संख्या एल0एल0आर0ए0(3)-1/2013.--हिमाचल प्रदेश की राज्यपाल, विधिक सेवा प्राधिकरण अधिनियम, 1987 (1987 का अधिनियम संख्यांक 39) की धारा 6 की उपधाराओं (5) और (6) के साथ पठित धारा 28 की उपधारा (2) के खण्ड (ङ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश उच्च न्यायालय के मुख्य न्यायमूर्ति के परामर्श से, इस विभाग की अधिसूचना संख्याः एल. एल. आर-बी (14)-4/96 तारीख 27-9-1997 द्वारा अधिसूचित और राजपत्र, हिमाचल प्रदेश (साधारण) में तारीख 11-7-1998 को प्रकाशित हिमाचल प्रदेश विधिक सेवाएं प्राधिकरण, विधिक साक्षरता समन्वयक, वर्ग-III (अराजपत्रित) भर्ती और प्रोन्नति नियम, 1997 का और संशोधन करने के लिए निम्ननिलिखत नियम बनाती हैें, अर्थात्‌ः-

267-राजपत्र/2014-14-3-2014 (7199)7200 राजपत्र, हिमाचल प्रदेश, 14 मार्च, 2014/23 फाल्गुन, 1935 1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश विधिक सेवाएं प्राधिकरण विधिक साक्षरता समन्वयक, वर्ग-III (अराजपत्रित) भर्ती और प्रोन्नति (प्रथम संशोधन) नियम, 2014 है।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे । 2. उपाबन्ध 'क' का संशोधन.--हिमाचल प्रदेश विधिक सेवाएं प्राधिकरण विधिक साक्षरता समन्वयक, वर्ग-III, (अराजपत्रित) भर्ती और प्रोन्नति नियम, 1997 (जिन्हें इसमें इसके पश्चात्‌ उक्त नियम कहा गया है) के उपाबन्ध 'क' में स्तम्भ संख्या 15-क की क्रम संख्या VII के खण्डों (ग) और (ङ) के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

"(ग) स्ांविदा पर नियुक्त व्यक्ति एक मास की सेवा पूरी करने के पश्चात, एक दिन के आकस्मिक अवकाश का हकदार होगा। तथापि संविदा पर नियुक्त कर्मचारी बारह सप्ताह के प्रसूति अवकाश और दस दिन के चिकित्सा अवकाश के लिए भी हकदार होगा/होगी। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 इत्यादि के लिए भी हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगा :

परन्तु अनुपभुक्त आकस्मिक अवकाश और चिकित्सा अवकाश, एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा। (ङ) संविदा पर नियुक्त पदधारी जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया है, आवश्यकता के आधार पर स्थानातरण हेतु पात्र होगा, जहां भी प्रशासनिक आधार पर ऐसा करना अपेक्षित हो ।"।

3. उपाबन्ध 'ख' का संशोधन.--उक्त नियमों के उपाबन्ध-'ख' में क्रम संख्याओं 4 और 6 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

"4. स्ांविदा पर नियुक्त विधिक साक्षरता समन्वयक एक मास की सेवा पूरी करने के पश्चात्‌, एक दिन के आकस्मिक अवकाश का हकदार होगा। तथापि संविदा पर नियुक्त कर्मचारी बारह सप्ताह के प्रसूति अवकाश और दस दिन के चिकित्सा अवकाश के लिए भी हकदार होगा/होगी। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 इत्यादि के लिए भी हकदार नहीं होगा/होगी। संविदा पर नियुक्त विधिक साक्षरता समन्वयक को उपरोक्त के सिवाय अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगा :

No. LLR-A(3)-1/2013.—In exercise of the powers conferred by clause (e) of sub-section (2) of section 28 read with sub-sections (5) and (6) of section 6 of the Legal Services Authorities Act, 1987 (Act No. 39 of 1987), the Governor, Himachal Pradesh in consultation with the Chief Justice of the Himachal Pradesh High Court, is pleased to make the following rules further to amend the Himachal Pradesh State Legal Services Authority, Legal Literacy Co-Ordinator, Class-III (Non- Gazetted), Recruitment and Promotion Rules, 1997 notified vide this Department Notification No. LLR-B(14)-4/96 dated 27.9.1997 and published in the Rajpatra, Himachal Pradesh (Ordinary) dated 11.7.1998, namely :—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh State Legal Services Authority, Legal Literacy Coordinator, Class-III, (Non-Gazetted), Recruitment and Promotion (First Amendment) Rules, 2014.

(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Annexure-A.—In Annexure-A to the Himachal Pradesh State Legal Services Authority, Legal Literacy Co-ordinator, Class-III, (Non-Gazetted), Recruitment and Promotion Rules, 1997 (hereinafter referred to the said rules) for the provisions against clause (c) and (e) of Serial No. VII of Column No. 15-A, the following shall be substituted, namely :-

"(c) Contract Appointee will be entitled for one day's casual leave after putting one month service. However, the contract employee will also be entitled for 12 weeks Maternity Leave and 10 day's Medical Leave. He/She shall not be entitled for Medical Re-imbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee :

Provided that the un-availed Casual Leave and Medical Leave can be accumulated upto the Calendar Year and will not be carried forward for the next Calendar Year.

(e) An official appointed on contract basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative grounds.".

3. Amendment of Annexure-'B'.—In Annexure –B of the said rules for the existing provisions against Serial No. 4 and 6, the following shall be substituted, namely :-

"4. Contractual Legal Literacy Co-Ordinator will be entitled for one day's casual leave after putting in one month service. However, the contract employee will also be entitled for 12 weeks Maternity Leave and 10 day's Medical Leave. 1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh State Legal Services Authority, Senior Scale Stenographer, Class-III, (Non-Gazetted), Recruitment and Promotion (First Amendment) Rules, 2014.

(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

संख्याः एल0एल0आर0ए0(3)-1/2013.--हिमाचल प्रदेश की राज्यपाल, विधिक सेवा प्राधिकरण अधिनियम, 1987 (1987 का अधिनियम संख्यांक 39) की धारा 6 की उपधाराओं (5) और (6) के साथ पठित धारा 28 की उपधारा (2) के खण्ड (ङ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश उच्च न्यायालय के मुख्य न्यायमूर्ति के परामर्श से, इस विभाग की अधिसूचना संख्याः एल. एल. आर-ए (3)-2/2002 तारीख 3-7-2003 द्वारा अधिसूचित और राजपत्र, हिमाचल प्रदेश (असाधारण) में तारीख 17-7-2003 को प्रकाशित हिमाचल प्रदेश विधिक सेवाएं प्राधिकरण, विधि अधिकारी वर्ग-II (राजपत्रित) भर्ती और प्रोन्नति नियम, 2003 का और संशोधन करने के लिए निम्ननिलिखत नियम बनाती हैं, अर्थात्‌ः-- 1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश विधिक सेवाएं प्राधिकरण विधि अधिकारी, वर्ग-II (राजपत्रित) भर्ती और प्रोन्नति (प्रथम संशोधन) नियम, 2014 है। (2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. उपाबन्ध 'क' का संशोधन.--हिमाचल प्रदेश विधिक सेवाएं प्राधिकरण विधि अधिकारी, वर्ग-II (राजपत्रित) भर्ती और प्रोन्नति नियम, 2003 (जिन्हें इसमें इसके पश्चात्‌ उक्त नियम कहा गया है) के उपाबन्ध 'क' में स्तम्भ संख्या 15-क की क्रम संख्याः VII के खण्डों (ग) और (ङ) के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः--

"(ग) संविदा पर नियुक्त व्यक्ति एक मास की सेवा पूरी करने के पश्चात, एक दिन के आकस्मिक अवकाश का हकदार होगा। तथापि संविदा पर नियुक्त कर्मचारी बारह सप्ताह के प्रसूति अवकाश और दस दिन के चिकित्सा अवकाश के लिए भी हकदार होगा/होगी। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 इत्यादि के लिए भी हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगा :

परन्तु अनुपभुक्त आकस्मिक अवकाश और चिकित्सा अवकाश, एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा।

(ङ) संविदा पर नियुक्त पदधारी जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया है, आवश्यकता के आधार पर स्थानातरण हेतु पात्र होगा, जहाँ भी प्रशासनिक आधार पर ऐसा करना अपेक्षित हो। "। 7208 राजपत्र, हिमाचल प्रदेश, 14 मार्च, 2014/23 फाल्गुन, 1935 3. उपाबन्ध 'ख' का संशोधन.--उक्त नियमों के उपाबन्ध-'ख' में क्रम संख्याओं 4 और 6 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

No. LLR-A(3)-1/2013.—In exercise of the powers conferred by clause (e) of sub-section (2) of section 28 read with sub-sections (5) and (6) of section 6 of the Legal Services Authorities Act, 1987 (Act No. 39 of 1987), the Governor, Himachal Pradesh in consultation with the Chief Justice of the Himachal Pradesh High Court, is pleased to make the following rules further to amend the Himachal Pradesh State Legal Services Authority, Law Officer, Class-II (Gazetted), Recruitment and Promotion Rules, 2003 notified vide this Department Notification No. LLR-A(3) 2/2002 dated 3.7.2003 and published in the Rajpatra Himachal Pradesh (Extra-ordinary) dated 17.7.2003, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh State Legal Services Authority, Law Officer Class-II (Gazetted), Recruitment and Promotion (First Amendment) Rules, 2014.

(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Annexure-'A'.—In Annexure-A to the Himachal Pradesh State Legal Services Authority, Law Officer Class-II, (Gazetted), Recruitment and Promotion Rules, 20037209 राजपत्र, हिमाचल प्रदेश, 14 मार्च, 2014/23 फाल्गुन, 1935 (hereinafter referred to the said rules) for the Existing provisions against clause (c) and (e) of Serial No. VII of Column No. 15-A, the following shall be substituted, namely:—

"(c) Contract Appointee will be entitled for one day's casual leave after putting one month service. However, the contract employee will also be entitled for 12 weeks Maternity Leave and 10 day's Medical Leave. He/She shall not be entitled for Medical Re- imbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee :

Provided that the un-availed Casual Leave and Medical Leave can be accumulated upto the Calendar Year and will not be carried forward for the next Calendar Year.

3. Amendment of Annexure-'B'.—In Annexure-B of the said rules for the Existing provisions against serial No. 4 and 6, the following shall be substituted, namely:—

संख्याः टी0 पी0 टी0-ए(3)-5/2013.--हिमाचल प्रदेश की राज्यपाल, मोटर यान अधिनियम, 1988 (1988 का 59) की धारा 212 के साथ पठित धारा 65 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्या 5-24/88-टी पी टी-II तारीख 12 जुलाई, 1999 द्वारा अधिसूचित और राजपत्र, हिमाचल प्रदेश (असाधारण) में तारीख 27 जुलाई, 1999 को प्रकाशित हिमाचल प्रदेश मोटर यान नियम, 1999 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है और इन्हें राजपत्र, हिमाचल प्रदेश में जन साधारण की सूचना के लिए एतद्‌द्वारा प्रकाशित किया जाता है;

इन प्रारूप नियमों द्वारा संभाव्य प्रभावित होने वाला कोई हितबद्ध व्यक्ति जिसे उक्त नियमों की बावत कोई आक्ष्ेाप (पों) सुझाव (वों) हो तो, वह इसे (उन्हें) प्रारूप नियमों के राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से सात दिन की अवधि के भीतर प्रधान सचिव (परिवहन) हिमाचल प्रदेश सरकार को भेज सकेगा;

उपरोक्त विनिदिष्ट अवधि के भीतर प्राप्त आक्षेप (पों) या सुझाव (वों), यदि कोई है/हैं, पर इन नियमों को अन्तिम रूप देने से पूर्व राज्य सरकार द्वारा विचार किया जाएगा, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश मोटर यान (संशोधन) नियम, 2014 है।7219 राजपत्र, हिमाचल प्रदेश, 14 मार्च, 2014/23 फाल्गुन, 1935 (2) ये नियम, राजपत्र हिमाचल प्रदेश में इनके प्रकाशन की तारीख प्रवृत्त होंगे।

2. नियम 42 का संशोधन.--हिमाचल प्रदेश मोटर यान नियम, 1999 के नियम 42 के उप-नियम (1) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात;-

"(1) जब मोटर यान के नए क्रेता को रजिस्ट्रीकरण प्राधिकारी कार्यालय के अस्थायी तौर पर बन्द होने के कारण या किन्हीं अन्य कारणों से साधरणतया किसी कारणवश रजिस्ट्रीकरण प्रमाण पत्र प्राप्त करना अव्यनहार्थ हो या नए मोटर यान का क्रेता बहुत शीघ्र से राज्य की सीमाओं से बाहर निर्यात करना चाहता हों या इसे शीघ्रता से उस क्षेत्र में ले जाना चाहता हो जहां कि वह स्थायी रूप से निवास करता है या व्यापार करता है तो, उप-नियम (2) के उपबन्धों के चिन्ह का इस निमित क्षेत्रीय परिवहन अधिकारी (आर0 टी0 ओ0) द्वारा नियुक्त यानों की फर्म, व्यौहारी (डीलर) या निर्माता, रजिस्ट्रीकरण चिन्ह का अस्थायी प्रमाण पत्र जारी कर सकेगा और ऐसा रजिस्ट्रीकरण चिन्ह तत्समय नियमित रजिस्ट्रीकरण चिन्ह प्रमाण पत्र के सभी प्रयोजनों की पूर्ति करेगा :

परन्तु यथा पूर्वोार व्यक्तियों या फर्म के नाम, जो अस्थायी रजिस्ट्रीकरण प्रमाण पत्र के हस्ताक्षरित करने के लिए सक्षम होंगे क्षेत्रीय परिवहन अधिकारी (आर टी ओ) द्वारा विनिर्दिष्ट होंगे।"

NOTIFICATION

Shimla-2, the 12th March, 2014

No. Tpt-A(3) 5/2013.—1. In exercise of the powers conferred by section 65 read with section 212 of the Motor Vehicle Act, 1988 (59 of 1988), the Governor, Himachal Pradesh, proposes to make the following rules further to amend the Himachal Pradesh Motor Vehicle Rules, 1999 notified vide this Department Notification No. 5-24/88 TPT-II dated 12th July, 1999 and published in Rajpatra Himachal Pradesh (Extra ordinary) on 27th July 1999 and the same are hereby published in the Rajpatra, Himachal Pradesh, for the information of the general public;

2. If any interested person, likely to be affected by these draft rules has any objection(s) or suggestion(s) to make with regard to the said rules, he may send the same to the Principal Secretary (Transport) to the Government of Himachal Pradesh, within a period of Seven days from the date of publication of the draft rules in the Rajpatra, Himachal Pradesh;

3. The objection(s) or suggestion(s), if any received within the period specified above shall be taken into consideration by the State Government before finalizing these rules, namely;

1. Short title and Commencement.—(1) These rules may be called the Himachal Pradesh Motor Vehicles (Amendment) Rules, 2014.

(2) They shall come into force from the date of their publication in the Rajpatra.

2. Amendment of Rule 42.—In rule 42 of the Himachal Pradesh Motor Vehicles Rules, 1999, for sub-rule (1), the following shall be substituted, Namely:—

"(1) When for any reason it is impracticable for the purchaser of a new motor vehicle to obtain a registration certificate in the ordinary course owing to a temporary closure of the office of the registering authority or for other reasons, or where the purchaser of a new motor vehicle intends to export it at once beyond the limits of the State or to take it immediately to the area where he/she has his permanent residence or place of business, a temporary certificate of registration mark may be issued by the firm of vehicles, dealer or manufacturer of vehicles appointed by the Regional Transport Officer in this behalf subject to the provisions of sub rule (2) and the temporary certificate and registration mark shall for the time being serve all the purpose of a regular certificate of registration and registration mark:—

Provided that the names of persons or the firm, as aforesaid, who shall be competent to sign the temporary certificate of registration, shall be specified by the Regional Transport Officer."
