संख्याःटी0पी0टी0-सी(9)-1/2002.--हिमाचल प्रदेश की राज्यपाल, हिमाचल प्रदेश मोटरयान कराधान अधिनियम, 1972 (1973 का अधिनियम संख्यांक-4) की धारा 14 की उपधारा (3) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और इस निमित जारी समस्त पूर्व आदेशों/अनुदेशों के अधिक्रमय में, उक्त अधिनियम के अधीन समस्त कराधान प्राधिकारियों को, हिमाचल प्रदेश राज्य में किसानों द्वारा अपने कृषि प्रयोजन के लिए उपयोग किए जा रहे/उपयोग किए जाने वाले ट्रैक्टरों की बाबत, ऐसे ट्रैक्टरों के स्वामी द्वारा निम्नलिखित शर्तों को पूर्ण करने के अध्यधीन, पूर्वोक्त अधिनियम की धारा 3 के अधीन उद्‌यग्रणीय कर के संदाय से लोक हित में छूट प्रदान करने हेतु प्राधिकृत करती हैः-

245-राजपत्र/2014-13-2-2014 (6633)6634 राजपत्र, हिमाचल प्रदेश, 13 फरवरी, 2014/24 माघ, 1935 1. टै्रक्टर स्वामी के कब्जे में, कम से कम एक हैक्टर कृषि भूमि, जो टै्रक्टर के उपयोग से जोती जा सके, होनी चाहिए।

2. भूमि उस स्वामी, जो छूट के लिए आवेदन करता है, के अपने नाम से होनी चाहिए, और परिवार द्वारा संयुक्तः स्वामित्व वाली भूमि पर विचार नहीं किया जाएगा।

3. भू धृति से सम्बन्धित राजस्व कागजात, इसकी किस्म (वर्गीकरण), संबद्ध कराधान प्राधिकारी, जिसकी अधिकारिता में ट्रैक्टर रजिस्ट्रीकृत किया जाना है, को, तहसीलदार द्वारा सम्यव्य रूप से प्रतिहस्ताक्षारित संबद्ध पटवारी की रिपोर्ट सहित, प्रस्तुत किए जाएंगे।

4. इस प्रभाव का शपथ पत्र, कि स्वामी टै्रक्टर का उपयागे अपनी भूमि के संबंध में अपने वास्तविक वैयक्तिक उपयोग के लिए करेगा और टै्रक्टर का उपयोग किसी वाणिज्यिक प्रयोजन हेतु नहीं किया जाएगा।

5. संबद्ध क्षेत्र के पटवारी/प्रधान की रिपोर्ट, कि स्वाामी, टै्रक्टर का उपयोग, केवल कृषि प्रयोजनों के लिए कर रहा है।

6. ट्रैक्टर के स्वामी के पास कृषि प्रयोजन हेतु उपयोग में लाए जाने वाले टै्रक्टर को चलाने के लिए विधिमान्य अनुज्ञाप्ति होनी चाहिए।

7. कर की छूट प्रति किसान, केवल एक टै्रक्टर तक सीमित होगी।

टोकन कर के संदाय से छूट प्रदान करने हेतु मामले पर विवार करने से पूर्व, समस्त संबद्ध कराधान प्राधिकारी, आवेदक/टै्रक्टर के स्वामियों द्वारा दिए जाने वाले उपरोक्त दस्तावेजों के साथ-साथ टै्रक्टर के स्वामी द्वारा क्रमशः उपाबंध "क एवं ख" के रूप में संलग्न शपथ पत्र और प्रारूप का सत्यापन सुनिश्चित करेंगे।

NOTIFICATION

Shimla-2, the 30th January, 2014

TPT-C(9)-4/2013.—In exercise of the powers conferred by sub-section 14 (3) of Himachal Pradesh Motor Vehicles Taxation Act, 1972 (Act No. 4 of 1973) and in supersession of all previous orders/instructions issued in this behalf, the Governor, Himachal Pradesh is pleased to authorize all Taxation Authorities under the said Act to grant exemption from the payment of tax leviable under section 3 of the Act ibid, in respect of tractors being used/to be used by farmers for his agricultural purpose in the State of Himachal Pradesh, subject to the fulfillment of the following conditions by the owner of such tractor in the public interest:—

1. The tractor owner should be in possession of atleast 1 hectare of agricultural land which can be tilled through the use of a tractor.

2. The land should solely be in the name of the owner who applies for exemption and the land owned jointly by the family shall not be considered.

3. The revenue papers relating to land holding, its KISAM (classification), shall be submitted to the concerned Taxation Authority in whose jurisdiction the tractor is to be registered alongwith the report of the concerned Patwari duly countersigned by the Tehsildar.

4. Affidavit to the effect that the owner will use the tractor for his own bonafide personal use in relation to his own land and that the tractor shall not be used for any commercial purpose.

5. Report of the Patwari/Pardhan of the area concerned that the owner is using the tractor for agricultural purposes only.

6. The owner of tractor should have valid license for driving the Tractor to be used for agriculture purpose.

7. The exemption of Tax shall be limited to only one tractor per farmer.

Before considering the case for granting exemption from the payment of token tax, all concerned taxation authorities shall ensure verification of above documents to be tendered by the applicant/owners of tractor as well as the affidavit and Performa attached by the owner of tractor as Annexure "A and B" respectively.

Subject: 'Letter of Intent' to set up Private University in Himachal Pradesh.

Sir,

I am directed to refer to your letter No. AES/NRC-Uni.-2009-10-1696 dated 3rd October, 2009 on the subject cited above and to issue the 'Letter of Intent' as per the provisions under para- 6636 राजपत्र, हिमाचल प्रदेश, 13 फरवरी, 2014/24 माघ, 1935 10 of the Guidelines dated 19th November, 2009 published in H.P. Rajpatra on 20th November, 2009 for establishing Abhilashi University in district Mandi in Himachal Pradesh, subject to the following conditions:—

1. (a) establish an endowment fund of five crore rupees in accordance with the provisions of para 11 of the guidelines;

(b) acquire atleast 50 bighas/100 kanals land on ownership basis or on lease from Government/Government Institution/Local Bodies for a lease period of atleast 30 years;

(c) acquire and construct a minimum of 15,000 square meters of covered space and that 100 percent of the area should be used for educational and academic purposes;

(d) purchase books and journals, including subscription thereof, of at least worth ten lacs rupees or as per the norms of regulating bodies, whichever is higher, and give an undertaking to incur expenditure for library networking and other facilities so as to well equip the library and to provide adequate facilities within first three years which shall not be less than thirty lacs rupees or as per the norms of regulating body, whichever is higher;

(e) Purchase equipment, computers, furniture, other movable and immovable assets and infrastructure facilities [(except buildings, under clause(b)] worth one hundred lacs rupees or as per the norms of the regulating bodies, whichever is higher, and give an undertaking to procure within the first five years equipment, computers, furniture, other movable and immovable assets and infrastructure facilities other than buildings under clause (b) worth not less than three hundred lacs rupees or as per the norms of regulating bodies, whichever is higher;

(f) give an undertaking to provide at least 25% reservation in admissions in each course to the students who are bonafide Himachalis on the basis of merit;

(g) give an undertaking to appoint at least one Professor, two Associate Professors and adequate number of Lecturers alongwith necessary supporting staff in each department or discipline at least one month before commencement of studies;

(h) give an undertaking to take up co-curricular activities like seminars, debates, quiz programmes and extra-curricular activities like games, sports, National Service Scheme, National Cadet Corps etc. for the benefit of students as per the norms laid down by the regulating bodies;

(i) give an undertaking for the establishment of provident fund and to take up welfare programmes for the employees;

(j) give an undertaking not to dissolve the University before twenty five years of its establishment;

(k) fulfil such other conditions and provide such information as may be prescribed by the University Grants Commission, All India Council for6637 राजपत्र, हिमाचल प्रदेश, 13 फरवरी, 2014/24 माघ, 1935 Technical Education or any other statutory body established by the law of the Central or the State Government;

(l) give an undertaking that the V.C. will be appointed as per the Guidelines of University Grants Commission/ State Government;

(m) give an undertaking that the assets of the university without liabilities free from all encumbrances will vest with the Government if the university is dissolved before twenty five years;

(n) give an undertaking that assets without liabilities free from all encumbrances will vest with the Government if the university is dissolved on account of contravention of the provisions of Act, Rules, Statutes, Ordinances, Regulations, directives of the Government/other bodies;

(o) Essentiality Certificate will be issued after issuance of Letter of Intent by the Government. The Government will also fix an upper limit of land for issue of Essentiality Certificate keeping in view the Project Report;

(p) Deviation from courses for which Letter of Intent has been issued will only be allowed with the prior approval of the Government; and

(q) give an undertaking that 80% of the Class-III and Class-IV posts to be filled in from the Bonafide Himachalis. In other posts also Bonafide Himachalis will be given preference.

(r) fulfil such other conditions and provide such information as may be prescribed by the University Grants Commission, All India Council of Technical Education or any other statutory body established by the law of the Central or State Government;

(s) Trust/Society/Company which is the Governing Body should get its subsidiary Trust/Society registered in the state of Himachal Pradesh to run its private university in the state;

(t) Infrastructure requirement of building, labs, libraries etc. should be further truncated into requirement of each course of study that the university wants to start;

(u) The Endowment Fund should be accompanied by an undertaking (in the form of an affidavit) and instructions to the Bank that the FDR will be automatically renewable;

(v) Post of Pro-Vice Chancellor may not be approved as per UGC guidelines.

(w) The sponsoring body shall seek approval of the concerned statutory Regulatory Authorities before starting the courses;

(x) The Certificate courses may not be approved for private universities;

(y) The twinning programmes with Foreign Universities are not approved for the time being. The sponsoring body should supply the details for reconsideration of the same.

2. (i) The sponsoring body shall establish an Endowment Fund for the university with an amount of five crore rupees which shall be pledged to the Government :

Provided that if the university is to be established in a tribal area, the amount of Endowment Fund shall be one crore rupees.

(ii) The endowment Fund shall be kept as security deposit to ensure strict compliance of the provisions of these guidelines and the provisions under the Act enacted for the University, rules, regulations, statutes, ordinances made thereunder.

(iii) The government shall have the powers to forfeit, in the prescribed manner, a part or whole of the Endowment Fund in case the university or the sponsoring body contravenes any of the provisions of these guidelines and the provisions under the Act enacted for the University, rules, regulations, statutes, ordinances made thereunder.

(iv) Income from Endowment Fund shall be utilized for the development of infrastructure of the university but shall not be utilized to meet out the recurring expenditure of the university.

(v) The amount of Endowment Fund shall be kept invested, until the dissolution of the university, by way of Fixed Deposit Accounts in any Scheduled Bank subject to the condition that this Fund shall not be withdrawn without the permission of the Government.

3. The sponsoring body shall fulfill the requirements and conditions specified in Para-I above and any other condition specified later within a period of two years from the date of issue of this 'Letter of Intent' and report compliance to the Government.

4. On receipt of compliance report, the Government shall refer it to the Committee constituted under para 4, of the guidelines dated 19th November, 2009 to verify the compliance report and to submit its report to the Government within one month from the date of receipt thereof from the Government specifying whether the sponsoring body has fulfilled the requirements and conditions laid down in para-10 of the guidelines.

5. If the sponsoring body fails to comply with the provisions of para-1 above and para- 10 of the Guidelines, its proposal shall stand rejected and the 'Letter of Intent' issued under the Guidelines shall stand cancelled.

6. The Government may further extend the time up to six months to the sponsoring body if there exists sufficient reasons for the delay.

7. For purchase of land, you should apply to the Principal Secretary (Education) for issue of Essentiality Certificate and any Essentiality Certificate issued earlier shall stand withdrawn.

8. You are, therefore, requested to fulfill the above requirements and conditions within a period of two years from the date of issuance of this letter and report compliance.
