No. EXN-E (2)-3/2010.—In compliance to the orders of Hon'ble High Court passed in CWP NO. 180/2010 titled-"Arun Kumar Jassal Vs State of H.P. & ors" on 01.05.2012 and on the recommendations of the Departmental Promotion Committee, the Governor Himachal Pradesh is pleased to promote Shri Arun Kumar Jassal, Supdt. NOTIFICATION

Dated : 22nd April, 2014

No. MCG/Plastic Waste/2014.—In compliance to the Hon'ble High Court order dated 26.12.2013 passed in CWP No. 1732/2010 along with other CWPs, the following Plastic Waste bye-laws, 2014 made by the Municipal Council Ghumarwin in exercise of the power conferred by Section 217 and Section 219 read with Clause( d) (v) of sub section (1) of Section 202 of the Himachal Pradesh Municipal Act, 1994 (Act No. 13 of 1994) as amended from time to time are hereby published in the Rajpatra, Himachal Pradesh (extraordinary) for the information of general public and notice is hereby given that the said draft bye-laws shall be considered by the Municipal Council Ghumarwin after expiry of a period of 15 days from the date of its publication in the Rajpatra, Himachal Pradesh.

If any person, likely to be affected by these draft bye-laws has any, objection(s) against these draft rules, he may send the written objections to the Executive Officer, Municipal Council Ghumarwin within the aforesaid period.

Objections, if any, received within the period as specified above, shall be taken into consideration by the Municipal Council Ghumarwin before finalizing these Bye-Laws namely:—

Municipal Council Ghumarwin (Management and Handling) of Plastic Waste Bye-laws, 2014."

Preliminary

1. Short title, commencement and application :—

i. These Bye-Laws may be called, "Municipal Council Ghumarwin Plastic Waste (Management and Handling) Bye-laws, 2014."

ii. These Bye-laws shall come into force from the date of their publication in the Rajpatra (extraordinary) Himachal Pradesh.

iii. These Bye-laws shall be applicable within the jurisdiction of Municipal Council Ghumarwin as defined from time to time.

2. Definitions:

(1) In these Bye-laws, unless the context otherwise requires:—

(a) "Act" means the H.P. Municipal Act, 1994 (13 of 1994) and Environment (Protection) Act,1986 (29 of 1986);

(b) "Authorized Officer" means any officer/official duly authorized by the Municipality under these Bye-laws;

(c) "Carry bags" means all plastic bags used to carry commodities, including self carrying features;

(d) "Compostable plastics" means plastic that undergoes degradation by biological processes during composting to yield CO2, water, inorganic compounds and biomass at a rate consistent with other known compostable materials and does not leave visible, distinguishable or toxic residue;

(e) Disintegration" means the physical breakdown of a material into very small fragments;

(f) "Extended Producer's Responsibility (EPR)" means the responsibility of a producer or a manufacturer of plastic carry bags and multilayered plastics, pouches or packages for the environmentally sound management of the product until the end of its life. This responsibility also applies to all manufactures using such packaging;

(g) "Manufacturer" means any producer who manufactures plastic carry bags, multilayered packing, pouches and the like or uses such materials in packing of a product;

(h) "Municipality" means an institution of Self Government constituted as a municipal council under this Act or any other local body constituted under the relevant statutes and, where the management and handling of municipal solid waste is entrusted to such agency;

(i) "Multilayered Plastics" means any material having a combination of more than one layer or packing material such as paper, paper board, polymeric materials, metalized layers or aluminum foil, either in the form of a laminate or co-extruded structure;

(j) "Occupier" includes any person who for the time being is paying or is liable to pay to the owner the rent or any portion of the rent of the land or building in respect of which such rent is paid or is payable and also include a tenant;

(k) "Plastic" means material which contain as an essential ingredient a high polymer and which at some stage in its processing into finished products can be shaped by flow;

(l) "Plastic waste" means any plastic product such as carry bags, pouches or multilayered packing, which have been discarded after use or after their intended life is over;

(m) "Registration" means registration of units manufacturing or recycling carry bags made of virgin or recycled plastics with the concerned State Pollution Control Board or Pollution Control Committee, as the case may be, within the jurisdiction of the Municipality;

(n) "Rule" means the rules made under the H.P. Municipal Act, 1994, (13 of 1994) and Environment (Protection) Act, 1986 (29 of 1986);

(o) "Section" means section of the Act;

(p) "Virgin Plastic" means plastic material which has not been subjected to use earlier and has also not been blended with scrap or waste;

(q) "Waste management" means the scientific reduction, re-use, recovery, recycling, composting or disposal of plastic waste;

(r) "Waste pickers" means individuals or groups of individuals engaged in the collection of plastic waste.

(2) All other words and expressions used in these Bye-laws, but not defined, shall have the same meaning as are assigned to them in the Act or Rules framed there under.

3. Prescribed Authority: - for enforcement of the provisions of these Bye-laws relating to the use, collection, segregation, transportation and disposal of post consumer plastic waste shall be the concerned municipality and its authorized officer/official, as the case may be.

4. Generation of Plastic Waste:

(1) The Municipality may assess the quantum of post consumer plastic waste generated through delineating high, mid and low waste generating areas within its jurisdiction and conducting waste audit in the manner as provided under Bye-Laws 9385 राजपत्र, हिमाचल प्रदेश, 25 अप्रैल, 2014/5 वैशाख, 1936 (2) The Municipality may ask manufacturers, distributors and other person who produce or handle commodities for plastic quantum within its jurisdiction and also with respect to type, size, labeling and composition of packaging.

5. Segregation of Plastic Waste:

(1) Municipality shall ensure post consumer plastic waste through primary or secondary segregation from the waste stream

(2) No owner or occupier of any premises shall keep or allow to be kept stacking or deposits of post consumer plastic waste which is likely to occasion a nuisance or is likely to be dangerous to health and environment.

6. Plastic Waste Management Centers (PWMC):

(1) Municipality shall be responsible for setting up, operationalisation and co-ordination of the plastic waste management system ensuring collection, storage, transportation, treatment, disposal and for performing the associated functions, namely:-The Municipality shall establish a plastic waste management centre (PWMC) headed by its Executive Officer. The plastic waste management centre within the municipality will ensure that post consumer plastic waste is recovered from the waste stream.

(2) The PWMC shall ensure the identification and involvement of the waste pickers, agencies working in waste management sector and formalization of the informal post consumer plastic waste collection units within jurisdiction of the Municipality.

(3) The PWMC shall register and grant authorization to such informal post consumer plastic waste collection units within the Municipality in the format as prescribed by the municipality from time to time.

(4) The registration granted under these bye laws shall be valid for a period of one year, unless revoked suspended or cancelled; and registration shall not be revoked suspended or cancelled without providing the registered plastic waste unit an opportunity for explanation to the authority.

(5) The PWMC may also establish plastic waste collection units in Municipality jurisdiction involving plastic bulk generators.

(6) The PWMC may ensure such unit's channelization to authorized recyclers.

(7) The PWMC shall create awareness among all stakeholders about their responsibilities and ill effects of plastic waste;

7. Plastic Waste Recycling and Recovery:

The plastic waste management shall be as under:—

(1) Recycling, recovery or disposal of post consumer plastic waste shall be carried out as per the rules, regulations and standards stipulated by the Central Government from time to time;

(2) Recycling of plastics shall be carried out in accordance with the Indian standard: IS 14534: 1998 titled as Guidelines for Recycling of Plastics, as amended from time to time;

(3) Recyclers shall ensure that recycling facilities are in accordance with the Indian Standard: IS 14534: 1998 titled as Guidelines for Recycling of Plastic and in compliance with the rules under the Environment (Protection) Act, 1986, as amended from time to time;

(4) The Municipality shall ensure that the residues generated from recycling processes are disposed off in compliance with Schedule II (Management of Municipal Solid Wastes) and Schedule III (Specifications for Landfill Sites) of the Municipal Solid Wastes (Management and Handling) Rules, 2000 made under the Environment (Protection) Act, 1986, as amended from time to time.

8. Prohibition on Littering and Burning of Plastic Waste:

(1) No owner or occupier shall dispose-off any post consumer plastic waste to run down or to be thrown into any drain sink or any other place within municipal area except in such a manner as shall prevent any avoidable nuisance.

(2) No owner or occupier of any premises shall deposite post consumer plastic waste in any street, on the verandha of any building, any unoccupied ground along side, on the bank of a water course, any dustbin, vehicle and vessel not intended for the removal of the same.

(3) No owner or occupier of any premises shall burn the post consumer plastic waste.

(4) If any corporate body, firm or other association of individuals committing offence under this section; every person who, at the time of the commission of the offence, was incharge of the conduct of the corporate body shall be deemed to be guilty.

9. Waste Audit:

(1) The Municipality shall manage the plastic waste by undertaking waste audit in the beginning of the year.

(2) The results of the waste audit shall be compiled and sent to the HP State Pollution Control Board / State Government.

10. Extended Producer's Responsibility :

The Municipality may ask the manufactures, either collectively or individually in line with the principle of Extended Producer's Responsibility (EPR) involving such manufactures, registered within its jurisdiction and brand owners with registered offices within its jurisdiction to provide the required finance to establish such collection centers.

11. Sustainable Use of Plastic Waste :

The Municipality shall encourage the use of plastic waste by adopting suitable technology such as road construction, co-incineration etc. The municipality or the operator intending to use such technology shall ensure the compliance with the prescribed standards including pollution norms prescribed by the competent authority in this regard.

12. Penalty :

Whosoever contravenes the provision of these Bye-laws shall be penalize as provided under the Act and the prescribed authority may request the competent authority to withdraw registration/recognition, if any, granted in his favour.

(j) "Occupier" includes any person who for the time being is paying or is liable to pay to the owner the rent or any portion of the rent of the land or building in respect of which such rent is paid or is payable and also include a tenant;

(k) "Plastic" means material which contain as an essential ingredient a high polymer and which at some stage in its processing into finished products can be shaped by flow;

(l) "Plastic waste" means any plastic product such as carry bags, pouches or multilayered packing, which have been discarded after use or after their intended life is over;

(m) "Registration" means registration of units manufacturing or recycling carry bags made of virgin or recycled plastics with the concerned State Pollution Control Board or Pollution Control Committee, as the case may be, within the jurisdiction of the Municipality;

(n) "Rule" means the rules made under the H.P. Municipal Act, 1994, (13 of 1994) and Environment (Protection) Act, 1986 (29 of 1986);

(o) "Section" means section of the Act;

(p) "Virgin Plastic" means plastic material which has not been subjected to use earlier and has also not been blended with scrap or waste;

(q) "Waste management" means the scientific reduction, re-use, recovery, recycling, composting or disposal of plastic waste;

(r) "Waste pickers" means individuals or groups of individuals engaged in the collection of plastic waste.

(2) All other words and expressions used in these Bye-laws, but not defined, shall have the same meaning as are assigned to them in the Act or Rules framed there under.

3. Prescribed Authority.—for enforcement of the provisions of these Bye-laws relating to the use, collection, segregation, transportation and disposal of post consumer plastic waste shall be the concerned municipality and its authorized officer/official, as the case may be.

4. Generation of Plastic Waste :

(1) The Municipality may assess the quantum of post consumer plastic waste generated through delineating high, mid and low waste generating areas within its jurisdiction and conducting waste audit in the manner as provided under Bye-Laws 9.

(2) The Municipality may ask manufacturers, distributors and other person who produce or handle commodities for plastic quantum within its jurisdiction and also with respect to type, size, labeling and composition of packaging.

5. Segregation of Plastic Waste :

(1) Municipality shall ensure post consumer plastic waste through primary or secondary segregation from the waste stream.

(2) No owner or occupier of any premises shall keep or allow to be kept stacking or deposits of post consumer plastic waste which is likely to occasion a nuisance or is likely to be dangerous to health and environment.

6. Plastic Waste Management Centers (PWMC) :

(1) Municipality shall be responsible for setting up, operationalisation and co-ordination of the plastic waste management system ensuring collection, storage, transportation, treatment, disposal and for performing the associated functions, namely:-The Municipality shall establish a plastic waste management centre (PWMC) headed by its Executive Officer. The plastic waste management centre within the municipality will ensure that post consumer plastic waste is recovered from the waste stream.

(2) The PWMC shall ensure the identification and involvement of the waste pickers, agencies working in waste management sector and formalization of the informal post consumer plastic waste collection units within jurisdiction of the Municipality.

(3) The PWMC shall register and grant authorization to such informal post consumer plastic waste collection units within the Municipality in the format as prescribed by the municipality from time to time.

(4) The registration granted under these bye laws shall be valid for a period of one year, unless revoked suspended or cancelled; and registration shall not be revoked suspended or cancelled without providing the registered plastic waste unit an opportunity for explanation to the authority.

(5) The PWMC may also establish plastic waste collection units in Municipality jurisdiction involving plastic bulk generators.

(6) The PWMC may ensure such unit's channelization to authorized recyclers.

(7) The PWMC shall create awareness among all stakeholders about their responsibilities and ill effects of plastic waste;

7. Plastic Waste Recycling and Recovery:

The plastic waste management shall be as under:—

(1) Recycling, recovery or disposal of post consumer plastic waste shall be carried out as per the rules, regulations and standards stipulated by the Central Government from time to time;

(2) Recycling of plastics shall be carried out in accordance with the Indian standard: IS 14534: 1998 titled as Guidelines for Recycling of Plastics, as amended from time to time;

(3) Recyclers shall ensure that recycling facilities are in accordance with the Indian Standard: IS 14534: 1998 titled as Guidelines for Recycling of Plastic and in compliance with the rules under the Environment (Protection) Act, 1986, as amended from time to time;

(4) The Municipality shall ensure that the residues generated from recycling processes are disposed off in compliance with Schedule II (Management of Municipal Solid Wastes) and Schedule III (Specifications for Landfill Sites) of the Municipal Solid Wastes (Management and Handling) Rules, 2000 made under the Environment (Protection) Act, 1986, as amended from time to time.

8. Prohibition on Littering and Burning of Plastic Waste:

(1) No owner or occupier shall dispose-off any post consumer plastic waste to run down or to be thrown into any drain sink or any other place within municipal area except in such a manner as shall prevent any avoidable nuisance.

(2) No owner or occupier of any premises shall deposite post consumer plastic waste in any street, on the verandha of any building, any unoccupied ground along side, on the bank of a water course, any dustbin, vehicle and vessel not intended for the removal of the same.

(3) No owner or occupier of any premises shall burn the post consumer plastic waste.

(4) If any corporate body, firm or other association of individuals committing offence under this section; every person who, at the time of the commission of the offence, was incharge of the conduct of the corporate body shall be deemed to be guilty.

9. Waste Audit:

(1) The Municipality shall manage the plastic waste by undertaking waste audit in the beginning of the year.

(2) The results of the waste audit shall be compiled and sent to the HP State Pollution Control Board / State Government.

10. Extended Producer's Responsibility :

The Municipality may ask the manufactures, either collectively or individually in line with the principle of Extended Producer's Responsibility (EPR) involving such manufactures, registered within its jurisdiction and brand owners with registered offices within its jurisdiction to provide the required finance to establish such collection centers.

11. Sustainable Use of Plastic Waste :

The Municipality shall encourage the use of plastic waste by adopting suitable technology such as road construction, co-incineration etc. The municipality or the operator intending to use such technology shall ensure the compliance with the prescribed standards including pollution norms prescribed by the competent authority in this regard.

12. Penalty :

Whosoever contravenes the provision of these Bye-laws shall be penalize as provided under the Act and the prescribed authority may request the competent authority to withdraw registration/recognition, if any, granted in his favour.

आदेश

1. यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 61 में यह उपबंधित है कि निर्वाचकों के प्रतिरूपण का निवारण करने की दृष्टि से उक्त अधिनियम की धारा 62 के अधीन वास्तविक निर्वाचकों को उनके मत देने के अधिकार को और अधिक प्रभावी बनाया जा सके, उक्त अधिनियम के अधीन नियमों द्वारा मतदान के समय निर्वाचकों की पहचान सुनिश्चित करने के उद्देश्य से निर्वाचकों के लिए निर्वाचक फोटो पहचान पत्र के प्रयोग हेतु नियमों के द्वारा उपबंधों को बनाया जा सकता है तथा

2. यतः, निर्वाचनों का रजिस्ट्रकरण नियम, 1960 को नियम 28 निर्वाचन आयोग को, इस दृष्टि से कि निर्वाचकेां के प्रतिरूपण का निवारण हो सके तथा मतदान के समय उनकी पहचान को सरल बनाया जा सके। निर्वाचकों को राज्य की लागत पर फोटोयुक्त निर्वाचक फोटो पहचान पत्र जारी करने के लिए निर्देश देने की शक्ति प्रदान करता है, तथा

3. यतः, निर्वाचकों का संचालन नियम, 1961 के नियम 49ज(3) तथा 49ट(2)(ख) में यह निर्दिष्ट है कि जहां किसी निर्वाचन क्षेत्र के निर्वाचकों का निर्वाचक रजिस्ट्रीकरण नियमस, 1960 के नियम 28 के उपबंधों के अधीन निर्वाचक फोटो पहचान पत्र दिए जाते हैं, निर्वाचकों को मतदान केन्द्र में अपना निर्वाचक फोटो पहचान पत्र दिखाना होगा तथा उनके द्वारा निर्वाचक फोटो पहचान पत्रों को नहीं दिखाए जाने व असमर्थ होने पर उन्हें मत डालने की अनुमति देने से इनकार किया जा सकता है, तथा

4. यतः, उक्त अधिनियम तथा नियमों के पूर्वोक्त उपबंधों को मिलाकर एवं सामंजस्यपूर्ण ढंग से उनके अध्ययन से यह स्पष्ट होता है कि यद्यपि मत देने का अधिकार निर्वाचक नामावली में नाम के होने पर ही होता है, यह निर्वाचन आयोग द्वारा राज्य की लागत पर, मतदान के समय उनकी पहचान सुनिश्चित करने के उद्देश्य से प्रदान करवाए गए निर्वाचक फोटो पहचान पत्र के प्रयोग पर भी निर्भर करता है, तथा दोनों को एक साथ प्रयोग करना होता है,

5. यतः, निर्वाचन आयोग ने समयबद्ध योजना के अनुसार सभी निर्वाचकों को निर्वाचक फोटो पहचान पत्र (ईपीआईसी) जारी करने के निर्देश देते हुए दिनांक 28 अगस्त, 1993 को एक आदेश जारी किया है, तथा 6. यतः, देश में पंजीकृत निर्वाचकों में से 97 प्रतिशत से अधिक निर्वाचकों को निर्वाचक फोटो पहचान पत्र जारी किए जा चुके हैं,

7. यतः, आयोग ने यह आदेश दिया है कि ''प्रमाणिक फोटो मतदाता पर्ची'' मतदाताओं को बांटी जाएगी,

8. अतः, अब सभी संबद्ध घटकों तथा विधिक एवं तथ्यात्मक स्थितियों को ध्यान में रखते हुए, निर्वाचन आयोग, एतद्‌द्धारा, यह निर्देश देता है कि एक साथ होने वाले लोक सभा, 2014 तथा आंध्र प्रदेश, अरूणाचल प्रदेश, ओडिशा एवं सिक्किम के राज्य विधान सभा, साधारण निर्वाचनों तथा 27 विधान सभा निर्वाचन क्षेत्रों के उप-निर्वाचन, जो कि 13.03.2014, 14.03.2014, 15.03.2014, 19.03.2014, 29.03.2014, 02. 04.2014, 12.04.2014 तथा 17.04.2014ए को अधिसूचित किए गए/किए जाने वाले हैं, सभी मतदाता जिन्हें निर्वाचक फोटो पहचान पत्र जारी किए गए हैं, मतदान स्थल पर मत डालने से पहले पहचान सुनिश्चित करने हेतु अपना निर्वाचक फोटो पहचान पत्र दिखाएंगे। ऐसे निर्वाचक जो अपना फोटो पहचान पत्र प्रस्तुत नहीं कर पाते हैं, उन्हें अपनी पहचान स्थापित करने के लिए निम्नलिखत वैकल्पिक फोटो पहचान दस्तावेजों में से कोई एक प्रस्तुत करना होगाः-

9. ईपीआईसी के संबंध में, लेखन अशुद्धि, वर्तनी की अशुद्धि इत्यादि को नजरअंदाज कर देना चाहिए बशर्ते मतदाता की पहचान ईपीआईसी से सुनिश्चित की जा सके। यदि कोई मतदाता फोटो पहचान पत्र प्रदर्शित करता है, जो कि किसी अन्य सभा निर्वाचन क्षेत्र के निर्वाचक रजिस्ट्रीकरण ऑफिसर द्वारा जारी किया गया है, ऐसे ईपीआईसी भी पहचान स्थापित करने हेतु स्वीकृत किए जाएंगे बशर्ते निर्वाचक का नाम जहां वह मतदान करने आया है उस मतदान स्थल से संबंधित निर्वाचक नामावली में उपलब्ध होना चाहिए। यदि फोटोग्राफ इत्यादि के बेमेल होने के कारण मतदाता की पहचान सुनिश्चित करना संभव न हो तब मतदाता को उपर्युक्त पैरा 8 में वर्णित किसी एक वैकल्पिक फोटो दस्तावेज को प्रस्तुत करना होगा। 10. ऊपर पैरा 8 में किसी बात के होते हुए भी, प्रवासी निर्वाचक जो अपने पासपोर्ट में विवरणों के आधार पर लोक प्रतिनिधित्व अधिनियम, 1950 की धारा 20क के अधीन निर्वाचक नामावलियाें में पंजीकृत हैं, उन्हें मतदान केन्द्र में उनके केवल मूल पासपोर्ट (तथा कोई अन्य पहचान दस्तावेज नहीं) के आधार पर ही पहचाना जाएगा।

ORDER

1. Whereas, Section 61 of the Representation of the People Act, 1951 provides that with a view to preventing impersonation of electors, so as to make the right of genuine electors to vote under section 62 of that Act more effective, provisions may be made by rules under that Act more effective, provisions may be made by rules under that Act for use of Electors Photo Identity Card for electors as the means of establishing their identity at the time of polling; and

2. Whereas, Rule 28 of the Registration of Electors Rules, 1960, empowers the Election Commission to direct, with a view to preventing impersonation of electors and facilitating their identification at the time of poll, the issue of Electors Photo Identity Card to electors bearing their photographs at State cost; and

3. Whereas, Rules 49H (3) and 49K (2) (b) of the Conduct of Elections Rules, 1961, stipulate that where the electors of a constituency have been supplied with Electors Photo Identity Card under the said provisions of Rule 28 of the Registration of Electors Rules, 1960, the electors shall produce their Electors Photo Identity Card at the polling station and failure or refusal on their part to produce those Electors Photo Identity Card may result in the denial of permission to vote; and396 राजपत्र, हिमाचल प्रदेश, 25 अप्रैल, 2014/5 वैशाख, 1936 4. Whereas, a combined and harmonious reading of the aforesaid provisions of the said Act and the Rules, makes it clear that although the right to vote arises by the existence of the name in the electoral roll, it is also dependent upon the use of the Electors Photo Identity Card, where provided by the Election commission at State cost, as the means of establishing their identity at the time of polling and that both are to be used together; and

5. Whereas, the Election Commission made an Order on the 28th August, 1993, directing the issue of Electors Photo Identity Card(EPIC) to all electors, according to a time bound programme; and 6. Whereas, Electors Photo Identity Card has been issued to more than 97% registered electors in the country; and

7. Whereas, the Commission has directed that 'Authenticated Photo Voters Slip' shall be distributed to the electors.

8. Now, therefore, after taking into account all relevant factors and the legal and factual position, the Election Commission hereby directs that for General Elections to the House of the People, 2014 and the State Legislative Assemblies of Andhra Pradesh, Arunachal Pradesh, Udisha & Sikkim and bye-elections from 27 Assembly Constituencies being held simultaneously, which have been notified/to be notified on 13-03-2014, 14-03-2014, 15-03-2014, 19-03-2014, 29-03-2014, 02-04- 2014, 12-04-2014 and 17-04-2014, all electors who have been issued EPIC shall produce the EPIC for their identification at the polling station before casting their votes. Those electors who are not able to produce the EPIC shall produce one of the following alternative photo identity documents for establishing their identity:—

(i) passport;

(ii) Driving License; (iii) Service Identity Cards with photograph issued to employees by Central/State Govt. PSUs/Public Limited Companies;

(iv) Passbooks with photograph issued by Bank/Post Office; (v) PAN Card; (vi) Aadhar Card; (vii) Smart Card issued by RGI under NPR; (viii) MNREGA Job Card; (ix) Health Insurance Smart Card issued under the scheme of Ministry of Labour; (x) Pension document with photograph; and (xi) Authenticated Photo Voter Slip issued by the election machinery.

9. In the case of EPIC clerical errors, spelling mistakes, etc. should be ignored provided the identity of the elector can be established by the EPIC. If an elector produces an Electors Photo Identity Card, which has been issued by Electoral Registration Officer of another Assembly Constituency, such EPICs shall also be accepted for identification provided the name of that elector finds place in the electoral roll pertaining to the polling station where the elector has turned up for voting. If it is not possible to establish the identity of the elector on account of mismatch of photograph, etc. the elector shall have to produce one of the alternative photo documents mentioned in para 8 above.

10. Notwithstanding anything in Para 8 above, overseas electors who are registered in the electoral rolls under Section 20A of the Representation of the People Act, 1950, based on the particulars in their Passport, shall be identified on the basis of their original passport only (and no other identity document) in the polling station.

इस इश्तहार राजपत्र द्वारा सर्वसाधारण को सूचित किया जाता है कि उक्त तृप्ता देवी पत्नी श्री शाम सिंह निवासी बडाला, तहसील इन्दौरा, जिला कांगड़ा की मृत्यु तिथि को पंजीकृत करने बारे किसी व्यक्ति को कोई भी एतराज हो तो वह असालतन या वकालतन दिनांक 23-5-2014 को प्रातः 10.00 बजे अदालत हजा में हाजिर होकर अपना एतराज पेश कर सकता है। कोई एतराज पेश न होने की सूरत में मृत्यु तिथि को पंजीकृत करने के आदेश पारित कर दिए जाएंगे।
