No. Home(A)-A (3)-2/2012.—In supersession to this department order of even number dated 06-03-2013and in exercise of the powers conferred by sections 26 and 37 of the Himachal Pradesh Police Act 2007, (Act No. 17 of 2007) the Governor, Himachal Pradesh is pleased to make the following order to specify Uniform and badges for Non-Gazetted-Police Officers Grade-I and Grade-II of Himachal Pradesh Police Department, namely:—
1. Short titled application and Commencement.—(1) This Order may be called the Himachal Pradesh Police Department Uniform and Badges Order, 2013.
(2) This Order shall be applicable to the Non- Gazetted-Police Officers Grade-I and Grade-II of the Police Department Himachal Pradesh.
(3) This Order shall come into force from the date of its publication in the Official Gazette.
2. Muster pattern of supply of Articles of Uniform.—The Non-Gazetted Police Officers shall be supplied Uniform and equipment articles as specified in following table:

NOTIFICATION

No. NPT (Bye-Laws)/2013-755.—In exercise of the powers conferred by Section 217 read with clause ( o ) of sub section 202 of Himachal Pradesh Municipal Act, 1994 (Act No.13 of 1994) as amended from time to time the Posting of Bills, Hoardings, Advertisement Bye-Laws having been formulated and approved by the Nagar Panchayat Talai, Distt. Bilaspur, H.P. are hereby published in the Rajpatra, Himachal Pradesh (extraordinary) for information of general public and notice is hereby given that the said draft bye-laws shall be considered by the Nagar Panchayat after expiry of a period of 30 days from the date of their publication in the Rajpatra Himachal Pradesh.
If any person, likely to be affected by these draft bye-laws has any objection(s) against these draft byelaws, he may send written objections to the Secretary, Nagar Panchayat within the aforesaid period.
Objections, if any, received within the period as specified above, shall be taken into consideration by the Nagar Panchayat, before finalizing these bye-laws namely:—
Nagar Panchayat Talai (To regulate the Posting of Bills, Hoardings, Advertisement etc.)
Bye-Laws-2013
1. Short titles commencement and Application.—These By-Laws may be called the "Bye-Laws" to regulate the posting of bills and fixing of advertisement, hoardings. sign boards etc. within Talai Nagar Panchayat limits, 2013.
1. These Bye Laws shall come into force after final publication in the Rajpatra, Himachal Pradesh.
2. These Bye Laws shall apply to Nagar Panchayat Talai area.
2. Defination.—In these Bye-Laws under the contest otherwise requires.
(a) "Act" means the Himachal Pradesh Municipal Act, 1994.
(b) "Bills" means any poster , notice and advertisement printed on paper or board or painted on Hoarding sign boards or walls etc. and hang on poles painted on walls etc., (c) "Panchayat" means the Nagar Panchayat Talai Distt. Bilaspur H.P.
(d) "Schedule" means the schedule indicating the rate in respect of sign boards.
3. No person shall with out the written permission of the Secretary Nagar Panchayat Talai stick, fix or hang or cause to be fixed , stick of hangs or paint bills posters, advertisement, notice, even walls etc. over any place or property whether private or public street or road in contravention of following conditions:—
(i) Hoarding advertisement/banners will not be allowed in the acquired width of the National/Sate High ways other schedule roads and foot path as they cause traffic hazard and are against the instruction of the Govt. of India and Hon'ble Court.

(iii) No hoarding , advertisements should be put on the Baba Balak Nath Ji Temple side above the road level including on the roof of buildings to preserve the aesthetic scenic beauty and the view of Temple.
(iv) No hoarding, advertisement should be put the place where effects endangers the grown of flora.
(v) No hoarding should be located in thickly wooded area and no any kind of hoarding should be placed on trees.
(vi) No hoarding advertisement should exceed dimension size of 16 Sqm.
(vii) No hoarding, advertisement, banners should be put up in contravention of any law& rules against the guidelines notified be any department.
(viii) No hoarding, advertisement should locate near a water source.
(ix) No hoarding, advertisement should be in the form of writing engraving nailing and carving on any Natural of inanimate object.
(x) No hoarding /advertisement /banner will allowed on the roofs of buildings.
(xi) Only singe of premises are allowed up to 3 Sqm. between slab and lintel of the building to the occupier/owner.
(xii) Discretional sign to the Govt. offices religious places will be allowed by the Nagar Panchayat. The type, size and location of these shall be also approved by the Panchayat. The Panchayat keeping in view requisite site clearness so that there is no traffic hazard due to installation of such board.
(xiii) No person shall without the written permission of the Secretary , stick fix or hang or cause to be stuck /fixed or hanged hoarding, advertisement, banner notice etc. over any place or property whether private or public street or road.
(xiv) The Panchayat shall provide notice board for the purpose of sticking fixing or hanging posters notice and advertisement which shall be available for use on an application to be made to the Secretary on payment of fee provided for in these bye laws.
(xv) No hoarding, advertisement should be located /positioned on a sharp turn "U" turn and blind turns.
(xvi) The beauty of nature for matters such as hills, rivers and rock should not be destroyed by indiscriminate installation of commercial advertisement.
(xvii) No writing/defacing of retaining walls and parapets could be allowed.
EXEMPTIONS:
Shopkeepers/traders/firms/company could be allowed to place hoarding/ advertisement/banners at shop/office on his own land with permission of Nagar Panchayat Talai after depositing requisite fee.

Penalties.—Who so ever commits any of breach of any of the Bye-Laws shall be punishable with fine, Which may extend to twenty five rupees to two hundred fifty rupees and when breach is a continuing one with a further fine, which may extend to Rs.25/- for every day , after the first day during which the breach continuous.

अपील आदेश दिनांक 23-4-2011 सहायक समाहर्ता तहसील बंगाणा, जिला ऊना, हिमाचल प्रदेश, 44/पी0बी0टी0/2010 शीर्षक विमला बनाम अंकुश कुमार आदि, गांव धुन्दला, तहसील बंगाणा, जिला ऊना, हिमाचल प्रदेश।
उपरोक्त विषय पर प्रतिवादीगण नं0 2 ता 28 को समन जारी किए गए, लेकिन तामील साधारण तरीके से नहीं हो पा रही है इस अदालत को पूर्ण विश्वास हो चुका है कि उक्त समस्त प्रतिवादीगण की तामील साधारण ढंग से नहीं हो सकती। 1584 राजपत्र, हिमाचल प्रदेश, 10 जून, 2013/20 ज्येष्ठ 1935 अतः इस इश्तहार हि0 प्र0 राजपत्र के माध्यम से प्रतिवादीगण नं0 2 ता 28 को सूचित किया जाता है कि वह निर्धारित तिथि पेशी दिनांक 29-6-2013 को दोपहर 2.00 बजे इस अदालत में असालतन या वकालतन उपस्थित आकर उक्त मुकद्दमा की पैरवी करें। हाजिर न आने की सूरत में उनके विरुद्ध यक तरफा कार्यवाही अमल में लाई जाएगी तथा मुकद्दमा हजा का निर्णय कर दिया जाएगा।
आज दिनांक 10-5-2013 को मेरे हस्ताक्षर व मोहर अदालत द्वारा जारी किया गया।
