संख्या मुद्रण (बी) 10-4/2011.--हिमाचल प्रदेश की राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, समसंख्यक अधिसूचना तारीख 27-12-2012 द्वारा अधिसूचित, हिमाचल प्रदेश मुद्रण एवं लेखन सामग्री विभाग, जिल्दसाज़, वर्ग-III (अराजपत्रित) (अलिपिक वर्गीय सेवाएं), भर्ती और प्रोन्नति नियम, 2012 का और संशोधन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ः--

220-राजपत्र/2014-13-1-2014 (5661)5662 राजपत्र, हिमाचल प्रदेश, 13 जनवरी, 2014/23 पौष, 1935 1. संक्षिप्त नाम और प्रारम्भ.--(i) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश मुद्रण एवं लेखन सामग्री विभाग, जिल्दसाज़, वर्ग-III (अराजपत्रित) (अलिपिक वर्गीय सेवाएं) (प्रथम संशोधन) नियम, 2014 है। (ii) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. उपाबन्ध "क" का संशोधन.--हिमाचल प्रदेश मुद्रण एवं लेखन सामग्री विभाग जिल्दसाज़, वर्ग- III (अराजपत्रित) (अलिपिक वर्गीय सेवाएं), भर्ती और प्रोन्नति नियम, 2012, (जिन्हें इसमें इसके पश्चात्‌ "उक्त नियम" कहा गया है) के उपाबन्ध 'क' में :--

स्तम्भ संख्या 15-क में : (VII) निबन्धन और शर्तें के खण्ड (ङ) के विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा; अर्थात्‌ :--

"संविदा पर नियुक्त पदधारी जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया है, आवश्यकता के आधार पर स्थानातरण हेतु पात्र होगा, जहां भी प्रशासनिक आधार पर ऐसा करना अपेक्षित हो।"

3. उपाबन्ध "ख" का संशोधन.--"उक्त नियमों'' के उपाबन्ध 'ख' में विद्यमान निबन्धन और शर्ते संख्या : 6 के उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा; अर्थात्‌ :--

संविदा के आधार पर नियुक्त पदधारी, जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया है, आवश्यकता के आधार पर स्थानातरण हेतु पात्र होगा, जहां भी प्रशासनिक आधार पर ऐसा करना अपेक्षित हो।

No: Mudran (B)10-4/2011.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the H.P. Public Service Commission is pleased to make the following rules further to amend the Himachal Pradesh Printing and Stationery Department, Binder, Class-III (Non-Gazetted) (Non-Ministerial-Services), Recruitment and Promotion Rules, 2012, notified vide Notification of even number dated 27-12-2012, namely :—

1. Short Title and Commencement.—(i) These rules may be called the Himachal Pradesh Printing and Stationery Department Binder, Class-III (Non-Gazetted) (Non-Ministerial- Services), Recruitment and Promotion (1st Amendment) Rules, 2014.

(ii) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Annexure "A".—In Annexure "A" to the Himachal Pradesh Printing and Stationery Department Binder, Class-III (Non-Gazetted) (Non-Ministerial-Services), Recruitment and Promotion Rules, 2 012, (hereinafter referred to as the said rules);

for the existing provisions against the Col No.15-A VII (e) of the said rules , the following shall be substituted namely;

"An official appointed on contract basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative grounds."

4. Amendment of Annexure "B".—In Annexure "B" to the said rules, for the existing terms and condition No: 6, the following shall be substituted, namely :—

"An official appointed on contract basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative grounds."

No: Mudran (B)10-4/2011.—In the English version of Himachal Pradesh Printing and Stationery Department, Binder, Class-III (Non-Gazetted) (Non-Ministerial-Services) Recruitment and Promotion Rules, 2012, notified vide this Department Notification of even number dated 27-12-2012, published in the Himachal Pradesh Rajpatra dated 28-1-2013, in the provision against Col. No: 15-A, for the words, "appointment to the", words "appointment to the post" shall be substituted.

(ii) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Annexure-"A".—In Annexure "A" to the Himachal Pradesh Printing and Stationery Department, Developer, Class-III (Non-Gazetted), Recruitment and Promotion Rules, 2012 (hereinafter referred to as the said rules);

For the existing clause (e) of the terms and conditions against the provisions of Col. No.15- A (VII), the following shall be substituted, namely;

No: Mudran (B)10—9/2010.—In the English version of Recruitment and Promotion Rules for the post of Developer, Class-III (Non-Gazetted) Recruitment and Promotion Rules, 2012 notified vide this Department Notification of even number dated 27-12-2012, and published in the Rajpatra Himachal Pradesh on 28-1-2013, in the existing proviso of Clause (c) of the Terms and Conditions, against Col. No: 15-A (VII) of the said rules, for the words, "unavialed" words "unavailed" shall be substituted.

सं0पी0बी0डव्ल्यू0(बी0)एफ-(5) 17/2013.--यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि हिमाचल प्रदेश सरकार को सरकारी व्यय पर सार्वजनिक प्रयोजन हेतु गांव बनीयाला, तहसील नालागढ़, जिला सोलन, हिमाचल प्रदेश मेेंं राष्ट्रीय उच्च मार्ग-21ए पिन्जौर-बद्‌दी-नालागढ़-स्वारघाट को चौड़ा करने के निर्माण हेतु भूमि अर्जित करनी अपेक्षित है, अतएव एतद्‌द्वारा यह घोषित किया जाता है कि निम्नलिखित विवरणी में वर्णित भूमि उपर्युक्त प्रयोजन के लिए अपेक्षित है।

2. यह घोषणा, भूमि अर्जन अधिनियम, 1894 की धारा-6 के उपबन्धों के अधीन इससे सम्बन्धित सभी व्यक्तियों को सूचना हेतु की जाती है तथा उक्त अधिनियम की धारा-7 के अधीन भू-अर्जन समाहर्ता लोक निर्माण विभाग, विन्टर फिल्ड शिमला को उक्त भूमि के अर्जन करने के आदेश लेने का एतद्‌द्वारा निदेश दिया जाता है।

HIMACHAL PRADESH ELECTRICITY REGULATORY COMMISSION, SHIMLA

NOTIFICATION

Shimla, the 10th January, 2014

No. HPERC/Secy/151.—In exercise of the powers conferred by sub-section (1) of section 92 and clause (zl) of sub-section (2) of section 181 of the Electricity Act, 2003 (36 of 2003), read with section 21 of the General Clauses Act, 1897 (10 of 1897), and all other powers enabling it in this behalf, and after previous publication, the Himachal Pradesh Electricity Regulatory Commission makes the following amendment in the Himachal Pradesh Electricity Regulatory Commission (Conduct of Business) Regulations, 2005, namely:—

REGULATIONS

1. Short title and commencement.—(1) These regulations may be called the Himachal Pradesh Electricity Regulatory Commission (Conduct of Business) (Seventh Amendment) Regulations, 2014.

(2) These regulations shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Regulation 2.—In regulation 2 of the Himachal Pradesh Electricity Regulatory Commission (Conduct of Business) Regulations, 2005 (hereinafter referred as "the said regulations" after clauses (c) and (i), the following clauses (ca) and (ia) shall be respectively added, namely:—

"(ca) "interlocutory application" means an application filed in any petition or proceeding already instituted before the Commission, but does not include an application for review;

(ia) "review petition" means the petition filed by any person under section 94(1) of the Act or regulation 63 of these regulations or any subsequent enactment thereof for review of the order or decision or directions of the Commission;".

3. Amendment of Regulation 11.—After sub-regulation (2) of regulation 11 of the said regulations, the following proviso shall be added:—

"Provided that where the Commission initiates suo-motu proceedings, the notice inviting public response shall clearly indicate the proposal of the Commission and shall be inserted/ uploaded/published in public domain for seeking suggestions and objections of the public." 4. Amendment of Regulation 22.—In sub-regulation (7) of regulation 22 of the said regulations, after the word "communicated" the words "within seven days" shall be inserted.

5. Insertion of Regulations 24-A and 24-B.—At the end of Chapter-II of the said regulations, the following new regulations 24-A and 24-B shall be inserted, namely:—

"24-A. Register of Petitions/Appeals.—(1) A register in Form CB 12-A (Annexure- XA) shall be maintained in regard to the petitions and appeals filed against the orders, decisions or directions of the Commission—

(i) before the High Court; (ii) before the Appellate Tribunal for Electricity; or (iii) before the Supreme Court of India;

and necessary entries' therein be promptly made in the Judicial Section of the Commission.

(2) The register shall be placed for scrutiny by the Chairperson in the first week of every month.

24-B. Placing of Supreme Court/High Court/Appellate Tribunal Orders before the Commission.—Whenever an interim or final order passed by the Supreme Court of India, or the Appellate Tribunal for Electricity or the High Court in any petition or appeal or other proceeding preferred against the order, decision or direction of the Commission is received, the same shall forthwith be placed before the Chairperson/Members for information and kept in the relevant case file. Immediate attention of the Secretary shall be drawn to the directions requiring compliance and it shall be the duty of the Secretary to take expeditious steps to comply with the directions of the Supreme Court of India, High Court or the Appellate Tribunal for Electricity as the case may be".

6. Amendment of Regulation 26.—In sub-regulation (3) of regulation 26 of the said regulations, after the word "proceedings" the words "and or by the beneficiaries of technical feasibility studies/general studies in proportion to the benefit to be derived by them" shall be inserted.

7. Amendment of Schedule.—In the Schedule to the said regulations.—

(A) the existing serial No. 1 shall be renumbered as serial No. 1-a and before renumbered serial No.1-a, the following serial No. 1 shall be inserted, namely.—

"1. Application/processing fee CBR 27 ` 1 lakh or any such other amount for grant of licence under the as may be prescribed by the State Act.

Govt. under section 15 of the Act;" (B) in renumbered serial No.1-a.—

(a) against item (iii) for figure and words "25 lakh per annum", the words and figures "`1 lakh minimum for 100 MUs or less plus `50,000/- for every additional 50 MUs or part thereof", shall be substituted;

(b) item (v) shall be omitted; and

(c ) in item (vi) clause (c) shall be omitted;

(C) for serial No. 2, the following serial No. 2 shall be substituted, namely:—

Therefore, the general public is hereby informed through this notice that any person who has any objection regarding this marriage can file the objection personally or in writing before this Court on or before 19-2-2014. The objection received after 19-2-2014 will not be entertained and marriage will be registered accordingly.
