संख्या एल0एल0आर0ए0(3)-1/2013.--हिमाचल प्रदेश की राज्यपाल, विधिक सेवा प्राधिकरण अधिनियम, 1987 (1987 का अधिनियम संख्यांक 39) की धारा 6 की उपधाराओं (5) और (6) के साथ पठित धारा 28 की उपधारा (2) के खण्ड (ङ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश उच्च न्यायालय के मुख्य न्यायमूर्ति के परामर्श से, इस विभाग की अधिसूचना संख्या एल एल आर -ए (3)-2/2002 तारीख 25-11-2004 द्वारा अधिसूचित और राजपत्र, हिमाचल प्रदेश (साधारण) में तारीख 18-12-2004 को प्रकाशित हिमाचल प्रदेश विधिक सेवाएं प्राधिकरण, चौकीदार वर्ग-IV, (अराजपत्रित) भर्ती और प्रोन्नति नियम, 2004 का और संशोधन करने के लिए निम्ननिलिखत नियम बनाती हैें, अर्थात्ः-
1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश विधिक सेवाएं प्राधिकरण चौकीदार, वर्ग-IV (अराजपत्रित) भर्ती और प्रोन्नति (प्रथम संशोधन) नियम, 2014 है।
(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे । 2. उपाबन्ध 'क' का संशोधन.--हिमाचल प्रदेश विधिक सेवाएं प्राधिकरण चौकीदार, वर्ग-IV, (अराजपत्रित) भर्ती और प्रोन्नति नियम, 2004 (जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है) के7173 राजपत्र, हिमाचल प्रदेश, 13 मार्च, 2014/22 फाल्गुन, 1935 उपाबन्ध 'क' में स्तम्भ संख्या 15-क की क्रम संख्या VII के खण्डों (ग) और (ङ) के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्ः-
"(ग) स्ांविदा पर नियुक्त व्यक्ति एक मास की सेवा पूरी करने के पश्चात, एक दिन के आकस्मिक अवकाश का हकदार होगा। तथापि संविदा पर नियुक्त कर्मचारी बारह सप्ताह के प्रसूति अवकाश और दस दिन के चिकित्सा अवकाश के लिए भी हकदार होगा/होगी। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 इत्यादि के लिए भी हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगा :
परन्तु अनुपभुक्त आकस्मिक अवकाश और चिकित्सा अवकाश, एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा। (ङ) संविदा पर नियुक्त पदधारी जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया है, आवश्यकता के आधार पर स्थानातरण हेतु पात्र होगा, जहाँ भी प्रशासनिक आधार पर ऐसा करना अपेक्षित हो।"।

No. LLR-A(3)-1/2013.—In exercise of the powers conferred by clause (e) of sub-section (2) of section 28 read with sub-sections (5) and (6) of section 6 of the Legal Services Authorities7174 राजपत्र, हिमाचल प्रदेश, 13 मार्च, 2014/22 फाल्गुन, 1935 Act, 1987 (Act No.39 of 1987), the Governor, Himachal Pradesh in consultation with the Chief Justice of the Himachal Pradesh High Court, is pleased to make the following rules further to amend the Himachal Pradesh State Legal Services Authority, Chowkidar, Class-IV, (Non- Gazetted), Recruitment and Promotion Rules, 2004 notified vide this Department Notification No. LLR-A(3)-2/2002 dated 25.11.2004 and published in the Rajpatra, Himachal Pradesh (Ordinary) dated 18.12.2004, namely : -
1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh State Legal Services Authority, Chowkidar,Class-IV, (Non-Gazetted), Recruitment and Promotion (First Amendment) Rules, 2014.
(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.
2. Amendment of Annexure –A.— In Annexure-A to the Himachal Pradesh State Legal Services Authority, Chowkidar,Class-IV, (Non-Gazetted), Recruitment and Promotion Rules, 2004 (hereinafter referred to the said rules) for the provisions against clause (c) and (e) of Serial No. VII of Column No. 15-A, the following shall be substituted, namely :-
"(c) Contract Appointee will be entitled for one day's casual leave after putting one month service. However, the contract employee will also be entitled for 12 weeks Maternity Leave and 10 day's Medical Leave. He/She shall not be entitled for Medical Re-imbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee :
Provided that the un-availed Casual Leave and Medical Leave can be accumulated upto the Calendar Year and will not be carried forward for the next Calendar Year.
(e) An official appointed on contract basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative grounds.".
3. Amendment of Annexure-'B'.—In Annexure–B of the said rules for the provisions against Serial No. 4 and 6 the following shall be substituted, namely :-
"4. Contractual Chowkidar will be entitled for one day's casual leave after putting in one month service. "(ग) स्ांविदा पर नियुक्त व्यक्ति एक मास की सेवा पूरी करने के पश्चात, एक दिन के आकस्मिक अवकाश का हकदार होगा। तथापि संविदा पर नियुक्त कर्मचारी बारह सप्ताह के प्रसूति अवकाश और दस दिन के चिकित्सा अवकाश के लिए भी हकदार होगा/होगी। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 इत्यादि के लिए भी हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगा :
परन्तु अनुपभुक्त आकस्मिक अवकाश और चिकित्सा अवकाश, एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा। (ङ) संविदा पर नियुक्त पदधारी जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया है, आवश्यकता के आधार पर स्थानातरण हेतु पात्र होगा, जहाँ भी प्रशासनिक आधार पर ऐसा करना अपेक्षित हो ।"।

No. LLR-A(3)-1/2013.—In exercise of the powers conferred by clause (e) of sub-section (2) of section 28 read with sub-sections (5) and (6) of section 6 of the Legal Services Authorities7179 राजपत्र, हिमाचल प्रदेश, 13 मार्च, 2014/22 फाल्गुन, 1935 Act, 1987 (Act No.39 of 1987), the Governor, Himachal Pradesh in consultation with the Chief Justice of the Himachal Pradesh High Court, is pleased to make the following rules further to amend the Himachal Pradesh State Legal Services Authority, Clerk Class-III, (Non- Gazetted), Recruitment and Promotion Rules, 1997 notified vide this Department Notification No. LLR- B(14)-4/96 dated 27.9.1997 and published in the Rajpatra, Himachal Pradesh (Ordinary) dated 21.3.1998, namely : -
1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh State Legal Services Authority, Clerk Class-III, (Non-Gazetted), Recruitment and Promotion (First Amendment) Rules, 2014.
(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.
2. Amendment of Annexure –A.—In Annexure-A to the Himachal Pradesh State Legal Services Authority, Clerk Class-III, (Non-Gazetted), Recruitment and Promotion Rules, 1997 (hereinafter referred to the said rules) for the provisions against clause (c) and (e) of Serial No. VII of Column No. 15-A, the following shall be substituted, namely :-
"(c) Contract Appointee will be entitled for one day's casual leave after putting one month service. He/She shall not be entitled for Medical Re-imbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee :
Provided that the un-availed Casual Leave and Medical Leave can be accumulated upto the Calendar Year and will not be carried forward for the next Calendar Year.
(e) An official appointed on contract basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative grounds.".
3. Amendment of Annexure-'B'.—In Annexure –B of the said rules for the existing provisions against Serial No. 4 and 6, the following shall be substituted, namely :-
" 4. Contractual Clerk will be entitled for one day's casual leave after putting in one month service. However, the contract employee will also be entitled for 12 weeks Maternity Leave and 10 day's Medical Leave. He/She shall not be entitled for Medical Re-imbursement and LTC etc. No leave of any other kind except above is admissible to the contractual Clerk :
Provided that the un-availed Casual Leave and Medical Leave can be accumulated upto the Calendar Year and will not be carried forward for the next Calendar Year.
6. An official appointed on contract basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative grounds.".

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश विधिक सेवाएं प्राधिकरण चालक, वर्ग-III (अराजपत्रित) भर्ती और प्रोन्नति (प्रथम संशोधन) नियम, 2014 है।

No. FDS-A(3)02/2009.—In exercise of the powers conferred under Section 10 (1) of the National Food Security Ordinance, 2013, the Governor, Himachal Pradesh, is pleased to notify the Rajiv Gandhi Anna Yojana Guidelines for identification of priority households under National Food Security Ordinance, 2013.
A. Following categories of persons shall be automatically included in the list of Eligible households:
1. All families identified as AAY beneficiaries in the state as per the updated lists approved during the gram sabha meetings on 7th of April 2013.
2. All families, identified as Below poverty line households (BPL) and Additional households for subsidized rations at BPL ratesand are not already covered under AAY scheme as per the updated lists approved by the respective gram Panchayats during the gram sabha meetings on 7th of April 2013.
3. Households with any member receiving pensions from Department of Social Justice and Empowerment like Old age pension, widow pension, disabled pension, Lepers pension.

5. Tibetans who are being issued PDS permit after proper verification.
In case of a situation, where a households name figures in more than one category, the
name of the household shall be considered once.
B. Inclusion/Exclusion criteria for left out households:
The maximum number of households, which can be included in the list of eligible household in each Gram Panchayat and Urban body, shall be limited to maximum 56.23 % for rural areas and 30.99 % for urban areas. Based on the total number of house holds, each Local body (Gram Panchayat/Urban body) shall calculate the number of households, which are to be covered in the Eligible household category. In case, in a local body, some households are to be identified for eligible household category even after automatic inclusion of families as per the criteria specified in Para A above, the balance households are to be identified using the following criteria:
1. Inclusion criteria:
The households in a Local body shall be included in the list in the following order of priority:
(i) Aikal Naris.
(ii) Orphans, abandoned children and those residing in Ashrams.
(iii) Household headed by a widow.
(iv) Household with any member having more than 60% disability duly certified by medical board.
(v) Households headed by terminally ill person.
(vi) Households headed by person of sixty years of age or more with no assured means of subsistence or social support.
(vii) Households headed by a person registered as construction worker under the provisions of the Building and other construction workers (Regulation of employment and conditions of service) Act, 1996.
(viii) Households who have completed 50 mandays of work under MGNREGA in the year before.
2. Exclusion criteria:
Following households shall be automatically excluded from being Eligible households:
(i) All the households whose any member is a regular or a contractual employee in any State or Central Government, Boards, Corporations, Autonomous Bodies, Banks, Govt Sector undertakings and Local bodies shall be excluded.
(ii) Any household, which is an Income Tax payee household, shall be excluded from the list of Priority Households.

(iv) Any household whose any member is drawing pension from any State or Central Government, Boards, Corporations, Autonomous Bodies, Banks, Govt. Sector undertakings and Local bodies.
In case a household falls in both inclusion criteria and exclusion criteria, the exclusion
criteria shall prevail and such household shall not be considered for inclusion in the list of Eligible
household.
C. Process of selection of households:
1. The selection of the Left out households shall be done by respective Gram Panchayats through their gram sabhas in case of rural areas and by Municipal Corporation/committee/Nagar Panchayat in case of urban areas.
2. For this purpose a special day shall be fixed for holding meetings after approval of the Rural/ Urban development department.
3. Every Gram sabha/ Urbanbody shall at the start of the meeting inform the number of left out households, which are to be, identified as Eligible households.
4. The Gram sabhas/ urban bodies shall thereafter start including the households in order of priority keeping in view the exclusion criteria till the desired number is arrived at.
5. After identification, the list of identified Eligible Households (AAY and Priority) shall be displayed by the concerned Gram Panchayat/ Urban body on their notice board/ website.
6. Any person aggrieved by the decision of the gram sabha/ Urban body can file an appeal with the concerned SDO (Civil) with in a period of 15 days from the date of the meeting of the gram sabha/Urban body where after no appeal shall lie. The SDO may based on the merits of the case order for inclusion/ exclusion of any family in the eligible household and the list of eligible households shall be modified accordingly by the concerned Panchayat Secretary/ Executive officer of the urban body.
7. The process of selection by the local bodies shall be completed within one month of the notification of these guidelines.
8. The final list of Eligible households shall be made available in the respective fair price shop.
D. Issuance of ration cards:
As the process to issue fresh ration cards is likely to take some time, to start with, all the existing ration cards of the families identified as Priority Households shall be stamped as such by the Specified Authority defined under HP Specified Articles (Regulation of Distribution) Order, 2003 or as instructed by the Director (Food, Civil Supplies and Consumer Affairs) for receiving their entitlements.

उपरोक्त प्रार्थिन दमोदरी ने इस अदालत में एक आवेदन-पत्र प्रस्तुत किया है। जिसमें निवेदन किया है कि उसकी दो पोतियों का नाम व जन्म तिथियां ग्राम पंचायत डलाह में दर्ज नहीं करवा सकी है। उक्त पोतियों का जन्म उसकी पुत्र वधु श्रीमती रीना देवी पत्नी श्री राधे श्याम पुत्र श्री नाग के पास गांव सनेड में हुआ है। प्रार्थिन दोनों की जन्म तिथियां व नाम ग्राम पंचायत डलाह में दर्ज करवाना चाहती है। जिनका नाम मुस्कान पुत्री श्री राधे श्याम जन्म तिथि 17-7-2004 व कुमारी शिवानी पुत्री श्री राधे श्याम जन्म तिथि 15-2-2007 है, परन्तु अज्ञानता के कारण वह उक्त पोतियों का नाम व जन्म पंजीकरण स्थानीय पंचायत डलाह में नहीं करवा सकी। अतः अनुरोध किया है कि स्थानीय पंचायत को आदेश पारित किए जाएं। अतः इस इश्तहार द्वारा सर्वसाधारण को सूचित किया जाता है कि किसी व्यक्ति को उक्त नाम व जन्म तिथियों के पंजीकरण करने बारा कोई एतराज हो तो वह असालतन या वकालतन तारीख पेशी 5-4-2014 को सुबह 10.00 बजे हाजिर होकर अपना एतराज पेश कर सकता है बसूरत गैर-हाजिरी एकपक्षीय कार्यवाही अमल में लाई जाएगी।
