Shimla-2, the 21st May, 2013

No. Shram (D) 1-2/2013.—The Governor of Himachal Pradesh is pleased to notify the Skill Development Allowance Scheme'2013 for the educated unemployed youth of Himachal Pradesh. The main objective is to upgrade/enhance Skill Development of educated unemployed youth to enable them to take employment or self employment in the sector of their choices. The details of scheme notified is given in the Annexure R-I alongwith prescribed form 'A'; ' B'; 'C'; 'D'; 45-राजपत्र/2013-29-05-2013 (1271)1272 राजपत्र, हिमाचल प्रदेश, 29 मई, 2013/8 ज्येष्ठ 1935 & 'E'; attached. The Director of Employment, H.P. and subordinate Employment Exchanges functioning under her/his administrative control shall be nodal agency for implementation of the aforesaid scheme. This scheme shall come into force with immediate effect.

ANNEXURE R-I SKILL DEVELOPMENT ALLOWANCE SCHEME 2013

A. Introduction:

"The Scheme of granting Skill Development Allowance to the unemployment youth has been detailed in the Budget Speech of Hon'ble Chief Minister for the Financial Year 2013- 14 which aims at providing allowance to educated unemployed persons for their Skill upgradation.

B. Objective:

(a) This scheme intends to provide allowance to eligible educated unemployed Himachali youth for their skill upgradation.

(b) This in turn will enable such youth to develop their skill which in turn will enable them to take up employment or self-employment in the Sector of their choice, since this scheme empowers the youth to choose the Sector in which they would like to develop their skill, at the training institute of their choice.

C. Details of the Scheme:

1. Short title & commencement.—(a) This scheme may be called "The Himachal Pradesh Payment of Skill Development Allowance to Educated Unemployed Persons Scheme, 2013".

(b) This scheme will be implemented with effect from the date of issuance of the notification.

(c) The allowance shall be payable to eligible persons in the age group of 25-35 years. 2. Definitions.—In this scheme, unless the context otherwise requires:

(a) 'Skill Development Course' means any Course which aims at enhancing the skill & employability of the applicant.

(b) 'Allowance' means Skill Development Allowance as defined in this scheme.

(c) 'Department' means the Department of Employment, Himachal Pradesh.

(d) 'Director' means the Director of Employment, Himachal Pradesh and includes any person to whom any or all the powers of Director may have been delegated by the Government.

(e) 'Educated unemployed applicant' means a person who is minimum 10+2 Pass from a Board recognized by the Govt. of Himachal Pradesh, who is on the Live Register of the Employment Exchange of the State of Himachal Pradesh for minimum two years as on the date of application and who applies under this Scheme for the grant of Skill Development Allowance, who has attained the age of 25 years but has not attained the age of 36 years on the date of such application and who remains on the Live Register.

(f) 'Employment Exchange' means any Employment Exchange set up by the Himachal Pradesh Government.

(g) 'Family' in relation to an educated unemployed applicant shall mean the natural family consisting of parents, spouse, brothers and unmarried/widow sisters.

(h) 'Form' means a form appended to this Scheme.

(i) 'Government' means the Government of Himachal Pradesh in the Administrative Department.

(j) 'Income' means family income and includes income through self-employment.

(k) 'Live Register' means the valid employment index cards of those persons who are registered in the Employment Exchanges of the State of Himachal Pradesh.

(l) '10+2' means a candidate who has passed the 10+2 examination or any examination held equivalent thereto, by Govt. of H. P.

(m) 'Officer incharge of the Employment Exchange' will include an Officer/Official to whom the powers of the officer incharge of the Employment Exchange under this Scheme may have been delegated by the Department.

(n) 'Year' means the Financial Year starting on First April and ending on Thirty-First March of the following Year.

(o) 'State' means the State of Himachal Pradesh.

3. Persons eligible.—Subject to the provisions of this Scheme, all educated unemployed applicants shall be eligible for the grant of Skill Development Allowance, who fulfill the following criteria:—

(a) She/He should be unemployed and should be a Bonafide Himachali.

(b) She/He should have passed minimum 10+2 from any Board/University/Institution recognized by H.P. Govt.

(c) She/He should be registered with any Employment Exchange in Himachal Pradesh for minimum two years as on the date of application.

(d) Her/His annual family income for the Financial Year immediately preceding date of application, from all sources including that of spouse should be less than Rs. 2.00 Lakh (Rs. Two Lakhs).

(e) She/He should be above 25 years and below 36 years of age, as on the date of application.

(f) She/He should not be receiving any social/retirement/other pension from Government. In case she/he is receiving other pension etc, she/he will have the option of opting for either that pension or this Allowance.

(g) She/He should not be self-employed.

(h) The employment under MGNREGA will not be counted as employment.

(i) She/He should not be a dismissed Govt. employee.

(j) She/He should not be convicted of any offence resulting in imprisonment for a period of 48 hours or more.

(k) She/he should be enrolled in a skill development course.

4. Persons not eligible.—The following categories of persons shall not be eligible to receive Skill Development Allowance under this Scheme:

(a) State/Central Government employees and also those of the Public Sector Undertakings, Local Bodies and Quasi-Government Institutions who have been dismissed from service or are in receipt of pension from such employers and persons who have been imprisoned for 48 hours or more.

(b) A person who had any income of his own or whose family income from all sources was Rs. 2.00 lakh (Rs. Two Lakh) or more during the year immediately preceding the date of application and also the period for which Skill Development Allowance is claimed.

(c) A person who is not a Bonafide Himachali.

(d) A person who has not attained the age of 25 years and who has attained the age of 36 years.

(e) Any person who does not fulfill any of the criteria given in Section 3.

5. Rate of Skill Development Allowance.—Allowance shall be payable to each educated unemployed applicant for a maximum period of two years; subject to fulfilling eligibility criteria & timely submission of attested copies of matriculation & 10+2 marks sheet/certificate to ascertain age and educational qualification and self declaration as per form 'C', at the following rates:—

(a) For Physically Challenged person who have minimum 50% permanent disability recorded in her/his Employment Exchange record (X-I), @ Rs. 1500/- (Rs. One Thousand Five Hundred) per month.

(b) For all other categories of Persons @ Rs. 1000/- (Rs. One Thousand) per month.

6. Application for the allowance.—(a) An educated unemployed applicant may make an application on his/her being eligible for the grant of Allowance alongwith documents mentioned in form 'A' to the Officer incharge of the Employment Exchange, where she/he is registered.– as per form 'A'.

(b) A duly completed application form may be sent by post or delivered personally at the Employment Exchange against a receipt.- as per form'B'.

(c) After the initial filing of claim in the prescribed form 'A', every claimant to the Allowance shall be required to submit self declaration- as per form'C', in the subsequent month of March to the Employment Exchange where his/her name is registered.

7. Processing of applications.—(a) The Employment Exchange will thoroughly scrutinize applications received under Section 7 and decide with regard to the admissibility of the Allowance to the applicant, within 45 days and in case the claim is inadmissible, suitable orders shall be issued under intimation to the applicant. – as per form 'D'.

(b) If applicant is aggrieved by any decision intimated to her/him under sub-rule (a), she/he may file an appeal to the Director whose decision thereon shall be final.

8. Power to sanction Allowance.—The power to sanction Allowance shall vest in the Officer incharge of the concerned Regional/District Employment Exchange, who will also act as the Drawing and Disbursing Officer for the purpose of this Scheme :

(a) Stoppage or recovery of the Allowance:- The authority empowered to sanction the Allowance may:

(i) Stop the payment of the Allowance to any recipient, if the said Allowance is no more payable due to any change in the circumstances in which the same was sanctioned;

(ii) Withdraw or withhold the payment of Allowance if at any stage, it is discovered that the Allowance was not admissible in the first instance and it was sanctioned by mistake or on false information or in disregard of any condition subject to which it could be sanctioned. The amount of Allowance already paid may also be recovered without prejudice to any action, whether civil or criminal to which the recipient may be liable.

(b) In the event of the death of the recipient the Allowance shall cease to be payable and if the recipient dies before receiving any payment, the amount not so disbursed, shall lapse to the Government.

9. Restoration of the Allowance.—The concerned Regional/District Employment Officer may restore the payment of Allowance to the original recipient if the payment of the Allowance was discontinued due to the removal of her/his name from the Live Register but her/his employment index card is brought on the Live Register of the Employment Exchange without loss of seniority, as per Departmental instructions.

10. Remittance of Allowance.—The Allowance shall be credited to the recipient by RTGS/NEFT/ECS through Banks as mentioned in Application Form, on monthly basis at the cost of the Government.

11. Accounting procedure.—The following provisions shall regulate the accounting procedure in respect of the Allowance payable under this Scheme:—

(a) On receipt of a fresh application in form 'A' it shall be recorded in a receipt register (Form 'E') maintained specially for the purpose in each Employment Exchange. Each applicant shall be issued a receipt in form 'B' by the Employment Exchange indicating there in the receipt number of the application for all future correspondence.

(b) The Allowance shall become payable for the period commencing from the month of application (if eligible) till March of that Financial Year and thereafter on production1276 राजपत्र, हिमाचल प्रदेश, 29 मई, 2013/8 ज्येष्ठ 1935 of fresh self declaration in March of that Year or till the applicant becomes ineligible, whichever is earlier.

(c) The Drawing and Disbursing Officer shall sign the RTGS/NEFT/ECS form and initial the entries in the office cash book.

12. Allowance not enforceable through court of law.—The Allowance under this Scheme shall not be enforceable through the Court of Law.

13. Supervision.—The Director shall have the power of supervision and control in respect of the Allowance payable under this Scheme and may from time to time issue directions for the smooth functioning of this Scheme.

14. Power to amend the Scheme.—The power to amend this Scheme shall vest in the Government.

15. Displaying of Beneficiaries Detail.—The details of the beneficiaries may be displayed on the Notice Board of the Employment Exchanges, on the Department's website and at any other suitable place, for the information of public at large.

No. MC/SNR/ Bye Laws under sec (202)/2013-2274 .—The following Bye Laws under sec (202) of the H. P. municipal Act,1994 to Regulate the posting of Bills/Hoardings,1283 राजपत्र, हिमाचल प्रदेश, 29 मई, 2013/8 ज्येष्ठ 1935 Advertisement with in limits of M.C. made by the MC Sundernagar in exercise of the power conferred by section 216, 217 and Section 219 read with clause (y and z b) of sub section 202 of the Himachal Pradesh Municipal Act, 1994 (act No. 13 of 1994) as amended from to time to time are hereby published in the Rajpatra, Himachal Pradesh (extraordinary ) for the information of general public and notice is hereby given that the said draft bye-laws shall be considered by the MC Sundernagar after expiry of a period of 15 days from the date of its publication in the Rajpatra, Himachal Pradesh.

If any person, likely to be affected by these draft bye-laws had any, objection (s) against these draft rules, he may sent the written objections to the Executive officer/Secretary of concerned ULB, within the aforesaid period.

1. Short titles commencement and application.—These Bye-Laws may be called the "Bye-Laws" to regulate the posting of bills and fixing of advertisement, hoardings, sign boards etc. with in limits of Municipal Council, Sunder Nagar, 2013.

(i) These Bye-Laws shall come into force at once as per directions of the Hoh'ble High Court of H. P.

(ii) These Bye-Laws apply to Municipal Council, Sunder Nagar area.

2. Definition.—In theses Bye-Laws under contest other wise requires.

(a) "Act means the H.P. Municipal Act,1994.

(b) "Bills" means the poster, notice and advertisement printed on paper on board or painted on Hoardings, Sign Boards or Walls etc. and hung on poles etc.

(c) "Council" means the Municipal Council Sunder Nagar H. P.

(d) "Schedule means the schedule indicating the rate in respect on sIgn boards.

3. No person shall without the written permission of Executive Officer, Council, Sunder Nagar stick, fix or hung or cause to be fixed, stick of hung or paint bills, posters, advertisement, notice, even walls etc. over any place or property whether private or public street or road in contravention of following conditions:—

(i) Hoarding will not be allowed in the acquired width of the Nation/state high ways and other scheduled roads as they cause traffic h azard and are against the instruction of the Govt. of India and Hon'ble High Court.

(iii) No Hoarding advertisement should be put on the valley side above the road level(including on the roofs of buildings) to preserve the aesthetics, scenic beauty and the views of hills.

(iv) No hoardings, advertisement should be put the place where effects endangers the growth of flora.

(v) No hoardings should be located thickly wooded area and no any kind of hoarding should be placed on trees.

(vi) No hoarding ,advertisement should exceed dimension size 16Sq.meters.

(vii) No hoardings, advertisement should be against the guideline of the P.W.D. deptt.

(viii) No hoarding, advertisement should located near a water source.

(ix) No hoardings, advertisement should be in the form of writing engraving nailing and caving on any Natural of inanimate object.

(x) Only sinage of perimises are allowed upto 3m2 between slab and lintel of the building to the occupier/owner.

(xi) Discetional sign to Govt. Offices religious places will be allowed by the Municipal Council . The type, size and location of these shall be also approved by the Municipal Council. The council keeping in view requisite site clearness so that there is no traffic hazard due to installation of such board.

(xii) No hoardings, advertisement should be located/positioned to the road. No hoarding, advertisement should be located/positioned on a sharp "U" turn and behind turns.

(xiii) The beauty of nature formatters such as hills, rivers, trees, and rocks should not be destroyed by indiscriminate installation of commercial advertisements.

3. Exemption.—Private boards may be erected on respective premises by Govt. offices, Association or Mercantile firms for posting their own notices, advertisement etc.

4. Advertisement containing indecent picture or language shall not be allowed. Executive Officer, Municipal Council shall be the authority to decide as to the decency or other wise of the advertisement and the appeal against the decision shall be made to the President/Executive Officer, Municipal Council, Sunder Nagar whose decision shall be final.

5. Fee for permission.—A fee @ Rs.300/- per Sq.mt. shall be payable for every permission granted under Bye-Laws as minimum for per year. Cloth Banner @ Rs.100/- per Sq.mt. banner for seven days.

6. Penalty.—Breach of the Bye-Laws shall be punishable with fine which may extend to two thousanded rupees and when breach is continued which may be exceed to Rs.200/- for every day, after the first day during which the breach continued.

इस कार्यालय में श्री तिलक राज सूद पुत्र स्व0 श्री आज्ञा राम, निवासी वार्ड नं0 4, नगर परिषद्‌ रोहड़ू, तहसील रोहड़ू, जिला शिमला (हि0 प्र0) ने प्रार्थना-पत्र गुजार कर निवेदन किया है कि उनके पुत्र चेतन सूद का जन्म दिनांक 10-12-1983 को हुआ है लेकिन उसकी जन्म तिथि अज्ञानतावश नगर परिषद्‌ रोहड़ू के रिकॉर्ड में पंजी—त नहीं हुई है। अतः प्रार्थी के पुत्र चेतन सूद का नाम व जन्म तिथि दर्ज करने के आदेश नगर परिषद्‌ रोहड़ू को दिए जाएं।

हिमाचल प्रदेश सहकारी सोसाइटी अधिनियम, 1968 (1969 का अधिनियम संख्यांक 3) का और संशोधन करने के लिए अधिनियम।

भारत गणराज्य के चौंसठवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रुप में यह अधिनियमित हो :- 1. संक्षिप्त नाम और प्रारम्भ.--(1) इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश सहकारी सोसाइटी (संशोधन) अधिनियम, 2013 है।

(2) यह 14 फरवरी, 2013 को प्रवृत्त हुआ समझा जाएगा।

2. धारा 34 का संशोधन.--हिमाचल प्रदेश सहकारी सोसाइटी अधिनियम, 1968, (1969 का 3) की धारा 34 की उपधारा (2) के प्रथम और द्वितीय परन्तुक का लोप किया जाएगा और तत्पश्चात्‌ निम्नलिखित नई उपधाराएं (2-क) और (2-कक) अन्तःस्थापित की जाएंगी, अर्थात्‌ः-

''(2-क) प्रबन्ध समिति, यथाशक्य शीघ्र, इसके निर्वाचित या नामनिर्दिष्ट सदस्यों में से प्रबन्ध समिति के, यथास्थिति, अध्यक्ष, उपाध्यक्ष या प्रधान, उप-प्रधान निर्वाचित करेगी। (2-कक) उपधारा (2-क) में अन्तर्विष्ट किसी बात के होते हुए भी, जहां राज्य सरकार ने- (i) किसी सहकारी सोसाइटी की शेयर पूंजी का अभिदान; या

(ii) धारा 48 के अधीन यथा उपबन्धित सहकारी सोसाइटी की शेयर पूंजी के निर्माण या संवर्धन में अप्रत्यक्षतः सहयोग; या

(iii) किसी सोसाइटी को मूल रकम के प्रतिसंदाय और ऋणों तथा अग्रिमों पर ब्याज के संदाय की गारंटी,

पचास लाख रूपए तक या इससे अधिक किया है या दी है, तो वहां राज्य सरकार, धारा 35 के अधीन नामनिर्दिष्ट किसी एक सदस्य को ऐसी सोसाइटी की प्रबन्ध समिति के अध्यक्ष के रूप में नियुक्त कर सकेगीः

परन्तु प्रबन्ध समिति का कोई भी सदस्य, ऐसी सहकारी सोसाइटी की प्रबन्ध समिति के अध्यक्ष या उपाध्यक्ष या प्रधान या उप-प्रधान के रूप में निर्वाचित या नियुक्त किए जाने के लिए पात्र नहीं होगा, यदि ऐसा सदस्य राज्य सरकार में मन्त्री है।''। 1306 राजपत्र, हिमाचल प्रदेश, 29 मई, 2013/8 ज्येष्ठ 1935 3. 2013 के अध्यादेश संख्यांक 1 का निरसन और व्यावृत्तियां.--(1) हिमाचल प्रदेश सहकारी सोसाइटी (संशोधन) अध्यादेश, 2013 का एतद्‌द्वारा निरसन किया जाता है।

(2) ऐसे निरसन के होते हुए भी इस प्रकार निरसित अध्यादेश के अधीन की गई कोई कार्रवाई या बात इस अधिनियम के तत्स्थानी उपबन्धों के अधीन विधिमान्य रूप से की गई समझी जाएगी।

Act No. 24 of 2013 THE HIMACHAL PRADESH CO-OPERATIVE SOCIETIES (AMENDMENT)

ACT, 2013

(AS ASSENTED TO BY THE GOVERNOR ON 20TH OF MAY, 2013)

AN

ACT

further to amend the Himachal Pradesh Co-operative Societies Act, 1968 (Act No.3 of

1969).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-fourth Year of the Republic of India as follows:—

1. Short title and commencement.— (1) This Act may be called the Himachal Pradesh Co-operative Societies (Amendment) Act, 2013.

(2) It shall be deemed to have come into force on 14th day of February, 2013.

2. Amendment of section 34.—In section 34 of the Himachal Pradesh Co-operative Societies Act, 1968, (3 of 1969) in sub-section (2), the first and second provisos shall be omitted and thereafter, the following new sub-sections (2-A) and (2-AA) shall be inserted, namely:—

"(2-A). The managing committee shall, as soon as may be, elect from amongst its elected or nominated members a Chairman, Vice-Chairman; or a President, Vice-President, as the case may be, of the managing committee.

(2-AA). Notwithstanding anything contained in sub-section (2-A), where the State Government has—

(i) subscribed to the share capital of a co-operative society, or

(ii) assisted indirectly in the formation or augmentation of the share capital of a co- operative society as provided under section 48, or1307 राजपत्र, हिमाचल प्रदेश, 29 मई, 2013/8 ज्येष्ठ 1935 (iii) guaranteed the repayment of principal amount and payment of interest on loans and advances to a society,

to the extent of rupees fifty lakhs or more, the State Government may appoint, one of the members nominated under section 35, as Chairman of the managing committee of such society:

Provided that no member of a managing committee shall be eligible to be elected or appointed as Chairman or Vice-Chairman or President or Vice-President of the managing committee of such society, if such member is a Minister in the State Government.". 3. Repeal of Ordiance No. 1 of 2013 and savings.—(1) The Himachal Pradesh Co- operative Societies (Amendment) Ordinance, 2013 is hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under the Ordinance so repealed shall be deemed to have been done or taken under the corresponding provisions of this Act.
