श्रीमती जीता मणी पत्नी स्व0 श्री कमलू राम, निवासी गांव पूनन, उप-तहसील ननखरी, जिला शिमला, हिमाचल प्रदेश ने उप मण्डलाधिकारी (ना0), रामपुर के माध्यध्म से इस अदालत में प्रार्थना-पत्र गुजारा है कि आवेदिका गांव पूनन, उप-तहसील ननखरी, जिला शिमला की स्थाई निवासी है। आवेदिका के पति स्व0 कमलू राम की मृत्यु दिनांक 11-1-2013 को दोपहर 2.30 बजे ग्राम खनेरी में दिल का दौरा पड़ने से हुई थी। स्थानीय ग्राम पंचायत रचोली में अपने पति की मृत्यु का पंजीकरण समय पर न करवा सकी है। अब स्थानीय ग्राम पंचायत अभिलेख रचोली में अपने पति की मृत्यु का पंजीकरण करवाना चाहती है।

अतः इस इश्तहार द्वारा सर्वसाधारण को सूचित किया जाता है कि यदि किसी व्यक्ति को उपरोक्त श्रीमती जीता मणी के पति स्व0 श्री कमलू राम की मृत्यु का पंजीकरण ग्राम पंचायत रचोली के अभिलेख में दर्ज करने बारे किसी भी व्यक्ति का कोई उजर या एतराज हो तो वह दिनांक 9-5-2013 को या इससे पूर्व अदालत हजा में हाजर आकर अपनी आपत्ति दर्ज करवा सकता है। बाद गुजरने मियाद कोई भी उजर/एतराज काबिले समायत न होगा तथा नियमानुसार ग्राम पंचायत धार-गौरा के अभिलेख में आवेदिका के पति की मृत्यु का पंजीकरण दर्ज करने के आदेश पारित कर दिए जाएंगे।

श्रीमती सुनीता देवी पत्नी श्री पे्रम सिंह, निवासी गांव रचोली, डा0 ज्यूरी, तहसील रामपुर बुशैहर, जिला शिमला, हिमाचल प्रदेश ने इस अदालत में प्रार्थना-पत्र मय शपथ-पत्र गुजारा है कि प्रार्थिया का विवाह श्री प्रेम सिंह (जन्म तिथि 15-3-1980) पुत्र श्री मोती लाल, निवासी गांव रचोली, तहसील रामपुर बुशैहर के साथ वर्ष 2005 में हिन्दू रीति-रिवाज के अनुसार सम्पन्न हुआ है। आवेदिका अपने मायके में निवास करती है इसलिए अपने पति का नाम अपने मायके ग्राम पंचायत रचोली के अभिलेख में दर्ज करवाना चाहती है। इसके अतिरिक्त आवेदिका अपने पुत्र करण (जन्म तिथि 18-7-2006) व पुत्री अन्जली (जन्म तिथि 18-11-2007) के नाम व जन्म तिथियाें का पंजीकरण स्थानीय ग्राम पंचायत अभिलेख रचोली में दर्ज नहीं करवा सकी है। इनके नाम व जन्म तिथियाें का इन्द्राज अपने साथ ग्राम पंचायत रचोली के अभिलेख में दर्ज करवाना चाहती है।403 राजपत्र, हिमाचल प्रदेश, 24 अप्रैल, 2013/4 वैशाख 1935 अतः इस इश्तहार द्वारा सर्वसाधारण को सूचित किया जाता है कि यदि किसी व्यक्ति को उपरोक्त प्रार्थिया के पति, पुत्र व पुत्री के नाम व जन्म तिथियों का इन्द्राज पंचायत अभिलेख में दर्ज करने बारा कोई उजर या एतराज हो तो वह दिनांक 9-5-2013 को या इससे पूर्व प्रातः 10.00 बजे हाजिर अदालत आकर अपनी आपत्ति दर्ज करवा सकता है। बाद गुजरने मियाद कोई भी उजर/एतराज काबिले समायत न होगा तथा नियमानुसार में आवेदिका के परिवार का नाम व जन्म तिथियों का पंजीकरण स्थानीय पंचायत अभिलेख में दर्ज करने के आदेश पारित कर दिए जाएंगे।

संख्याः टी0पी0टी0-एफ (4)1/2008-11.-हिमाचल प्रदेश की राज्यपाल, मोटरयान अधिनियम,1988 की धारा 72 (2) और 212 के साथ पठित धारा 95 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए इस विभाग की अधिसूचना संख्याः 5-14/88/परि-3 तारीख 12 जुलाई, 1999 द्वारा अधिसूचित और तारीख 27 जुलाई, 1999 को राजपत्र, हिमाचल प्रदेश में प्रकाशित हिमाचल प्रदेश मोटरयान नियम, 1999 में और संशोधन करने के लिए निम्नलिखित नियम बनाने का प्रस्ताव करती हैं तथा जिन्हें इनके द्वारा संभाव्य प्रभावित होने वाले व्यक्तियों की जानकारी के लिए एतद्‌द्वारा राजपत्र, हिमाचल प्रदेश में प्रकाशित किया जाता है;

2. कोई हितबद्ध व्यक्ति, जो प्रस्तावित संशोधन की बावत कोई आक्षेप करना चाहे या सुझाव देना चाहे, तो वह उसे उक्त प्रारूप नियमों को राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से तीस दिन की अवधि के भीतर, अतिरिक्त मुख्य सचिव (परिवहन), हिमाचल प्रदेश सरकार, हिमाचल प्रदेश सचिवालय, शिमला-171002 को भेज सकेगा;

3. उपर्युक्त नियत अवधि के भीतर प्राप्त हुए आक्षपे (पों) या सुझाव(वों), यदि कोई हों, पर उक्त प्रारूप नियमों को अंतिम रूप देने से पूर्व राज्य सरकार द्वारा विचार किया जाएगा, अर्थात्‌ः-

1. संक्षिप्त नाम.- इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश मोटरयान (संशोधन) नियम, 2013 है। 2. नियम 73 का संशोधन.-हिमाचल प्रदेश मोटरयान नियम, 1999 (जिन्हें इसमें इसके पश्चात्‌ "उक्त नियम" कहा गया है) के नियम 73 में खण्ड (6) क पश्चात्‌ निम्नलिखित खण्ड जोड़े जाएंगे, अर्थात्‌ः- "(7) मंजिली गाडी़ अनुज्ञापत्र" (स्टेज कैरिज परमिट) का धारक, विशेष प्रवर्ग यात्री (एस.सी.पी.) हेतु सीटों के आरक्षण की बावत सरकार द्वारा जारी किसी निदेश (निदश्ेाों) का, उक्त निदेश (निदेशों) में जैसे विनिर्दिष्ट किया जाए, वैसे पालन करेगा; और

"(8) मंजिली गाडी़ अनुज्ञापत्र (स्टेज कैरिज परमिट)का धारक बस के भीतर और बाहर, सार्वजनिक सूचना के प्रदर्शन की बाबत सरकार द्वारा जारी किसी निदेश (निदेशों) का, उक्त निदेशों में जैसे विनिर्दिष्ट किया जाए, वैसे पालन करेगा"।

3. नियम 90 का संशोधन.- उक्त नियमों के नियम 90 में उपनियम (1) में खण्ड (28) के पश्चात्‌ और "तो'' शब्द से पूर्व निम्नलिखित खण्ड जोड़ा जाएगा, अर्थात्‌ः-

"(29) जो स्वयं नियम 73 के अधीन यथा विनिर्दिष्ट विशेष प्रवर्ग यात्री (एस.सी.पी) के प्रवर्ग से संबन्धित न हो और बस के परिचालक या चालक के कहने पर उक्त प्रवर्ग के पक्ष में आरक्षित किसी सीट को रिक्त करने से मना करता हो"।

No. TPT-F(4)/2008-II.—In exercise of the powers conferred by section 95 read with sections 72(2) and 212 of the Motor Vehicles Act, 1988, the Governor of Himachal Pradesh proposes to make the following rules further to amend the Himachal Pradesh Motor Vehicles Rules, 1999 notified vide this department's notification No: 5-14/88-TPT-II, dated 12th July, 1999 and published in Rajpatra, Himachal Pradesh, (Extra Ordinary), dated 27th July, 1999 and the same are hereby published in Rajpatra, Himachal Pradesh for the information of the person(s) likely to be effected thereby;

2. Any interested person who has any objection(s) or suggestion(s) with regard to the proposed amendments, he may send the same to the Additional Chief Secretary (Transport) to the Government of Himachal Pradesh, H.P. Secretariat, Shimla-171002, within a period of 30 days from the date of publication or the said draft rules in Rajpatra, Himachal Pradesh;

3. The objection(s) or suggestion(s) if any received within the above stipulated period shall be taken into considered by the State Government before finalizing the said draft rules, namely:—

1. Short title.—These rules may be called the Himachal Pradesh Motor Vehicle (Amendment) Rules, 2013.

2. Amendment of Rule-73.— In rule 73 of the Himachal Pradesh Motor Vehicle Rules, 1999 (hereinafter referred to as the "said rules") after clause (vi) the following clauses shall be added, namely:—

"(vii) the holder of a stage carriage permit shall comply with any direction(s) issued by the Government regarding reservation of seats for Special Category Passenger (SCP), as may be specified in the said direction(s); and

(vii) the holder of a stage carriage permit shall comply with any direction(s) issued by the Government regarding display of public information within and outside the bus as may be specified in the said direction(s)."

3. Amendment of rule 90.—In rule 90 of the said rules in sub-rule (1) after clause (xxviii), the following clause shall be added namely:—

"(xxix) who himself does not belong to the Category of Special Category Passenger (SCP) as specified under rule 73 and refuses to vacate a seat reserved in favour of the said category upon being asked by either the conductor or the driver of the bus."
