262-राजपत्र/2014-07-03-2014 (7067)7068 राजपत्र, हिमाचल प्रदेश, 7 मार्च, 2014/16 फाल्गुन, 1935 यह घोषणा भूमि अर्जन अधिनियम, 1894 की धारा-6 के उपबन्धों के अधीन इससे सम्बन्धित सभी व्यक्तियों की सूचना हेतू की जाती है तथा उक्त अधिनियम की धारा 7 के अधीन भू-अर्जन समाहर्ता शिमला (ग्रामीण) जिला शिमला, हिमाचल प्रदेश को उक्त भूमि के अर्जन करने के आदेश लेने का एतद द्वारा निर्देश दिया जाता है।

भूमि का रेखांक भू-अर्जन अधिकारी एवं उपमण्डल समाहर्ता शिमला (ग्रामीण) जिला शिमला हिमाचल प्रदेश के कार्यालय में निरीक्षण किया जा सकता है।

(राज्यपाल महोदया द्वारा तारीख 3 मार्च, 2014 को यथाअनुमोदित)

हिमाचल प्रदेश गृह-रक्षक दल अधिनियम, 1968 (1968 का अधिनियम संख्यांक 20) का और संशोधन करने के लिए अधिनियम।

भारत गणराज्य के चौंसठवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित होः-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश गृह-रक्षक दल (संशोधन) अधिनियम, 2013 है ।

(2) यह 08 अक्तूबर, 2013 को प्रवृत्त हुआ समझा जाएगा।

2. धारा 5 का संशोधन.--हिमाचल प्रदेश गृह-रक्षक दल अधिनियम, 1968, (1968 का 20) की धारा 5 में,-

(क) उपधारा (1) के स्थान पर निम्नलिखित उपधारा रखी जाएगी, अर्थात्‌ः-

''(1) यथास्थिति, महाआदेशक या आदेशक सरकार के पूर्व अनुमोदन से व्यक्तियों की ऐसी संख्या जैसी सरकार द्वारा अवधारित की जाए सीधे अपने नियन्त्रण के अधीन कमॉँड के किसी कार्यालय में गृह-रक्षक दल के स्वयंसेवकों के रूप में अभ्याविष्ट कर सकेगा, जो सेवा करने के लिए उपयुक्त और रजामन्द हैं।''; और

(ख) उपधारा (2) का लोप किया जाएगा।

3. 2013 के हिमाचल प्रदेश अध्यादेश संख्यांक 6 का निरसन और व्यावृत्तियां.--(1) हिमाचल प्रदेश गृह-रक्षक दल (संशोधन) अध्यादेश, 2013 का एतद्‌द्वारा निरसन किया जाता है ।

(2) ऐसे निरसन के होते हुए भी इस प्रकार निरसित अध्यादेश के अधीन की गई कोई बात या कार्रवाई इस अधिनियम के तत्स्थानी उपबन्धों के अधीन की गई समझी जाएगी ।

Act No. 8 of 2014 THE HIMACHAL PRADESH HOME GUARDS (AMENDMENT) ACT, 2013 (AS ASSENTED TO BY THE GOVERNOR ON 3RD MARCH, 2014)

ACT

further to amend the Himachal Pradesh Home Guards Act, 1968 (Act No. 20 of 1968).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty- fourth Year of the Republic of India as follows:—

1. Short title and commencement.—(1) This Act may be called the Himachal Pradesh Home Guards (Amendment) Act, 2013.

(2) It shall be deemed to have come into force on 8th day of October, 2013.

2. Amendment of section 5.—In section 5 of the Himachal Pradesh Home Guards Act, 1968, (20 of 1968),—

(a) for sub-section (1), the following sub-section shall be substituted, namely:—

"(1) The Commandant General or the Commandant, as the case may be, may enrol, with the prior approval of the Government, such number of persons, who are fit and willing to serve, as may be determined by it, as volunteers of the Home Guards to any office of command under his immediate control."; and (b) sub-section (2) shall be omitted.

3. Repeal of H. P. Ordinance No. 6 of 2013 and savings.—(1) The Himachal Pradesh Home Guards (Amendment) Ordinance, 2013 is hereby repealed.

(2) Notwithstanding such repeal anything done or any action taken under the Ordinance so repealed shall be deemed to have been done or taken under the corresponding provisions of this Act.

2. धारा 10 का संशोधन.--हिमाचल प्रदेश न्यायालय अधिनियम, 1976, (1976 का 23) (जिसे इसमें इसके पश्चात्‌ ''मूल अधिनियम'' कहा गया है) की धारा 10 में, "पन्द्रह लाख" शब्दों के स्थान पर ''तीस लाख'' शब्द रखे जाएंगे।

3. धारा 21 का संशोधन.--मूल अधिनियम की धारा 21 की उपधारा (1) के खण्ड (क) में, ''दस लाख'' शब्दों के स्थान पर ''बीस लाख'' शब्द रखे जाएंगे।

4. 2013 के हिमाचल प्रदेश अध्यादेश संख्यांक 5 का निरसन और व्यावृत्तियां.--(1) हिमाचल प्रदेश न्यायालय (संशोधन) अध्यादेश 2013 का एतद्‌द्वारा निरसन किया जाता है।

और हिमाचल प्रदेश की राज्यपाल का समाधान हो गया है कि पूर्वोक्त योजना क्षेत्र में, भू-उपयोग में परिवर्तन या उस पर किसी निर्माण संक्रिया से सतह या किसी भूमि या मिट्‌टी पर हानिकारक अवरोध होने की सम्भावना है या मिट्‌टी के संरक्षण, भूमि खिसकने से रोकथाम करने या कटाव से संरक्षण हेतु हानिकारक समझा गया है और पूर्वोक्त अधिनियम के उपबन्धों के अनुसार उक्त क्षेत्र की योजना बनाना और विकास करना कठिन होने की सम्भावना है;

अतः हिमाचल प्रदेश की राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा 15-क की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, ''सुन्दरनगर योजना क्षेत्र'' के विद्यमान भू-उपयोग पर, इस अधिसूचना के राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से तीन वर्ष की अवधि के लिए रोक लगाती है।

No. TCP- F (5)-3/2011.—Whereas "Sundernagar Planning Area" has been constituted under sub-section (1) of Section-13 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No 12 of 1977) vide Notification No. TCP-F(5)-3/2011 Dated 04.03.2014

And whereas, Existing Land Use Map of the said Planning Area has not yet been published under sub-section (1) of Section-15 of the aforesaid Act;

And whereas, the Governor of Himachal Pradesh is satisfied that in the aforesaid Planning Area, the change of land use or any building operation therein is likely to cause injurious disturbance of the surface or any land or soil, or is considered detrimental to the preservation of the soil, prevention of land slips or protection against erosion and is likely to make it difficult to plan and develop the said area in accordance with the provisions of the aforesaid Act;

Now, therefore, in exercise of the powers conferred by sub - section (1) of Section 15-A of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor of Himachal Pradesh is pleased to freeze the Existing Land Use of the "Sundernagar Planning Area" for a period of three years from the date of publication of this Notification in the Official Gazette, Himachal Pradesh.
