संख्याः श्रम (बी) 10-52/2010(स्थापना).--हिमाचल प्रदेश की राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से हिमाचल प्रदेश श्रम एवं रोज़गार विभाग म,ें संयुक्त श्रमायुक्त, वर्ग-I (राजपत्रित) के पद के लिए इस अधिसूचना से संलग्न उपाबन्ध 'क' के अनुसार भर्ती और प्रोन्नति नियम बनाती हैं, अर्थात्‌ः-- 1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश श्रम एवं रोज़गार विभाग, संयुक्त श्रमायुक्त, वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति नियम, 2013 है।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. निरसन और व्यावृाियाँ.--(1) इस विभाग की अधिसूचना संख्या श्रम(बी)2-20/97 तारीख 30-10-1998 द्वारा अधिसूचित हिमाचल प्रदेश श्रम एवं रोज़गार विभाग, संयुक्त श्रमायुक्त, वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति नियम, 1998 का एतद्‌ द्वारा निरसन किया जाता है ।

(2) ऐसे निरसन के होते हुए भी उपर्युक्त उप नियम (1) के अधीन इस प्रकार निरसित नियमों के अधीन की गई कोई नियुक्ति, बात या कार्रवाई, इन नियमों के अधीन विधिमान्य रुप में की गई समझी जाएगी।

उपाबन्ध-"क" हिमाचल प्रदेश श्रम एवं रोज़गार विभाग में संयुक्त श्रमायुक्त, वर्ग-I (राजपत्रित) के पद के लिए भर्ती और प्रोन्नति नियम

1. पद का नामः--संयुक्त श्रमायुक्त।

2. पदों की संख्याः-- 01 (एक)।

3. वर्गीकरणः--वर्ग-I (राजपत्रित)।

4. वेतनमानः--पे बैण्ड `15600-39100/-जमा त 6600/-ग्रेड पे

5. "चयन' पद अथवा 'अचयन' पद :--चयन ।

6. सीधी भर्ती के लिए आयु :--लागू नहीं ।

7. सीधे भर्ती किए जाने वाले व्यक्तियों के लिए अपेक्षित न्यूनतम शैक्षिक और अन्य अर्हताएंः--(क) अनिवार्य अर्हता(एं) : लागू नहीं ।4960 राजपत्र, हिमाचल प्रदेश, 30 नवम्बर, 2013/9 अग्रहायण, 1935 (ख) वांछनीय अर्हता(ए) :--लागू नहीं । 8. सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित आयु और शैक्षिक अर्हताएं, प्रोन्नत व्यक्ति (यों) की दशा में लागू होंगी या नहीं :--आयु : लागू नहीं ।

शैक्षिक अर्हताः--लागू नहीं ।

9. परिवीक्षा की अवधि, यदि कोई हो :--दो वर्ष, जिसका एक वर्ष से अनधिक ऐसी और अवधि के लिए विस्तार किया जा सकेगा, जैसा सक्षम प्राधिकारी विशेष परिस्थितियों में और लिखित कारणों से आदेश दे।

10. भर्ती की पद्धति : भर्ती सीधी होगी या प्रोन्नति, प्रतिनियुक्ति, स्थानान्तरण और विभिन्न पद्धतियों द्वारा भरे जाने वाले पद(पदों) की प्रतिशतता :--शत-प्रतिशत प्रोन्नति द्वारा।

11. प्रोन्नति, प्रतिनियुक्ति, उप-श्रमायुक्तों में से प्रोन्नति द्वारा, जिनका तीन वर्ष का स्थानान्तरण की दशा में श्रेणिया(ंग्रेड) जिनसे प्रोन्नति/प्रतिनियुक्ति/स्थानान्तरण किया जाएगा :--नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके तीन वर्ष का नियमित सेवा काल हो, ऐसा न होने पर उप-श्रमायुक्त में से प्रोन्नति द्वारा, जिनका उप-श्रमायुक्त और श्रम अधिकारी के रूप में संयुक्ततः आठ वर्ष का नियमित सेवाकाल या की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके आठ वर्ष का नियमित सेवाकाल हो जिसमें उप-श्रमायुक्त के रूप में दो वर्ष की सेवा अनिवार्य होनी चाहिए। (1) प्रोन्नति के सभी मामलों में, पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद में की गई लगातार तदर्थ सेवा, यदि कोई हो, प्रोन्नति के लिए इन नियमों में यथाविहित सेवाकाल के लिए, इस शर्त के अधीन रहते हुए गणना में ली जाएगी, कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति, भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया के अपनाने के पश्चात्‌ की गई थी :

परन्तु यह कि उन सभी मामलों में, जिनमें कोई कनिष्ठ व्यक्ति सम्भरक (पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गई तदर्थ सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो), के आधार या उपर्युक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहां अपने-अपने प्रवर्ग/पद/संवर्ग में उससे वरिष्ठ सभी व्यक्ति विचार किए जाने के पात्र समझे जाएंगे और विचार करते समय कनिष्ठ व्यक्ति से ऊपर रखे जाएंगे :

परन्तु यह और कि उन सभी पद्‌धारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, कम से कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगी :

परन्तु यह और भी कि, जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बंधी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जाएंगे ।

स्पष्टीकरणः--अन्तिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा, यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है, जिसे डिमोबिलाईजड आर्मड फोर्सिस परसोनल (रिजर्वेशन ऑफ वेकेन्सीज इन हिमाचल स्टेट नॉन-टैकनीकल सर्विसीज) रूल्ज, 1972 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया है और इसके अन्तर्गत वरीयता लाभ दिए गए हों या जिसे एक्स-सर्विसमैन (रिजर्वेशन ऑफ वेकेन्सीज इन दी हिमाचल प्रदेश टैकनीकल सर्विसीज) रूल्ज, 1985 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो और इसके अन्तर्गत वरीयता लाभ दिए गए हों।

(2) इसी प्रकार स्थार्यीकरण के सभी मामलों में ऐसे पद पर नियमित नियुक्ति/प्रोन्नति से पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवाकाल के लिए गणना में ली जाएगी,4961 राजपत्र, हिमाचल प्रदेश, 30 नवम्बर, 2013/9 अग्रहायण, 1935 यदि तदर्थ नियुक्ति/प्रोन्नति, उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार की गई थी :

परन्तु की गई उपर्युक्त निर्दिष्ट तदर्थ सेवा को गणना में लेने के पश्चात्‌ जो स्थायीकरण होगा, उसके फलस्वरूप, पारस्परिक वरीयता अपरिवर्तित रहेगी ।

12. यदि विभागीय प्रोन्नति समिति विद्यमान हो तो, उसकी सरंचना ः--जैसी कि समय-समय पर सरकार द्वारा गठित की जाए।

13. भर्ती करने में जिन परिस्थितियों में हिमाचल प्रदेश लोक सेवा आयोग से परामर्श किया जाएगाः--जैसा विधि द्वारा अपेक्षित हो ।

14. सीधी भर्ती के लिए अनिवार्य अपेक्षा :--लागू नहीं ।

15. सीधी भर्ती द्वारा पद पर नियुक्ति के लिए चयनः--लागू नहीं ।

16. आरक्षणः--सेवा मेें नियुक्ति, हिमाचल प्रदेश सरकार द्वारा, समय-समय पर अनुसूचित जातियोंं/अनुसूचित जनजातियों/अन्य पिछड़े वर्गों/अन्य प्रवर्ग के व्यक्तियों के लिए सेवा में आरक्षण की बाबत जारी किए गए आदेशों के, अधीन होगी ।

17. विभागीय परीक्षाः--सेवा में प्रत्येक सदस्य को समय-समय पर यथा संशोधित हिमाचल प्रदेश विभागीय परीक्षा नियम, 1997 मे यथा विहित विभागीय परीक्षा उर्तीण करनी होगी ।

18. शिथिल करने की शक्तिः--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह कारणों को लिखित में अभिलिखित करके और हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, आदेश द्वारा, इन नियमों के किन्हीं उपबन्ध (उपबन्धों) को किसी वर्ग या व्यक्ति (यों) के प्रवर्ग या पद (पदों) की बाबत, शिथिल कर सकेगी ।

NOTIFICATION

Shimla-2, the 28th November, 2013

No. Shram(B)10-52/2010.—In exercise of the powers conferred by proviso to Article 309 of the constitution of India, the Governor, Himachal Pradesh, in consultation with the H.P. Public Service Commission, is pleased to make the Recruitment and Promotion Rules for the post of Joint Labour Commissioner, Class-I (Gazetted) in the Department of Labour and Employment, Himachal Pradesh as per Annexure-"A" attached to this Notification, namely:—

1. Short title and Commencement:—(1)These rules may be called the Himachal Pradesh Labour and Employment Department, Joint Labour Commissioner, Class-I(Gazetted), Recruitment and Promotion Rules, 2013.

(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Repeal and Savings:—(1) The Himachal Pradesh Labour and Employment Department, Joint Labour Commissioner, Class-I (Gazetted), Recruitment and Promotion Rules, 1998 notified vide this Department notification No. Shram(B)2-20/97 dated 30-10-1998 are hereby repealed.

(2) Not withstanding such repeal, any appointment made or any thing done or any action taken under the Rules, so repealed under sub rule (1) supra shall be deemed to have validly made or done or taken under these rules.

In case of recruitment by promotion, deputation, transfer, grade from which promotion/ deputation/ transfer is to be made:—By promotion from amongst the Deputy Labour4963 राजपत्र, हिमाचल प्रदेश, 30 नवम्बर, 2013/9 अग्रहायण, 1935 Commissioners with three years regular service or regular combined with continuous adhoc service, if any, in the grade failing which by promotion from amongst the Deputy Labour Commissioners with eight years' regular service or regular combined with continuous adhoc service, if any, combined as Deputy Labour Commissioner & Labour Officer out of which two years essential service as Deputy Labour Commissioner.

(1) In all cases of promotion, the continuous adhoc service rendered in the feeder post, if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these Rules for promotion subject to the condition that the adhoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R & P Rules;

Provided that in all cases where a junior person becomes eligible for consideration by virtue of his/ her total length of service (including the service rendered on adhoc basis, followed by regular service/ appointment) in the feeder post in view of the provision referred to above, all persons senior to him/ her in the respective category/ post/ cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration;

Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of at least three years' or that prescribed in the R & P Rules for the post, whichever is less;

Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him/ her shall also be deemed to be ineligible for consideration for such promotion;

Explanation:—The last proviso shall not render the junior incumbent(s) ineligible for consideration for promotion if the senior ineligible person(s) happened to be Ex-Servicemen recruited under the provisions of Rule-3 of the Demobilized Armed Forces Personnel (Reservation of vacancies in Himachal State Non-Technical Service) Rules, 1972 and having been given the benefit of seniority there-under or recruited under the provisions of rule-3 of the Ex-Serviceman (Reservation of vacancies in the Himachal Pradesh Technical Services) Rules, 1985 and having been given the benefit of seniority there-under.

(2) Similarly, in all cases of confirmation, adhoc service rendered on the feeder post, if any, prior to the regular appointment/ promotion against such post shall be taken into account towards the length of service, if the adhoc appointment/ promotion had been made after proper selection and in accordance with the provision of the R & P Rules.

Provided that inter-se-seniority as a result of confirmation after taking into account, adhoc service rendered as referred to above shall remain unchanged.

12. If a Departmental Promotion Committee exists, what is its composition?.—As may be constituted by the Government from time to time.

13. Circumstances under which the H.P.P.S.C. is to be consulted in making recruitment:—As required under the Law.

14. Essential requirement for direct recruitment:—Not applicable.

15. Selection for appointment to post by direct recruitment:—Not applicable.

16. Reservation:—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes/ Scheduled Tribes/ Other Backward classes/ other categories of persons issued by the Himachal Pradesh Government from time to time.

17. Departmental Examination:—Every member of the service shall pass a Departmental Examination as prescribed in the H.P. Departmental Examination Rules, 1997, as amended from time to time.

18. Power to relax:—Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with the Himachal Pradesh Public Service commission relax any of the provision(s) of these Rules with respect to any Class or Category of person(s) or post(s).

संख्याः एफ0एफ0ई0-बी-ए(3)-2/2013.--हिमाचल प्रदेश की राज्यपाल, भारतीय वन अधिनियम, 1927(1927 का अधिनियम संख्यांक 16) की धारा 41 और 42 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश की क्षेत्रीय सीमाओं में, से और के भीतर भू-मार्ग द्वारा वन उपज के संचलन को विनियमित करने के लिए निम्नलिखित नियम बनाती है, अर्थातः--

1. संक्षिप्त नाम, विस्तार और प्रारम्भ.--(1 ) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश वन उपज अभिवहन (भू-मार्गों द्वारा) नियम, 2013 है ।

(2) ये नियम, सम्पूर्ण हिमाचल प्रदेश राज्य को लागू होंगे।

(3) ये तुरन्त प्रवृत्त हाेंगे।

2. परिभाषाएं.--(1) इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,--

(क) 'अधिनियम' से भारतीय वन अधिनियम, 1927 (1927 का अधिनियम संख्यांक 16) अभिप्रेत है;

(ख) 'धारा' से उक्त अधिनियम्‌ की धारा अभिप्रेत है;

(ग) 'मण्डल' से वन के प्रबन्धन के प्रयोजन के लिए गठित और सरकार द्वारा इस रूप में अधिसूचित वनों की कार्यपालक वन प्रबन्धन इकाई अभिप्रेत है;

(ध) ''वन मण्डल अधिकारी'' से, सम्बद्ध मण्डल के प्रभार को धारण करने वाला अधिकारी अभिप्रेत है;

(ङ) ''अरण्यपाल'' से सम्बद्ध वन वृत के प्रभार को धारण करने वाला अधिकारी अभिपे्रत है; और (च) पडताल ''चौकी'' से वन उपज की पड़ताल और संचलन को विनियमित करने के लिए इन नियमों के उपबन्धों के अधीन इस प्रकार विनिर्दिष्ट कोई चौकी अभिपे्रत है ।

(2) उन अन्य समस्त शब्दों और पदों के, जो इसमें प्रयुक्त हैं, किन्तु इन नियमों में परिभाषित नहीं है, वही अर्थ होंगे जो अधिनियम में उनके हैं ।

3. सम्पत्ति चिन्हों के साथ परिवहन.--कोई भी व्यक्ति ईंधन की लकड़ी, खैर की लकडी़, बांस, चारकाले, औषधीय पौधे, घास, छाल, पत्ते, तना, जडें, फूल, फल, काने सहित पौधों के अन्य भाग और बीज, जिनके उपर रजिस्ट्रीकरण चिन्ह छाप नहीं लगती है, से अन्यथा किसी वन उपज का परिवहन नहीं करेगा या परिवहन कारित नहीं करवाएगा ।

4. सम्पत्ति चिन्ह का रजिस्ट्रीकरण और इसका उपयोग.--(1) नियम 3 के अधीन से अन्यथा भूू-मार्गों द्वारा वन उपज के परिवहन के इच्छुक समस्त व्यक्ति, वन मण्डल अधिकारी के कार्यालय में चिन्ह या चिन्हों, जो ऐसी वन उपज में उनके साम्पत्तिक अधिकार उपदर्शित करते हैं, को रजिस्टर करेगा; परन्तु किसी इमारती लकड़ी, जिसका अधिकार धारक द्वारा केवल सम्बद्ध राजस्व सम्पदा के भीतर, उसके पक्ष में इस प्रभाव की मंजूरी के परिणामस्वरूप परिवहन किया जा रहा है, पर कोइ चिन्ह अंकित करना अपेक्षित नहीं है। 4966 राजपत्र, हिमाचल प्रदेश, 30 नवम्बर, 2013/9 अग्रहायण, 1935 (2) किसी व्यक्ति को कोई चिन्ह (चिन्हों को) जो पहले ही किसी व्यक्ति या विभाग के पक्ष में रजिस्ट्रीकृत है, रजिस्टर करना अनुज्ञात नहीं किया जाएगा । वन मण्डल अधिकारी किसी चिन्ह के रजिस्ट्रीकरण से इन्कार कर सकेगा, जो उसके अनुसार सरकारी विभाग द्वारा प्रयुक्त चिन्ह (चिन्हों को) से मिलता जुलता है या किसी अन्य व्यक्ति(यों) के पक्ष में रजिस्ट्रीकृत हुआ है।

5. रजिस्ट्रीकरण का प्रमाण पत्र जारी करना.--प्रत्येक व्यक्ति को जारी किए गए उसके चिन्ह के रजिस्ट्रीकरण के प्रमाण-पत्र में, रजिस्ट्रीकरण की तारीख, अवधि, जिसके लिए यह विधिमान्य है और फीस के संदाय की अभिस्वीकृति, प्रतिरूप या चिन्ह दर्शाया जाएगा ।

6. रजिस्ट्रीकरण प्रमाण पत्र की विधिमान्यता की अवधि.--रजिस्ट्रीकरण का प्रत्येक प्रमाण-पत्र, रजिस्ट्रीकरण की तारीख से तीन वर्ष की अवधि के लिए विधिमान्य होगा। प्रत्येक चिन्ह की बाबत रजिस्ट्रीकरण फीस पाचं सौ रूपए होगी और यदि किसी व्यक्ति के पक्ष में रजिस्टर किए जाने वाले चिन्हों की संख्या तीन से अधिक हो जाती है, तो ऐसे प्रत्येक अतिरिक्त चिन्ह के लिए फीस एक हजार रूपए होगी। तथापि किसी सरकारी विभाग द्वारा कोई फीस संदेय नहीं है ।

7. वन उपज के निर्यात या परिवहन के लिए पास जारी करना.--कोई भी पास, ईंधन की लकड़ी, खैर की लकडी, बांस, चारकाले, औषधीय पौध,े घास, छाल, पत्त,े तना, जडें, फूल, फल, काने सहित पौधों के अन्य भाग और बीज, जिनके उपर कोई रजिस्ट्रीकरण चिन्ह नहीं लग सकता है, से अन्यथा अचिन्हित वन उपज के लिए जारी नहीं किया जाएगा, जैसा कि इसमें इसके पश्चात्‌ उपबन्धित हैः--

(i) वन मण्डल अधिकारी निर्यात या परिवहन के लिए कोई पास जारी करने से इन्कार कर सकेगा, यदि उसके पास विश्वास करने का कारण है या किसी अन्य विधिमान्य कारण स,े कि आवेदक ने वन उपज को वैध रूप से अभिप्राप्त नहीं किया है । तथापि, पास को जारी करने से इन्कार स्वतः आख्यापक अभिलिखित आदेश के रूप में किया जाएगाय और

(ii) व्यक्ति जिसे पास जारी करने से इन्कार किया गया है, वह इन्कार करने की तारीख से पन्द्रह दिन के भीतर, सम्बद्ध क्षेत्र के प्रभारी मुख्य वन अरण्यपाल/वन अरण्यपाल को अपील कर सकेगा और अपील पर उसका आदेश अन्तिम होगा ।

8. वन उपज के परिवहन को प्रतिषिद्ध करना.--(1) कोई भी व्यक्ति भू-मार्गोंं द्वारा, उपाबन्ध 'घ' की अनुसची-। में अन्तर्विष्ट उपबन्धों के अनुसार प्राप्य और उसमें विनिर्दिष्ट पौधों की प्रजातियों से अभिप्राप्त के सिवाय, सम्बद्ध वन मण्डल अधिकारी या किसी अधिकारी या इस प्रकार प्राधिकृत व्यक्ति से पास अभिप्राप्त (उपाबन्ध-क ) किए बिना, किसी वन उपज का परिवहन करना या परिवहन करवाना कारित नहीं करेगा । नियम 8 के प्रयोजन के प्रयोजन के लिए स्पष्टीकरण.--वन मण्डल अधिकारी के अन्तर्गत मण्डल, जहां से संविदात्मक करार के अधीन वन उपज निकाली गई है, का प्रभार धारण करने वाला अधिकारी सम्मिलित होगा।

(2) उस वन उपज के मामले में, जो ऐसी प्रजातियों से अभिप्राप्त की गई है जिन्हें राज्य में लागू किसी विधि (अधिनियम, नियम या आदेश) के अधीन संग्रहण या कटान के लिए प्रतिषिद्ध किया गया है या जिन पर पाबंदी लगाई गई है, कोई ऐसा पास जारी नहीं किया जाएगा सिवाय इसके कि जब ऐसा संग्रहण उस अधिनियम, नियम या आदेश में उपबन्धित विनिर्दिष्ट उपबन्धों के अनुसार किया गया है।

(3) कोई भी व्यक्ति किसी इमारती लकड़ी का, चिरान के लिए सम्परिवर्तन करने हेतु या मार्ग में विक्रय करने हेतु परिवहन नहीं करेगा या परिवहन कारित नहीं करवाएगा ।

(4) कोई भी व्यक्ति, ईंधन की लकड़ी, लुगदी की लकड़ी, बांस और उपाबन्ध-घ की अनुसुची-1 में अन्तर्विष्ट उपबन्धों के अनुसार, प्राप्य और उसमें सूचीबद्ध पौधों की प्रजातियों से अभिप्राप्त के सिवाय किसी भी इमारती लकड़ी का परिवहन नहीं करेगा या परिवहन कारित नहीं करवाएगा जब तक कि इमारती लकड़ी पर4967 राजपत्र, हिमाचल प्रदेश, 30 नवम्बर, 2013/9 अग्रहायण, 1935 सम्बद्ध वन अरण्यपाल द्वारा प्राधिकृत वन अधिकारी द्वारा निर्यात हथौड़ा (हैमर) का चिन्ह (हैमर मार्क) समुचित रूप से नहीं लगाया गया हो ।

9. परिवहन मार्ग ओरेर अन्य शर्तें.--(1) पास जारी करने वाला प्राधिकारी एक मार्ग विनिर्दिष्ट करेगा केवल जिसके द्वारा ही वन उपज का हिमाचल प्रदेश से बाहर निर्यात के लिए परिवहन ऐसी रीति में हो कि वह वन उपज, आबकारी एवं कराधान विभाग द्वारा स्थापित निम्नलिखित बैरियरों में से किसी एक से होते हुए गुजरे (पार हो) :--

परन्तु ऐसा प्राधिकारी पड़ताल चौकी (चौकियों) को भी विनिर्दिष्ट करेगा, जहां वन उपज की मार्ग में अनिवार्यतः पड़ताल की जाएगी :

परन्तु यह और कि किसी वन डिपू या मध्यवर्ती डिपू या प्रेषण के प्रथम स्टेशन/डिपू से किसी इमारती लकडी़ या अन्य वन उपज का यानों, ट्रालियों, बैल गाड़ियों आदि में सूर्यास्त के पश्चात्‌ और सूर्योदय से पूर्व लदान नहीं किया जाएगा । सम्बद्व वन मण्डल अधिकारी, सूर्यास्त के पश्चात्‌ और सूर्योदय से पूर्व वन उपज के संचलन को नियंंित्रत करने के लिए यदि औचित्यपूर्ण हो, तो कोई और निर्बन्धन अधिरोपित कर सकेगा।

(2) यदि वन उपज का हिमाचल प्रदेश राज्य क्षेत्र से बाहर निर्यात नहीं किया जाना है, तो पास जारी करने वाला प्राधिकारी मार्ग विनिर्दिष्ट करेगा, केवल जिसके द्वारा ही वन उपज का परिवहन किया जा सकेगा और पड़ताल चौकी (चौकिया)ें का अवधारण भी करेगा, जहां पर इसकी अनिवार्यतः पड़ताल की जाएगी । (3) जारी करने वाला प्राधिकारी उन अन्य शर्तों को भी अवधारित करेगा, जिनके अध्यधीन पास जारी किया जाएगा और वह अवधि भी अवधारित करेगा जिसके लिए पास विधिमान्य रहेगा । तथापि, किसी पास की विधिमान्यता, किन्हीं भी परिस्थितियों में कोई विस्तार अनुज्ञात करने सहित, छह मास की अवधि से अधिक नहीं होगी। ऐसे पास को जारी करने के लिए सौ रूपए की फीस उद्धग्रहणीय होगी :

परन्तु हिमाचल प्रदेश राज्य से बाहर निर्यात किए जाने वाले बिरोजा की दशा में, दो सौ रूपए प्रति क्विंटल की दर से निर्यात फीस उद्‌गृहीत की जाएगी :

परन्तु उपाबन्ध-घ की अनुसुची-II में सूचीबद्ध प्रजातियों से अभिप्राप्त वन उपज की दशा में अनुज्ञापत्र फीस इसमें यथाविनिर्दिष्ट ही होगी :

परन्तु उपाबन्ध-घ की अनुसुची-II में सूचीबद्ध सहित उपाबन्ध-घ की अनुसुची-III में अन्तर्विष्ट उपबन्धों के अनुसार प्राईवेट भूमि पर उगाई गई प्रजातियों से अभिप्राप्त वन उपज की दशा में अनुज्ञा पत्र फीस सौ रूपए होगी :

परन्तु यह और कि उपाबन्ध-घ की अनुसुची-II में यथा सम्मिलित औषधीय पौधों की बाबत, जिनका परिवहन अधिसूचित जड़ी-बूटी (हर्बल)/कृषि मण्डियों को किया जाना आभयित है, अनुज्ञापत्र फीस उपाबन्ध-ङ में वर्णित प्रक्रिया की अनुसार उद्‌गृहीत की जाएगी ।

10. चालान (चालानों) का जारी किया जाना.--व्यक्ति जिसके पक्ष में पास जारी किया गया है, या उसका प्राधिकृत अभिकर्ता यदि एक ही बार में वह सम्पूर्ण वन उपज का परिवहन नहीं कर सकता है और वन उपज के साथ पास नहीं ले जा सकता है, तो वह वन उपज के साथ चालान (उपाबन्ध-ख) रखेगा । चालान अधिकतम साठ घण्टे के लिए विधिमान्य होगा ।

11. पड़त़ताल चौकी (चौकियों) स्थापित करना.--(1) वन मण्डल अघिकारी, अरण्यपाल की अनुज्ञा से, वन उपज की पड़ताल और जांच के प्रयोजन के लिए उपयुक्त स्थान (स्थानों) पर पड़ताल चौकी या पड़ताल चौकियों की स्थापना अधिसूचित कर सकेगा ।

(2) प्रत्येक पड़ताल चौकी पर, पड़ताल चौकी से जाने वाली वन उपज के ब्यौरे अभिलिखित करने के लिए रजिस्टर (उपाबन्ध-ख) रखा जाएगा ।

12. जांच के लिए पास/चालान का प्रस्तुत करना.--वन अधिकारी या पुलिस अधिकारी, वन उपज का परिवहन करने वाले किसी व्यक्ति से, किसी भी समय ऐसी उपज का परिवहन करने के लिए यथा जारी पास/चालान को प्रस्तुत करने की अपेक्षा कर सकेगा। कोई व्यक्ति पास/चालान, जिसे वह स्वयं धारित नहीं करता है किन्तु किसी अन्य व्यक्ति के पास है या किसी और के पास होने का कथन किया गया है, के आधार पर वन उपज का परिवहन करने का हकदार नहीं है।

13. वन उपज और अन्य वस्तुओं आदि को निरूद्ध करना.--पास/चालान को प्रस्तुत न किए जानेकी दशा में वन अधिकारी या पुलिस अधिकारी, वन उपज, यान, उँट, खच्चर आदि, जिसके द्वारा इसका परिवहन किया जा रहा था, को निरूद्व कर सकेगा तथा उसका संचलन तब तक कारित नहीं होने देगा जब तक वन उपज की युक्तियुक्त रूप से आवश्यक जांच न कर दी जाए या जब तक विधिमान्य पास/चालान प्रस्तुत नहीं कर दिया जाता है ।

14. वन उपज और अन्य वस्तुओं आदि का अभिग्रहण.--पास/चालान को प्रस्तुत न किए जाने की दशा में वन अधिकारी या पुलिस अधिकारी, वन उपज और परिवहन के साधनों तथा अन्य वस्तुओं का प्रवृत्त विधि के अनुसार अभिग्रहण करेगा ।

15. अधिकार धारकों को पास अभिप्राप्त करने की छूट.--इन नियमों में अन्तर्विष्ट किसी बात को होते हुए भी अधिकार धारक जिसने अपने अभिलिखित अधिकारों के प्रयोग में वन उपज का संग्रहण किया है, उस राजस्व सम्पदा के भीतर, जिसमें इसे इस प्रकार संगृहीत किया गया है, पास को अभिप्राप्त किए बिना ऐसी वन उपज का परिवहन कर सकेगा :

परन्तु वन से किसी भी ईमारती लकड़ी को तब तक नहीं हटाया जाएगा जब तक कि इसकी पड़ताल न की गई हो और इस पर हथौड़ा चिन्ह (हैमर मार्क) न लगाया गया हो तथा इस निमित्त प्राधिकृत वन अधिकारी द्वारा, निकाली गई ईमारती लकड़ी का ब्यौरा, अनुज्ञापत्र के दूसरी ओर न लिखा गया हो । 16. रेल द्वारा, डाक द्वारा और विमानपत्तन द्वारा वन उपज की बुकिंग का वर्जन.-- कोई भी व्यक्ति हिमाचल प्रदेश के भीतर किसी रेलवे स्टेशन से रेल द्वारा या किसी डाकघर से डाक द्वारा या किसी विमानपत्तन से हवाई सेवा द्वारा तब तक किसी वन उपज का निर्यात करने के लिए प्रस्ताव नहीं करेगा, जब तक कि यह इन नियमों के अधीन जारी पास के अन्तर्गत न आता हो और न ही रेलवे, डाक, विमानपत्तन प्राधिकरण रेल, डाक या हवाई सेवा द्वारा तब तक किसी वन उपज का परिवहन/पारेषण करने के लिए स्वीकार नहीं करेगा, जब तक कि इसके साथ विधिमान्य पास न हो ।

17. चिन्हों का परिवर्तन करने या विरूपण करने का वर्जन.--कोई भी व्यक्ति वन मण्डल अधिकारी की लिखित अनुज्ञा के बिना, किसी वन उपज पर लगाए गए किसी चिन्ह को अभिवहन के दौरान न तो परिवर्तित करेगा या न ही विरूपित करेगा या न ही मिटाएगा । 4970 राजपत्र, हिमाचल प्रदेश, 30 नवम्बर, 2013/9 अग्रहायण, 1935 18. नियमों के भंग के लिए शास्ति.--कोई भी व्यक्ति जो इन नियमों का उल्लंघन करता है तो वह कारावास से, जिसकी अवधि छह मास तक की हो सकेगी या जुर्माने से जो पांच हजार रूपए तक का हो सकेगा या दोनों से दंडनीय होगा और परिवहन की जा रही वन उपज भी अभिग्रहण की जा सकेगी तथा उस से भारतीय वन अधिनियम के उपबन्धों के अनुसार बरता जाएगा :

परन्तु उन मामलो में, जहां अपराध, सूर्यास्त के पश्चात्‌ या सूर्योदय से पूर्व किया जाता है या विधिपूर्ण प्राधिकारी के प्रतिरोध के पश्चात्‌ या जहां अपराधी उसी प्रकार के अपराध के लिए पहले भी दोषसिद्ध है, शास्तियां दोगुनी हो जाएंगी ।

19. निरसन और व्यावृत्तियां.--(1) इन नियमों के प्रारम्भ की तारीख को और से हिमाचल प्रदेश फॉरेस्ट प्रॉडयूस ट्रैंजिट (लैंड रूट्‌स) रूल्ज, 1978 का एतद्‌द्वारा निरसन किया जाता है ।

(2) ऐसे निरसन के होते हुए भी इस प्रकार निरसित नियमों के अधीन की गई कोई बात या कार्रवाई इन नियमों के तत्स्थानी उपबन्धों के अधीन की गई समझी जाएगी ।

टिप्पणः--(1) उत्तरी रेलवे के हिमाचल प्रदेश में किसी रेलवे स्टेशन से वन उपज के रेल द्वारा आरक्षित किए जाने की दशा में, सम्बद्ध स्टेशन मास्टर कृपया और पड़ताल सुकर बनाने हेतु पास के पीछे तारीख और मंजिल सहित इस प्रकार आरक्षित काष्ठ या अन्य किसी वन उपज की मात्रा पृष्ठांकित कर सकेगा ।

(2) अनुज्ञापत्र (पास) के अवसान के पश्चात्‌ प्राप्तिकर्ता कृपया रिपोर्ट करेगा कि क्या इसका उपयोग पूर्णतः या भागतः किया गया है ।

प्राईवेट भूमि पर उगने वाली और अभिवहन पास की अपेक्षा से छूट प्राप्त निम्नलिखित पौध प्रजातियोेंं से अभिप्रााप्त वन उपज

तथापि कुठ (साएसयूरिया कोस्टस (एस0लप्पां)का निर्यात वन्य जीव (संरक्षण) अधिनियम, 1972 की अपेक्षा को पूर्ण करने के अध्यधीन होगा ।

इस अनुसूची में सूचीबद्व और प्राईवेट भूमि में उगने वाली पौध प्रजातियों से अभिप्राप्त वन उपज का हटाया जाना और परिवहन करना निम्नलिखित उपबन्धों के अनुसार होगा :

(i) भूस्वामी स्थानीय वन रक्षक के माध्यम से सम्बद्ध वन परिक्षेत्र अधिकारी को फसल प्रारम्भ होने से पूर्व प्राप्ति के प्राक्कलन सहित, अनुसूची में सूचीबद्ध पौध प्रजातियों से वन उपज एकत्र करने की अपनी आश्य लिखित में सूचित करेगा ।

(ii) वन परिक्षेत्र अधिकारी स्वयं या अपने प्रतिनिधि के माध्यम से उस भूमि का, जिससे ऐसी फसल एकत्र की जानी प्रस्तावित है, निरीक्षण कर सकेगा और प्राप्ति सत्यापित करेगा ।

(iii) वन परिक्षेत्र अधिकारी, भस्ू वामी को प्राईवेट भूमि से अभिप्राप्त वन उपज के ब्यौरे देते हुए पत्र जारी करेगा ।

(iv) भूस्वामी इस पत्र को सत्यापित की गई उपज के परिवहन के दौरान साथ ले जाएगा ।

उत्पादको के रजिस्ट्रीकरण, प्राईवेट भूमि पर औषधीय पौधों की खेती ओर इस प्रकार अभिप्राप्त वन उपज के परिवहन से सम्बन्धित साधारण उपबन्ध

क. औषधीय पौधों की खेती के लिए उत्पादकों का रजिस्ट्रीकरण :

1. अपनी प्राईवेट भूमि पर अनुसूची-II में सूचीबद्ध औषधीय पौधों की खेती करने (उगानें) का आश्य रखने वाला/ वाली प्रत्येक उत्पादक सम्बद्ध वन मण्डल अधिकारी (डी0एफ0ओ0) के पास सौ रूपए की रजिस्ट्रीकरण फीस सदं त्त करके स्वयं का रजिस्ट्रीकरण करवा सकेगा/सकेगी। इस प्रयोजन के लिए उत्पादक, सम्बद्ध खण्ड के उप परिक्षेत्र अधिकारी को अनुसूची-3 (क) में दिए गए विनिर्दिष्ट प्रपत्र में रजिस्ट्रीकरण फीस सहित, द्विप्रतीक में पूर्ण आवेदन प्रस्तुत करेगा जो, (i) आवेदन की प्राप्ति की अभिस्वीकृति के पश्चात्‌, उत्पादक को एक प्रति वापस करेगा, और (iiं) आवेदन को सम्बद्ध वन परिक्षेत्र अधिकारी (आर0एफ0ओ0) को, वन मण्डल अधिकारी (डी0एफ0ओ0) के पास, रजिस्ट्रीकरण के लिए प्रस्तुत करेगा। रजिस्ट्रीकरण के पश्चात, वन रक्षक अनुसूची-3 (ख) में दिए प्रपत्र में आवेदन को प्रस्तुत करने के एक मास के भीतर आवेदक को रजिस्ट्रीकरण प्रमाण-पत्र साैंपेगा ।

2. आवेदक, रजिस्ट्रीकरण के लिए आवेदन के साथ रजिस्ट्रीकृत मुख्तारनामा प्रस्तुत करेगा, यदि भूमि उसके नाम नहीं है ।

3. रजिस्ट्रीकरण केवल उन्हीं प्रजातियों की बाबत विधिमान्य होगा, जिनके लिए रजिस्ट्रीकरण अभिप्राप्त किया गया है ।

4. रजिस्ट्रीकरण, रजिस्ट्रीकरण की तारीख से पांच वर्ष की अवधि के लिए विधिमान्य होगा और तत्पश्चात्‌ पुनः रजिस्ट्रीकरण करवाना आवश्यक होगा ।

ख औषधीय पौधों की खेती :

1. उत्पादक, स्थानीय वन रक्षक के माध्यम से सम्बद्ध वन परिक्षेत्र अधिकारी (आर0एफ0ओ0) को उसके द्वारा अपनी प्राईवेट भूमि पर खेती किए गए (उगाए गए) औषधीय पौधों की प्रजातियों के बारे में उनकी बुआई करने/पौध लगाने के एक मास के भीतर, सूचित करेगा।4977 राजपत्र, हिमाचल प्रदेश, 30 नवम्बर, 2013/9 अग्रहायण, 1935 2. उत्पादक केवल प्रमाणित स्त्रोतों से ही खेती के लिए बीज/जनन-द्रव्य प्राप्त करेगा और उनका वन्य स्त्रोतों से तब तक संग्रहण नहीं करेगा/नहीं हटाएगा, जब तक कि वन मण्डल अधिकारी द्वारा लिखित में अनुज्ञात न कर दिया जाए ।

3. उत्पादक उस वर्ष के राजस्व अभिलेख में औषधीय पौध की खेती वाली भूमि के खसरावार ब्यौरे दर्ज करवाएगा ।

4. वन परिक्षेत्र अधिकारी (आर0एफ0ओ0) या उसका प्रतिनिधि, औषधीय पौध खेती वाले खेतों का पक्वनावधि के दौरान दौरा कर सकेगा और ऐसी फसल की मात्रा और गुणवत्ता को प्रमाणित करेगा ।

5. उत्पादक, स्थानीय वन रक्षक के माध्यम से वन परिक्षेत्र अधिकारी (आर0एफ0ओ0) को खेती के समय के बारे में (i) कम से कम एक मास पूर्वोत्तर और (ii) फसल काटने के तुरन्त पश्चात्‌ सूचित करेगा ।

6. उत्पादक, अपनी भूमि पर औषधीय पौधों की खेती-बाड़ी से सम्बन्धित आवश्यक अभिलेख वन परिक्षेत्र अधिकारी (आर0एफ0ओ0) या उसके प्रतिनिधि को खेती के सत्यापन को सुकर करने के लिए उपलब्ध करवाएगा ।

ग. खेती के स्त्रोतों से अभिप्राप्त उपज का परिवहन :

1. उत्पादक या उसका प्राधिकृत प्रतिनिधि, इन नियमों के अधीन वन मण्डल अधिकारी (डी0एफ0ओ0) से आवश्यक अभिवहन पास अभिप्राप्त करने के पश्चात्‌ सामग्री का परिवहन करेगा । 2. खेती की उपज का परिवहन करने के अन्य विनियम, इन नियमों के उपबन्धों के अनुसार होंगे । घ. उपबन्धों के उल्लंघन के लिए शास्ति इत्यादि :

इस उपाबन्ध में अन्तर्विष्ट उपबन्धों के उल्लंघन की दशा में रजिस्ट्रीकरण रद्‌द कर दिया जाएगा और उपज अभिगृहीत कर ली जाएगी और आगामी कार्रवाई विधि के अनुसार की जाएगी ।

औषधीय पौधों बीज और विभिन्न एनटीएफपीज का अधिसूचित जड़ी-बूटी (हर्बल) मण्डियों को अभिवहन और उनकी बिक्री के लिए मार्गदर्शक सिद्वांत

1. इन नियमों की अनुसूची-''II'' के अधीन सूचीबद्व प्रजातियों में से, वन्य/खेतीहर भूमि से संगृहीत वन उपज को हिमाचल प्रदेश के भीतर अधिसूचित जड़ी-बूटी (हर्बल) मण्डियों (हिमाचल प्रदेश राज्य वन विकास निगम और/या एपीएमसी द्वारा सचांलित) में परिवहन का आश्य रखने वाले व्यक्ति, 10/-रुपये की अनुज्ञप्ति फीस के साथ उपाबन्ध-ङ (I) (आवेदन प्ररूप की फोटो प्रति नीचे दी गई है) पर हर्बल मण्डियों के लिए ''पास'' जारी करने हेतु वन मण्डलाधिकारी (डी0एफ0ओ0) को आवेदन करेंगे । हर्बल मण्डी को परिवहन की जाने वाली ऐसी वन उपज पर कोई निर्यात फीस उदगृहीत नहीं की जाएगी ।

2. वन मण्डलाधिकारी, अपने क्षेत्रीय कर्मचारीवृन्द से वन उपज को सत्यापित करवाने के पश्चात्‌ सत्यापन आवेदन की प्राप्ति के तीन दिन के भीतर, ऐसे आवेदक को उपाबन्ध-ङ (2) पर जड़ी -बूटी (हर्बल) मण्डियों को 'पास' (ऐसे पास का आदि प्ररूप नीचे उपाबन्ध-ङ (2) में दिया गया है) जारी करेगा। 3. आवेदक, जड़ी-बूटी (हर्बल) मण्डियों को, पास की प्राप्ति के सात दिन के भीतर विक्रय डिपो को माल का परिवहन करेगा ।

4. इस प्रकार अधिसूचित जड़ी-बूटी (हर्बल) मण्डियों में लाई गई उपज को विक्रय डिपो प्राधिकारियों सम्बद्ध द्वारा विनिर्दिष्ट निलामी नियमों के अनुसार नीलामी के लिए रखी जाएगी ।

5. बिक्रय के सफलतापूर्वक पूर्ण होने पर, सम्बद्ध वन मण्डलाधिकारी जिसकी अधिकारिता में जड़़ी-बूटी मण्डी आती है, क्रेता(आें) से इन नियमों के अधीन अनुसूची-II में विहित निर्यात फीस की वसूली के पश्चात्‌ अनिवार्य अभिवहन पास जारी करेगा ।

NOTIFICATION

Shimla-171 002, the 26th November, 2013

No. FFE-B-A(3)-2/2013.—In exercise of the powers conferred under sections 41 and 42 of the Indian Forest Act, 1927 (XVI of 1927), the Governor, Himachal Pradesh is pleased to make the following rules to regulate the movement of Forest Produce by land routes into, from and within the territorial limits of the Himachal Pradesh, namely:—

1. Short title, extent and commencement.— (1) These rules may be called the Himachal Pradesh Forest Produce Transit (Land Routes) Rules, 2013;

(2) They shall apply to the whole of the State of Himachal Pradesh;

(3) They shall come into force forthwith;

2. Definitions.— (1) In these rules, unless the context otherwise requires,—

(a) 'Act' means the Indian Forest Act, 1927 (XVI of 1927);

(b) 'section' means a section of the said Act;

(c) 'Division' means an executive forest management unit of forests constituted for the purpose of administration of forests and notified as such by the Government;

(d) 'Divisional Forest Officer' means an Officer holding the charge of the concerned division;

(e) 'Conservator of Forests' means an Officer holding the charge of the concerned forest circle; and

(f) 'Check Post' means any post so specified under the provisions of these rules for checking and regulating the movement of forest produce.

(2) All other words and expression used but not defined in these rules shall have the same meaning as assigned to them in the Act.

3. Transportation with property mark(s).— No person shall transport or cause to be transported any forest produce other than fuelwood, Khairwood, bamboos, charcoal, medicinal plants, grass, other plant parts including bark, leaves, stem, roots, flowers, fruits, cones, and seeds that does not bear the imprint of the registered mark.

4. Registration of property mark and its use.— (1) All persons willing to transport forest produce other than under rule 3 by land routes shall register at the office of the Divisional Forest Officer the mark or marks which indicate their propriety rights in such forest produce; provided that no mark is required to be imprinted on any timber which is being transported within the concerned revenue estate only by a right holder in consequence of a grant to that effect in his favour.

(2) No person shall be allowed to register any mark(s) already registered in favour of other persons or the Department. The Divisional Forest Officer may refuse registration of any mark (s) which according to him closely resemble(s) used by the Government Department or has/ have been registered in favour of some other person(s).

5. Issue of certificate of registration.—A certificate showing the facsimile or the mark, the date of registration, the period for which it is valid and acknowledging the payment of fees shall be issued to every person registering his mark (s).

6. Validity period of registration Certificate.—Every certificate of registration shall be valid for three years commencing from the date of registration. The registration fee in respect of each mark shall be Rs. 500 and if the number of marks to be registered in favour of one person exceeds three, the fee shall be Rs. 1000/- for each such additional mark. However, no fee is payable by any Government Department.

7. Issue of pass for Export or transport of Forest Produce.— No pass shall be issued for any unmarked forest produce other than fuelwood, khairwood, bamboos, charcoal, medicinal plants, grass, other plant parts including bark, leaves, stem, roots, flowers, fruits, cones and seeds as bears the marks not registered as herein after provided:-

(i) the Divisional Forest Officer may refuse to issue a pass for export or transport if he has reasons to believe or for any other valid reasons that the forest produce has not been legally obtained by the applicant. However, the refusal to issue a pass shall be made in the shape of self speaking written order; and

(ii) the person who has been refused the issue of pass may within fifteen days of the date of refusal prefer an appeal to the Chief Conservator/Conservator of Forests incharge of the area concerned and his orders on appeal shall be final.

8. Prohibition on transport of Forest Produce.- (1) No person shall transport or cause to be transported any forest produce, except that obtained from plant species specified in and obtained in accordance with provisions contained in Schedule - 'I' of Annexure-D by land routes, without obtaining pass (Annexure-'A') from the concerned Divisional Forest Officer or any officer or person so authorized.

Explanation for the purposes of rule 8:—Divisional Forest Officer shall include an officer

holding the charge of the Division from where the forest produce has been extracted under

contractual agreement.

(2) No such pass shall be issued in case of forest produce obtained from species declared as prohibited or banned for collection or harvesting under any law (Act, Rule or Order) applicable in the State except when such collection is carried out as per specific provisions provided in that Act, Rule or order.

(3) No person shall transport or cause to be transported any timber for conversion for sawing or for sale en route.

(4) No person shall transport or cause to be transported any timber except firewood, pulpwood , bamboo and that obtained from plant species listed in and obtained in accordance with provisions contained in Schedule - 'I' of Annexure –D unless the timber is properly affixed with an export hammer mark by the forest officer authorized by the Conservator of Forests concerned.

9. Transport Routes and other conditions.—(1) The authority issuing the pass shall specify a route by which alone the forest produce may be transported for export outside Himachal Pradesh in such a manner that the forest produce crosses through one of the following barriers established by the Excise and Taxation Department:—

Provided that such authority shall also specify the check post(s) where the forest produce shall be compulsory checked en-route:

Provided further that no timber or other forest produce from any forest depot or intermediate depot or first station/ depot of dispatch shall be loaded in vehicles, trollies, bullock carts etc. after sun-set and before sun rise. The Divisional Forest Officer concerned may further impose any restriction(s) if so warranted for controlling the movement of the forest produce after sun-set and before sun-rise.

(2) In case the produce is not to be exported outside the territory of Himachal Pradesh, the authority issuing the pass shall specify the route by which alone the forest produce may be transported and shall also determine the check post(s) where it shall be compulsory checked.

(3) The issuing authority shall also determine the other conditions subject to which the pass shall be issued and shall also determine the period for which the pass shall remain valid. However, the validity of any pass shall under no circumstances exceed a period of Six months including any extension(s) allowed. A fee of Rs. 100/- shall be leviable for the issue of such pass:

Provided that the export pass fee @ Rs 200/- per quintal shall be levied in case of resin to be exported outside the State of Himachal Pradesh:

Provided that permit fee in case of forest produce obtained from species listed in Schedule II of Annexure-"D", shall be as specified in it:

Provided that permit fee in respect of forest produce obtained from species, including that listed in Schedule-II of Annexure-"D", cultivated on private land in accordance with provisions contained in Schedule III of Annexure-'D' shall be Rs. 100/-:

Provided further that in respect of medicinal plants as included in Schedule-II of Annexure-'D', purported to be transported to the notified Herbal/ Agricultural Mandis, permit fee shall be levied in accordance with procedure detailed in Annexure-"E".

10. Issue of Challan (s).—The person in whose favour the pass has been issued or his authorized Agent shall carry a challan (Annexure- 'B') to accompany the forest produce in case all the forest produce cannot be transported at the same time and the pass cannot accompany the forest produce. The challan will be valid for a maximum 60 hours.

11. Setting up of check post (s).—(1) The Divisional Forest Officer may with the permission of the Conservator of Forests notify the setting up of a check post or check posts at suitable point(s) for purposes of check and examination of forest produce.

(2) At every check post, registers (Annexure-C) to record the details of forest produce passing through the check post shall be maintained.

12. Production of pass/challan for examination.—Forest Officer or Police Officer may at any time require any person transporting forest produce to produce the pass/challan as issued for4986 राजपत्र, हिमाचल प्रदेश, 30 नवम्बर, 2013/9 अग्रहायण, 1935 the transportation of such produce. No person is entitled to transport forest produce by virtue of pass/challan which he does not himself held but is or is stated to be in the hands of some other person.

13. Detention of Forest Produce and other articles etc.— In the event of the pass/challan not being produced, the Forest Officer or Police Officer may detain the Forest Produce, vehicle, camels, mules etc. by which it was being transported and cause the same not to move as long as may be reasonably necessary to examine the forest produce and/or till the valid pass/challan is produced.

14. Seizure of Forest Produce and other articles etc.— In the event of the pass/challan being not produced, the Forest Officer or Police Officer shall seize the forest produce and means of transport and other articles, in accordance with the law in force.

15. Exemption to right holders obtaining of pass.— Notwithstanding anything contained in these rules, a right-holder who has collected forest produce in exercise of his recorded rights may, without obtaining a pass transport such forest produce within the revenue estate in which it has been so collected:

Provided that no timber will be removed from the forests unless checked and hammer marked and detail of timber extracted written on the overleaf of the permit by the forest officer authorized in this behalf.

16. Bar on booking of forest produce by rail, by post and by air.— No. person shall offer any forest produce for export by rail on any railway station or by post at any post office or by air on any airport within Himachal Pradesh unless it is covered by the pass issued under these rules and nor Railway, Postal, Airport authority shall accept any forest produce for transport/transmission by rail, post or air, unless it is accompanied by a valid pass.

17. Bar on altering or defacing of marks.—No person shall without the written permission of the Divisional Forest Officer alter or deface or obliterate any mark placed on any forest produce while in transit.

18. Penalty for breach of rules.—Any person who contravene these rules shall be liable to imprisonment for a term which may extend to six months or with fine which may extend to rupees Five thousand or with both and the forest produce being transported may also be seized and dealt with under the provisions of the Indian Forest Act:

Provided that the penalties will be doubled in cases where the offence has been committed after sun-set or before sun-rise, or after resistance to the lawful authority or where the offender has been previously convicted for similar offence.

19. Repeal and Savings.—(1) On and from the date of commencement of these rules, the Himachal Pradesh Forest Produce Transit (Land Routes) Rules, 1978 are hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under the rules so repealed, shall be deemed to have been done or taken under the corresponding provisions of these rules.

*Export of Kuth (Saussurea costus/lappa) will however be subject to fulfillment of requirement under Wildlife (Protection) Act 1972.

The removal and transportation of the forest produce obtained from plants species listed in this schedule and growing on private lands shall be in accordance with the following provisions:

(i) The landowner shall intimate in writing to the concerned Range Forest Officer through the local Forest Guard of his intent to harvest the forest produce from plant species listed in this schedule along with estimate of yield before starting the harvest.

(ii) The Range Forest Officer may himself or through his representative inspect the land from which such harvest is proposed and verify the yield.

(iii) Range Forest Officer shall issue a letter to the landowner giving detail of forest produce obtained from private land.

(iv) The landowner shall carry this letter during transportation of the verified produce.

General Provisions relating to Registration of Grower, Cultivation of Medicinal Plants on

Private Land and Transportation of Produce so Obtained

A. Registration of Growers for Cultivation of Medicinal Plants:

1. Every grower intending to cultivate medicinal plants listed in Schedule-'II' on his/ her private land shall get himself/ herself registered with the concerned Divisional Forest Officer (DFO) by paying a registration fee of Rs. 100/-. For this purpose, the grower will submit completed applications in the specified format given in Schedule-III(A), in duplicate, alongwith registration fee to the Deputy Ranger of the concerned block, who will (i) return one copy to the grower after acknowledging the receipt of application, and (ii) submit the application to the concerned Range Forest Officer (RFO) for getting registered with the DFO. After registration, the Forest Guard will hand over the registration certificates, in the given format given in Schedule-III(B), to the applicant, within one month of submission of application.

2. Applicant shall submit registered power of attorney alongwith application for registration in case the land is not in his name.

3. The registration shall be valid only in respect of the species for which registration has been obtained.

4. Registration shall be valid for a period of five years from the date of registration, after which it would need to be re-registered.

B. Cultivation of Medicinal Plants: 1. The growers shall inform the concerned RFO through the local Forest Guard about the medicinal plant species cultivated by him/ her on his/ her private land within one month of sowing/ planting.

2. The grower shall procure seed/ germplasm for cultivation from certified sources only and shall not collect/ remove the same from wild resources, unless permitted in writing by the Divisional Forest Officer (DFO).

3. The grower shall get the khasra-wise land details bearing medicinal plant cultivation entered in the revenue records for the year.

4. The Range Forest Officer (RFO) or his representative may visit the fields under medicinal plant cultivation within the gestation period and certify the extent and quality of such crop.

5. The grower shall inform the Range Forest Officer through the local Forest Guard about the time of harvest (i) at least one month in advance, and (ii) immediately after harvesting.

6. The grower shall make the necessary records pertaining to the medicinal plant cultivation on his/ her land available to the RFO or his representative to facilitate verification of cultivation.

C. Transportation of Produce Obtained from Cultivated Sources:

1. The grower or his authorized person shall transport the material after obtaining necessary transit pass under these Rules from the Divisional Forest Officer.

2. Other regulations to transport the cultivated produce shall be as per the provisions of these rules.

D. Penalty, etc. for Violation of Provisions:

In case of violation of provisions contained in this annexure, the registration shall be cancelled and produce shall be seized and further action shall be taken as per law.

Guidelines for Transit of Medicinal Plants, Seeds and Miscellaneous NTFPs to the notified

Herbal Mandis and Sale thereof

1. Persons intending to transport forest produce, collected from wild/ cultivated land, of the species listed under Schedule-'II' of these rules to the notified Herbal Mandis (operated by HPSFDC and/ or APMC) within Himachal Pradesh, shall apply to the Divisional Forest Officer ( DFO) for issue of 'Pass' Nihanu to Herbal Mandis' on Annexure-E(I) (prototype of application form given below) along with a Permit Fee of Rs. 10/-. No export Fee will be leviable on such forest produce being transported to the herbal mandi.

2. The DFO shall issue 'Pass to Herbal Mandis' on Annexure-E(2) to such applicant after getting the forest produce verified from his field staff, within three (3) days of receipt of application verification (prototype of such pass given below as Annexure-E(2).

3. The applicant shall transport the material to the sale depot within 7 days of receipt of pass to Herbal Mandis.

4. The produce thus brought to the notified herbal mandis shall be put to auction by the concerned sale depot authorities as per specified auction rules.

5. On successful completion of sale, the concerned DFO in whose jurisdiction the herbal mandi exists shall issue the necessary Transit Pass under these rules to the buyer(s) after recovery of Export Fee prescribed in Schedule-II from the buyer (s).
