संख्याः एल0एल0आर0ए0(3)-1/2013.--हिमाचल प्रदेश की राज्यपाल, विधिक सेवा प्राधिकरण अधिनियम, 1987 (1987 का अधिनियम संख्यांक 39) की धारा 6 की उपधाराओं (5) और (6) के साथ पठित धारा 28 की उपधारा (2) के खण्ड (ङ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश उच्च न्यायालय के मुख्य न्यायमूर्ति के परामर्श से, इस विभाग की अधिसूचना संख्याः एल. एल. आर-बी (14)-4/96 तारीख 27-9-1997 द्वारा अधिसूचित और राजपत्र, हिमाचल प्रदेश (साधारण) में तारीख 7-3-1998 को 264-राजपत्र/2014-11-03-2014 (7135) 7136 राजपत्र, हिमाचल प्रदेश, 11 मार्च, 2014/20 फाल्गुन, 1935 प्रकाशित हिमाचल प्रदेश विधिक सेवाएं प्राधिकरण, वरिष्ठ सहायक वर्ग-III, (अराजपत्रित) लिपिक वर्गीय सेवाएं भर्ती और प्रोन्नति नियम, 1997 का और संशोधन करने के लिए निम्ननिलिखत नियम बनाती हैें, अर्थात्‌ः--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश विधिक सेवाएं प्राधिकरण वरिष्ठ सहायक, वर्ग-III, (अराजपत्रित) लिपिक वर्गीय सेवाएं भर्ती और प्रोन्नति (प्रथम संशोधन) नियम, 2014 है।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे । 2. उपाबन्ध 'क' का संशोधन.--हिमाचल प्रदेश विधिक सेवाएं प्राधिकरण वरिष्ठ सहायक, वर्ग-III, (अराजपत्रित) लिपिक वर्गीय सेवाएं भर्ती और प्रोन्नति नियम, 1997 (जिन्हें इसमें इसके पश्चात्‌ उक्त नियम कहा गया है) के उपाबन्ध 'क' में स्तम्भ संख्या 15-क की क्रम संख्याः VII के खण्डों (ग) और (ङ) के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः--

"(ग) संविदा पर नियुक्त व्यक्ति एक मास की सेवा पूरी करने के पश्चात, एक दिन के आकस्मिक अवकाश का हकदार होगा। तथापि संविदा पर नियुक्त कर्मचारी बारह सप्ताह के प्रसूति अवकाश और दस दिन के चिकित्सा अवकाश के लिए भी हकदार होगा/होगी। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 इत्यादि के लिए भी हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगा :

परन्तु अनुपभुक्त आकस्मिक अवकाश और चिकित्सा अवकाश, एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा।

(ङ) संविदा पर नियुक्त पदधारी जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया है, आवश्यकता के आधार पर स्थानातरण हेतु पात्र होगा, जहाँ भी प्रशासनिक आधार पर ऐसा करना अपेक्षित हो। "।

3. उपाबन्ध 'ख' का संशोधन.--उक्त नियमों के उपाबन्ध-'ख' में क्रम संख्याओं 4 और 6 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः--

"4. संविदा पर नियुक्त वरिष्ठ सहायक एक मास की सेवा पूरी करने के पश्चात्‌, एक दिन के आकस्मिक अवकाश का हकदार होगा। तथापि संविदा पर नियुक्त कर्मचारी बारह सप्ताह के प्रसूति अवकाश और दस दिन के चिकित्सा अवकाश के लिए भी हकदार होगा/होगी। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 इत्यादि के लिए भी हकदार नहीं होगा/होगी। संविदा पर नियुक्त वरिष्ठ सहायक को उपरोक्त के सिवाय अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगा :

No. LLR-A(3)-1/2013.—In exercise of the powers conferred by clause (e) of sub-section (2) of section 28 read with sub-sections (5) and (6) of section 6 of the Legal Services Authorities Act, 1987 (Act No. 39 of 1987), the Governor, Himachal Pradesh in consultation with the Chief Justice of the Himachal Pradesh High Court, is pleased to make the following rules further to amend the Himachal Pradesh State Legal Services Authority, Sr. Assistant Class-III, (Non Gazetted), Ministerial services, Recruitment and Promotion Rules, 1997 notified vide this Department Notification No. LLR-B(14)-4/96 dated 27-9-1997 and published in the Rajpatra, Himachal Pradesh (Ordinary) dated 7-3-1998, namely :—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh State Legal Services Authority, Sr.Assistant Class-III, (Non-Gazetted),Ministerial Services Recruitment and Promotion (First Amendment) Rules, 2014.

(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Annexure-'A'.—In Annexure–A to the Himachal Pradesh State Legal Services Authority, Sr. Assistant Class-III, (Non- Gazetted), Ministerial Services, Recruitment and Promotion Rules, 1997, (hereinafter referred to the said rules) for the provisions against clause (c) and (e) of Serial No. VII of Column No. 15-A, the following shall be substituted, namely :—

"(c) Contract Appointee will be entitled for one day's casual leave after putting one month service. However, the contract employee will also be entitled for 12 weeks Maternity Leave and 10 day's Medical Leave. He/She shall not be entitled for Medical Re- imbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee.

Provided that the un-availed Casual Leave and Medical Leave can be accumulated upto the Calendar Year and will not be carried forward for the next Calendar Year.

(e) An official appointed on contract basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative grounds.".

3. Amendment of Annexure-'B'.—In Annexure–B of the said rules for the existing provisions against Serial No. 4 and 6, the following shall be substituted, namely:—

2. The District Level Committee will look into the following matters related to electricity:-

(i) to co-ordinate and review the extension of electricity in each district;

(ii) to review the quality of power supply and consumer satisfaction;

(iii) to promote energy efficiency and its conservation and

(iv) to monitor/review all the schemes of rural electrification including Rajiv Gandhi Grameen Vidyutikaran Yojana (RGGVY).

3. This committee will co-ordinate for smooth efficient development of power system in the State.

4. he committee will meet at least once in every quarter.

Whereas the said programme was further modified vide Notification No. SEC.13-103/2013 2936-3000 dated 20-8-2013;

Whereas the Deputy Commissioner Mandi has brought to the notice of this Commission that the work of electoral roll of Municipal Council Mandi could not be completed due to technical difficulty in ERMS. software;

Whereas the Deputy Commission Mandi now is ready to publish the Electoral Rolls of Municipal Council Mandi after completion of all stages as required under the H.P. Municipal (Election) Rules, 1994;

Therefore, the State Election Commission in exercise the power vested in it under Article 243 ZA of the Constitution of India, Section 281 of Himachal Pradesh Municipal Act 1994 read with Rule 3 of Himachal Pradesh Municipal (Election) Rules 1994 hereby orders that the electoral roll of Municipal Council Mandi shall be finally published on 12th March, 2014.

The earlier notification dated 8-8-2013 to 20-8-2013 are modified to this extent in respect of Municipal Council Mandi.
