संख्याःई0एक्स0एन0-एफ(10)-7/2011-पार्ट.--हिमाचल प्रदेश की राज्यपाल, हिमाचल प्रदेश मूल्य परिवर्धित कर अधिनियम, 2005 (2005 का अधिनियम संख्यांक 12) की धारा 63 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्या ई0एक्स0एन0-एफ(5)-4/2005 127-राजपत्र/2013-11-09-2013 (3491) 3492 राजपत्र, हिमाचल प्रदेश, 11 सितम्बर, 2013/20 भाद्रपद 1935 तारीखः 2 दिसम्बर, 2005 द्वारा अधिसूचित और राजपत्र, हिमाचल प्रदेश (असाधारण) में तारीख 7 दिसम्बर, 2005 को प्रकाशित हिमाचल प्रदेश मूल्य परिवर्धित कर अधिनियम, 2005 में और संशोधन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश मूल्य परिवर्धित कर (तृतीय संशोधन) नियम, 2013 है ।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत होंगे । 2. नियम 61ख का संशोधन.--हिमाचल प्रदेश मूल्य परिवर्धित कर नियम, 2005 के नियम 61ख के उप-नियम (1) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :--

''61ख. माल के राज्यांतरिक वहन हेतु कर बीजकों/ं बिलों/कैश मैमों की इलैक्ट्रोनिक घोषणा.--(1) नियम 61 और 61क में किसी बात के होते हुए भी, कोई रजिस्ट्री—त व्यौहारी, जो हिमाचल प्रदेश राज्य के भीतर किसी क्रेता को 30,000/- रूपए या इससे अधिक के मूल्य के माल का विक्रय/पे्रषण करता है, तो वह माल के ऐसे प्रेषण से पूर्व, कर बीजक/बिल/कैश मैमों की बाबत, आबकारी एवं कराधान विभाग की ऑफिशियल वैबसाइट के माध्यम से इलैक्ट्रोनिकली मूल्य परिवर्धित कर प्ररूप 26 में घोषणा देगा । तथापि, माल के संचलन से यदि राज्य में पुनः प्रवेश अन्तर्वलित है, तो मूल्य परिवर्धित कर प्ररूप 26अ में की गई घोषणा पर्याप्त होगी, बशर्ते ऐसी घोषणाएं, ऐसे माल के प्रेषण से पूर्व की गई हों ।''

No. EXN-F(10)-7/2011-Part.—In exercise of the powers conferred by sub-section (1) of section 63 of the Himachal Pradesh Value Added Tax Act, 2005 (Act No. 12 of 2005), the Governor of Himachal Pradesh, is pleased to make the following rules further to amend the Himachal Pradesh Value Added Tax Rules, 2005, notified vide this department notification No. EXN-F(5)-4/2005 dated 2nd December, 2005 and published in the Rajpatra, Himachal Pradesh (extra ordinary), dated 7th December, 2005, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Value Added Tax (Third Amendment) Rules, 2013.

(2) They shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Amendment of rule 61B.—In rule 61B of the Himachal Pradesh Value Added Tax Rules, 2005 for sub-rule(1), the following shall be substituted, namely:—

"61B. Electronic Declaration of tax invoices/bills/cash memos for intra- State movement of goods.—(1) Notwithstanding anything contained in rules 61 and 61-A, a registered dealer who sells/dispatches goods worth Rs. 30,000/- or more to any purchaser, within the State of Himachal Pradesh shall furnish a declaration regarding tax invoice/bill/cash memo before dispatch of goods in Form VAT-XXVI, electronically through the official website of the Excise and Taxation Department. However, in case of movement of goods involving re-entry into the State the declaration in Form VAT-XXVIA will suffice provided the declarations are made before the dispatch of such goods."

5. फर्नीचर के विक्रय का कारबार करने वाले विनिर्माता/व्यौहारी ।

No. EXN-F(10)-7/2011-Part.—In continuation to this Department's notification of even number dated 21-09-2012, the Governor of Himachal Pradesh, in exercise of the powers conferred by sub-rule (2) of rule 61B of the Himachal Pradesh Value Added Tax Rules, 2005, is pleased to also notify the following classes of dealers for the purpose of making compulsory e-declaration w.e.f 01-10-2013 in Form VAT-XXVI before the dispatch of taxable goods in the course of intra- state transactions of goods:—

1. Manufacturers/dealers dealing in sale of medicines.

2. Manufacturers/dealers dealing in sale of electrical items.

3. Manufacturers/dealers dealing in sale of edible oils.

4. Manufacturers/dealers dealing in sale of marble.

5. Manufacturers/dealers dealing in sale of furniture.

6. Manufacturers/dealers dealing in sale of timber.

No.: EDN-B-F(4)18/2012.—The Governor, Himachal Pradesh is pleased to institute an incentive/Award named as "Mukhiya Mantri Protsahan Yojna" for all those students of the State who are selected and take admission for a degree course in any Indian Institutes of Technology (IIT) or All India Institute of Medical Sciences (AIIMS) and for a post Graduate Diploma Course in any Indian Institute of Management (IIMs). The Scheme shall come into force w,e,f, current financial year i.e. 2013-14. The guidelines for regulation/implementation of scholarship scheme are as under:—

1. A onetime Incentive/Awards of Rs. 75000/-( Seventy Five thousand) will be given to all those students of the State who are selected and take admission for a degree course in any Indian Institutes of Technology (IIT) or All India Institute of Medical3495 राजपत्र, हिमाचल प्रदेश, 11 सितम्बर, 2013/20 भाद्रपद 1935 Sciences(AIIMS) and for a post Graduate Diploma Course in any Indian Institute of Management (IIMs).

3. In case of any dispute, the Director (Hr.Education) will decided all the matter/issues, immediately. However, any person aggrieved with the decision of Director (Hr/ Education), may file an appeal before the Secretary (Hr.Education) to the Government of Himachal Pradesh within 45 days of decision.

And whereas the Ministry of Law and Justice, Government of India, has issued directions and guideline to enable the Registrar Generals of High Courts and Law/Home Secretaries of the State Governments to make necessary preparation in advance for launching he above-mentioned drives in the States;

And whereas, with a view to achieve objectives of the Pendency Reduction Drive, the High Court of H.P. has framed Guidelines for withdrawal of stale and ineffective criminal cases by the State of Himachal Pradesh and copy of these Guidelines is attached with this notification as Annexure;

Therefore, the Governor, Himachal Pradesh, on the recommendation of the High Court of Himachal Pradesh, is pleased to notify the guidelines enclosed herewith as Annexure for the purpose stated above.

श्रीमती शालू पुत्री श्री ओम प्रकाश, निवासी सिविल बाजार धर्मशाला, तहसील धर्मशाला, जिला कांगड़ा ने इस अदालत में शपथ-पत्र सहित मुकद्दमा दायर किया है कि उसकी स्वयं की जन्म तिथि 17-9-1983 है परन्तु एम0 सी0 धर्मशाला में जन्म तिथि पंजीकृत न है। अतः इसे पंजीकृत किये जाने के आदेश दिये जायें। इस नोटिस के द्वारा समस्त जनता तथा सम्बन्धित रिश्तेदारों को सूचित किया जाता है कि यदि किसी को उपरोक्त शालू की जन्म तिथि पंजीकृत किये जाने बारे कोई एतराज हो तो वह अपना एतराज हमारी अदालत में दिनांक 1-10-2013 को असालतन या वकालतन हाजिर आकर पेश कर सकता है अन्यथा मुताबिक शपथ-पत्र जन्म तिथि पंजी—त किये जाने बारे आदेश पारित कर दिये जाएंगे।

प्रार्थीगण सर्व श्री भगत राम पुत्र दुर्गा, निवासीगण बैहली, डा0 एम0 डी0 गलू, तहसील सुन्दरनगर, जिला मण्डी, हिमाचल प्रदेश ने इस अदालत में प्रार्थना-पत्र इस आशय पर पेश किया है कि खेवट नं0 3, खतौनी नं0 3, खसरा नं0 3, खसरा कित्ता 3, रकबा तादादी 2-15-10 बीघा तथा खेवट, नं0 4, खतौनी नं0 4, खसरा कित्ता 3, रकबा तादादी 3-4-4 बीघा व खेवट नं0 5, खतौनी नं0 5, खसरा कित्ता 2, रकबा तादादी 0-7-10 बीघा स्थित मुहाल फंगवास/138 में मथरू पुत्री श्री हुकमियां सहस्वामी दर्ज कागजात माल है तथा दिनांक 15-7-1984 से घर से लापता है और आज तक किसी ने उसे नहीं देखा। उसका पति भी फौत हो चुका है लेकिन मथरू का कागजात माल में नाम दर्ज होने के कारण प्रार्थीगण एवं तरतीबी फरीकदोयम को राजस्व सम्बन्धी कार्य करवाने में असुविधा हो रही है। इसलिए राजस्व रिकॉर्ड से मथरू का नाम रद्द कर दिया जावे।

अतः इश्तहार राजपत्र एवं दो समाचार-पत्रों (दिव्य हिमाचल व दैनिक भास्कर) के माध्यम से फरीकदोयम आम जनता एवं फरीकदोयम को सूचित किया जाता है कि उपरोक्त दरुस्ती बारे किसी को कोई भी उजर/एतराज हो तो वह दिनांक 5-10-2013 को सुबह 10.00 बजे असालतन या वकालतन हाजर अदालत आकर अपना उजर/एतराज पेश कर सकते हैं अन्यथा फरीकदोयम के खिलाफ कार्यवाही एकतरफा अमल में लाई जाएगी।

Shri Ashwani Guleria s/o Sh. Devender Singh Guleria, r/o Village and P. O. Tilli, Tehsil Sadar, District Mandi, Himachal Pradesh and Smt. Kanchan Jaswal d/o Shri Suresh Jaswal, r/o Village and P. O. Simas, Tehsil Ladbharol, District Mandi, Himachal Pradesh have filed an application alongwith affidavits in the court of undersigned under section 15 of Special Marriage Act, 1954 that they have solemnized their marriage on 21-10-2009 according to hindu rites and customs at Village Tilli (Kehnwal), Tehsil Sadar Mandi, District Mandi, Himachal Pradesh and they are living together as husband and wife since then, hence their marriage may be registered under Special Marriage Act, 1954.

Therefore, the general public is hereby informed through this notice that any person who has any objection regarding this marriage can file the objection personally or in writing before this court on or before 3-10-2013 after that no objection will be entertained and marriage will be registered.
