर्ग में हिमाचल प्रदेश न्यायिक सेवा का सदस्य अभिप्रेत है;

(च) "कर्मचारिवृन्द का सदस्य (मेम्बर आफ स्टाफ)" से न्यायालयों में कार्यरत कोई व्यक्ति या कर्मचारी अभिप्रेत है/हैं;

3. अवकाश न्यायालयों (हॉलिडे कोर्टस) की अधिकारिता.-अवकाश न्यायालयों (हॉलिडे कोर्टस) की अधिकारिता मामलों के निम्नलिखित प्रवर्गों की बावत होगीः

1) अन्तर्वती आवेदन (सिविल प्रक्रिया संहिता 1908 के आदेश 38, 39 और 40 के अधीन) और उससे संबद्ध या उससे आनुषंगिक आवेदन;

2) मोटरयान अधिनियम से सम्बन्धित मामले आनुषंगिक विनियम;

3) हिमाचल प्रदेश दुकान और वाणिज्यिक स्थापन अधिनियम, 1969 से सम्बन्धित मामले;

4) परक्राम्य लिखत अधिनियम, 1881 की धारा 138 के अधीन चैक बांउन्सिंग के मामले;

5) दण्ड प्रक्रिया संहिता,1973 की धारा 125 के अधीन भरण-पोषण के लिए याचिकाएं;

6) सिविल प्रक्रिया संहिता,1908 के आदेश 37 के अधीन धन वसूली हेतू सिविल मामले जहां दावा 50,000/-(पचास हजार रुपये) से अधिक का नहीं है;

7) कोई अन्य मामले जिन्हें पक्षकारों की सहमति से अवकाश न्यायालयों (हॉलिडे कोर्टस) को अन्तरित किया जा सके;

8) छोटे मोटे अपराध जैसे किः-

क) भारतीय दण्ड संहिता की धारा 324, 325, 335, 344, 357, 379, 381, 406, 407, 408, 411, 414, 418, 419, 420, 429, 430, 451 और 494 के अधीन अपराध को अपवर्जित करके प्रक्रिया संहिता,1973 की धारा 320 सारणी-। और ।।;

ख) भारतीय दण्ड संहिता की धारा 160, 279, 294 और 336; और1857 राजपत्र, हिमाचल प्रदेश, 18 जून, 2012/28 ज्येष्ठ, 1934 ग) किसी भी अधिनियम के अधीन समस्त अपराध जो दो वर्ष तक के कारावास से दण्डनीय हैं।

स्पष्टीकरणः-शंकाओं के निराकरण हेतु, एतद्‌ द्वारा स्पष्टीकरण किया जाता है किः- (1) उपरोक्त प्रवर्गों के मामलों का निपटारा करने की न्यायालयों की अधिकारिता अपवर्जित नहीं की गई है।

(2) न्यायालयों को यथालागू सन्नियम (मानक) अवकाश न्यायालयों (हॉलिडे कोर्टस) को भी लागू होंगे।

4. अवकाश न्यायालयों (हॉलिडे कोर्टस) की अधिसूचनाः-उच्च न्यायालय, सरकार के परामर्श से, इन नियमों के अधीन, किसी भी न्यायालय को अवकाश न्यायालयों (हॉलिडे कोर्ट) अधिसूचित कर सकेगा। 5. काम के घंटेः-न्यायिक कार्य के लिए, अवकाश न्यायालयों (हॉलिडे कोर्टस) के काम के घण्टे रविवार, अन्य राजपत्रित और न्यायालय छुटि्‌टयां, जैसी कि उच्च न्यायालय द्वारा विनिश्चित की जाएं, पूर्वाहन दस बजे से अपराहन पांच बजे तक होंगे। दोपहर के भोजन (लन्च) के लिए सामान्य विराम होगा। 6. सन्नियमः-अवकाश न्यायालयों (हॉलिडे कोर्टस) को सोंपे गए मामलों के निपटारे हेतु सन्नियम ऐसे होंगे, जैसे उच्च न्यायालय द्वारा नियत किए जाएं।

7. मानदेयः-अवकाश न्यायालयों (हॉलिडे कोर्टस) में कार्यरत पीठासीन अधिकारियों और कर्मचारिवृन्द का सदस्य (मेम्बर आफ स्टाफ) को तेरहवें वित्त आयोग द्वारा, आबंटित निधि में से ऐसी दरों पर जैसी उच्च न्यायालय द्वारा विनिश्चित की जाए और जो इन नियमों से संलग्न अनुसूची-। में वर्णित है मानदेय संदत किए जाएंगे।

8. पर्यवेक्षणः-उच्च न्यायालय के समग्र नियन्त्राण के अध्यधीन, सम्बद्ध जिला न्यायाधीश, अवकाश न्यायालयों (हॉलिडे कोर्टस) के कृत्यों का पर्यवेक्षण और अनुश्रवण करेगा।

9. सेवा शर्तेंः-हिमाचल प्रदेश न्यायिक सेवा नियम, 2004 और अधीनस्थ न्यायालय कर्मचारी(स्टाफ)(भर्ती, प्रोन्नति और सेवा की शर्तें) नियम,1997 में वर्ग-3 और 4 सेवाओं के भर्ती नियमों के उपबन्धों में अन्तर्विष्ट किसी बात के होते हुए भी, अवकाश न्यायालयों(हॉलिडे कोर्टस) में कार्यरत न्यायिक अधिकारियों, अन्य अधिकारियों और सदस्यों की सेवा शर्तें इन नियमों द्वारा शासित होंगी।

संख्या ः विद्युत-छः (5)-23/2012.-यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत हेाता है कि हिमाचल प्रदेश राज्य विद्युत परिषद्‌ लिमिटेड, जो कि भूमि अर्जन अधिनियम 1894 (1894 का पहला अधिनियम) की धारा 3 के खण्ड (सी.सी.) के अन्तर्गत सरकार के स्वामित्व और नियन्त्रण के अधीन एक निगम है, के द्वारा अपने व्यय पर सार्वजनिक प्रयोजन हेतु नामतः मुहाल जठोत, सन्याड़ी, जाबल जाबलु, चमाकड़ी, दाओं, ध्याणा, रनोहसासन, गन्धेवटा, बड़ोग हनुमान, मन्धोटी, सोखर, क्यारी, रहेउटा, सिमु, धरनो, महोल, दिदू, बपडूण, बाहंवा, चथड़याणा, बातल, जखौली, डांगरी, खूराड़ी, मज्याट, खनोल, नगर सिहावां, तहसील अर्की, जिला सोलन व मुहाल बिल, तहसील व जिला सोलन, हिमाचल प्रदेश में 220 के0वी0 लाईन कुनिहार से रोड़ी (दाड़लाधाट) के निर्माण हेतु भूमि अर्जित करनी अति आवश्यक अपेक्षित हैं। अतएवं एतद्‌द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है।

संख्या ः विद्युत.-छ-(5)-58/2009.-यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत हेाता है कि हिमाचल प्रदेश राज्य विद्युत निगम लिमिटेड जो कि भू-अर्जन अधिनियम, 1894 (1894 का पहला अधिनियम) की धारा-3 के खण्ड (सी.सी) के अन्तर्गत सरकार के स्वामित्व और नियन्त्रण के अधीन एक निगम है के द्वारा अपने व्यय पर सार्वजनिक प्रयोजन हेतू नामतः मुहाल जामू, तहसील रेणुका जी, जिला सिरमौर, हि0प्र0 में रेणुका बांध के निर्माण व इसके जलमग्न क्षेत्र हेतु भूमि अर्जित करनी अति आवश्यक अपेक्षित है, अतएवः एतद्‌द्वारा यह घोषित किया जाता है कि उक्त परिक्षेत्र में जैसा कि नीचे विवरणी में निर्दिष्ट किया गया है, उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है।1861 राजपत्र, हिमाचल प्रदेश, 18 जून, 2012/28 ज्येष्ठ, 1934 2. भूमि अर्जन अधिनियम, 1894 की धारा-6 के उपबन्धों के अधीन इससे सम्बन्धित सभी व्यक्तियों की सूचना हेतु घोषणा की जाती है और उक्त अधिनियम की धारा-7 के उपबन्धों के अधीन भू अर्जन समाहर्ता, हिमाचल प्रदेश राज्य विद्युत निगम लिमिटेड, उत्तम भवन, शिमला-4 को उक्त भूमि के अर्जन के लिए आदेश लेने का एतद्‌द्वारा निर्देश दिया जाता है।

3. इसके अतिरिक्त उक्त अधिनियम की धारा-17 की उप धारा-1 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए हिमाचल प्रदेश के राज्यपाल यह निर्देश देते है्र कि अति आवश्यक मामला होने के कारण भूमि अर्जन समाहर्ता, हिमाचल प्रदेश राज्य विद्युत निगम लिमिटेड, उत्तम भवन, शिमला-4 उक्त अधिनियम की धारा-9 की उप धारा-1 के अधीन नोटिस के प्रकाशन के 15 दिन की अवधि समाप्त होने पर पंचाट देने से पूर्व भूमि का कब्जा ले सकते हैं।

संख्या 479/2012ः- यतः भारत के राष्ट्रपति श्रीमती प्रतिभा देवीसिंह पाटिल की पदावधि की समाप्ति संविधान के अनुच्छेद 56 के खण्ड (1) की शर्तों पर तारीख 24 जुलाई, 2012 को हो रही है; और यतः संविधान के अनुच्छेद 62 के खण्ड (1) की शर्तों पर अपनी पदावधि समाप्त होने से पूर्व पदधारी राष्ट्रपति की पदावधि समाप्त होने के कारण उत्पन्न हुई रिक्ति को भरने के लिए निर्वाचन कराया जाना है; और यतः राष्ट्रपतीय और उपराष्ट्रपतीय निर्वाचन अधिनियम, 1952 (1952 का 31) की धारा 4 की उपधारा (3) के अधीन निर्वाचन आयोग द्वारा भारत के राष्ट्रपति के पद को भरने के लिए निर्वाचन के लिए तारीख इस तरह नियत की जानी अपेक्षित है कि यह निर्चाचन समय के अन्दर पूरा हो जाए ताकि इस प्रकार निर्वाचित राष्ट्रपति अपना पदभार जुलाई के पच्चीसवें दिन को ग्रहण कर सके।

अतः अब उक्त अधिनियम की धारा 4 की उपधारा (1) के अनुसरण में निर्वाचन आयोग उक्त निर्वाचन के सम्बन्ध में एतद्‌द्वारा यह निर्धारित करता हैः-

टिप्पणी.- सामान्य, संसद सदस्यों से अपना मतदान नई दिल्ली में डालने और सभी राज्यों की संबंधित विधान सभा के सदस्यों से, संबंधित राज्य की राजधानी में मतदान करने की आशा की जाती है । तथापि, विशेष परिस्थितियों में किसी भी तात्कालिक आवश्यकता के कारण संसद सदस्य राज्य की राजधानी/ दिल्ली/ पुद्‌दुचेरी के किसी भी मतदान केन्द्र में अपना मत डाल सकते हैं । इसी प्रकार कोई भी विधान सभा सदस्य जो संबंधित राज्य की राजधानी में मत डालने के बजाय नई दिल्ली या अन्य राज्य की राजधानी में मत डालने का इच्छुक हो, तो डाल सकता है । इस उद्‌देश्य के लिए निर्वाचकों को रिटर्निंग आफिसर/सहायक रिटर्निंग आफिसर के पास तथा आयोग की वेबसाइट (www.eci.nic.in) पर उपलब्ध निर्धारित प्रपत्र पर आवेदन करना होगा जिससे कि यह मतदान की तारीख से कम से कम 10 दिन पहले निर्वाचन आयोग के पास पहॅुंच जाए ।

No. 479/2012.—Whereas, the term of office of Smt Pratibha Devisingh Patil, President of India, is due to expire, in terms of clause (1) of Article 56 of the Constitution, on the 24th Day of July, 2012; and

Whereas, an election is due to be held, in terms of clause (1) of Article 62 of the Constitution, to fill the vacancy to be caused by the expiration of the term of office of the incumbent President before the expiration of term of her office; and

Whereas, under sub-section (3) of Section 4 of the Presidential and Vice-Presidential Elections Act, 1952 (31 of 1952), the Election Commission of India is required to so appoint the1868 राजपत्र, हिमाचल प्रदेश, 18 जून, 2012/28 ज्येष्ठ, 1934 dates for the election to fill the vacancy in the office of the President of India that the election will be completed at such time as will enable the President thereby elected to enter upon his office on the 25th Day of July, 2012;

Now, therefore, in pursuance of sub-section (1) of Section 4 of the said Act, the Election Commission hereby appoints, in respect of the said election -

a) the 30th June, 2012 (Saturday), as the last date for making nominations;

b) the 02nd July, 2012 (Monday), as the date for scrutiny of the nominations;

c) the 04th July, 2012 (Wednesday), as the last date for the withdrawal of candidatures;

and

d) the 19th July, 2012 (Thursday), as the date on which a poll shall, if necessary, be taken.

NOTE :-

Normally, members of Parliament are expected to cast their votes at New Delhi and members of all respective State Legislative Assemblies at the concerned State's Capital. However, on account of any exigency for special circumstances, the Members of Parliament can vote in any of the polling stations in the State Capital/Delhi/Puducherry. Similarly, any MLA desirous of voting at New Delhi or at any other State Capital instead of voting in the relevant State Capital can also do so. For this purpose, the electors have to apply in the prescribed format available with the Returning Officer and Assistant Returning Officers and on the Commission's website (www.eci.nic.in) so as to reach the Election Commission at least 10 days before the date of poll.

भारत के राष्ट्रपति पद को भरने के लिए निर्वाचन करने के लिए, निर्वाचन आयोग द्वारा, राष्ट्रपतीय और उपराष्ट्रपतीय निर्वाचन अधिनियम, 1952 की धारा 4 की उपधारा (1) के अधीन अधिसूचना निकाल दी गई है, अतः ऐसे निर्वाचन के लिए रिटर्निंग आफिसर, मैं विवेक कुमार अग्निहोत्री सूचना देता हूं कि .......

(iii) हर अभ्यर्थी केवल पन्द्रह हजार रुपये की राशि जमा करेगा या जमा करवाएगा। यह रकम नामनिर्देशन पत्र प्रस्तुत करते समय रिटर्निंग आफिसर के पास नकद जमा की जा सकेगी या भारतीय रिजर्व बैंक या किसी सरकारी खजाने में इससे पहले जमा की जा सकेगी और पश्चात्कथित दशा में ऐसी रसीद का, जिसमें यह दर्शित किया हो कि उक्त राशि जमा कर दी गई है, नामनिर्देशन पत्र के साथ लगाया जाना आवश्यक होगा;

(iv) नामनिर्देशन पत्रों के प्ररूप पूर्वोक्त कार्यालय से पूर्वोक्त समय पर प्राप्त किए जा सकेंगे;

(v) अधिनियम की धारा 5ख की उपधारा (4) के अधीन नामंजूर किए गए नामनिर्देशन पत्रों से भिन्न नामनिर्देशन पत्रों की संवीक्षा उक्त कार्यालय में कमरा सं. 29, भूतल, संसद भवन, नई दिल्ली में सोमवार, 2 जुलाई, 2012 को पूर्वाह्‌न 11 बजे की जाएगी;

WHEREAS a notification under sub-section (1) of section 4 of the presidential and vicepresidential Elections Act, 1952, for the holding of an election to fill the Office of president of India has been issued by the Election Commission, I, V.K. Agnihotri, the Returning Officer for such election, do hereby give notice that—

(i) Nomination papers may be delivered by a candidate or any one of his proposes or seconders to the undersigned at his office in Room NO.29, Ground Floor,1876 राजपत्र, हिमाचल प्रदेश, 18 जून, 2012/28 ज्येष्ठ, 1934 Parliament House, New Delhi, or if he is unavoidably absent, to the Assistant Returning Officers, Shri S.K. Ganguli, joint Secreatary/Shri Deepak Goyal, joint secretary, Rajya Sabha Secretariat at the said office between 11 A.M. and 3 P.M. on any day (other than a public holiday) not later than the 30th of june, 2012;

(ii) each nomination paper shall be accompanied by a certified copy of the entry relating to the candidate in the electoral roll for the parliamentary constituency in which the candidate is registered as an elector;

(iii) every candidate shall deposit or cause to be deposited a sum of Rupees Fifteen Thousand only. This amount may be deposited in cash with the Returning Officer at the time of presentation of the nomination paper or deposited earlier in the Reserve Bank of India or in a Government Treasury and in the latter case a receipt showing that the said deposit of the sum has been so made is required to be enclosed with the nomination paper;

(iv) forms of nomination papers may be obtained from the above said office at the time aforesaid;

(v) the nomination papers, other than those rejected under sub-section (4) of section 5B of the Act, will be taken up for scrutiny at the said office in Room No.29, Ground Floor, Parliament House, New Delhi on Monday, the 2nd of july, 2012 at 11A.M.;

(vi) the notice of withdrawal of candidatures may be delivered by a candidate, or any one of his proposers or seconders who has been authorised in this behalf in writing by the candidate, to the undersigned at the place specified in paragraph(i) above before three o'clock in the afternoon of 4th of july, 2012;

(vii) in the event of the election being contested, the poll will be taken on Thursday, the 19th of July, 2012 between the hours of 10A.M. and 5P.M. at the places of polling fixed under the rules.

No. EXN-F (16)3/1999.—The Governor of Himachal Pradesh, in exercise of the powers vested in her under sub-section (2) of Section 6 of the Himachal Pradesh Entertainments Tax (Cinematograph Shows) Act, 1968 (Act No. 11 of 1968) is pleased to exempt the "Akkad Bakkad Bam Be Bo" produced by JSR Productions Pvt. Ltd. from the payment of entertainment tax under the Act ibid for a period of three months with immediate effect. This notification is issued in suppression of this Deptt's notification of even no. dated 11/6/2012 published in Rajpatra on 11th June, 2012.

संख्याः एएचवाई-ई(3)-24/2009-लूज.-हिमाचल प्रदेश की राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्या. एएचवाई-ए(3)4/89, तारीख 25.3.1997 द्वारा अधिसूचित हिमाचल प्रदेश पशुपालन विभाग, सांख्यिकी सहायक/अन्वेषक/निरीक्षक वर्ग-III (अराजपत्रित) भर्ती एवं प्रोन्नति नियम 1997 में और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारम्भ.-(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश पशुपालन विभाग, सांख्यिकीय सहायक, वर्ग-III (अराजपत्रित), भर्ती और प्रोन्नति (द्वितीय संशोधन) नियम, 2012 है । (2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. स्ांक्षिप्त नाम का संशोधन.-हिमाचल प्रदेश पशुपालन विभाग सांख्यिकी सहायक/ अन्वेषक/निरीक्षक वर्ग-।।। (अराजपत्रित) भर्ती एवं प्रोन्नति नियम 1997 (जिन्हे इसमेें इसके पश्चात ''उक्त नियम'' कहा गया है) के संक्षिप्त नाम में ''/अन्वेषक/निरीक्षक'' चिन्हों और शब्दों का लोप किया जाएगा । 3. उपाबन्ध ''अ'' में संशोधन.-उक्त नियमों के उपाबन्ध ''अ'' में, -

(क) विद्यमान शीर्षक में ''/अन्वेषक/निरीक्षक'' चिन्हों और शब्दों का लोप किया जाएगा ; और (ख) स्तम्भ संख्या-1 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थातः- ''सॉंख्यिकी सहायक'' ।

Shimla-2, the 14th June, 2012

No. Ahy-E(3)-24/09-loose.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, is pleased to make the following Rules further to amend the Himachal Pradesh Animal Husbandry Department Statistical Assistant/ Investigator/ Inspector Class-III (Non-Gazetted) Recruitment and Promotion Rules 1997 notified vide this department Notification No. Ahy-A(3)-4/89 dated 25.3.1997 namely :-

1. Short title and Commencement.—(1) These rules may be called the Himachal Pradesh Animal Husbandry Department, Statistical Assistant, Class-III (Non-Gazetted), Recruitment and Promotion (2nd amendment) Rules, 2012.

(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Short title.—In short title of the Himachal Pradesh Animal Husbandry Department Statistical Assistant/Investigator/Inspector ( Class-III; Non-Gazetted) Recruitment and Promotion Rules, 1997 ( hereinafter referred to as the said Rules), the signs and words "/Investigator/ Inspector" shall be deleted.

Amendment of Annexure-A.—In Annexure –"A" to the said Rules, -

(a) In the existing heading the signs & words "/Investigator/ Inspector" shall be deleted;

and

(b) for the existing provisions against Col. No.1 the following shall be substituted namely:- "Statistical Assistant".
