संख्या टी0पी0टी0-एफ (4)1/2008-11.- हिमाचल प्रदेश मोटरयान नियम, 1999 में संशोधन करने हेतु प्रारूप अधिसूचना को, मोटरयान अधिनियम, 1988 की धारा 212 की उपधारा (1) के अधीन यथापेक्षित के अनुसार उससे सम्भव्य प्रभावित व्यक्तियों से इसके राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से तीस दिन की अवधि के भीतर आक्षेप या सुझाव आमंत्रित करने के लिए तारीख 24-4-2013 के राजपत्र, हिमाचल प्रदेश में प्रकाशित किया गया था;

उपरोक्त नियत अवधि के भीतर प्राप्त आक्षेप (पों) या सुझाव (वों) पर विचार किया गया है; 63-राजपत्र/2013-22-06-2013 (1711)1712 राजपत्र, हिमाचल प्रदेश, 22 जून, 2013/1 आषाढ़ 1935 अतः हिमाचल प्रदेश की राज्यपाल पूर्वाक्त अधिनियम की धारा 96 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए हिमाचल प्रदेश मोटरयान नियम, 1999 में और संशोधन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ः-

1. संक्षिप्त नाम.-इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश मोटरयान (संशोधन) नियम, 2013 है। 2. नियम 73 का सशोंधन.-हिमाचल प्रदेश मोटरयान नियम, 1999 (जिन्हें इसमें इसके पश्चात्‌ "उक्त नियम" कहा गया है) के नियम 73 में खण्ड (6) के पश्चात्‌ निम्नलिखित खण्ड जोड़े जाएंगे, अर्थात्‌ः- "(7) मंजिली गाड़ी अनुज्ञापत्र" का धारक, विशेष प्रर्वग यात्री (एस.सी.पी.) हेतु सीटों के आरक्षण की बावत सरकार द्वारा जारी किसी निदेश (निदेशों) का, उक्त निदेश (निदेशों) में जैसे विनिर्दिष्ट किया जाए, वैसे पालन करेगा; और

गाड़ी अनुज्ञापत्र का धारक बस के भीतर और बाहर, सार्वजनिक सूचना के प्रदर्शन की बाबत सरकार द्वारा जारी किसी निदेश (निदेशों) का, उक्त निदेशों में जैसे विनिर्दिष्ट किया जाए, वैसे पालन करेगा"।

3. नियम 90 का संशोधन.-उक्त नियमों के नियम 90 में उप-नियम (1) में खण्ड (28) के पश्चात्‌ और "तो" शब्द से पूर्व निम्नलिखित खण्ड जोड़ा जाएगा, अर्थात्‌ः-

"(29) नियम 73 के अधीन यथा विनिर्दिष्ट विशेष प्रवर्ग यात्री (एस.सी.पी) के प्रवर्ग से संबन्धित न हो और बस के परिचालक या चालक के कहने पर उक्त प्रवर्ग के पक्ष में आरक्षित किसी सीट को रिक्त करने से मना करता है;"।

NOTIFICATION

Shimla-2, the 21st July, 2013

No.TPT-F(4)1/2008-II.—Whereas the draft notification regarding carrying out amendments in the Himachal Pradesh Motor Vehicle Rules, 1999 was published in Rajpatra, Himachal Pradesh dated 24th April, 2013 for inviting objection(s) or suggestion(s) from the persons(s) likely to be affected thereby with in a period of 30 days from the date of its publication in the Rajpatra, Himachal Pradesh, as required under sub-section (1) of section 212 of the Motor Vehicle Act, 1988;

And Whereas the objection(s) or suggestion(s) received within the above stipulated period have been considered.

Now therefore, in exercise of the powers conferred by section 96 of the Act ibid, the Governor, Himachal Pradesh, is pleased to make the following rules further to amend the Himachal Pradesh Motor Vehicle Rules, 1999, namely :

1. Short title.—These rules may be called the Himachal Pradesh Motor Vehicle (Amendment) Rules, 2013.

2. Amendment of rule 73.—In rule 73 of the Himachal Pradesh Motor Vehicle Rules, 1999 (hereinafter referred to as the "said rules"), after clause (vi), the following clause shall be added, namely:—

"(vii) the holder of a stage carriage permit shall comply with any direction(s) issued by the Government regarding reservation of seats for Special Category Passenger (SCP), as may be specified in the said direction(s); and

(viii) the holder of a stage carriage permit shall comply with any direction(s) issued by the Government regarding display of public information within and outside the bus as may be specified in the said direction(s)."

3. Amendment of rule 90.— In rule 90 of the said rules, in sub-rule (1), after clause (xxviii), the following clause shall be added namely :—

"(xxix) does not belong to the Special Category Passenger (SCP) as specified under rule 73 and refuses to vacate a seat reserved in favour of the said category upon being asked by either the conductor or the driver of the bus;"

No.LLR-E(9)2/2012.—The Governor Himachal Pradesh is pleased to order that Shri Rishi Tandon Advocate, will represent the State of H.P. in Central Administrative Tribunal at Chandigarh as Advocate for Civil and Criminal case with immediate effect.

The engagement is purely at the pleasure of the State Government and can be withdrawn at any stage without assigning any reasons thereof.

The fee structure and other terms and conditions as contained in Notification No. LLR-E(9)- 2/2012 dated 31st July, 2012 would continue to apply to him also.

Staff Strength for Himachal Pradesh Commission for Protection of child rights in H. P.

The posts mentioned at Sr. No. 4, &5 shall be filled up either on secondment basis or from retirees having the age of not more than 62 years or by outsourcing basis. The post at Sr. No. 6 shall be filled up through outsourcing basis only.

NOTIFICATION

Date the, 27th April, 2013

No. SJE-F(5)-7/2006.—In pursuance of Section 17(1) of the Commissions for Protection of Child Rights Act, 2005 No. 4 of 2006, the Governor of Himachal Pradesh is pleased to constitute Himachal Pradesh Commission for Protection of Child Rights with immediate effect with its headquarter at Shimla.

The Commission shall consist of the following Members:—

(a) A chairperson who is a person of eminence and has done outstanding work for promoting the Welfare of Children; and

(b) A Member Secretary who is an officer not below the rank of the Secretary to the State Government; and

(c) Six members, out of which at least two shall be women, from the following fields, to be appointed by the State Government from amongst persons of eminence, ability, integrity, standing and experience in,-

(i) Education;

(ii) child health, Care, welfare or child development;

(iii) juvenile justice or care of neglected or marginalized children or children with disabilities;

(iv) elimination of child labour or children in distress;

(v) child psychology or sociology; and

(vi) laws relating to children.

Tenure of the office of the Chairperson and every Member shall be for a term of three years from the date on which he/she assumes office; provided that no Chairperson or a Member shall hold the office for more than two terms: provided further that no Chairperson or any other Member shall hold office as such after he has attained :—

(a) in the case of Chairperson, the age of sixty-five years; and

(b) in the case of a Member, the age of sixty years.

सं0 100/हि0 प्र0-लो0स0/1/2013.-यतः, हिमाचल प्रदेश राज्य से लोक सभा में उस राज्य के 2-मण्डी लोक सभा निर्वाचन क्षेत्र से निर्वाचित, श्री वीरभद्र सिंह, का स्थान उनके त्यागपत्र देने के परिणामस्वरूप तारीख 1 जनवरी, 2013 को रिक्त हो गया है; और

2. यतः, इस प्रकार हुई रिक्ति को भरने के प्रयोजन से आयोग की दिनांक 29 मई, 2013 की समसंख्यांक अधिसूचना के द्वारा उप-निर्वाचन कराया जाना घोषित किया गया था;

3. अतः, लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा 149 की उप धारा (1), तथा धाराओं 30 और 56 के अनुसरण में, भारत निर्वाचन आयोग ने दिनांक 29 मई, 2013 की समसंख्यांक अधिसूचना के द्वारा :-

(अ) हिमाचल प्रदेश राज्य में उक्त 2-मण्डी लोक सभा निर्वाचन क्षेत्र से यह अपेक्षा की थी कि 30 जून, 2013 (रविवार) से पूर्व तथा उक्त अधिनियम के और तद्‌धीन बनाए गए नियमों और किये गए आदेशों के उपबन्धों के अनुसार लोक सभा में उक्त रिक्ति को भरने के प्रयोजन से एक व्यक्ति निर्वाचित किया जाए;

(आ) उक्त निर्वाचन के सम्बन्ध में :-

(क) नामनिर्देशन करने की अन्तिम तारीख ः 5 जून, 2013 (बुधवार);

(ख) नामनिर्देशनों की संवीक्षा की तारीख ः 6 जून, 2013 (वीरवार);

(ग) अभ्यर्थिताएं वापस लेने की अंतिम तारीख ः 8 जून, 2013 (शनिवार);

(घ) वह तारीख, जिसको यदि आवश्यक ः 23 जून, 2013 (रविवार); और हुआ तो, मतदान होगा

(ड़) वह तारीख, जिससे पूर्व निर्वाचन ः 30 जून, 2013 (रविवार); सम्पन्न करा लिया जाएगा नियत कर दी थी; और

(ई) 8.00 बजे पूर्वाह्‌न से 5.00 बजे अपराह्‌न तक का समय, ऐसे समय के रूप में नियत किया गया था जिसके दौरान यदि आवश्यक हुआ तो, निर्वाचन के लिए उपरोक्त विनिर्दिष्ट तारीख को, मतदान होगा। 4. यतः, मुख्य निर्वाचन अधिकारी, हिमाचल प्रदेश ने यह सूचित किया है कि हाल ही में हुई अप्रत्याशित वर्षा/हिमपात/बादल फटने से आई तेज बाढ़ और भू-स्खलन के कारण सम्पर्क मार्गों सहित राष्ट्रीय राजमार्ग-22 या तो बह गया है या अनेक स्थानों पर अवरूद्ध हो गया है और यह कि जिला प्रशासन बचाव अभियान में पूरी तरह से व्यस्त है और मतदान स्टाफ मतदान केन्द्रों पर नहीं पहुंँच सकता है और इसलिए 2-मण्डी संसदीय निर्वाचन क्षेत्र के 68-किन्नौर (अ0ज0जा0) विधान सभा खण्ड में 23 जून, 2013 को निर्वाचन आयोजित करना सम्भव नहीं होगा;

5. अब, अतः आयोग ने यह निर्णय लिया है कि 2-मण्डी संसदीय निर्वाचन क्षेत्र के उक्त किन्नौर विधान सभा खण्ड में निर्वाचन 23 जून, 2013 से आगे बढ़ाकर 27 जून, 2013 को करवाया जाए और तदानुसार दिनांक 29 मई, 2013 की अपनी अधिसूचना के अनुच्छेद 3 (आ) के खण्ड (घ) और (ङ) में निम्नलिखित अनुसार संशोधन किया हैः-

खण्ड (घ) और (ड़ निम्नलिखित खण्ड से प्रतिस्थापित किया जाएगा :-

"(घ) (i) 23 जून, 2013 (रविवार) वह तारीख जिसको 68-किन्नौर(अ0ज0जा0) विधान सभा खण्ड के सिवाय उक्त 2-मण्डी संसदीय निर्वाचन क्षेत्र में मतदान होगा।

(ii) 27 जून, 2013 (बृहस्पतिवार) वह तारीख जिसको उक्त 68-किन्नौर (अ0ज0जा0) विधान सभा खण्ड में मतदान होगा।

(ड़) 15 जुलाई, 2013 (सोमवार) वह तारीख जिससे पूर्व निर्वाचन पूर्ण कर लिया जाएगा।"

NOTIFICATION

No. 100/HP-HP/1/2013.— WHEREAS, the seat of Shri Virbhadra Singh, in the House of the People, elected from 2-Mandi Parliamentary Constituency in the State of Himachal Pradesh, has became vacant on 1st January, 2013, by the reason of his resignation; and

2. WHEREAS, a bye-election was announced to be held for the purpose of filling the vacancy so caused vide Commission's Notification of even number dated 29th May, 2013; and 3. WHEREAS, in pursuance of sub-section (1) of section 149, and sections 30 and 56 of the Representation of the People Act, 1951 (43 of 1951), the Election Commission of India vide Notification of even number dated 29th May, 2013: –

(A) called upon the said 2-Mandi Parliamentary Constituency in the State of Himachal Pradesh, to elect, before the 30th June, 2013 (Sunday) and in accordance with the provisions of the said Act and of the rules and orders made thereunder, a person for the purpose of filling the said vacancy in the House of the People;

(B) appointed, with respect to the said election:—

(a) the 5th June, 2013 (Wednesday), as the last date for making nominations;

(b) the 6th June, 2013 (Thursday), as the date for the scrutiny of nominations;

(c) the 8th June, 2013 (Saturday), as the last date for the withdrawal of candidatures;

(d) the 23rd June, 2013 (Sunday), as the date on which a poll shall, if necessary, be taken; and

(e) the 30th June, 2013 (Sunday), as the date before which the election shall be completed; and

(C) fixed the hours from 8.00 AM to 5.00 PM, as the hours during which poll shall, if necessary, be taken on the date specified above, for the election; and

4. WHEREAS, the Chief Electoral Officer, Himachal Pradesh has informed the Commission that it would not be possible to conduct poll in 68-Kinnaur(ST) assembly segment of the said 2-Mandi Parliamentary Constituency on 23rd June, 2013 in the wake of recent unprecedented rainfall/snowfall/cloudburst, due to which National Highway-22 and link roads, have either been washed away or blocked at many places following heavy flood and landslides and that the district administration is totally busy in rescue operations and polling staff cannot reach the polling booths;

5. NOW, THEREFORE, the Commission has decided to postpone the poll in the said Kinnaur assembly segment of 2-Mandi Parliamentary Constituency from 23rd June, 2013 to 27th June, 2013, and has accordingly amended clauses (d) and (e) of para 3(B) of its Notification dated 29th May, 2013 as under:—

Clause (d) and (e) shall be substituted by the following clauses:—

"(d) (i) the 23rd June, 2013 (Sunday), as the date on which a poll shall be taken in the said 2-Mandi Parliamentary Constituency except in 68-Kinnaur(ST) assembly segment;

(ii) the 27th June, 2013 (Thursday) as the date on which a poll shall, be taken in the said 68-Kinnaur(ST) assembly segment;

(e) the 15th July, 2013 (Monday) as the date before which the election shall be completed."

Solan, Tehsil and District Solan, Himachal Pradesh because her name was wrongly entered in the M. C. record as Jasmine Ranhot, which is wrong.

The general public of the concerned area is hereby called upon to file objection, if any, regarding correction of name of above Vanshika Ranhot in the birth record of M. C. Solan in place of Jasmine Ranhot in writing to this office. The objections should reach this office on or before 27th June, 2013 positively otherwise necessary order will be passed to correct her name in the M. C. Record.
