संख्या विद्युत-छः (5)-20/2013.-यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत हेाता है कि राष्ट्रीय जल विद्युत परियोजना निगम समिति (एन0 एच0 पी0 सी0), जो कि भूमि अर्जन अधिनियम 1894 (1894 का पहला अधिनियम) की धारा 3 के खण्ड (सी.सी.) के अन्तर्गत सरकार के स्वामित्व और नियन्त्रण के अधीन एक निगम है के द्वारा अपने व्यय पर सार्वजनिक प्रयोजन हेतु नामतः मौजा मौखरी ह0 न0 (149) में चमेरा पावर स्टेशन-III की सर्च साफट से हुये पानी के रिसाव से क्षतिग्रस्त होने पर भूमि अर्जित करनी अपेक्षित है अतएव एतद्‌द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है।

संख्याः विद्युत-छः (5)-1/2013.-यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत हेाता है कि हिमाचल प्रदेश राज्य विद्युत परिषद्‌ लिमिटेड, जो कि भूमि अर्जन अधिनियम 1894 (1894 का पहला अधिनियम) की धारा 3 के खण्ड (सी.सी.) के अन्तर्गत सरकार के स्वामित्व और नियन्त्रण के अधीन एक निगम है के द्वारा अपने व्यय पर सार्वजनिक प्रयोजन हेतु नामतः मुहाल जुगाहण, तहसील सुन्दरनगर, जिला मण्डी, हिमाचल प्रदेश में 132 के0वी0 डबल सर्केट टावर नम्बर- 103 पर पुश्ता दीवार (Protection Wall) के निर्माण हेतु भूमि अर्जित करनी अपेक्षित है अतएव एतद्‌द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है। 2. यह अधिसूचना ऐसे सभी व्यक्तियों को जो इससे सम्बन्धित हैं या हो सकते हैं की जानकारी के लिए भू-अर्जन अधिनियम, 1894 की धारा-4 के उपबन्धों के अन्तर्गत जारी की जाती है।

विषय.--प्रार्थना-पत्र जेर धारा 40-41, भारतीय पंजीकरण अधिनियम 1908.

उपरोक्त प्रार्थिया ने अधोहस्ताक्षरी की अदालत में प्रार्थना-पत्र मय ब्यान हल्फी व अन्य कागजात इस आशय से गुजारा है कि स्व0 श्री संजीव गुप्ता पुत्र श्री राजपाल गुप्ता उसके पति थे, जोकि दिनांक 11-7-2013 को फौत हो चुके हैं। उनके द्वारा दिनांक 16-10-2006 को एक वसीयत बनाई गई है, जिसे जेर धारा 40-41, भारतीय अधिनियम 1908 के अन्तर्गत प्रार्थिया के नाम पंजी—त किया जावे।

दिनांक 17-10-2013 को प्रार्थिया संध्या गुप्ता पत्नी स्व0 श्री संजीव गुप्ता, श्री राजपाल गुप्ता पुत्र श्री दीवान चन्द, श्री दर्शन सिंह पुत्र श्री प्रेम सिंह, श्री अशोक कुमार पुत्र श्री राम नाथ, श्री संजीव मल्होत्रा अधिवक्ता आदि हाजिर अदालत हुए। उपरोक्त हाजिरिन ने बयानात कलमबन्द करवाए कि स्व0 श्री संजीव गुप्ता पुत्र श्री राजपाल गुप्ता के कहने पर दिनांक 16-10-2006 को श्री संजीव मल्होत्रा अधिवक्ता ने वसीयतनामा लिखा था। श्री संजीव मल्होत्रा अधिवक्ता ने ब्यान किया कि दिनांक 16-10-2006 को स्व0 श्री संजीव गुप्ता पुत्र श्री राजपाल गुप्ता के कहने पर ही उन्होंनेे वसीयतनामा लिखा था। श्री राजपाल गुप्ता पुत्र श्री दीवान चन्द भी श्रीमती संध्या गुप्ता पत्नी स्व0 श्री संजीव गुप्ता के नाम वसीयत पंजी—त करने में सहमत हैं।

इस सम्बन्ध में सर्वसाधारण जनता को बजरिया इश्तहार राजपत्र हिमाचल प्रदेश द्वारा सूचित किया जाता है कि प्रार्थिया श्रीमती संध्या गुप्ता पत्नी स्व0 श्री संजीव गुप्ता के नाम उक्त वसीयत पंजी—त करने पर यदि किसी को कोई उजर-एतराज हो तो वह असालतन या वकालतन अदालत अधोहस्ताक्षरी के समक्ष4203 राजपत्र, हिमाचल प्रदेश, 26 अक्तूबर, 2013/4 कार्तिक 1935 दिनांक 25-11-2013 तक हाजिर आकर अपना एतराज दर्ज करवा सकता है। हाजिर न आने की सूरत में एकतरफा कार्यवाही अमल में लाई जा करके वसीयत पंजी—त करने के आदेश दे दिए जाएंगे।

उपरोक्त प्रार्थी ने अधोहस्ताक्षरी की अदालत में प्रार्थना-पत्र मय अन्य राजस्व कागजात इस आशय से गुजारा है कि मुहाल मोती टिब्बा के खाता खतौनी नम्बर 10 मिन/15, खसरा नम्बर 252, कित्ता-1, रकवा तादादी 00-00-26 है0 में नगर परिषद्‌ डलहौजी का इन्द्राज बतौर काश्त व कब्जा है, वह गलत दर्ज है, जिसकी दरुस्ती की जावे।

इस सम्बन्ध में विस्तृत रिपोर्ट गिरदावर कानूनगो बनीखेत से ली गई। रिपोर्ट गिरदावर कानूनगो बनीखेत नम्बर 602 दिनांक 8-10-2013 से पाया गया कि मुहाल मोती टिब्बा के खसरा नम्बर 252, कित्ता-1, रकबा तादादी 00-00-26 है0 में नगर परिषद्‌ डलहौजी ने गैर-मुमकिन शैड बना रखा था, उसका कब्जा छोड़ दिया है तथा उक्त खसरा नम्बर से नगर परिषद्‌ डलहौजी का इन्द्राज हटाया जा करके काश्त व कब्जा स्वयं मालकान दर्ज किए जाने की सिफारिश की है।

इस सम्बन्ध में सर्वसाधारण जनता को बजरिया इश्तहार राजपत्र सूचित किया जाता है कि प्रार्थी द्वारा दायर दरख्वास्त की दरुस्ती बारे यदि किसी को कोई उजर-एतराज हो तो वह असालतन या वकालतन अदालत अधोहस्ताक्षरी दिनांक 25-11-2013 को हाजिर आकर दर्ज करवा सकता है। हाजिर न आने की सूरत में एकतरफा कार्यवाही अमल में लाई जा करके दरुस्ती के आदेश दे दिए जाएंगे।

Whereas, Shri Moti Ram s/o Shri Roshan Lal, r/o Village Kehal, Tehsil Theog, District Shimla, Himachal Pradesh has preferred an application to the undersigned for the registration of name of his son namely Samar whose date of birth is 2-11-2012 in the record of Gram Panchayat Satheya, Tehsil Theog, District Shimla (H. Therefore, by this proclamation, the general public is hereby informed that any person having any objection for entry as to date of birth mentioned above, may submit his/her objection in writing in this court within one month from the publication of this proclamation failing which no objection will be entertained after expiry of date and the case will be decided accordingly.
