No. Ayur-A(3)-9/2010.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh is pleased to make the following amendment/corrections in the Recruitment and Promotion Rules for the post of Senior Ayurvedic 113-राजपत्र/2013-24-08-2013 (2915)2916 राजपत्र, हिमाचल प्रदेश, 24 अगस्त, 2013/2 भाद्रपद 1935 Chikitsak (Specialist), Class-I (Gazetted), Recruitment and Promotion Rules, 2013 notified vide this Department Notification No. Ayur-A(3)-9/2010 dated 23rd March, 2013, Namely:—

1. Short title & Commencement.—(1) These rules may be called the Himachal Pradesh, Department of Ayurveda, Senior Ayurvedic Chikitsak (Specialist), Class-I(Gazetted), Recruitment & Promotion Rules, 2013.

(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Annexure-"A".—(1) (a) Para 3 of the Column No. 6 the word 'Provide' before 'further' may be substituted as 'Provided'.

(b) Para 4 of the Column No. 6 in line three words 'of such' before constitutions may be treated as deleted.

(c) Para 4 of the Page-15 the word 'Finally' before 'absorbed' may be read as 'finally.

(d) Point No.-2 of Para-4 of Page-15 the word 'will' before 'qualified' may be read as 'well'.

(e) Column No. 11 of Page No. 16 the words at the place of 'recruitment By promotion' may be read as 'recruitment by promotion'.

(f) Point No.(e) of the Terms and Conditions at Serial No. VII of Page-20 the words 'five years tenure' may be substituted as 'three year tenure'.

हिमाचल प्रदेश युद्ध पुरस्कार अधिनियम, 1972 (1972 का अधिनियम संख्यांक 9) का और संशोधन करने के लिए विधेयक।

भारत गणराज्य के चौंसठवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित हो :--

1. स्ांक्षिप्त नाम.--इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश युद्ध पुरस्कार (संशोधन) अधिनियम, 2013 है।

2. धारा 3 का संशोधन.--हिमाचल प्रदेश युद्ध पुरस्कार अधिनियम, 1972 की धारा 3 (1972 का 9) में, "दो" शब्द के स्थान पर "पाँच" शब्द रखा जाएगा ।

उद्देश्यों और कारणों का कथन

वर्तमानतः हिमाचल प्रदेश युद्ध पुरस्कार अधिनियम, 1972 की धारा 3, समस्त पात्र व्यक्तियों को प्रतिवर्ष दो हजार रुपए के मूल्य की युद्ध जागीर देने का उपबन्ध करती है। कीमतों में अत्यधिक वृद्धि के कारण, समस्त पात्र व्यक्तियों के लिए, युद्ध जागीर के मूल्य को दो हजार रुपए से बढ़ाकर पाँच हजार रुपए वार्षिक किया जाना आवश्यक समझा गया है। उपरोक्त के दृष्टिगत, पूर्वोक्त अधिनियम की धारा 3 में उपयुक्त संशोधन करने का विनिश्चय किया गया है। इसलिए पूर्वोक्त अधिनियम में संशोधन करना आवश्यक हो गया है।

यह विधेयक उपर्युक्त उद्देश्यों की पूर्ति के लिए है।

विधेयक का खण्ड 2, हिमाचल प्रदेश युद्ध पुरस्कार अधिनियम, 1972 के अधीन प्रतिवर्ष संदेय, समस्त पात्र व्यक्तियों के लिए, युद्ध जागीर के मूल्य को दो हजार रुपए से बढ़ाकर पाँच हजार रुपए करने का उपबन्ध करता है। प्रस्तावित बढ़ौतरी के कारण प्राक्कलित व्यय का निर्धारण नहीं किया जा सकता है क्योंकि पूर्वोक्त अनुदान के लिए पात्र व्यक्तियों की संख्या समय-समय पर बदलती रहती है। तथापि, यदि पात्र व्यक्तियों की वर्तमान संख्या में कोई वृद्धि नहीं होती है, तो राजकोष से प्रतिवर्ष लगभग 41,55,000/- रुपए का अतिरिक्त व्यय अन्तर्वलित होगा।

further to amend the Himachal Pradesh War Awards Act, 1972 (Act No. 9 of 1972).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-fourth Year of the Republic of India as follows :—

1. Short title.—This Act may be called the Himachal Pradesh War Awards (Amendment) Act, 2013.

2. Amendment of section 3.—In section 3 of the Himachal Pradesh War Awards Act, 1972 (9 of 1972) for the word "two", the word "five" shall be substituted.

STATEMENT OF OBJECTS AND REASONS

At present section 3 of the Himachal Pradesh War Awards Act, 1972 provides for the grant of war jagirs of the value of two thousand rupees per annum to all the eligible persons. Due to sharp increase in the prices, it has been felt necessary to enhance the value of war jagir from two thousand rupees to five thousand rupees annually for all the eligible persons. In view of the above, it has been decided to make suitable amendments in section 3 of the Act. This has necessitated amendment in the Act ibid.

This Bill seeks to achieve the aforesaid objective.

FINANCIAL MEMORANDUM

Clause 2 of the Bill seeks to make provision to enhance the value of War Jagir payable annually under the Himachal Pradesh War Awards Act, 1972 from two thousand rupees to five thousand rupees to all the eligible persons. The estimated expenditure due to proposed increase can not be assessed as the number of eligible persons for the aforesaid grant continues to vary from time to time. However, if there is no increase in the present number of eligible persons the additional expenditure involved would be Rs. 41,55,000/- per annum approximately from the State Ex-chequer.

हिमाचल प्रदेश भू-राजस्व अधिनियम, 1954 (1954 का अधिनियम संख्यांक 6) का और संशोधन करने के लिए विधेयक। 2924 राजपत्र, हिमाचल प्रदेश, 24 अगस्त, 2013/2 भाद्रपद 1935 भारत गणराज्य के चौंसठवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित हो :—

1. संक्षिप्त नाम.--इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश भू-राजस्व (संशोधन) अधिनियम, 2013 है।

2. धारा 34 का संशोधन.--हिमाचल प्रदेश भू-राजस्व अधिनियम, 1954 (जिसे इसमें इसके पश्चात्‌ ''मूल अधिनियम'' कहा गया है) की धारा 34 में,—

(क) उपधारा (1) में, ''प्रत्येक सम्पदा के सम्बद्ध राजस्व अधिकारी से'' शब्दों के स्थान पर ''प्रत्येक सम्पदा के पटवारी से'' शब्द रखे जाएंगे; और

(ख) उपधारा (3) में, ''और राजस्व अधिकारी'' शब्दों का लोप किया जाएगा।

3. धारा 35 का संशोधन.--मूल अधिनियम की धारा 35 में,—

(क) उपधारा (1) में, ''या सम्बद्ध राजस्व अधिकारी'' शब्दों का लोप किया जाएगा;

(ख) उपधारा (2) में, ''या सम्बद्ध राजस्व अधिकारी'' शब्दों का लोप किया जाएगा;

(ग) उपधारा (3) में, ''यथास्थिति, पटवारी या राजस्व अधिकारी'' शब्दों और चिन्ह के स्थान पर ''पटवारी'' शब्द रखा जाएगा; और

(घ) उपधारा (5) में, ''या राजस्व अधिकारी'' शब्दों का लोप किया जाएगा।

उद्‌देश्यों और कारणों का कथन

हिमाचल प्रदेश भू-राजस्व (संशोधन) अधिनियम, 2011 (2011 का अधिनियम संख्यांक 41) द्वारा यथा संशोधित हिमाचल प्रदेश भू-राजस्व अधिनियम, 1954 की धारा 34 और 35 यह उपबन्ध करती है कि भू-स्वामी के रूप में किसी सम्पदा में कोई अधिकार प्राप्त करने वाले किसी व्यक्ति के पास, विनिर्दिष्ट रजिस्ट्रीकृत दस्तावेजों के आधार पर नामान्तरण को, या तो तहसील कार्यालय में या पटवार वृत्त में, जैसा वह चाहे, दर्ज करवाने और सत्यापित करवाने का विकल्प है। परन्तु ये उपबन्ध धारा 35 की उपधारा (7) के उपबन्धोें के अनुरूप नहीं पाए गए हैं, जो नामान्तरण की कार्यवाहियों में समस्त हितबद्ध पक्षकारों को और संयुक्त सम्पत्ति में समस्त सह-अंशधारियों की सुनवाई के लिए उपबन्ध करती है। इसलिए इस अस्पष्टता को दूर करने और धारा 35(7)के उपबन्धों की कड़ी अनुपालना सुनिश्चित करने के आशय से धारा 34 और 35 के पूर्ववर्ती उपबन्धों को, जो संशोधन अधिनियम, 2011 के प्रवृत्त होने से पूर्व विद्यमान थे, प्रत्यावर्तित करना आवश्यक समझा गया है, ताकि नामान्तरणों का सत्यापन राजस्व अधिकारियों द्वारा, केवल क्षेत्र निरीक्षण के दौरान ही किया जाए और हितबद्ध पक्षकारों को सुनवाई का अवसर प्राप्त हो सके। इसलिए पूर्वोक्त अधिनियम में संशोधन करना आवश्यक हो गया है।

यह विधेयक उपर्युक्त उद्‌देश्यों की पूर्ति के लिए है।

further to amend the Himachal Pradesh Land Revenue Act, 1954 (Act No. 6 of 1954).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-fourth Year of the Republic of India as follows:—

1. Short title.—This Act may be called the Himachal Pradesh Land Revenue (Amendment) Act, 2013.

2. Amendment of section 34.—In section 34 of the Himachal Pradesh Land Revenue Act, 1954 (hereinafter referred to as "the principal Act"),—

(a) in sub-section (1), for the words "by the Revenue Officer concerned for each estate", the words "by the Patwari of each estate" shall be substituted; and (b) in sub-section (3), the words "and the Revenue Officer" shall be omitted.

3. Amendment of section 35.—In section 35 of the principal Act,—

(a) in sub-section (1), the words "or the Revenue Officer concerned" shall be omitted;

(b) in sub-section (2), the words "or the Revenue Officer concerned" shall be omitted;

(c) in sub-section (3), the words and signs "or the Revenue Officer, as the case may be," shall be omitted; and

(d) in sub-section (5), the words "or the Revenue Officer" shall be omitted.

STATEMENT OF OBJECTS AND REASONS

Sections 34 and 35 of the Himachal Pradesh Land Revenue Act, 1954 as amended vide the Himachal Pradesh Land Revenue (Amendment) Act, 2011 (Act No. 41 of 2011) provides that any person acquiring any right in an estate as a land owner has option to get the mutation entered and attested either at the Tehsil office or at the Patwar Circle as he may desire, on the basis of specified registered documents. But these provisions are not found in consonance with the provisions of sub- section (7) of section 35 which provides for an opportunity of being heard to all the interested parties and also to all the co-sharers in a joint holding in mutation proceedings. Thus, in order to remove this ambiguity and to ensure strict implementation of the provisions of section 35(7), it has been considered necessary to restore the earlier provisions of sections 34 and 35 which were in existence before coming into force the Amendment Act, 2011 so that mutations are attested by the Revenue Officers during field visits only and the interested parties may get an opportunity of being heard. This has necessitated amendments in the Act ibid.

This Bill seeks to achieve the above objectives.

Besides above, 2% of the funds allocated for the Scheme in a year will be allowed for publicity and administrative expenses. PUBLIC NOTICE

Whereas the above named applicants have made an application under section 8 (4) of the Himachal Pradesh Registration of Marriages Act, 1996 alongwith an affidavit stating therein that they have solemnized their marriage on 9-11-2012 at Sukhu Ghat but has not been found entered in the records of the Registrar of Marriages Kuthrana.

And whereas, they have also stated that they were not aware of the laws for the registration of marriage with the Registrar of Marriages and now, therefore, necessary order for the registration of their marriage be passed so that their marriage may be registered by the concerned authority.

Now, therefore, objections are invited from the general public that if anyone has any objection regarding the registration of the marriage of the above named applicants, they should appear before the court of undersigned on 28-9-2013 at Tehsil Office Dharamshala at 10.00 A. अतः इस इश्तहार द्वारा आम जनता को सूचित किया जाता है कि यदि किसी व्यक्ति को नाम की दरुस्ती बारे कोई भी एतराज हो तो वह अपना एतराज लिखित तौर में या फिर स्वयं अदालत में प्रस्तुत होकर दिनांक 23-9-2013 को पेश कर सकता है।
