No. HHC/Rules/22(31)/84.—Hon'ble the Chief Justice and the Hon'ble Judges of the High Court of Himachal Pradesh in exercise of the powers vested in them under Section 29 of the H.P. Courts Act, 1976 and all other powers enabling hereunto have been pleased to insert the following amendment in the "Himachal Pradesh Subordinate Courts Typists (Grant of Licence, Registration and Control) Rules, 2001.

1. Short title.—These Rules shall be called "Himachal Pradesh Subordinate Courts Typists (Grant of Licence, Registration and Control) (Ist Amendment-2013) Rules, 2001.

2. Extent.—They shall apply to the Typists engaged in typing work in the Subordinate Courts premises in the State of Himachal Pradesh.

3. Commencement.—The amendment shall come into force with immediate effect.

4. Amendment.— Sr. Nos. 6 (A) as per Annexure -A, Sr. No. ix as per Annexure-'B' and Sr.No. i(a) under "Terms and Conditions shall be added in the Himachal Pradesh Subordinate Courts Typists (Grant of Licence, Registration and Control) Rules, 2001.

TERMS AND CONDITIONS

The typist shall :

(i) During the tenure of licence carry on his work only on such seat, as is assigned to him/her and no where else:

(i) (a) He should prominently display the copy of licence while sitting in the premises of the Court.

(ii) Carry out his/her work in a manner causing the least disturbance and maintain due cleanliness:

iii) Work in such a manner that persons are not allowed to gather around him/her, so as to cause general disturbance and obstruction:

iv) Present the licence for renewal/inspection as prescribed under these Rules, but renewal shall not be claimed as a matter of right:

(v) Make his/her services available in the Court premises at the prescribed seat on every working day from 9.00 a.m., to 5.00 p.m.

(vi) Type-out material with utmost decency and accuracy:

संख्याः ए.एच.वाई-ए(3)1/2013.-हिमाचल प्रदेश की राज्यपाल, भारत के संविधान के अनुछेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, इस विभाग की अधिसूचना संख्या ए.एच.वाई.-ए(3) 7/2009 तारीख 14.06.2012 द्वारा अधिसूचित, हिमाचल प्रदेश पशुपालन विभाग निदेशक, वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति नियम, 2012 में और संशोधन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थातः-4805 राजपत्र, हिमाचल प्रदेश, 21 नवम्बर, 2013/30 कार्तिक, 1935 1. संक्षिप्त नाम और प्रारम्भ.-(1) इन नियमों का संक्षिप्त नाम, हिमाचल प्रदेश पशुपालन विभाग निदेशक, वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति (प्रथम संशोधन) नियम, 2013 है।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत होंगे । 2. उपाबन्ध "क" का संशोधन.-हिमाचल प्रदेश पशुपालन विभाग निदेशक, वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति नियम, 2012 के उपाबन्ध "क" में,

स्तम्भ संख्या-11 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः- "संयुक्त निदेशक, पशुपालन में से प्रोन्नति द्वारा, जिनका दो वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके दो वर्ष का नियमित सेवाकाल हो, ऐसा न होने पर संयुक्त निदेशक, पशुपालन में से प्रोन्नति द्वारा जिनका संयुक्त निदेशक, पशुपालन और उप निदेशक, पशुपालन के रूप में संयुक्ततः तीन वर्ष का नियमित सेवाकाल या की गई लगातार तदर्थ सेवा को सम्मिलित करके तीन वर्ष का नियमित सेवाकाल हो, जिसमें संयुक्त निदेशक, पशुपालन के रूप में एक वर्ष का सेवाकाल भी अनिवार्य है । दोनों के न होने पर संयुक्त निदेशक, पशुपालन में से प्रोन्नति द्वारा जिनका संयुक्त निदेशक, पशुपालन, उप निदेशक, पशुपालन और सहायक निदेशक, पशुपालन के रूप में संयुक्ततः चार वर्ष का नियमित सेवाकाल या की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके चार वर्ष का नियमित सेवाकाल हो, जिसमें संयुक्त निदेशक, पशुपालन के रूप में तीन माह का सेवाकाल भी अनिवार्य है।

परन्तु प्रोन्नति के प्रयोजन के लिए प्रत्येक कर्मचारी को, जनजातीय/दुर्गम क्षेत्रों में पद/(पदों) की ऐसे क्षेत्रों में पर्याप्त संख्या की उपलब्धता के अध्यधीन, कम से कम एक कार्यकाल तक सेवा करनी होगीः परन्तु यह और कि उपर्युक्त परन्तुक क(1) उन कर्मचारियों के मामले में लागू नहीं होगा, जिनकी अधिवर्षिता के लिए पांच वर्ष या उससे कम की सेवा शेष रही हो :

परन्तु यह और भी कि उन अधिकारियों/कर्मचारियों को, जिन्होंने जनजातीय/दुर्गम क्षेत्र में कम से कम एक कार्यकाल तक सेवा नहीं की है, ऐसे क्षेत्र में उसके अपने संवर्ग (काडर) में सर्वथा वरिष्ठता के अनुसार स्थानान्तरित किया जाएगा ।

स्पष्टीकरण-I.-उपर्युक्त परन्तुक के प्रयोजन के लिए जनजातीय/दुर्गम क्षेत्रों में "कार्यकाल'' से साधारणतया तीन वर्ष की अवधि या प्रशासनिक अपेक्षाओं और कर्मचारी द्वारा किए गए कार्य को ध्यान में रखते हुए ऐसे क्षेत्रों में तैनाती की इससे कम अवधि अभिप्रेत होगी ।

स्पष्टीकरण-II.—उपर्युक्त परन्तुक के प्रयोजन के लिए जनजातीय/दुर्गम क्षेत्र निम्न प्रकार से होंगेः- 1. जिला लाहौल एवं स्पिति ।

2. चम्बा जिला का पांगी तथा भरमौर का उपमण्डल ।

3. रोहडू उपमण्डल का डोडरा क्वार क्षेत्र।

4. जिला शिमला की रामपुर तहसील का पन्द्रह बीस परगना, मुनीष, दरकाली और ग्राम पंचायत काशापाट ।

5. कुल्लू जिला का पन्द्रह बीस परगना।

(1) प्रोन्नति के सभी मामलों में पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद में की गई लगातार तदर्थ सेवा, यदि कोई हो, प्रोन्नति के लिए इन नियमों में यथाविहित सेवाकाल के लिए, इस शर्त के अधीन रहते हुए गणना में ली जाएगी, कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति, भर्ती और प्रोन्नति नियमों के उपवन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात्‌ की गई थी :

परन्तु यह कि उन सभी मामलों में, जिनमें कोई कनिष्ठ व्यक्ति सम्भरक (पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गई तदर्थ सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हों) के आधार पर उपर्युक्त निदिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहां अपने-अपने प्रवर्ग/पद/काडर में उससे वरिष्ठ सभी व्यक्ति, विचार किए जाने के पात्र समझे जाएंगे और विचार करते समय कनिष्ठ व्यक्ति से ऊपर रखे जाएंगे :

परन्तु यह और भी कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, कम से कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगी :

परन्तु यह और कि जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जाएंगे ।

स्पष्टीकरण-1.-अन्तिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा/समझे जाएंगे, यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है, जिसे डिमोबिलाइज्ड आर्मड फोर्सिज परसोनल (रिजर्वेशन आफ वैकेन्सीज इन हिमाचल स्टेट नॉन-टैक्नीकल सर्विसिज) रूल्ज, 1972 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया है और इनके अन्तर्गत वरीयता लाभ दिए गए हों या जिसे एक्स-सर्विसमैन (रिजर्वेशन आफ वैकेन्सीज इन दी हिमाचल प्रदेश टैक्नीकल सर्विसिज) रूल्ज, 1985 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो और इनके अन्तर्गत वरीयता लाभ दिए गए हों । (2) इसी प्रकार स्थायीकरण के सभी मामलों में ऐसे पद पर नियमित नियुक्ति/प्रोन्नति से पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवाकाल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति, उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार की गई थी :

परन्तु की गई उपर्युक्त निर्दिष्ट तदर्थ सेवा को गणना में लेने के पश्चात्‌ जो स्थाईकरण होगा, उसके फलस्वरूप पारस्परिक वरीयता अपरिवर्तित रहेगी "।

ANIMAL HUSBANDRY DEPARTMENT

NOTIFICATION

Shimla-2, the 19 November, 2013

No. AHY-A(3)1/2013.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor of Himachal Pradesh, in consultation with the H.P.Public Service Commission, is pleased to make the following Rules further to amend the Himachal Pradesh, Animal Husbandry Department, Director, Class-I (Gazetted), Recruitment & Promotion Rules, 2012 notified vide this Department Notification AHY-A(3)- 7/2009 dated 14.06.2012, namely:—

1. Short title and Commencement.—(1) These rules may be called the Himachal Pradesh Animal Husbandry Department, Director, Class-I (Gazetted), Recruitment & Promotion (First Amendment) Rules, 2013.

(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Annexure-A.—In Annexure "A" to the Himachal Pradesh Animal Husbandry Department, Director, Class-I(Gazetted), Recruitment & Promotion Rules, 2012 ;

For the existing provisions against Col. No. 11 the following shall be substituted, namely:—

" By promotion from amongst the Joint Directors, Animal Husbandry with 02 years regular service or regular combined with continuous adhoc service, if any, in the grade failing which by promotion from amongst the Joint Directors, Animal Husbandry with 03 years regular service or regular combined with continuous adhoc service, if any, combined as Joint Director, Animal Husbandry & Deputy Director, Animal Husbandry which shall also include essential service of 01 year as Joint Director, Animal Husbandry failing both by promotion from amongst the Joint Directors, Animal Husbandry with 04 years regular service or regular combined with continuous adhoc service, if any, combined as Joint Director, Animal Husbandry, Deputy Director, Animal Husbandry & Assistant Director, Animal Husbandry, which shall also include essential service of 03 months as Joint Director, Animal Husbandry.

Provided that the purpose of promotion every employee shall have to serve atleast one term in the Tribal/Difficult areas subject to adequate number of post(s) available in such areas;

Provided further that the proviso (1) supra shall not be applicable in the case of those employee's who have five years or less service, left for superannuation.

Provided further that Officers/ Officials who have not served atleast one tenure in Tribal / Difficult areas shall be transferred to such area strictly in accordance with his/her seniority in the respective cadre.

Explanation–I.—For the purpose of proviso I supra the "term" in Tribal/ Difficult areas shall mean normally three years or less period of posting in such areas keeping in view the administrative requirements and performance of the employee.

Explanation-II.—For the purpose of proviso I supra the Tribal /Difficult Areas shall be as under :—

1. District Lahaul & Spiti.

2. Pangi and Bharmaur Sub-Division of Chamba District.

3. Dodra Kawar Area of Rohru Sub-Division.

4. Pandrah Bis Pargana, Munish Darkali and Gram Panchayat Kashapat, Gram Panchayats of Rampur Tehsil of Distt. Shimla.

5. Pandrah Bis Pargana of Kullu Distt.

6. Bara Bhangal Area of Baijnath Sub-Division of Kangra Distt.

7. District Kinnaur.

8. Kathwar and Kosrga Patwar Circles of Kamrau Sub Tehsil, Bhaladh Bhalona and Sangna Patwar Circles of Renukaji Tehsil and Kota Pab Patwar Circle of Shilai Tehsil, in Sirmaur Distt.

(1) In all cases of promotion, the continuous adhoc services rendered in the feeder post, if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these Rules for promotion subject to the condition that the adhoc appointment /promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R&P rules, provided that;

In all cases where a junior person becomes eligible for consideration by virtue of his/her total length of service (including the service rendered on adhoc basis, followed by regular service/appointment) in the feeder post in view of the provision referred to above, all persons senior to him/her in the respective category post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration;

Provided further that all incumbents to be considered for promotion shall process the minimum qualifying service of atleast three years or that prescribed in the R&P rules for the post, whichever is less;

Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him/her shall also be deemed to be ineligible for consideration for such promotion.

Explanation.—The last proviso shall not render the junior incumbent(s) ineligible for consideration for promotion if the senior ineligible person(s) happened to be Ex-Servicemen recruited under the provisions of Rule-3 of Demobilized Armed Forces Personnel (Reservations of vacancies in Himachal State Non-Technical services) Rules, 1972 and having been given the benefit of seniority thereunder or recruited under the provision of Rule-3 of Ex-Servicemen (Reservations of vacancies in Himachal State Technical Services) Rules, 1985 and having been given the benefit of seniority thereunder.

(2) Similarly, in all cases of confirmation continuous adhoc service rendered in the feeder post, if any, prior to the regular appointment / promotion against such posts shall be taken into account towards the length of service, if the adhoc appointment/promotion had been made after proper selection and in accordance with the provisions of R&P Rules;

Provided that inter-se-seniority as a result of confirmation after taking into account, adhoc service rendered as referred to above shall remain unchanged".

Shri Deepak Sharma and Monika have filed an application U/S 5 of Special Marriage Act, 1954 alongwith affidavits in the court of undersigned in which they have stated that they intend to solemnized marriage within three calendar months.

Therefore, the general public is hereby informed through this notice that any person who has any objection regarding this marriage can file the objection personally or in writing before this Court on or before 30-12-2013. The objection received after 30-12-2013 will not be entertained and marriage will be registered accordingly.

श्री परमा राम सुपुत्र श्री सन्त राम, निवासी डबरेड़ा, मौजा उगयालता, तहसील भोरंज, जिला हमीरपुर, ने शपथ-पत्र सहित दरख्वास्त गुजारी है कि उसका नाम पंचायत रिकॉर्ड में परस राम दर्ज है जो कि सही है। परन्तु राजस्व रिकार्ड टीका डुगली में उसका नाम प्रेमा दर्ज है जो कि गलत है। प्रार्थी राजस्व रिकार्ड में सही नाम का इन्द्राज करवाना चाहता है।

अतः इस इश्तहार द्वारा आम जनता को सूचित किया जाता है कि टीका डुगली मौजा उगयालता, तहसील भोरंज, जिला हमीरपुर के राजस्व रिकॉर्ड में प्रेमा उर्फ परस राम पुत्र संत राम दर्ज करने बारे किसी को कोई उजर/एतराज हो तो वह दिनांक 7-12-2013 को असालतन/वकालतन हाजिर अदालत आकर एतराज पेश कर सकता है। हाजिर न आने की सूरत में एकतरफा कार्यवाही अमल में लार्ई जाकर आगामी कार्यवाही की जाएगी। उसके बाद का उजर जेर समायत न होगा।

श्री जगत सिंह पुत्र श्री अच्छबू, निवासी ग्राम बडयार, डा0 काण्डो-भटनोल, तहसील शिलाई, जिला सिरमौर, हिमाचल प्रदेश ने न्यायालय में दरख्वास्त गुजारी है कि उसकी धर्म पत्नी श्रीमती पानो देवी उसकी विवाह शुद्धा पत्नी है परन्तु ग्राम पंचायत बान्दली के रिकॉर्ड में मेरी उक्त धर्मपत्नी को मेरे भाई श्री जवाहर सिंह पुत्र श्री सोभा राम, निवासी बडयार के नाम पर गलती से दर्ज किया गया है। पंचायत रिकॉर्ड को दरुस्त किया जाए तथा ग्राम पंचायत बान्दली के रिकॉर्ड में श्रीमती पानो देवी को श्री जवाहर सिंह के नाम से काटकर मेरे नाम दर्ज किया जाए। इस बारे श्री जवाहर सिंह व श्रीमती पानो देवी ने भी अपने ब्यान हलफिया/सहमति प्रकट की है।

अतः सर्वसाधारण को सूचित किया जाता है कि यदि इस बारे किसी व्यक्ति को कोई एतराज हो तो वह दिनांक 26-12-2013 को इस कार्यालय/अदालत हजा स्थित शिलाई में असालतन या वकालतन हाजिर आकर अपनी स्थिति/एतराज प्रस्तुत कर सकता है। निश्चित तिथि पर कोई एतराज न होने की सूरत में प्रार्थना-पत्र श्री जगत सिंह पुत्र श्री अच्छबू पर नियमानुसार कार्यवाही कर दी जाएगी।

2. Out of the above newly created posts, the post of Assistant Professor will be filled up by way of promotion/ direct recruitment as the case may be.

3. The expenditure on this account is debitable to Major Head "2210-Medical & Public Health, 105-Allopasthy-05-Medical Education and Research, 06-Dr. RPGMC, Kangra at Tanda (Non Plan) under SOE Salary during the current financial year 2013-14.
