No. Per(AP)AB(3)27/96.—Shri Rahul Anand, IAS(HP:96) was afforded an opportunity, to explain his position with regard to his un-authorized absence from duty beyond 19-06-2010, for which officer is liable to be proceeded against under the provisions of Rule 7(2)(a) of AIS (Leave) Rules, 1977 and is deemed to have resigned from the Government service, vide Memorandum of even number dated 7th December, 2011.

Shri Rahul Anand, IAS in response to the aforesaid Memorandum vide his letter dated 21-12-2011 attached with his e-mail dated 22-12-2011, stated that he has never sent any application/communication under his signature to the State Government stating that he has joined the IMF as an economist and requested further extension of his leave by three years. The officer requested to provide the copy of application/communication according to him is the very basis of issuing of said memorandum and he also made request to grant him further six weeks time to file explanation.

95-राजपत्र/2012-1-8-2012 (2559)2560 राजपत्र, हिमाचल प्रदेश, 1 अगस्त, 2012/10 श्रावण, 1934 The officer was supplied the copy of letter dated 20-06-2011 vide which he had informed that he had joined IMF on 28-06-2010 and granted further extension of six weeks time to explain his position vide letter of even number dated 20-01-2012.

In response to the above letter dated 20-01-2012 the officer, vide his letter dated 02/04/2012 attached with e-mail dated 03/04/2012, stated that document supplied to him clearly indicate that he did not ask for any further leave of 3 years w.e.f. 19-06-2010. The said document relates to permission/deputation under Rule 6(2)(ii) of IAS (Cadre) Rules, 1954. He has also stated that he had applied for seeking permission/deputation to work at IMF under Rule 6(2)(ii) of IAS (Cadre) Rules, 1954 vide his application dated 29-04-2010 and 12-06-2010 which are still pending for decision by the competent authority. He further requested to supply the copy of his application in which he has applied for 3 (three) years further leave from 19-06-2010.

The State Government vide letter dated 21/04/2012 supplied the copies of applications dated 29/04/2010 and 27/06/2010 and State Government decision dated 26th May, 2010, which clearly stated that as he was on long leave w.e.f. 20-06-2005, therefore, his application seeking permission to work with IMF (International Monetary Fund) under Rule 6(2)(ii) of the IAS (Cadre) Rules, 1954 was not acceded to. He was further directed to report back to the State Government immediately on completion of E.O.L. on 19-06-2010.

The officer without his explanation to the aforesaid memorandum once again, vide letter dated 30/05/2012 attached with e-mail dated 31-05-2012 requested to supply him the copy of the leave application whereby he has requested to leave of three years with effect from 19-06-2010 to work with IMF on the basis of which above mentioned memo has been issued and as per record he has not made any such application leave application.

As per the Rule 6 (2)(ii) of IAS (Cadre) Rules, 1954 a cadre officer can be deputed for service under an International organization, an autonomous body not controlled by the Government, or a private body, by the Central Government in consultation with the State Government, read with the guidelines for deputation of member of the AIS under Rule 6(2)(ii) of IAS (Cadre) Rule, 1954 issued vide letter No. 14017/33/2005-AIS(II(PartI) dated 27th Depcember, 2006. The para 7 of the guidelines reads as under:—

7. All deputations under Rule 6(2)(ii) shall be considered only with the consent of the officer concerned and the approval of the cadre controlling authority. Cadre Controlling Authority would mean the State Government concerned if the officer is in his cadre. If the officer is with the Government of India, then it would mean the Ministry of Home Affairs in the case of IPS officers, MOEF in the case of IfoS officers. This approval is a precondition for the cases being placed in the Committee detailed in Para 8 below. In the case of IAS officers serving in the Government of India, since the Committee at Para 8 below also includes Secretary(P) th proposals would directly be placed before the Committee.

The approval of the cadre controlling authority, i.e., State Government is precondition for considering the deputation of officer under Rule 6(2)(ii) of IAS (Cadre) Rule, 1954 and in case of Shri Rahul Anand, the State Government had conveyed its decision vide letter dated 26-05-2010 that his request under Rule (2)(ii) of the IAS (Cadre) Rules, 1954 cannot be acceded to as he was on long leave since 20-06-2005 and he was also advised to report back to the State Government2561 राजपत्र, हिमाचल प्रदेश, 1 अगस्त, 2012/10 श्रावण, 1934 immediately on completion of Extra Ordinary leave on 19/06/2010. The copy of this decision was also conveyed to the Government of India vide letter No. Per (AP)AB(3)-27/96-Vol-II dated 26th May, 2010. Since the approval of the State Government is precondition to consider the case for deputation with IMF, therefore, contention of the officer that decision of competent authority is still pending is baseless, wrong, factually incorrect and does not present true picture as per official records.

Instead of reporting back to the State Government on completion of completion of Extra Ordinary Leave on 19-06-2010, Shri Rahul Anand vide his "Application for Leave" dated )-19-06- /2010 requested to grant him four weeks of earned leave or any other leave of kind due to him w.e.f. 21-06-2010, as the school year of his children in USA were till end of June and later on vide letter dated 21/07/2010 in continuation of letter dated 19-06-2010 requested to grant him 3 (three) months leave without pay. vide letter dated 21/07/2010. In response to the said "Application to Leave without pay" dated 21/07/2010, the officer vide letter dated 18-08-2010 was informed that Leave Rules do not provide for allowing absence beyond 5 (five) years and he being on long leave since 20-06-2005 to 19-06-2010, and was again advised to report back to the State Government at once.

Instead of reporting back to the State Government Shri Rahul Anand continues to remain on un-authorized absence from duty. The State Government vide letter dated 19-05-2011 informed the officer that as per Rules 7(1) and 7 (2) of the All India Service (Leave) if member of the service cannot be granted leave for a continuous period exceeding five year and absent without authorization for a period of exceeding one year from the date of expiry of sanctioned leave, he shall be deemed to have resigned from the service. Accordingly, the officer was directed to report back to the State Government before 20-06-2011 failing which he will be deemed to have resigned from the service.

Technically, when permission to work with IMF and request for extension of leave without pay beyond 19-06-2010 were not approved by the State Government as it meant granting leave beyond prescribed period of 5 (Five) years, therefore, the stand and the basis of the officer seems totally wrong.

Inspite of repeated directions to report back to cadre Shri Rahul Anand, disobeyed the Government orders and remained absent without authorization for a period which is now exceeding two (2) years from the date of expiry of sanctioned leave, i.e., 19-06-2010 and hence liable to be proceeded against under the Rule 7(2) of AIS (Leave) Rules, 1954. Accordingly, an opportunity to explain his position within three weeks was afforded vide this Department's Memorandum of even number dated 07-12-2011 to Shri Rahul Anand. No satisfactory reply has been received from Shri Rahul Anand, IAS to the aforesaid Memorandum so far.

Keeping in view the above facts on record, it is amply clear that permission to work with the IMF was not acceded to by the State Government, which is precondition to consider the case for deputation with an International Organization. Shri Rahul Anand's application for leave without pay for three months w.e.f. 20-06-2010 was also not sanctioned, as continuous period of leave exceeds five years. Shri Rahul Anand did not obey the Government order to report back to the State Government and instead joined the IMF. Thereby, Shri Rahul Anand has remained on un- authorized leave w.e.f. 20-06-2010 till date for a period which now exceed two (2) years from the2562 राजपत्र, हिमाचल प्रदेश, 1 अगस्त, 2012/10 श्रावण, 1934 date of expiry of sanctioned leave, i.e., 19-06-2010 and hence deemed to have been resigned from the service under the Rule 7(2) of AIS (Leave) Rules, 1954.

Therefore, before Rule-7(2)(a) is invoked, Shri Rahul Anand, IAS is hereby given last opportunity to explain his position within one month's time, from the date of issue of this memorandum.

No: EDN-B-E(3)-6/2010.—The tentative Seniority list of Principal, School Cadre (Lecturer Cadre) as on 31-12-2006 was circulated vide this Department Notification of even No. dated 8-8-2011. Against this seniority list, representations received were considered carefully in accordance with the instructions of the Department. Review DPCs were held and consequently the revised seniority list (Annexure-A) of Principal, School Cadre (Lecturer Cadre) indicating the position as on 31-12-2006 has been prepared which is being circulated amongst the Officers concerned. If there is any objection with regard to this tentative seniority list, a representation should be sent to the Special Secretary (Education) to the Government of Himachal Pradesh within a period of 30 days from the date of issuance of this Notification. If no objection in this context is received within stipulated period, it will be presumed that the tentative seniority list is correct/final and no objection thereafter shall be treated.

हरगाह एतद्‌द्वार यह सूचित किया जाता है कि आवेदक गुडू राम ने इस न्यायालय में एक आवेदन पत्र दिया है कि उसकी पुत्री कुमारी प्रिया जन्म तिथि 12-3-2006 तथा बेटे का नाम कर्ण सिंह जन्म तिथि 18-3-2008 पंचायत अभिलेख यानि जन्म मृत्यु रजिस्टर में दर्ज नहीं है जबकि परिवार रजिस्टर पंचायत में दर्ज है। आवेदन-पत्र स्वीकार किया जावे।

अतः फरीकदोयम आम जनता को बजरिया उद्‌घोषणा राजपत्र के द्वारा आगाह किया जाता है कि किसी को उपरोक्त बारे कोई आपत्ति हो तो वह मिति 6-9-2012 को वरवक्त 10.00 बजे सुबह असालतन या वकालतन हाजिर आकर पेश करे अन्यथा कार्यवाही एकपक्षीय अमल में लाई जाएगी।

संख्याः ई0एक्स0एन0-एफ(10)-7/2011-पार्ट.--हिमाचल प्रदेश की राज्यपाल, हिमाचल प्रदेश मूल्य परिवर्धित कर अधिनियम, 2005 (2005 का अधिनियम संख्यांक 12) की धारा 63 की उपधारा (1) द्वारा प्रदा शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्या इर्.एक्स.एन.-एफ(5)-4/2005, तारीख 2 दिसम्बर, 2005 द्वारा अधिसूचित और राजपत्र, हिमाचल प्रदेश (असाधारण) में तारीख 7 दिसम्बर, 2005 को प्रकाशित हिमाचल प्रदेश मूल्य परिवर्धित कर नियम, 2005 में और संशोधन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ः--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश मूल्य परिवर्धित कर (तृतीय संशोधन) नियम, 2012 है।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत होंगे। 2. नियम 61 ख. का अन्तःस्थापन.--हिमाचल प्रदेश मूल्य पररिवर्धित कर नियम, 2005 (जिन्हें इसमें इसके पश्चात्‌ 'उक्त नियम' कहा गया है) के नियम 61 क के पश्चात्‌ निम्नलिखित नियम अन्तःस्थापित किया जाएगा, अर्थात्‌ः--

"61ख. माल के राज्यांतरिक वहन हेतु कर बीजकों/बिलों/कैश मैमों की इलैक्ट्रोनिक घोषणा.--(1) नियम 61 और 61क में किसी बात के होते हुए भी, कोई रजिस्ट्रीकृत व्यौहारी, जो हिमाचल प्रदेश राज्य के भीतर व्यौहारियों को कराधेय माल प्रेषित करता है, माल के ऐसे वहन हेतु कर बीजक/बिल/कैश मैमो की बाबत घोषणा आबकारी एवं कराधान विभाग की आफिशियल बैबसाइट के माध्यम से इलैक्ट्रोनिकली मू0 प0 कर प्ररूप 26 में देगा।

(2) व्यौहारियों या माल के ऐसे वर्ग के लिए, जो राज्य सरकार द्वारा अधिसूचित किए जाएं राज्यांतरिक संव्यवहारों के दौरान कराधेय माल के प्रेषण से पूर्व मू0प0 कर प्ररूप 26 में ई-घोषणा अनिवार्य होगी और कराधेय माल के प्रेषण से पूर्व ई-घोषणा न करने पर हिमाचल प्रदेश मूल्य परिवर्धित कर अधिनियम, 2005 की धारा 34 के अधीन शास्तिक कार्रवाई की जाएगी।"

3. मू0 प0 कर प्ररूप-26 में घोषणा का प्रतिस्थापन.--उक्त नियमों में मू0 प0 कर प्ररूप-26 के स्थान पर निम्नलिखित प्ररूप रखा जाएगा, अर्थात्‌ः--2601 राजपत्र, हिमाचल प्रदेश, 1 अगस्त, 2012/10 श्रावण, 1934

No. EXN-F(10)-7/2011-Part.—In exercise of the powers conferred by sub-section (1) of section 63 of the Himachal Pradesh Value Added Tax Act, (Act No. 12 of 2005), the Governor of Himachal Pradesh, is pleased to make the following rules further to amend the Himachal Pradesh2602 राजपत्र, हिमाचल प्रदेश, 1 अगस्त, 2012/10 श्रावण, 1934 Value Added Tax Rules, 2005, notified vide this department notification No. EXN-F(5)-4/2005 dated 2nd December, 2005 and published in the Rajpatra, Himachal Pradesh (extra ordinary), dated 7th December, 2005, namely—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Value Added Tax (Third Amendment) Rules, 2012.

(2) They shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Insertion of rule 61B.—After rule 61 A of the Himachal Pradesh Value Added Tax Rules, 2005 (hereinafter referred to as the 'said rules'), the following rule shall be inserted, namely:—

"61B. Electronic Declaration of tax invoices/bills/cash memos for intra-State movement of goods.—(1) Notwithstanding anything contained in rules 61 and 61-A, a registered dealer who dispatches taxable goods to dealers within the State of Himachal Pradesh shall furnish a declaration regarding tax invoice/bill/cash memo for such movement of goods in Form VAT-XXVI, electronically through the official website of the Excise and Taxation Department.

(2) For such class of dealers or goods as may be notified by the State Government, the e-declaration in Form VAT-XXVI shall be compulsory before the dispatch of taxable goods in the course of intra-state transactions and non e-declaration before the dispatch of taxable goods shall attract penal action under section 34 of the Himachal Pradesh Value Added Tax Act, 2005.

3. Substitution of declaration in Form VAT-XXVI.—In the said rules for Form VATXXVI, the following Form shall be substituted, namely:—

"FORM VAT-XXVI

{See rule 61 (1) and 61-B}

Signature or thumb impression of the person transporting the goods".

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश सूचना का अधिकार (छठवां संशोधन) नियम, 2012 है।

(2) ये नियम, राजपत्र हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे।

2. नियम 6 का संशोधन.--हिमाचल प्रदेश सूचना का अधिकार नियम, 2006 के नियम 6 के उप नियम (5) में निम्नलिखित प्रतिस्थापित किया जाएगा :--

"(5) पक्षकार सुनवाई की तारीख पर या किसी अन्य दिन को, जिसको सुनवाई स्थगित की जा सकेगी, अपील प्राधिकारी/आयोग के समक्ष अपनी उपस्थिति दर्ज करेंगे। यदि अपीलार्थी ऐसी तारीख पर उपस्थित होने में असमर्थ रहता है तो अपील प्राधिकारी/आयोग गुणागुण के आधार पर मामले का विनिश्चय करेगा।"

No.Per (AR)F(7)-1/2008.—In exercise of the powers conferred by sub-section (2) of section 27 of the Right to Information Act, 2005, the Governor of Himachal Pradesh is pleased to make the following rules further to amend the Himachal Pradesh Right to Information Rules, 2006, notified vide this department's notification No. Per (AR)F(7)-2/98-Vol-I, Dated 21st January 2006 and published in the Rajpatra, Himachal Pradesh dated 15/02/2006, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Right to Information (6th amendment) Rules, 2012.

(2) They shall come into force on the date of their publication in the Rajpatra, Himachal Pradesh.

2. Amendment of rule 6.—For sub-rule (5) of rule 6 of the Himachal Pradesh Right to Information Rules, 2006, the following shall be substituted, namely:—

"(5) On the date of hearing or on any other day to which the hearing may be adjourned, the parties shall put their appearance before the Appellate Authority/Commission. If the appellant fails to appear on such date, the Appellate Authority/Commission shall decide the matter on merits".
