No. FDS-LSP 271-341.—In super-session of all previous notifications & in exercise of the powers conferred upon me under clause 3(i) (e) of the Himachal Pradesh Hoarding and profiteering prevention Order 1977, I, B. S. Thakur District Magistrate, Lahoul Spiti With a view to make the following items available to the public /consumer at reasonable rates in the market do hereby fix the maximum retail price inclusive of all taxes and other incidental charges in respect of the 87-राजपत्र/2013-22-07-2013 (2411)2412 राजपत्र, हिमाचल प्रदेश, 22 जुलाई, 2013/31 आषाढ़ 1935 following items that may be charged by the dealer of the producer in Lahoul & Spiti District with immediate effect.

Note.—All the dealers of Lahoul Spiti District are hereby directed to display the rate list of above commodities conspicuously in " DEVNAGRI" script at their business premises for the information of the consumers duly signed either by the owner/ Prop or Manager.

This Notification shall valid for a period of one month from the date of its publication in official Gazette.

No. 478-479.—The following Bye Laws made by the Nagar Panchayat Santokhgarh for regulating the Posting of Bills Hoardings, Advertisement Sign boards in exercise of the power conferred by section 2002(0) read with section 217 of the Himachal Pradesh Municipal Act, 1994 (13 of 1994) have been confirmed by State Govt. as required under section 217 of the aforesaid Act are here by published for general information.

BYE LAWS TO REGULATE POSTING OF BILLS HOARDINGS ADVERTISEMENTS

OF NAGAR PANCHAYAT SANTOKHGARH 2013

1. Short title commencement and application.—These Bye-Laws may be called the Nagar Panchayat Santokhgarh (Regulation of Posting of Bills and fixing of advertisement hoardings, sign boards etc.) Bye-Laws-2013

(1) They shall come into force on the date of their publication in the Rajpatra, Himchal Pradesh.

(2) They shall apply to Nagar Panchayat Santokhgarh area.

2. Definition.—In these bye laws unless the context otherwise requires.—

(a) "Act" means the Himachal Pradesh Municipal Act, 1994.

(b) "Bills" means any poster, notice and advertisement printed on paper of board or painted on Hoarding, Signboards or walls etc. and hung on poles etc.

(c) "Nagar Panchayat" means the Nagar Panchayat Santokhgarh and

(d) "Schedule" means the schedule indication the rate in respect of sign board.

3. Prohibition of sticking, fixing hanging or painting bills, posters, advertisement, notice etc.—No person shall without the written permission of the Secretary Nagar Panchayat stick fix or hung or cause to be fixed stick or hung or paint bills, posters, advertisement, notice over any2414 राजपत्र, हिमाचल प्रदेश, 22 जुलाई, 2013/31 आषाढ़ 1935 place or property whether private or public in public street or road in contravention of the following conditions.—

(i) Hoarding shall not be allowed in the required width the National/ State ways and other scheduled roads as they cause traffic hazard and are against the instructions of the Govt. of India and Hon'ble Himachal Pradesh High Court.

(ii) No hoardings, advertisements shall be put on the valley side above the road level (including on the roofs of buildings) to preserve the aesthetics, scenic, beauty and the views of hills.

(iii) No hoardings, advertisement shall be put at the place where it affects endangers the growth of flora.

(iv) No hoardings shall be located in thickly wooded area and no wire of any kind shall be placed on trees.

(v) No hoarding advertisement shall exceed dimension of size of 16 sq. mtrs.

(vi) No hoardings advertisement shall be against the guidelines of the PWD.

(vii) No hoarding advertisement shall be located near water source.

(viii) No hoardings advertisement shall be in the form of writing engraving nailing and carving on any natural animate or inanimate object.

(ix) No hoarding advertisement shall be located to the road. No hoarding advertisement should be located on a sharp "U" turn and blind turns.

(x) The beauty of nature formation such as hills, rivers, trees and rocks shall not be destroyed indiscriminate installation of commercial advertisement.

4. Exemption.—Subject to the conditions mentioned in Bye Laws 3 private boards may be erected on respective premises by Govt. Offices, Association or mercantile firms for posting their own notices advertisements etc. Prohibition of displaying indecent picture or language. Advertisement containing indecent picture or language shall not be allowed Secretary Nagar Panchayat Santokhgarh shall be authority to be decide as to the decency or otherwise of the advertisements and the appeal against the decision shall be made to the President Nagar Panchayat Santokhgarh whose decision shall be final.

5. Fee for permission.—

(i) Fee @ Rs. 300/- per sq. meter shall be payable for every permission granted under bye laws No. 3. above per annum.

(ii) Cloth Banners @ Rs. 100/- per month per banner.

6. When a person desires to remove the advertisement, he will put the space as it was before and no reimbursement of fee will be made.

7. Penalties.—Whoever contravenes any of these bye laws shall be punishable with fine which may extend to Five thousand Rupees and when the contravention is a continuing one, with further fine which may extent of Rupees 200/- for every day, shall the first day during which such contravention continues.

संख्याः पीसीएच-एचए-(1) 11/2010-ए0ई0.--हिमाचल प्रदेश की राज्यपाल, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (1994 का अधिनियम संख्यांक 4) की धारा 186 के साथ पठित धारा 135 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, पूर्वोक्त अधिनियम के प्रयोजनों को कार्यान्वित करने के लिए निम्नलिखित नियम बनाने का प्रस्ताव करती हैं और इन्हें एतत्‌द्वारा जनसाधारण की सूचना के लिए राजपत्र, हिमाचल प्रदेश में प्रकाशित किया जाता है;

इन प्रारूप नियमों द्वारा संभाव्य प्रभावित होने वाले किसी व्यक्ति के उक्त नियमों की बाबत, यदि कोई आक्षेप या सुझाव है/हैं, तो वह उसे/उन्हें प्रारूप नियमों के राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से तीस दिन की अवधि के भीतर, निदेशक, पंचायती राज एस.डी.ए. कम्पलैक्स, ब्लाक नं0 27, कसुम्पटी, शिमला-171009 को भेज सकेगा;

उपरोक्त विनिर्दिष्ट अवधि के भीतर प्राप्त हुए आक्षेप (पों) या सुझाव (वों), यदि कोई हो पद इन नियमों को अन्तिम रूप देने से पूर्व राज्य सरकार द्वारा विचार किया जाएगा, अर्थात्‌ः

प्रारूप नियम

1. संक्षिप्त नाम.--इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश पंचायती राज (जिला परिषद्‌ में सहायक अभियन्ताओं की नियुक्ति और सेवा की शर्तें) नियम, 2013 है।

2. परिभाषाएं.--(1) इन नियमों में, जब तक संदर्भ से अन्यथा अपेक्षित न हो,-

(क) ''अधिनियम'' से हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 अभिप्रेत है; और (ख) ''प्ररूप'' से इन नियमों से संलग्न प्ररूप अभिप्रेत हैं।

(2) उन शब्दों और पदों, जो इसमें प्रयुक्त हैं किन्तु परिभाषित नहीं हैं, के वही अर्थ होंगे जोे उनके अधिनियम में हैं।

3. पदों की संख्या.--सहायक अभियन्ता के पदों की, जिला परिषदों में, ऐसी संख्या होगी, जैसी राज्य सरकार द्वारा मंजूर की गई हो और समय समय पर मंजूर की जाए।

4. वेतनमान.--सहायक अभियन्ता के पद के लिए वेतनमान, पे बेण्ड-II-15660-39100/-रूपए 5400/- रूपए ग्रेड पे होगा।

5. पद का प्रकार (चयन अथवा अचयन पद.--सहायक अभियन्ता का पद चयन होगा। 6. परिविक्षा की अवधि.--सहायक अभियन्ता दो वर्ष की अवधि के लिए परिवीक्षा पर रहेगा, जिसका एक वर्ष से अनधिक ऐसी और अवधि के लिए विस्तार किया जा सकेगा, जैसा निदेशक विशेष परिस्थितियों में और लिखित कारणों से आदेश दे।

7. नियुक्ति की पद्धति.--सहायक अभियन्ता शतप्रतिशत प्रोन्नति द्वारा नियुक्त किया जाएगा, ऐसा न होने पर सैकेण्डमैंट आधार पर।

8. अंशदायी पेंशन स्कीम.--नियमित आधार पर नियुक्त व्यक्ति, अंशदायी पेंशन स्कीम के लिए हकदार होंगे, जैसी राज्य सरकार द्वारा अधिसूचित की जाए। 2416 राजपत्र, हिमाचल प्रदेश, 22 जुलाई, 2013/31 आषाढ़ 1935 9. प्रोन्नती, सैकेण्डमैंट, स्थानान्तरण की पद्धति और ग्रेड (श्रेणियां) जिनसे प्रोन्नति/सैकेण्ड/ स्थानान्तरण किया जाएगा.--सहायक अभियन्ता को राज्य स्तर पर संगणित और तैयार की गई पारस्परिक वरिष्ठता के आधार पर, जिला परिषदों के नियमित स्नातक कनिष्ठ अभियन्ताओं में से प्रान्नति द्वारा नियुक्त किया जाएगा, जिनका कम से कम तीन वर्ष का नियमित सेवाकाल या ग्रेड में की गई तदर्थ सेवा, यदि कोई है, को सम्मिलित करके तीन वर्ष का नियमित सेवाकाल हो और गैर स्नातक कनिष्ठ अभियन्ताओं की दशा में सात वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा, यदि कोई है, को सम्मिलित करके सात वर्ष का नियमित सेवाकाल हो।

10. नियुक्ति प्राधिकार.--सम्बद्ध जिला परिषद्‌ का मुख्य कार्यकारी अधिकारी नियुक्ति प्राधिकारी होगा और नियुक्ति-पत्र मुख्य कार्यकारी अधिकारी, जिला परिषद्‌ द्वारा जारी किया जाएगा।

11. विभागीय प्रोन्नति समिति.--जैसी निदेशक द्वारा समय-समय पर गठित की जाए।

12. आरक्षण.--सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा, समय-समय पर अनुसूचित जातियों/अनुसूचित जनजातियों/अन्य पिछड़े वर्गों और अन्य प्रवर्ग के व्यक्तियों के लिए, सेवा में आरक्षण की बाबत जारी किए गए आदेशों के अध्यधीन होगी।

13. जॉब चार्ट.--जैसा निदेशक पंचायती राज द्वारा समय-समय पर विनिर्दिष्ट किया जाए। 14. प्रशिक्षण और परीक्षा.--सेवा के सदस्यों ऐसी परीक्षा अर्हित करनी होगी और ऐसा प्रशिक्षण प्राप्त करना होगा, जैसा निदेशक, पंचायती राज द्वारा समय-समय पर विहित किया जाए।

15. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह, कारणों को लिखित में अभिलिखित करके, आदेश द्वारा, इन नियमों के किन्हीं उपबन्धों को किसी वर्ग या व्यक्ति (व्यक्तियों) के प्रवर्ग या पद (पदों) की बाबत, शिथिल कर सकेगी।

16. निरसन और व्यावृतियां.--(1) इन नियमों के प्रवृत होने की तारीख पर और से अधिसूचना संख्या पी0सी0एच0-एच0बी0(1)36/01-एइ तारीख 20 अगस्त, 2001 द्वारा, जिला परिषद द्वारा संविदा आधार पर सहायक अभियन्ताओं की नियुक्ति हेतु अधिसूचित स्कीम, निरसित हो जाएगी।

(2) ऐसे निरसन के होते हुए भी, इस प्रकार निरसित स्कीम के अधीन की गई कोई नियुक्ति, बात या कार्रवाई, इन नियमों के अधीन विधिमान्य रूप में की गई समझी जाएगी।

NOTIFICATION

Shimla-9, the 9th July, 2013

No. PCH-HA (1) 11 / 2010-A.E.—In exercise of the powers conferred by sub-section (2) of section 135 read with section 186 of the Himachal Pradesh Panchayati Raj Act, 1994 (Act No. 4 of 1994), the Governor, Himachal Pradesh, proposes to make the following rules for carrying out2417 राजपत्र, हिमाचल प्रदेश, 22 जुलाई, 2013/31 आषाढ़ 1935 the purposes of the Act ibid and the same are hereby published in the Rajpatra, Himachal Pradesh, for the information of the general public;

If any person, likely to be affected by these draft rules has any objection(s) or suggestions(s) to make with regard to the said rules, he may send the same to the Director of Panchayati Raj, Himachal Pradesh, SDA Complex, Block No. 27, Kasumpti, Shimla-171009, within a period of thirty days from the date of publication of the draft rules in the Rajpatra, Himachal Pradesh ;

The objections(s) or suggestions(s), if any, received within the period specified above shall be taken into consideration by the State government, before finalizing these rules, namely:—

DRAFT RULES

1. Short title.—These rules may be called the Himachal Pradesh Panchayati Raj (Appointment and Conditions of Service of Assistant Engineers in Zila Parishads) Rules, 2013.

2. Definitions.— (1) In these rules, unless the context otherwise requires,--

(a) "Act" means the Himachal Pradesh Panchayati Raj Act, 1994; and

(b) "Form" means a form appended to these rules.

(2) The words and expressions used but not defined in these rules shall have the same meaning as respectively assigned to them in the Act.

3. Number of Posts.—There shall be such number of posts of Assistant Engineers as sanctioned and may be sanctioned by the State Government from time to time in the Zila Parishads.

4. Scale of Pay.—The Scale of Pay for the post of Assistant Engineer shall be Pay Band- II -Rs.15660-39100 + 5400 Grade Pay.

5. Type of post (whether selection or non selection post.).—The post of the Assistant Engineer shall be Selection Post.

6. Period of Probation.—The Assistant Engineer shall remain under probation for a period of two years subject to such further extension for a period of not exceeding one year, as may be ordered by the Director in special circumstances and reasons whereof shall be recorded in writing.

7. Method of appointment.—The Assistant Engineer shall be appointed 100% by promotion, failing which on Secondment basis.

8. Contributory Pension Scheme.—The regular appointees shall be entitled for Contributory Pension Scheme as may be notified by the State Government.

9. Mode of promotion, secondment, transfer and grades from which promotion/ secondment/ transfer is to be made.—The Assistant Engineers shall be appointed by promotion from amongst regular graduate Junior Engineers of Zila Parishads having at least 3 years regular service or regular combined with continuous ad-hoc service rendered, if any, in the grade and in cas e of non-graduate Junior Engineers 7 years regular service or regular combined with continuous ad- hoc service rendered, if any, in the grade, on the basis of inter-se-seniority calculated and maintained at the State level.

10. Appointing Authority.—(1) The Chief Executive Officer of Zila Prishad concerned shall be the appointing authority and letter of appointment shall be issued by the Chief Executive Officer, Zila Parishad.

11. Departmental Promotion Committee.—As may be constituted by the Director from time to time.

12. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes/ Scheduled Tribes/ Backward Classes/ Other Categories of persons issued by the Himachal Pradesh Government from time to time.

13. Job Chart.—As may be specified by the Director Panchayati Raj from time to time.

14. Training & Examination.—The members of the service shall have to qualify such examination and shall undergo such training as may prescribed by the Director Panchayati Raj from time to time.

15. Power to relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order relax any of the provisions(s) of these rules with respect to any class or category of person (s) or post (s).

16. Repeal & Savings.—(1) On and from the date of commencement of these rules, the Scheme notified for the appointment of Assistant Engineers on contract basis by Zila Parishad vide notification No. PCH-HB (1) 36/01-AE, dated 20th August, 2001 shall stand repealed.

(2) Notwithstanding such repeal, any appointment made or anything done or any action taken, under the scheme so repealed, shall be deemed to have been validly made, done or taken under these rules.

संख्या पीसीएच-एचए (1) 18/2008-I.—हिमाचल प्रदेश की राज्यपाल, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (1994 का अधिनियम संख्याक 4) की धारा 186 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्या पीसीएच-एचए (3) 6/94, तारीख 7 फरवरी, 1995 द्वारा अधिसूचित और राजपत्र, हिमाचल प्रदेश (असाधारण) में तारीख 8 फरवरी, 1995 को प्रकाशित हिमाचल प्रदेश पंचायती राज (निर्वाचन) नियम, 1994 का और संशोधन करने हेतु निम्नलिखित नियम बनाने का प्रस्ताव करती हैंं तथा उनको, जन साधारण की जानकारी के लिए राजपत्र, हिमाचल प्रदेश में, एत्‌द्‌द्वारा, प्रकाशित किया जाता है;

कोई हितबद्ध व्यक्ति प्रस्तावित नियमों की बाबत कोई आक्षेप करना चाहे या सुझाव देना चाहे, तो वह उसे/उन्हें प्रस्तावित नियमों के राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से तीस दिन की अवधि के भीतर निदेशक, पंचायती राज, हिमाचल प्रदेश एस0 डी0 ए0 कम्पलैक्स, कसुम्पटी, शिमला-171009 को भेज सकेगा ;

राजपत्र, हिमाचल प्रदेश, 22 जुलाई, 2013/31 आषाढ़ 1935 उपरोक्त नियत अवधि के भीतर प्राप्त आक्षेप या सुझाव, यदि कोई हो, पर सरकार द्वारा प्रस्तावित प्रारूप नियमों को अन्तिम रूप देने से पूर्व विचार किया जाएगा, अर्थात्‌ः-

1. संक्षिप्त नाम.--इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश पंचायती राज (निर्वाचन) संशोधन नियम, 2013 है।

2. नियम 12 का संशोधन.--हिमाचल प्रदेश पंचायती राज (निर्वाचन) नियम, 1994 (जिन्हें इसमें इसके पश्चात्‌ उक्त नियम कहा गया है) के नियम 12 के प्रथम परन्तुक के स्थान पर निम्नलिखित परन्तुक रखा जाएगा, अर्थात्‌ :-

''परन्तु राज्य निर्वाचन आयोग स्वविवेकानुसार, इन नियमों के अधीन निर्वाचन हेतु प्रारूप निर्वाचन हेतु प्रारूप निर्वाचक नामावली को तैयार करने के लिए भारत निर्वाचन आयोग के आंकड़े आधार (डाटा वेस) का उपयोग कर सकता है।''

3. नियम 35 का संशोधन.--उक्त नियमों के नियम 35 के उप-नियम (2) के पश्चात्‌ निम्नलिखित परन्तुक अन्तःस्थापित किया जाएगा, अर्थात्‌ः-

''परन्तु प्रत्येक नामांकन पत्र के साथ संबद्ध पंचायत द्वारा प्ररूप-18 क में जारी अदेय प्रमाण पत्र संलग्न किया जाएगा।''।

4. प्ररूप 18 का संशोधन.--उक्त नियमों में संलग्न विद्यमान प्ररूप-18 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात :-

NO. PCH-HA(1)18/2008-I.—In exercise of the powers conferred by section 186 of the Himachal Pradesh Panchayati Raj Act, 1994 (Act No. 4 of 1994), the Governor Himachal Pradesh, proposes to make the following rules further to amend the Himachal Pradesh Panchayati Raj (Election) Rules, 1994 notified vide this Department notification No. PCH-HA (3) 6/94, dated 7th February, 1995 and published in the Rajpatra, Himachal Pradesh (Extra-ordinary), on 8th February, 1995 and the same are hereby published in the Rajptra, Himachal Pradesh, for the information of the general public;

Any interested person who has any objection(s)/suggestion(s) with regard to the proposed rules, may send the same to the Director Panchayati Raj, Himachal Pradesh, SDA Complex, Kasumpti, Shimla-171009, within a period of thirty days from the date of publication of the proposed rules in the Rajpatra, Himachal Pradesh ;

The objection(s) or suggestion(s), if any, received within the period stipulated above shall be taken into consideration by the State Government before finalizing the proposed draft rules, namely :—

DRAFT RULES

1. Short title.—These rules may be called the Himachal Pradesh Panchayati Raj (Election) Amendment, Rules, 2013.

2. Amendment of rule 12.—In rule 12 of the Himachal Pradesh Panchayati Raj (Election) Rules, 1994 (hereinafter referred to as the said rules), for the first proviso, the following proviso shall be substituted, namely:—

"Provided that the State Election Commission may in its own discretion, use data base of the Election Commission of India for the preparation of the draft electoral rolls for the elections under these rules."

3. Amendment of Rule 35.—In rule 35 of the 'said rule', after sub-rule (2), the following proviso shall be inserted, namely:—

"Provided that every nomination paper shall be accompanied by No Dues Certificate issued by the concerned Panchayat in Form-18-A."

4. Amendment of Form-18.—For existing Form-18 appended to the said rules, the following shall be substituted, namely : —

संख्याः ई0एक्स0एन0-एफ(1)-7/2012.--हिमाचल प्रदेश की राज्यपाल, हिमाचल प्रदेश मूल्य परिवर्धित कर अधिनियम, 2005 (2005 का अधिनियम संख्यांक 12) की धारा 10 द्वारा प्रदा शक्तियों का प्रयोग करते हुए, उक्त अधिनियम से संलग्न अनुसूची 'क' के भाग-2 और अनुसूची 'ख' में निम्नलिखित संशोधन करने का प्रस्ताव करती हैं और इन्हें जनसाधारण की सूचना के लिए राजपत्र, हिमाचल प्रदेश में एतद्‌द्वारा प्रकाशित किया जाता है;

No. EXN-F(1)-7/2012.—In exercise of the powers conferred by section 10 of the Himachal Pradesh Value Added Tax Act, 2005 (Act No. 12 of 2005), the Governor, Himachal Pradesh proposes to make the following amendment in Part-II of Schedule 'A' and Schedule 'B' appended to the Act and the same are hereby published in the Rajpatra, Himachal Pradesh for the information of the general public;
