अनुबन्ध-क AGREEMENT UNDER SECTION 41 OF THE LAND ACQUISITION ACT, 1894

In respect of

JSW Energy Kutehr Hydro Electric Project (240 MW)

THIS AGREEMENT is made on this 16th day of August, Two thousand thirteen

BETWEEN

The M/s JSW Energy Limited, a Company registered under the Companies Act, 1956 and having it registered office at JSW Centre, Bandra Kurla Complex, Bandra (East), Mumbai-400051 through Mr. Sanjeev Kumar Mahajan, General Manager, appointed by the Company as its Attorney (hereinafter called "The Company" which expression shall include its heirs, successors and assigns) of the first part

AND

THE GOVERNOR of Himachal Pradesh through the Principal Secretary (MPP& Power) to the Government of Himachal Pradesh (Hereinafter called the "Government", which expression shall include its successors in office and assigns) of the Second part.

WHEREAS, upon the applicant of the Company for the acquisition of surface rights over land required for implementation of 240 MW JSW Energy Ltd Kutehr Hydro Electric Project, the Government of Himachal Pradesh have agreed to acquire the land on behalf of the Company under the provision of the Land Acquisition Act, 1894 (Act No.1 of 1894), the pieces or parcels of land described and delineated in the Schedule hereto annexed and situated in the revenue estate Village Mohal Sutkar, Kuther, Bhatda, Lamu, Chanhouta and Ullansa, Tehsil Bharmour, Distt. Chamba, Himachal Pradesh, total measuring 45-16-15 Bighas(Kitta-35) having been shown to the satisfaction of the said Government that the proposed acquisition is needed for implementation of 240 MW JSW Energy Ltd. Kutehr Hydro Electric Project and whereas the said Government have called upon the Company under the provisions of Section 41 of the Act ibid to enter into an agreement with the Government hereinafter contained.

Now, these presents witness and it is hereby agreed and declared as follows:—

1. On demand, the Company shall pay to the Government of Himachal Pradesh all and every compensation in respect of the said land tendered, paid or awarded to be tendered, paid or awarded by the Collector under the Land Acquisition Act, 1894, or by the Court or Courts to which an appeal from the award of the said Court may be preferred and all costs, charges and expenses of the proceedings in the aforesaid Courts or otherwise incidental to the proposed acquisition or payable in respect thereof under the provisions of the said Act.

2. On demand, made by the said Collector the obligations of the Company under the last preceding clause not being thereby limited, the Company shall deposit with the said Collector such sum or sums of money as in his discretion the said Collector may in anticipation estimate to be necessary for the purpose mentioned in the preceding clause.

3. On payment by the Company of all demands under the foregoing first clause, or, in the discretion of the said Government of Himachal Pradesh (On deposit by the Company of all estimated amounts as provided in the section clause) but not before possession shall have been taken under the provisions of the above mentioned Act, the Governor, Himachal Pradesh shall make over possession of the said land to the company and shall execute and do such all acts and deeds as may be necessary and proper for effectually vesting the same in the Company.

4. In case, Company has offered the land and construction etc. there in as security with the previous sanction of the Government for raising loans from financial Institutions/ Banks etc., within in India and outside, the Government not withstanding such sanction shall have recourse to its rights for resumption of the land under this clause even during the period such loan is outstanding, if the land is not utilized for the purpose for which it was acquired under the provisions of the Land Acquisition Act, 1894.

5. The said land shall be held by the Company for the purpose for which it is acquired or purpose legitimately connected as is herein before mentioned and without the sanction in writing of the said Government of Himachal Pradesh first had obtained for no other purpose whatsoever.

6. That said construction shall be completed and fully equipped in all respect ready for use within the time schedule as stipulated in the Implementation Agreement for the JSW Energy Kutehr (240MW) Hydroelectric Project. Should the said construction not be completed ( and fully equipped in all respect ready for use) within the time schedule as stipulated in the Implementation Agreement stated in the last preceding clause or within such further period as in its discretion may be prescribed or allowed by the said Government of Himachal Pradesh or should the said land at any time thereafter cease for a period as prescribed by the Government of Himachal Pradesh to be held and used or cease to be required for the purpose or purposes provided for in the foregoing clauses then in any such case, the said Government may summarily re-enter upon and take possession of the said land together with all structures/ buildings thereon, whether such structures/ buildings were erected before or after transfer of the land and buildings shall absolutely cease and determine and vest in the State Government free from all encumbrances.

1. The company shall provide employment to one member of each of the displaced families during the construction period of the project, which shall form part of the rehabilitation plan to be prepared and implemented at the cost of company. During the operation and maintenance of the project, the company shall give preference for employment to the members of the displaced families employed during the construction period.

2. In case of breach of any conditions by the company, the state Government shall have right to determine the agreement by giving 15 days show cause notice to the company. In case the company fails to explain its position to the satisfaction of the State Government and rectify the breach of the conditions so enumerated in the show cause notice, the State Government shall have absolute right to rescind the agreement and re-enter upon and take possession of the said land together with all structures/buildings thereon and thereupon the interest of the company in the said land and structures/ buildings shall cease and determine and vest in the state Government free from all encumbrances.

संख्या ः विद्युत-छः (5)-6/2012.--यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत हेाता है कि हिमाचल प्रदेश राज्य विद्युत निगम, जो कि भूमि अर्जन अधिनियम 1894 (1894 का पहला अधिनियम) की धारा 3 के खण्ड (सी.सी.) के अन्तर्गत सरकार के स्वामित्व और नियन्त्रण के अधीन एक निगम है के द्वारा अपने व्यय पर सार्वजनिक प्रयोजन हेतु नामक मुहाल मलाहन टुहरी, उप-तहसील ददाहु, जिला सिरमौर, हिमाचल प्रदेश में रेणुका बांध निर्माण व इसके जलमग्न क्षेत्र हेतु भूमि अर्जित करनी अति आवश्यक आपेक्षित है अतएव एतद्‌द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है।

2. भूमि अर्जन अधिनियम, 1894 की धारा-6 के उपबन्धों के अधीन इससे सम्बन्धित सभी व्यक्तियों की सूचना हेतु घोषणा की जाती है और उक्त अधिनियम की धारा-7 के उपबन्धों के अधीन भू-अर्जन समाहर्ता हिमाचल प्रदेश ऊर्जा निगम, उत्तम भवन, शिमला-4 को उक्त भूमि के अर्जन के लिए आदेश लेने का एतद्‌द्वारा निर्देश दिया जाता है।

HIGHER EDUCATION DEPARTMENT

ORDER

Shimla-171002, the 24th August, 2013

No. EDN-A-Kha(14)5/2009-Savita.—WHEREAS Smt. Savita Sharma, Lecturer in Maths, Government College Palampur (Distt. Kangra), H.P. was served with a Charge Sheet under Rule- 14 of the Central Civil Services (Classification Control and Appeal) Rules, 1965 vide this Department Memorandum of even number dated 18th August 2011 on the following charges:—

Article-I of Annexure-I.—That the said Smt. Savita Sharma, Lecturer in Mathematics, SCVB Government College Palampur, Distt. Kangra, H.P. while working in the aforesaid college2942 राजपत्र, हिमाचल प्रदेश, 26 अगस्त, 2013/4 भाद्रपद 1935 has remained willfully absent w.e.f. 16-01-2001 to till date, which is very unbecoming and tantamount to misconduct and violation of Rule 3 (1) i & iii of CCS (conduct) Rules, 1964 in general and F.R.17-A in particular.

Article-I of Annexure-II.—"That the said Smt. Savita Sharma, Lecturer in Mathematics, SCVB Government College Palampur, Distt. Kangra, H.P. while working in the aforesaid college during the year 2000 applied for permission for making passport and visit abroad which was granted by this department vide letter No. EDN-(9)1/94- Shiksha-Ka-dated:10-03-2000. Accordingly she was granted Extra Ordinary Leave w.e.f. 15-03-2000 to 16-09-2000. After that she availed 27days Earned Leave (w.e.f.17-09-2000 to 13-10-2000) which was sanctioned by the then Principal, SCVB Govt. College Palampur (HP) and she joined her duties on 14- 10-2000. From the office record of said college, it reveals that the said lecturer again proceeded on 6days earned leave w.e.f.18-12-2000 to 23-12-2000 with suffix holidays 24 & 25- 12-2000 followed by vacations, which was also sanctioned by the then Principal vide office order No. EDN. KGR. PLP/99- 2000/E.i./ Leave dated: 22-12-2000. The said lecturer joined her duties on 15-01-2001and again submitted an application on 16-01-2001 for five years E.O.L to visit Australia and left the college without waiting for the sanction of the competent authority and failed to resume her duties till date. Thus the said Smt. Savita Sharma, Lecturer in Mathematics is willfully absent from duties w.e.f. 16-01-2001 to till date resulting loss of studies of the students which is very unbecoming being a Government employee and tantamount to misconduct and violation of Rule 3(1) i & iii of CCS (conduct) Rules, 1964 in general and F.R.17-A in particular.

2. AND WHEREAS, the memorandum issued in favour of Smt. Savita Sharma, Lecturer in Maths, was received back at the Government level 'undelivered'. Thereafter, the Principal, GC Palampur was directed vide this department letter of even no. dated 13th Sep. 2011 for sending the said memorandum to the CO at her last known address and as per letter No.EDN-KGR-GCP/2011 2012/648-49 dated 22-9-2011 the Principal, GC Palampur posted the said charge sheet the CO at her address i.e. Dr, Savita Sharma, B-IX, 667/7, Santokh Pura (Old Hoshiarpur Road) Jalandhar City-4 (Pb.) and the Principal vide letter No. EDN-KGR-GCP/2011-2012/683 dated 7-12-2011 informed that the same has not been received in the college unclaimed so far, which was quite clear that the Charge Sheet was delivered to her.

3. AND WHEREAS, the Charged Officer has not submitted written statement of her defence.

4. AND WHEREAS, under sub-rule (2) of the Rule-14 of the Central Civil Services (Classification Control & Appeal) Rules, 1965 and Inquiring Authority was appointed vide this department order of even number dated 28 Feb. 2012 to enquire into the charges framed against Smt. Savita Sharma, Lecturer in Maths, who submitted the Inquiry Report vide his letter EDN-GC NB(Inquiry)2012-152 dated 17-4-2012 in which the charges leveled against the CO stood unequivocally proved beyond reasonable doubt. Before taking the action under Rule-14 of Central Civil Services (Classification Control & Appeal) Rules, 1965, a copy of the Inquiry Report was also supplied to the Charge Officer vide this department memo of even number dated 24th Nov. 2012 and 29th March 2013 through registered post as well as through e-mail on 22nd May 2013 thereby enabling her to submit reply within 15 days with regard to the findings given in the Inquiry Report.

3. AND WHEREAS, the charged officer replied through e-mail on 9th June 2013 as under:—

"in this regard, I would like to submit that I applied for EOL for period of five years on 18th Nov. 2000 which was forwarded by the Principal of SCVB Government College, Palampur, H.P. (India) to the Commissioner cum Secretary (Education) Govt. of Himachal2943 राजपत्र, हिमाचल प्रदेश, 26 अगस्त, 2013/4 भाद्रपद 1935 Pradesh vide his letter No. EDN-KGR-PLP/2000- Abroad-1486-1488 dated 18th Nov. 2000. Later, I personally visited the Secretariat in January 2001 to discuss the matter and get a decision on my application. Unfortunately, all my efforts went in vain and I have not received any response to that application till date."

4. AND WHEREAS, as per inquiry report the CO was more inclined to go abroad and stay there with her spouse rather than serving the Education Department in H.P.

5. AND WHEREAS, the undersigned has carefully gone through the charges framed against the officer, findings thereon given by the Inquiring Authority, all other records pertaining to this case and negligent attitude of the said delinquent and found that the charged officer remained willfully absent from duty w.e.f. 16-1-2001 to till date and the plea of the CO that she made many efforts is baseless and can't be relied upon as she even didn't report back on duty after the five years of the said period and just send in a letter of her resignation. Her sudden absence from college shows clearly that she has no regard for discipline. Her unauthorized absence for such a long time is an act of gross misconduct, insubordination and negligence.

5. AND WHEREAS, keeping in view the facts and circumstances of the case as discussed above and after careful consideration of the whole matter, the undersigned does not find any reason to disagree with the findings given by the Inquiry Officer and the report of inquiry is fully agreed to and accepted accordingly. I hold that it has been proved beyond reasonable doubt that Smt. Savita Sharma, Lecturer in Maths, GC Palampur has remained on unauthorized absence absent w.e.f. 16-1-2001 till date, which amounts to misconduct and conduct unbecoming of a Government servant thereby violation of the provisions of the CCS (Conduct) Rules, 1964 is proved against her.

6. NOW, THEREFORE, the undersigned, in exercise of the powers vested under Rules 15 read with Rule-11 of the Central Civil Services (Classification, Control and Appeal) Rules, 1965 hereby impose the penalty of "Removal from Government Service." on Smt. Savita Sharma, Lecturer in Maths, GC Palampur, Distt. Kangra H.P., with immediate effect.

The composition of the Committee shall be as under:—

3. The Principal Secretary (PWD) to the Member Government of Himachal Pradesh.

(a) Review of the presently applicable mining policy of the State.

(b) Suggest amendments of related rules.

(c) Examine the issue of grant of legal concession to control illegal mining as also boost the revenue of the State.

(d) Examine and suggest means to facilitate mining in the 9 districts (of old Himachal) with regards to the applicability of the FCA.

(e) Examine the feasibility of impounding vehicles carrying mined material illegally as is being done by the Forest Department in similar cases.

(f) Examine the proposal of the department to strengthen the mining wing as also augmentation if its fleet strength.

श्रीमती कौशल्या देवी पत्नी श्री रमेश कुमार गुप्ता, निवासी गांव जखोह, डा0 खनेरी, तहसील रामपुर बुशैहर, जिला शिमला, हिमाचल प्रदेश ने इस अदालत में प्रार्थना-पत्र मय शपथ-पत्र गुजारा है कि प्रार्थिया ने अपनी शादी हिन्दू रीति-रिवाज के अनुसार श्री रमेश कुमार गुप्ता पुत्र श्री सोहन लाल गुप्ता, निवासी गांव देलठ, तहसील रामपुर बुशैहर, जिला शिमला (हि0 प्र0) के साथ सम्पन्न की है। प्रार्थिया ने अपनी शादी का पंजीकरण कहीं नहीं करवाया है। प्रार्थिया अपने पति का नाम व जन्म तिथि 7-1-1961 का पंजीकरण अपने साथ ग्राम पंचायत अभिलेख रचोली में करवाना चाहती है।

अतः इस इश्तहार द्वारा सर्वसाधारण को सूचित किया जाता है कि यदि किसी व्यक्ति को उपरोक्त श्रीमती कौशल्या के पति का नाम व जन्म तिथि का पंजीकरण स्थानीय ग्राम पंचायत अभिलेख रचोली में दर्ज करने बारे कोई आपत्ति हो तो वह दिनांक 17-9-2013 को या इससे पूर्व अदालत हजा में हाजिर आकर अपनी आपत्ति दर्ज करवा सकता है। बाद गुजरने मियाद कोई भी उजर/एतराज काबिले समायत न होगा तथा नियमानुसार पंचायत अभिलेख में प्रार्थिया के पति का नाम व जन्म तिथि के पंजीकरण करने के आदेश पारित कर दिए जाएंगे।

आज दिनांक 14-8-2013 को मेरे हस्ताक्षर व मोहर अदालत से जारी किया गया।

श्री नरेन्द्र नेगी पुत्र स्व0 श्री शंकर नेगी, निवासी गांव शिलानाला, डा0 सराहन, तहसील रामपुर बुशैहर, जिला शिमला, हिमाचल प्रदेश ने इस अदालत में प्रार्थना-पत्र मय शपथ-पत्र गुजारा है कि प्रार्थी ग्राम शिलानाला, चक सराहन, पंचायत क्षेत्र सराहन, तहसील रामपुर बुशैहर (हि0 प्र0) का स्थाई निवासी है तथा प्रार्थी का जन्म इसी गांव में हुआ है परन्तु आवेदक व उसके परिवार का नाम व जन्म तिथि का इन्द्राज पंचायत अभिलेख में दर्ज न है। प्रार्थी अपना व अपनी पत्नी का नाम तथा अपनी पुत्रियों प्रियांशी नेगी जन्म तिथि 21-11-2004 व दिवयांशी नेगी जन्म तिथि 22-6-2006 का इन्द्राज स्थानीय पंचायत अभिलेख में दर्ज करवाना चाहता है।
