No. 5-8/2011-ELN.—Whereas, in view of the directions of Hon'ble Supreme Court of India restraining the State Govt. from making any promotion conveyed by Department of Personnel vide its letter No. PER(AP)-C-E(3)-2/2009-III, dated 11th January, 2013 and PER(AP)-C-F(1)- 2/2011, dated 31st January, 2013, , the following employees of Election Kanungo cadre of Election Department were entrusted with the charge of vacant posts of Naib-Tehsildar(Election) in their own pay scales without any financial benefit to attend to important and time-bound statutory works pertaining to Special Summary Revision of Photo Electoral Rolls-2014 and preliminary activities of preparedness for General Elections to Lok Sabha-2014, till further orders vide this departments office order of even number, dated 6th September, 2013:-

Whereas, in view of the decision of the State Govt. not to grant reservation in promotion to the members of the Scheduled Castes and Scheduled Tribes categories as per the Constitution (85th Amendment) Act, 2001 the instructions conveyed by the State Govt. vide its letter No. PER(AP)-C- E(3)-2/2009-III, dated 11th January, 2013 and PER(AP)-C-F(1)-2/2011, dated 31st January, 2013 have been superceded by the instructions of the Govt. communicated by its letter No. PER(AP)- CF(1)-2/2011-Vol.I, dated 30th October, 2013;

However, in view of the directions of Hon'ble Supreme Court of India in its interim order in Spl. Leave Petitin(Civil) No.66-68 of 2008 and in Spl. Leave Petition(Civil) No.8710 of 2009, to maintain status quo in the cases of benefits under Demobilized Indian Arms Forces Personnel(Reservation of Vacancies in HPAS) Rules, 1974, Demobilized Armed Forces(Reservation of Vacancies in Himachal State Non-Technical Services) Rules, 1972 and Ex- Servicemen(Reservation of Vacancies in Himachal Pradesh Technical Services) Rules, 1985 conveyed by Department of Personnel vide its letter No. PER(AP)-C-B(19)-3/96-Vol-VII, dated 17th May, 2013, promotion order in respect of the official appearing at Sr. No.1, i.e. Sh. Om Prakash who has been recruited to the post of Election Kanungo against the post reserved for Ex- Servicemen, can not be made till further directions.

Therefore, on the recommendations of Departmental Promotion Committee, the official appearing at Sr. No.2, i.e. Sh. Mohinder Kumar is hereby promoted to the post of Naib-Tehsildar (Election) in the pay scale of Rs. 10300-34800/- plus Rs. 4200/- Grade Pay against vacant post with immediate effect.

On promotion, the aforesaid official will continue to function as Naib-Tehsildar(Election) at his present place of postings and will be entitled to all promotional benefits with immediate effect.

The above official will remain on probation for a period of two years from the date of issue of these orders subject to such further extension for a period not exceeding one year as may be ordered by the competent authority in special circumstances and reasons to be recorded in writing.

The above official will also exercise option for fixation of pay under the provisions of saving clause of FR-22(I)(a)(1) within a period of one month from the date of issue of these orders.
