संख्या 576/3/ई.वी.एम./2012/एस0डी0आर (वि.स.-हि.प्र.).--यतः लोक प्रतिनिधित्व अधिनियम 1951 की धारा 61क में यह उपबंधित है कि मतदान मशीनों द्वारा मत ऐसी रीति से डाले और रिकार्ड किए जाएंगें जैसा कि भारत निर्वाचन आयोग ऐसे निर्वाचन क्षेत्रों के लिए प्रत्येक मामले की विशिष्ट परिस्थितियों को ध्यान में रखते हुए निर्दिष्ट करे; तथा

2. यतः आयोग ने हिमाचल प्रदेश में 68 विधान सभा निर्वाचन क्षेत्रों की परिस्थितियों पर विचार किया है, और वह संतुष्ट है कि उपर्युक्त विधानसभा निर्वाचन क्षेत्रों में मतदान के लिए पर्याप्त संख्या में इलेक्ट्रॉनिक वोटिंग मशीनें उपलब्ध है, तथा मतदान कर्मचारी इलेक्ट्र्‌ॉनिक वोटिंग मशीनों को दक्षतापूर्वक संचालन करने के लिए प्रशिक्षित हैं तथा निर्वाचक भी इलेक्टॅ्रानिक वोटिंग मशीनों की कार्यप्रणाली से पूर्णतया परिचित हैं।

3. अतः, अब, भारत निर्वाचन आयोग एतद्‌द्वारा हिमाचल प्रदेश के 68 विधान सभा निर्वाचन क्षेत्रों को ऐसे निर्वाचन क्षेत्रों के रूप में उल्लिखित करता है, जिसमें 10-10-2012 को अधिसूचित किए गए विधान सभाओं के लिए चालू विधान सभा निर्वाचनों में, निर्वाचनों का संचालन नियम, 1961 के अधीन मत निर्धारित रीति से इलेक्ट्रॅ्‌ानिक मतदान मशीनों के माध्यम से डाले और रिकार्ड किए जाएंगे जैसा कि इस विषय पर आयोग द्वारा समय समय पर अनुपूरक अनुदेश जारी किए गए हैं।

No. 576/3/EVM/2012/SDR(LA-HP):—Whereas, Section 61A of the Representation of the People Act, 1951, provides that the giving and recording of votes by Voting Machines in such manner as may be prescribed, may be adopted in such constituencies as the Election Commission of India may, having regard to the circumstances of each case specify; and

2. Whereas, the Commission has considered the circumstances in all the 68 Assembly Constituencies in Himachal Pradesh, and is satisfied that sufficient number of Electronic Voting Machines are available for taking the poll in the above mentioned Assembly Constituencies, the polling personnel are well trained in efficient handling of the Electronic Voting Machines and the electors are also fully conversant with the operation of the Electronic Voting Machines;

3. Now, therefore, the Election Commission of India hereby specifies all the 68 Assembly Constituencies in Himachal Pradesh, as the constituencies in which the votes at the current general elections to the Legislative Assemblies of the said State, notified on 10th October, 2012, shall be given and recorded by means of Electronic Voting Machines in the manner prescribed under the Conduct of Elections Rules, 1961, and the supplementary instructions issued by the Commission from time to time on the subject.

सं0 576/एक्जिट/2011/एस0डी0आर(सा.नि.-वि.स.).--लोक प्रतिनिधित्व अधिनियम 1951 की धारा 126 क की उप-धारा(1) के अधीन शक्तियों का प्रयोग करते हुए तथा उक्त धारा की उप-धारा (2) के उपबंधो को ध्यान में रखते हुए आयोग एतदद्वारा दिनांक 04.11.2012 अर्थात हिमाचल प्रदेश में मतदान का प्रथम दिन के पूर्वाहन 08.00 बजे से दिनांक 17-12-2012 अर्थात्‌ गुजरात में मतदान के अन्तिम दिन के अपराहन 05.30 बजे तक के समय को ऐसे समय के रूप में, अधिसूचित करता है, जिसके दौरान आयोग के दिनांक 3.10.2012 को घोषित किये गए हिमाचल प्रदेश एवं गुजरात राज्य की विधान सभाओं के सामान्य निर्वाचनों के संबंध में किसी भी मामले में किसी प्रकार का निर्गम मत सर्वेक्षण करना तथा प्रिंट या इलेक्ट्रानिक मीडिया अथवा किसी अन्य रीति से प्रकाशित या प्रचारित करना निषिद्ध होगा। पुनः यह भी स्पष्ट किया जाता 4588 राजपत्र, हिमाचल प्रदेश, 30 अक्तूबर, 2012/8 कार्तिक, 1934 है कि लोक प्रतिनिधित्व अधिनियम 1951 की धारा 126(1)(ख) के अधीन उपरोक्त सामान्य निर्वाचनों के संबंध में किसी भी इलेक्ट्रानिक मीडिया में किसी ओपिनियन पोल या किसी भी अन्य मत सर्वेक्षण के परिणाम सहित, निर्वाचन से संबंधित किसी भी सामग्री का प्रदर्शन करना मतदान की समाप्ति के लिए नियत किए गए समय के साथ समाप्त होने वाले 48 घंटों की कालावधि के दौरान निषिद्ध होगा।

No.576/EXIT/2012/SDR(GE-LA).—In exercise of the powers under sub-section(1) of Section 126A of the Representation of People Act, 1951, and having regard to the provisions of sub-section (2) of the said Section, the Commission hereby notifies the period between 8.00 A.M. on 04-11-2012, i.e. the first day of poll in Himachal Pradesh and 5.30 P.M. on 17-12-2012 i.e. the last day of the poll in Gujrat, as the period during which conducting any exit poll and publishing or publicizing by means of the print or electronic media or disseminating in any other manner whatsoever, the result of any exit poll in connection with the current general elections to the Legislative Assemblies of Himachal Pradesh and Gujarat, announced by the Commission on 03-10 2012, would be prohibited.

It is further clarified that under Section 126(1)(b) of Representation of People Act, 1951, displaying any election matter including results of any opinion poll or any other poll survey, in any electronic media, would be prohibited during the period of 48 hours ending with the hours fixed for conclusion of poll in connection with aforesaid general election.

अतः इस इश्तहार के माध्यम से सर्वसाधारण को सूचित किया जाता है कि यदि किसी व्यक्ति को भागमल के पिता क नाम राजस्व अभिलेख में मोतिया के बजाए जानीया दर्ज करने बारा कोई उजर व एतराज हो तो वह इस इश्तहार के प्रकाशित होने के एक माह के अन्दर दिनांक 19-11-2012 असालतन या वकालतन अदालत हजा में हाजिर आकर अपना उजर व एतराज पेश कर सकता है अन्यथा नाम जानिया दर्ज करने के आदेश पारित किए जाएंगे।

अतः इस अदालती इश्तहार के माध्यम से आम जनता/सगे सम्बन्धियों को सूचित किया जाता है कि अगर प्रार्थी श्री राजेश कुमार का नाम राजस्व रिकॉर्ड मौजा भाटगढ़ व चाडना, तहसील रेणुका में दरुस्त करने में किसी व्यक्ति को कोई उजर एवं एतराज हो तो वह दिनांक 10-12-2012 को प्रातः 10.00 बजे हमारी अदालत में उपस्थित होकर उजर एवं एतराज प्रस्तुत कर सकता है। बाद गुजरने तारीख सुनवाई कोई उजर काबिले गौर न होगा तथा प्रार्थी के पक्ष में आवश्यक आदेश पारित कर दिए जाएंगे।
