Hence their marriage may be registered under Special Marriage, Act, 1954.

उपरोक्त वर्णित प्रार्थी ने पीठासीन अधिकारी की अदालत में अपने नाम की राजस्व अभिलेख महाल साई-दा-लाहड़, मौजा व उप-तहसील थुरल, जिला कांगड़ा (हि0 प्र0) की दरुस्ती हेतु प्रार्थना-पत्र प्रस्तुत3973 राजपत्र, हिमाचल प्रदेश, 26 सितम्बर, 2012/4 आश्विन, 1934 किया है। प्रार्थी के अनुसार उसके शैक्षणिक व ग्राम पंचायत अभिलेख में उसका नाम सुदेश कुमार पुत्र सरवण दर्ज है किन्तु राजस्व अभिलेख महाल साई-दा-लाहड़, मौजा व उप-तहसील थुरल में गलती से उसका नाम सुदेश कुमार के बजाए देश राज दर्ज हो गया है जोकि गलत है। अतः प्रार्थी राजस्व अभिलेख महाल साई-दा-लाहड़ में अपने नाम की दरुस्ती करवा करके देश राज के बजाए देश राज उपनाम सुदेश कुमार पुत्र श्री सरवण दर्ज करवाना चाहता है। इसकी पुष्टि में प्रार्थी ने नकल जमाबन्दी जेरधारा महाल साई-दा-लाहड़, शैक्षणिक प्रमाण-पत्र की छाया प्रति, वोटर कार्ड की छाया प्रति व शपथ-पत्र भी शपथ-पत्र के साथ संलग्न किए हैं।

अतः प्रार्थी के प्रकरण को स्वीकार करते हुए इस मुस्त्री मुनादी चस्वांगी इश्तहार राजपत्र हि0 प्र0 प्रकाशन के माध्यम से प्रत्यार्थी आम जनता को सूचित किया जाता है कि यदि किसी व्यक्ति को उपरोक्त श्री देश राज उपनाम सुदेश कुमार के राजस्व अभिलेख महाल साई-दा-लाहड़ की दरुस्ती बारे किसी प्रकार का उजर व एतराज हो तो वह दिनांक 19-10-2012 को असालतन या वकालतन हाजिर अदालत होकर अपना उजर पेश कर सकता है अन्यथा इस तिथि को किसी प्रकार का उजर एतराज पेश न होने की सूरत में राजस्व अभिलेख महाल साई-दा-लाहड़, मौजा व उप-तहसील थुरल में देश राज के बजाए देश राज उपनाम सुदेश कुमार पुत्र श्री सरवण की प्रविष्टी दर्ज करने के आदेश पारित कर दिए जाएंगे।

दरख्वास्त मकफूद-उल-खबरी हमारे समक्ष फरीक अब्बल श्री राज कुमार पुत्र श्री ठाकुर राम, निवासी गांव रंगोरी, तहसील रामपुर बुशैहर, जिला शिमला, हिमाचल प्रदेश ने इस आशय के साथ प्रस्तुत की है कि फरीक अब्बल का चाचा श्री गोपाल पुत्र श्री जटी पुत्र श्री तुलसू, निवासी गांव रंगोरी, तहसील रामपुर बुशैहर, जिला शिमला, हिमाचल प्रदेश वर्ष 1977 से लगभग 35 वर्ष से लापता है तथा इस अवधि के अन्दर गोपाल घर न आया, उनका आज तक कोई पता न चला तथा न ही उनकी ओर से कोई चिट्‌ठी-पत्र आया है। उनकी कोई शादी न थी और न ही उनकी कोई औलाद है। जब गोपाल घर से लापता हुआ तब आवेदक मात्र 11-12 वर्ष का था। श्री गोपाल पुत्र श्री जटी खाता/खतौनी नं0 31/106 ता 107, किते 3, रकबा तादादी 0-21-93 है0 व खाता/खतौनी नं0 28 मिन/98 ता 102 किते 21, रकबा तादादी 02-11-09 है0 वाका चक रंगोरी का बरुए जमाबन्दी वर्ष 2009-10 का बशराक्त हिस्सेदार काशी राम आदि मालिक व काविज दर्ज कागजात माल है। फरीक अब्बल को यकीन हो गया है कि श्री गोपाल अब जीवित नहीं है। जिसका फरीक अब्बल मकफूद-उल-खबरी का इन्तकाल जायज वारसान के हक में तस्दीक करवाना चाहता है।

अतः इस इश्तहार द्वारा सर्वसाधारण को सूचित किया जाता है कि यदि किसी व्यक्ति या गोपाल जीवित हो तो उपरोक्त मकफूद-उल-खबरी का इन्तकाल जायज वारसान के हक में तस्दीक करने बारा कोई उजर या एतराज है तो वह दिनांक 23-10-2012 को या इससे पूर्व अदालत हजा में हाजिर आकर अपनी आपत्ति दर्ज करवा सकता है। बाद गुजरने मियाद कोई भी उजर/एतराज काबिले समायत न होगा तथा नियमानुसार उपरोक्त मकफूद-उल-खबरी का इन्तकाल जायज वारसान के हक में तस्दीक करने के आदेश पारित कर दिए जाएंगे।

संख्या इण्ड-II (एफ) 6-8/2008.--हिमाचल प्रदेश की राज्यपाल, खान और खनिज (विकास और विनियमन) अधिनियम, 1957 की धारा 15 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयागे करते हुए, इस विभाग की अधिसूचना संख्या 13-3/70-एस.आई., तारीख 13 अप्रैल, 1971 को अधिसूचित और राजपत्र, हिमाचल प्रदेश में तारीख 5 मई, 1971 को प्रकाशित दी हिमाचल प्रदेश माईनर मिनरल्स (कन्सेशन) रिवाईज्ड रूल्ज, 1971 का और संशोधन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ः-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम दी हिमाचल प्रदेश माईनर मिनरल्स (कन्सेशन) रिवाईज्ड (संशोधन) नियम, 2012 है ।

(2) ये नियम, राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत होंगे।

2. नियम 53 का संशोधन.--उक्त नियमों के नियम 53 में,--

(क) उप नियम (2) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌--

"(2) Any contravention of sub-rule (1) shall be punishable with imprisonment for a term which may extend to two years or with fine which may extend to Rs. 25000/- or with both:

Provided that the contravention of sub-rule (1) for the first and the second time ay be compounded by a person authorized by the State Government under section 22 and the case in relation to the subsequent contravention shall be filed by the person so authorized in the competent court of law for which the penalty shall be as provided under this sub-rule. The manner of compounding of offence shall be as under:—

(i) The amount of compounding fee in case of unauthorized mining carried out manually shall not be less than Rs. 10000/-.

(ii) That in case of second contravention a minimum compounding fee of Rs. 5000/- shall be charged in addition to the amount compounded for the first contravention.

(iii) That the amount of compounding fee shall not be less than Rs. 25000/- for unauthorized mining done mechanically in the river/stream beds."; and (ख) इस प्रकार रखे गए उप नियम (2) के पश्चात्‌ निम्न लिखित उप नियम जोडा जाएगा, अर्थात्‌ः-

"(3)(i) whenever any person raises, transports or causes to be raised or transported without any lawful authority, any mineral from any land and for that purpose, uses any tool, equipment, vehicle or any other thing, such mineral tool, equipment, vehicle or any other thing shall be liable to be seized by an officer or authority specially empowered in this behalf by the State Government under sub-section (4) of section 21.

(ii) Any mineral, tool, equipment, vehicle or any other thing seized under clause (i), shall be liable to be confiscated by an order of the court competent to take cognizance of the offence under sub-rule (2) and shall be disposed off in accordance with the directions of such court.".

3. नियम 57 का संशोधन.--उक्त नियमों के नियम 57 में,--

(क) उप नियम (6) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः--

"Any person found to have contravened any provision of sub-rules (2), (3) or (5), shall, on conviction, be punishable with imprisonment of either description for a term which may extend upto 2 years or with fine which may extend upto Rs. 25000/:

Provided that the contravention of sub-rules (2), (3) and (5) for the first time may be compounded by a person authorized in this behalf by the State Government under Section 22 and the case in relation to the subsequent contravention shall be filed in the competent court of law for which the penalty shall be as provided under this sub-rule. The compounding of offences under this sub-rule shall be as under:—

The amount of the compounding fee shall not be less than Rs. 4500/- for tractor, Rs. 7000/- for medium truck/tipper having capacity upto 7 metric ton, Rs. 10,000/- for trucks having capacity upto 10 metric ton and Rs. 15000/- for trucks with capacity more than 10 metric ton, and Rs. 200/- for mule/horse.".

Shimla-2, the 20th September, 2012

No. Ind-II(F) 6-8/2008.—In exercise of the power conferred by sub-section (1) of section 15 of the Mines and Minerals (Development and Regulation) Act, 1957, the Governor, Himachal Pradesh is pleased to make the following rules further to amend the Himachal Pradesh Minor Minerals (Concession) Revised Rules, 1971, notified vide this Department notification number 13- 3/70- SI, dated 13th April, 1971 and published in the Rajpatra, Himachal Pradesh dated 5th May, 1971, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Minor Minerals (Concession) Revised (Amendment) Rules, 2012.

(2) They shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Amendment of rule 53.—In rule 53 of the said rules,—
