संख्याःई0एक्स0एन0-एफ(1)-1/2014.--हिमाचल प्रदेश की राज्यपाल, हिमाचल प्रदेश पथकर अधिनियम, 1975 (1975 का अधिनियम संख्यांक 9) की धारा 3-की उपधारा (1) के अधीन उनमें निहित शक्तियों का प्रयोग करते हुए, प्रथम अप्रैल, 2014 को ऐसी तारीख विनिर्दिष्ट करती हैं जिससे पूर्वोक्त अधिनियम 278-राजपत्र/2014-28-3-2014 (7611) 7612 राजपत्र, हिमाचल प्रदेश, 28 मार्च, 2014/7 चैत्र, 1936 की धारा 3 के अधीन उद्‌गृहीत पथकर के संग्रहण का अधिकार वित्तीय वर्षों 2014-2015 से 2016-17 अर्थात्‌ 1-4-2014 से 31-3-2017 के लिए किसी सड़क अवसंरचना पर से गुजरने वाले यान्त्रिक यानों पर, किसी व्यक्ति को, नीलामी या निविदा या दोनों के संयोजन से या किसी अन्य पद्धति द्वारा, जो राजस्व के हित में, समीचीन समझी जाए, ऐसे निबन्धनों और शर्तों पर जैसी आयुक्त राज्य सरकार के अनुमोदन के अध्यधीन अवधारित करे, पट्‌टे पर दिया जाएगा।

NOTIFICATION

Shimla-171002, the 27th March, 2014

No. EXN-F(1)-1/2014.—In exercise of the powers vested in her under sub-section(1) of section 3-A of the Himachal Pradesh Tolls Act, 1975 (Act No. 9 of 1975), the Governor of Himachal Pradesh is pleased to specify 1st April, 2014, as a date with effect from which the right to collect toll levied under section 3 of the Act ibid, on mechanical vehicles passing over any road infrastructure, for the financial years 2014-15 to 2016-17 i.e. 01-04-2014 to 31-3-2017, shall be leased out to any person by auction or tender or combination of both, or any other mode which is considered expedient in the interest of revenue on such terms and conditions as the Commissioner may determine, subject to approval of the State Government.

No. EXN-F(1)-1/2014.—In exercise of the powers conferred by section 6 of the Himachal Pradesh Tolls Act, 1975 (Act No. 9 of 1975), the Governor of Himachal Pradesh is pleased to order the shifting, change in name and closure of the Toll Barriers mentioned in the Tables(A), (B) and (C) respectively given below with effect from 1st April, 2014, namely:—

संख्याःई0एक्स0एन0-एफ(1)-1/2014.--हिमाचल प्रदेश की राज्यपाल, हिमाचल प्रदेश पथकर अधिनियम, 1975 (1975 का अधिनियम संख्यांक 9) की धारा 13 की उपधारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त अधिनियम से संलग्न अनुसूची-II में निम्नलिखित, और संशोधन करती हैं और इन्हें राजपत्र हिमाचल प्रदेश में इनके प्रकाशन की तारीख से तीस दिन की अवधि के भीतर तद्‌द्वारा सम्भाव्य प्रभावित होने वाले व्यक्तियों से आक्षेप (पों) या सुझाव (वों) आमन्त्रित करने के लिए प्रकाशित किया जाता है;

प्रस्तावित संशोधन के सम्बन्ध में किसी हितबद्ध व्यक्ति को यदि कोई आक्षेप/सुझाव है/हैं तो वह उसे/उन्हें उपरोक्त नियत अवधि के भीतर आयुक्त, आबकारी एवं कराधान हिमाचल प्रदेश, शिमला-171009 को भेज सकेगा।

उपरोक्त नियत अवधि के भीतर प्राप्त हुए आक्षेप/सुझाव, यदि कोई है/हैं, पर प्रारूप संशोधन को अन्तिम रूप देने से पूर्व सम्यक रूप विचार किया जाएगा;

उक्त अधिनियम से संलग्न अनुसूची-II की विद्यमान मद संख्या 9 के पश्चात्‌ निम्नलिखित नई मद संख्या 10 जोड़ी जाएगी, अर्थात्‌ः-

No. EXN-F(1)-1/2014.—In exercise of the powers conferred by sub-section (2) of section 13 of the Himachal Pradesh Tolls Act, 1975 (Act No. 9 of 1975), the Governor of Himachal Pradesh, is pleased to make the following further amendment in Schedule-II appended to the said Act and the same is published in the Rajpatra, Himachal Pradesh for inviting objections(s) or suggestion(s) from the person(s) likely to be affected thereby within a period of 30 days from the date of its publication.

Any interested person who has any objection(s)/suggestion(s), if any, in relation to the proposed amendment he may send the same to the Excise & Taxation Commissioner, Himachal Pradesh,Shimla-171009 within the above stipulated period.

The objection(s)/suggestion(s), if any, received within the above stipulated period shall be duly considered before the finalization of the draft amendment;

In Schedule-II appended to the said Act, after the existing item No. 9, the following new item No. 10 shall be added, namely:—
