संख्या पी.बी.डब्लयू(बी)एफ (5)34/2012.--यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि हिमाचल प्रदेश सरकार को सरकारी व्यय पर सार्वजनिक प्रयोजन हेतु नामत गांव आंसला, तहसील सुजानपुर, जिला हमीरपुर में आंसला से कंगरी वाया सौड़ सड़क के निर्माण हेतु भूमि अर्जित करनी अपेक्षित है, अतएव एतद्‌द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है, उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है।

2. यह अधिसूचना ऐसे सभी व्यक्तियाें को, जो इससे सम्बन्धित हो सकते हैं, की जानकारी के लिए भू-अर्जन अधिनियम, 1894 की धारा, 4 के उपबन्धाें के अन्तर्गत जारी की जाती है।

महोदय,

निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार अधिनियम-2009 की धारा-13(1) व (2) के अनुसार (इसमें इसके प्श्चात अधिनियम उल्लिखित) निर्देश दिए जाते हैं कि अधिनियम के धारा-2 के खण्ड (एन) के उप खण्डों (i) (ii) (iii) तथा (iv) में वर्ण्ाित कोई भी व्यक्ति या स्कूल बच्चे या उसके माता-पिता को चयन प्रक्रिया हेतु बाध्य नहीं करेगा जैसा कि अधिनियम के धारा-2(ओ) में परिभाषित है। इसके अतिरिक्त जहां स्कूल बच्चे को पूर्व प्राथमिक स्तर पर प्रवेश देता है वहां ऐसे दाखिले उस स्तर पर अधिनियम धारा 2(ओ) के अनुसार होंगे।

धारा-13(1) तथा धारा-2(ओ) के प्रावधान का उद्देश्य यह सुनिश्चित करना है कि सभी स्कूल एक भेदभाव रहित, तर्क संगत तथा पारदर्शी दाखिला प्रक्रिया अपनाए तथा वह बच्चों को प्रवेश देने या न देने का निर्णय लेने के लिए बच्चों व उनके माता-पिता को प्रवेश परीक्षा एवं साक्षात्कार के लिए बाध्य नहीं करें। आमतौर पर प्रवेश परीक्षा एवं साक्षात्कार बच्चे को प्रवेश देने या न देने का एक आधार होता है, अतः बच्चे की बुद्धिमता को जांचने के लिए छंटनी प्रक्रिया पर प्रतिबन्ध होना चाहिए। शिक्षा का अधिकार अधिनियम इस विश्वास पर आधारित है कि विभिन्न सामाजिक एवं आर्थिक पृष्ठ भूमि से संबंध रखने वाले बच्चों को समान अवसर उपलब्ध होने से हमारे संविधान में निहित समानता की धारणा सशक्त होगी तथा यह भी सुनिश्चित होगा कि बच्चों से सामाजिक अथवा आर्थिक पृष्ठभूमि या किसी भी प्रकार के आधार पर भेदभाव नहीं होता है। सजातीय या अपवर्जक (वर्जित करने वाले) स्कूलों की बजाय विविध पृष्ठभूमि से आए बच्चों के साथ समावेशित/संयुक्त कक्षा-कक्षों का रूख करने की आवश्यकता है। यह एक शैक्षिणिक तथ्य है कि कक्षा-कक्ष में विभिन्नता से अधिक रचनात्मकता आती है।

अतः इन उद्देश्यों के दृष्टिगत निम्न मार्गदर्शन दिया जाता है :

कक्षा एक (या पूर्व प्राथमिक) में दाखिले के लिए सभी स्कूल प्राप्त आवेदनों में से बिना सोची समझी चयन प्रणाली (random selection) अपनाएंगे। प्रत्येक स्कूल एक नीति बनाएगा जिसके तहत प्रवेश दिया जाएगा इस नीति में तर्कसंगत, उचित एवं न्यायसंगत आधार पर स्कूल के उद्देश्यों के दृष्टिगत आवेदनों के वर्गीकरण के मानदण्ड भी शामिल होने चाहिए। अभिभावकों की शैक्षणिक योग्यताओं के आधार पर बच्चों का चयन किसी भी रूप में नहीं होगा । स्कूल द्वारा अपनाई गई नीति जनसाधारण की पहुंच में होनी चाहिए। उसे व्यापक प्रचार मिलना चाहिए तथा स्कूल प्रोस्पेक्टस में स्पष्ट रूप में उल्लेखित होनी चाहिए। कोई भी बच्चा या अभिभावक किसी श्रेणी विशेष में आते हों या नहीं की परीक्षा या साक्षात्कार नहीं लिया जाएगा। चयन पूर्णतया random आधार पर होगा । दाखिला इसी आधार पर पूरी सख्ती के साथ होना चाहिए।

इन दिशा-निर्देशों की अनुपालना से असन्तुष्ट कोई भी व्यक्ति इस संबन्ध में सरकार द्वारा अधिसूचित सक्षम प्राधिकारी द्वारा घारा-36 के तहत अभियोजन स्वीकृति प्राप्त कर संबंधित क्षेत्र के न्यायिक मजिस्टे्रट के पास शिकायत दर्ज कर सकता है ।

Subject:— Guidelines under section 13(1) of the Right of Children to Free and Compulsory Education Act, 2009-regarding procedure for admission in schools.

Sir,

In pursuance of Section 13(1) &(2) of the Right of Children to Free and Compulsory Education Act, 2009(herein after referred to as the Act) it is directed that no person or a school which is a school specified in sub-clause(i),(ii),(iii) or (iv) of clause(n) of section 2 of the Act, shall subject the child or his/her parents to any screening procedure as defined in Section 2(o) of the Act. Further where the school admits children at pre-primary level, such admissions shall be made at that level in accordance with Section 2(o) of the Act.

The objective of the provisions of section 13(1) read with section 2(o) is to ensure that all schools adopt an admission procedure which is non-discriminatory, rational and transparent and that schools do not subject children and their parents to admission tests and interviews in order to decide whether they will admit a child or not. Admission tests and interviews are generally a tool for profiling and eliminating children, and therefore, screening to assess a child's intelligence should be prohibited. The RTE Act is anchored in the belief that availability of equal education opportunities to children belonging to different social and economic background will reinforce the idea of equality and enshrined in our Constitution and ensure that children are not discriminated on the basis of social or economic background or any such criteria. There is need for moving towards composite classrooms with children from diverse backgrounds rather than homogeneous and exclusivist schools. It is an academically established point that heterogeneity in the classroom leads to greater creativity.

Keeping these objectives in view the following guidelines are issued:

For admission in class 1(or pre-primary class as the case may be) all schools shall follow a system of random selection out of the application received. Each school should formulate a policy under which admissions will take place. This policy should include criteria for categorization of applicants in terms of the objectives of the school on a rational, reasonable and just basis. There shall be no profiling of the children based on parental educational qualifications. The policy should be placed by the school in the school public domain, given wide publicity and explicitly stated in the school prospectus. There shall be no testing or interviews for any child/parent falling within or1386 राजपत्र, हिमाचल प्रदेश, 31 मई, 2013/10 ज्येष्ठ 1935 outside the categories and selection would be on a random basis. Admission should be made strictly on this basis.

Any person aggrieved on account of non-compliance of these guidelines by the school may file a complaint with the Judicial Magistrate of the area concerned after obtaining prosecution sanction under section-36 from the competent authority notified by the Government in this regard.

(बी) शिक्षा का अधिकार संरक्षण प्राधिकरण (रेपा) के कार्य एवं अधिकारिताः

रेपा मॉनीटर करेगा कि हिमाचल प्रदेश राज्य में निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार अधिनियम, 2009 के अन्तर्गत 6 से 14 वर्ष की आयुवर्ग के बच्चों को प्रदत्त अधिकार/विधिक हकदारी उनके लिए सुनिश्चित हो गए हैं ।

(सी) शिक्षा का अधिकार संरक्षण प्राधिकरण हिमाचल प्रदेश के समक्ष शिकायतें प्रस्तुत करने की रीति : कोई भी व्यथित व्यक्ति सदस्य सचिव रेपा के पास अपनी शिकायत को लिखित रूप में/फैक्स/ई-मेल द्वारा नीचे दिए गए पते पर प्रस्तुत कर सकता हैः--

No. EDN-C- A(3)-3/2011.— In exercise of the powers conferred under Section 31(3) of the Right of Children to Free and Compulsory Education Act, 2009 read with Rule 20 of the HP State RTE Rules 2011, the Governor Himachal Pradesh is pleased to constitute the Right to Education Protection Authority for the State of Himachal Pradesh as follows :

(B) The Functions and the Jurisdiction of REPA :

The REPA will monitor that the rights/legal entitlements conferred upon the children of 6 to 14 years age group under Right of Children to Free and Compulsory Education Act are ensured to them in the state of Himachal Pradesh.

Subject:— Guidelines under section 13(1) of the Right of Children to Free and Compulsory Education Act, 2009-regarding procedure for admission in schools.

Sir,

In pursuance of Section 13(1) &(2) of the Right of Children to Free and Compulsory Education Act, 2009(herein after referred to as the Act) it is directed that no person or a school which is a school specified in sub-clause(i),(ii),(iii) or (iv) of clause(n) of section 2 of the Act, shall subject the child or his/her parents to any screening procedure as defined in Section 2(o) of the Act. Further where the school admits children at pre-primary level, such admissions shall be made at that level in accordance with Section 2(o) of the Act.

The objective of the provisions of section 13(1) read with section 2(o) is to ensure that all schools adopt an admission procedure which is non-discriminatory, rational and transparent and that schools do not subject children and their parents to admission tests and interviews in order to decide whether they will admit a child or not. Admission tests and interviews are generally a tool for profiling and eliminating children, and therefore, screening to assess a child's intelligence should be prohibited. The RTE Act is anchored in the belief that availability of equal education opportunities to children belonging to different social and economic background will reinforce the idea of equality and enshrined in our Constitution and ensure that children are not discriminated on the basis of social or economic background or any such criteria. There is need for moving towards composite classrooms with children from diverse backgrounds rather than homogeneous and1392 राजपत्र, हिमाचल प्रदेश, 31 मई, 2013/10 ज्येष्ठ 1935 exclusivist schools. It is an academically established point that heterogeneity in the classroom leads to greater creativity.

Keeping these objectives in view the following guidelines are issued:

For admission in class 1(or pre-primary class as the case may be) all schools shall follow a system of random selection out of the application received. Each school should formulate a policy under which admissions will take place. This policy should include criteria for categorization of applicants in terms of the objectives of the school on a rational, reasonable and just basis. There shall be no profiling of the children based on parental educational qualifications. The policy should be placed by the school in the school public domain, given wide publicity and explicitly stated in the school prospectus. There shall be no testing or interviews for any child/parent falling within or outside the categories and selection would be on a random basis. Admission should be made strictly on this basis.

Any person aggrieved on account of non-compliance of these guidelines by the school may file a complaint with the Judicial Magistrate of the area concerned after obtaining prosecution sanction under section-36 from the competent authority notified by the Government in this regard.

Subject:— Directions for special training as per the provisions contained in section-4 of the Right of Children to Free and Compulsory Education Act, 2009.

Sir,

I am directed to say that in exercise of the powers conferred under Section 35(2) of the Right of Children to Free and Compulsory Education Act, 2009 (herein after referred to as the Act) and in view of provisions contained in section -4 of the Act read with Rule 3 contained in H.P. State Right of Children to Free and Compulsory Education, Himachal Pradesh Rules 2011 notified vide Notification No. EDN-C-F10)-8/09 dated 5th March, 2011, the following procedure is1393 राजपत्र, हिमाचल प्रदेश, 31 मई, 2013/10 ज्येष्ठ 1935 specified for imparting special training to the child who is directly admitted into a class appropriate to her/his age or to a child who is not having competencies corresponding to the class in which she/he is enrolled.

(1) Every year the Centre Head Teacher in case of children within the age group of 6-11 years and the concerned school head in case of children in the age group of 12-14 years, will get conducted, a survey to identify the children in the respective age group who have never been enrolled in any school or who are dropouts from any of the elementary classes.

(2) The particulars of such children shall be entered in the Village Education Register maintained by the concerned S.M.C.

(3) The children thus identified will be enrolled in the nearest neighborhood school and thereafter they will be put to a test to assess the competencies, they have acquired and the class to which their competencies correspond.

(4) On the basis of their achievement levels such children will be imparted special training based on a residential or non-residential bridge course so as to achieve the learning levels in such children corresponding to their age appropriate class. Such special training may last from minimum three months to two years depending upon the learning gap and the pace of learning of such children.

(5) The bridge course material developed in accordance with the guidelines of the academic authority for the elementary classes will be used for imparting special training which in turn will be classified into the following levels:

(a) Level I material from classes 1 and 2(age 6-7 years); (b) Level II material for classes 3 and 4(age 8-9 years); (c) Level III material for class 5th (age 10-11 years) (d) Level IV for class 6th (age 11-12 years) (e) Level V for class 7th (age 12-13 years) (f) Level VI for class 8th (age 13 years and above up to the age of 18 years).

(6) Special training will be imparted by the NRBC instructors especially recruited for the purpose in special Non Residential Bridge course centers or the regular teachers in the schools as the case may be. Appropriate TLM, various activities including the filed visits, discussions, linkage with local knowledge and other child friendly methods will also be used for promoting proper understanding amongst the children.

(7) For regular assessment of the learning levels and the improvement therein, the baseline, mid-term and end term assessment will be conducted by the concerned NRBC instructor or the teacher in the supervision of Head of the Institution/Centre Head Teacher/Head Teacher and complete record related to the progress of the child shall be maintained in the concerned school in a separate register in the following format:—

(8) As and when the child acquires the age appropriate class level of competencies, the child will be imparted further elementary education in accordance with the procedure laid down in section 29 of the Act till the completion of elementary education.

Shimla-2, the 31st May, 2013

No.Fin-2-C-(12)-1/2013.—Government of Himachal Pradesh hereby notifies the sale of Himachal Pradesh Government Stock (securities) of 10-year tenure for an aggregate amount of ` 600.00 crore (Nominal). The sale will be subject to the terms and conditions spelt out in this notification (called specific Notification) as also the terms and conditions specified in the General Notification No.Fin-2-C(12)-11/2003 dated July 20, 2007 of Government of Himachal Pradesh.

Object of the loan

1. (i) The proceeds of the State Government Securities will be utilized for the development programme of the Government of Himachal Pradesh.

(ii) Consent of Central Government has been obtained to the floatation of this loan as required by Article 293 (3) of the Constitution of India.

Method of Issue

2 Government Stock will be sold through the Reserve Bank of India, Mumbai Office (PDO) Fort, Mumbai-400 001 by auction in the manner as prescribed in paragraph 6.1 of the General Notification No.Fin-2-C(12)-11/2003, dated July 20, 2007 at a coupon rate to be determined by the Reserve Bank of India at the yield based auction under multiple price format.

Allotment to Non-Competitive Bidders

3. The Government Stock upto 10% of the notified amount of the sale will be allotted to eligible individuals and institutions subject to a maximum limit of 1% of the notified1395 राजपत्र, हिमाचल प्रदेश, 31 मई, 2013/10 ज्येष्ठ 1935 amount for a single bid as per the Revised Scheme for Non Competitive Bidding Facility in the Auctions of State Government Securities of the General Notification (Annexure-II).

Place and Date of Auction

4. The auction will be conducted by the Reserve Bank of India, at its Mumbai Office, Fort, Mumbai-400 001 on June 04, 2013. Bids for the auction should be submitted in electronic format on the Reserve Bank of India Core Banking Solution (E-Kuber) System as stated below on June 04, 2013.

(a) The competitive bids shall be submitted electronically on the Reserve Bank of India Core Banking Solution (E-Kuber) System between 10:30AM and 12:00 PM.

(b) The non-competitive bids shall be submitted electronically on the Reserve Bank of India Core Banking Solution (E-Kuber) System between 10:30 AM and 11:30 AM.

Result of the Auction

5. The result of the auction shall be displayed by the Reserve Bank of India on its website on the same day. The payment by successful bidders will be on June 05, 2013.

Method of Payment

6. Successful bidders will make payments on June 05, 2013 before close of banking hours by means of cash, bankers' cheque/pay order, demand draft payable at Reserve Bank of India, Mumbai/New Delhi or a cheque drawn on their account with Reserve Bank of India, Mumbai(Fort)/New Delhi.

Tenure

7. The Stock will be of 10-year tenure. The tenure of the Stock will commence on June 05, 2013.

Date of Repayment

8. The loan will be repaid at par on June 05, 2023.

Rate of Interest

9. The cut-off yield determined at the auction will be the coupon rate percent per annum on the stock sold at the auction. The interest will be paid on December 05 and June 05.

Eligibility of Securities

10. The investment in Government Stock will be reckoned as an eligible investment in Government Securities by banks for the purpose of Statutory Liquidity Ratio (SLR) under Section 24 of the Banking Regulation Act, 1949. The stocks will qualify for the ready forward facility.

Shri Rajeev Gupta s/o Sh. Tara Pati, r/o H. No. 312/12, Ram Nagar, Mandi Town, District Mandi, Himachal Pradesh and Smt. Harsha Gupta d/o Shri Bala Nand Gupta, r/o V. P. O. Churag, Tehsil Karsog, District Mandi, Himachal Pradesh (at present wife of Shri Rajeev Gupta s/o Sh. Tara Pati, r/o H. No. 312/12, Ram Nagar, Mandi Town, District Mandi, Himachal Pradesh) have filed an application alongwith affidavits in the court of undersigned under section 15 of Special Marriage Act, 1954 that they have solemnized their marriage on 7-5-1989 according to Hindu rites and customs at their respective houses and they are living together as husband and wife since then, hence their marriage may be registered under Special Marriage Act, 1954.

Therefore, the general public is hereby informed through this notice that any person who has any objection regarding this marriage can file the objection personally or in writing before this court on or before 17-6-2013 after that no objection will be entertained and marriage will be registered.

The general public of the concerned area is hereby called upon to file objection, if any regarding correction of name of above Kumari Trashi in her birth record in M. C. Solan in place of Atyantika in writing to this office.
