संख्याः ई0 एक्स0 एन0-एफ (10)-2/2004-I.-हिमाचल प्रदेश की राज्यपाल, हिमाचल प्रदेश में यात्रियों तथा सामान पर कर लगाने का अधिनियम, 1955 (1955 का अधिनियम संख्यांक 15) की धारा 22 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्याः आर. 102-23/53 तारीख 5 अप्रैल, 1957 द्वारा अधिसूचित हिमाचल प्रदेश पैसेंजर एण्ड गुड्‌ज़ टैक्सेशन रूल्ज,़ 1957 का और संशोधन करने के लिए निम्नलिखित नियम बनाती हैं और इन्हें जनसाधारण की सूचना के लिए राजपत्र, हिमाचल प्रदेश में प्रकाशित किया जाता है ;

46-राजपत्र/2014-7-6-2014 (1055) 1056 राजपत्र, हिमाचल प्रदेश, 7 जून, 2014/17 ज्येष्ठ, 1936 यदि इन प्रारूप नियमों से संभाव्य प्रभावित होने वाले किसी हितबद्ध व्यक्ति का/ के, उक्त नियमों की बाबत कोई आक्षेप या सुझाव है । हैं, तो वह उसे/उन्हें (प्रारूप नियमों के राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से पंद्रह दिन की अवधि के भीतर प्रधान सचिव (आबकारी एवं कराधान) हिमाचल प्रदेश सरकार को भेज सकेगा ;

उपरोक्त नियत अवधि के भीतर प्राप्त हुए आक्षेप(पों) या सुझाव(वों) , यदि कोई है । हों, पर राज्य सरकार द्वारा इन नियमों को अन्तिम रूप देनेे से पूर्व, विचार किया जाएगा, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारम्भ.- (।) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश पैसेंजर एण्ड गुड्‌ज़ टैक्सेशन (अमैंडमैंट) रूल्ज, 2014 है ।

(2) ये नियम राजपत्र, हिमाचल में इनके प्रकाशन की तारीख से प्रवृा होंगेे ।

2. रूल 3 का संशोधन.-हिमाचल प्रदेश पैसेंजर एण्ड गुड्‌ज़ टैक्सेशन रूल्ज, 1957 (जिन्हें इसमें इसके पश्चात्‌ 'उक्त रूल्ज' कहा गया है) के रूल 3 के क्लॉज़ (क) का लोप किया जाएगा ।

3. रूल 4 का संशोधन.-उक्त रूल्ज के रूल 4 के सब रूल (3) (a) में, "and accompanied by a treasury receipt of Re. 1" शब्दा,ें संक्षेपाक्षर, चिन्ह और अंक का लोप किया जाएगा ।

4. रूल 9 का संशोधन.-उक्त रूल्ज के रूल 9 के सब रूल (8) (a) में, कलॉज़ (ia) के पश्चात्‌ निम्नलिखित क्लाजिंज अन्तः स्थापित किया जाएगा, अर्थात्‌ः-

"(ib) Ordinary contract carriage Rs. 3000/- per seat per annum.

(ic) Deluxe/AC contract carriages Rs. 4000/- per seat per annum."

5. रूल 9 D का संशोधन.-उक्त रूल्ज के रूल 9 D के सब रूल (।), में " in the concerned district office" शब्दों के पश्चात्‌ " and the registration certificate shall be granted in form PGT-21- AGT " शब्द, संक्षेपाक्षर, चिन्ह और अंक अंतः स्थापित किए जाएंगे।

6. फॉर्म PGT- 21-AGT का जोड़ा जाना.-उक्त रूल्ज से संलग्न फार्म PGT- 21-A के पश्चात्‌ निम्नलिखित जोड़ा जाएगा, अर्थात्‌ :-

EXCISE AND TAXATION DEPARTMENT

NOTIFICATION

Shimla-2, 4th June, 2014

No. EXN-F(10)-2/2004-I-–In exercise of the power conferred by Section 22 of the imachal Pradesh Passengers and Goods Taxation Act, 1955(Act No.15 of 1955) the Governor of Himachal Pradesh proposes to make the following rules further to amend the Himachal Pradesh Passenger and Goods Taxation Rules,1957 notified vide this department notification No. R.102-23/53 dated 5th April, 1957 and the same is published in Rajpatra Himachal Pradesh for the information of general Public;

If any interested person, likely to be affected by these draft rules, has any objection(s) or suggestion(s) to make with regard to the said rules, he may send the same to the Pr. Secretary (E&T) to the Government of Himachal Pradesh within a period of fifteen days from the date of publication of the draft rules in the Rajpatra, Himachal Pradesh;

The objection(s) or suggestion(s), if any received within the period specified above shall be taken into consideration by the State Government before finalizing these rules, namely:-- 1. Short Title and commencement—(1) These rules may be called the Himachal Pradesh Passengers and Goods Taxation (Amendment) Rules, 2014.

(2) They shall come into force from the date of their publication in the Rajpatra.

2. Amendment of rule 3.–In the Himachal Pradesh Passenger and Goods Taxation Rules, 1957(hereinafter called the said rules), in rule 3, clause (d) shall be deleted.

3. Amendment of rule 4.–In sub rule(3)(a) of rule 4 of the said rules, the words, abbreviation, sign and figure "and accompanied by a treasury receipt of Re. 1" shall be deleted.

4. Amendment of rule 9.– In sub rule (8)(a) of rule 9 of the said rules, after clause(ia), the following clauses shall be inserted, namely:--1058 राजपत्र, हिमाचल प्रदेश, 7 जून, 2014/17 ज्येष्ठ, 1936

संख्याः यू0डी0-ए (3)-7/2013.-राज्यपाल, हिमाचल प्रदेश प्रस्तावित करती हैं कि संलग्न अनुसूची में यथा विनिर्दिष्ट क्षेत्रों को, हिमाचल प्रदेश नगरपालिका अधिनियम, 1994 की धारा 4 के अधीन, नेरचौक को नगर पंचायत के रूप में वर्गीकृत किए जाने हेतू उक्त क्षेत्र के बेहतर विकास और सुव्यवस्थित व्यवस्था के लिए उक्त अधिनियम की धारा 3 की उप-धारा (2) के अधीन नगरपालिका गठित किए जाने के आशय से, नगरपालिका क्षेत्र के रूप में घोषित किया जाना चाहिए।

उक्त अनुसूची में विनिर्दिष्ट क्षेत्र के निवासियों से नगर पंचाचत नेरचौक की प्रस्तावित घोषणा के सम्बन्ध में अपने-अपने आक्षेप/सुझाव, यदि कोई हों, प्रस्तुत करने की अपेक्षा की जाती है और ऐसे आक्षेप /सुझाव इस अधिसूचना के राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से छह सप्ताह की अवधि के भीतर, उपायुक्त, मण्डी के माध्यम से सचिव (शहरी विकास), हिमाचल प्रदेश सरकार को प्रस्तुत किए जाने चाहिए। उपर्युक्त नियत अवधि के अवसान के पश्चात्‌ कोई भी आक्षेप, जो भी हो, स्वीकार नहीं किए जाएंगे।

URBAN DEVELOPMENT DEPARTMENT

NOTIFICATION

Shimla-2, the 4th June, 2014

No. UD-A(3)-7/2013.—The Governor of Himachal Pradesh is pleased to propose that the areas as specified in the Schedule enclosed, should be declared as municipal area under section 4 of the Himachal Pradesh Municipal Act, 1994 in order to constitute a municipality under sub-section (2) of section 3 of the Act to be classified as Nagar Panchayat at Nerchowk, for better development and improved arrangement in the said area.

The inhabitants of the area specified in the said schedule are hereby called upon to submit their objections/suggestions, if any, to the proposed declaration of Nagar Panchayat, Nerchowk and such objections/suggestions should be submitted to the Secretary (Urban Development) to the Government of Himachal Pradesh in writing through the Deputy Commissioner, Mandi within a period of six weeks from the date of publication of this notification in the Rajpatra, Himachal Pradesh. After the expiry of above stipulated period, no objections, whatsoever will be entertained.

Municipal Council Paonta Sahib Plastic Waste (Management and Handling) Bye-laws, 2014."

NOTIFICATION

No.MCP/Solid Waste/2014/-206--In compliance to the Hon'ble High Court order dated 26- 12-2013 passed in CWP No. 1732/2010 along with other CWPs, the following Plastic Waste bye- laws, 2014 made by the Municipal council Paonta Sahib in exercise of the power conferred by Section 217 and Section 219 read with Clause d) (v) of sub section (1) of Section 202 of the Himachal Pradesh Municipal Act, 1994 (Act No. 13 of 1994) as amended from time to time were published in the news papers Himachal Dastak and Dainik Bhaskar on Dated 03.05.2014 and 04.05.2014 respectively for the information of general public. No objections/Suggestions were received within the stipulated period and the said draft bye-laws were again placed before the house on dated 30.05.2014 and the house unanimously resolved vide resolution no.03 that the said byelaws may be published in the Rajpatra, Himachal Pradesh (extraordinary).

Preliminary

1. Short title, commencement and application:–(i) These Bye-Laws may be called, Municipal Council Paonta sahib Plastic Waste (Management and Handling) Bye-laws, 2014." (ii) These Bye-laws shall come into force from the date of their publication in the Rajpatra (extraordinary) Himachal Pradesh.

(iii) These Bye-laws shall be applicable within the jurisdiction of Municipal Council Paonta Sahib as defined from time to time.

2. Definitions:--(1) In these Bye-laws, unless the context otherwise requires:-- (a) "Act" means the H.P. Municipal Act, 1994 (13 of 1994) and Environment (Protection) Act,1986 (29 of 1986);

(b) "Authorized Officer" means any officer/official duly authorized by the Municipality under these Bye-laws;

(c) "Carry bags" means all plastic bags used to carry commodities, including self carrying features;

(d) "Compostable plastics" means plastic that undergoes degradation by biological processes during composting to yield CO2, water, inorganic compounds and biomass at a rate consistent with other known compostable materials and does not leave visible, distinguishable or toxic residue;

(e) Disintegration" means the physical breakdown of a material into very small fragments;

(f) "Extended Producer's Responsibility (EPR)" means the responsibility of a producer or a manufacturer of plastic carry bags and multilayered plastics, pouches or packages for the environmentally sound management of the product until the end of its life. This responsibility also applies to all manufactures using such packaging;

(g) "Manufacturer" means any producer who manufactures plastic carry bags, multilayered packing, pouches and the like or uses such materials in packing of a product;

(h) "Municipality" means an institution of Self Government constituted as a Nagar Panchayat or municipal council or Municipal Corporation under this Act or any other local body constituted under the relevant statutes and, where the management and handling of municipal solid waste is entrusted to such agency;

(i) "Multilayered Plastics" means any material having a combination of more than one layer or packing material such as paper, paper board, polymeric materials, metalised layers or aluminium foil, either in the form of a laminate or co-extruded structure;

(j) "Occupier" includes any person who for the time being is paying or is liable to pay to the owner the rent or any portion of the rent of the land or building in respect of which such rent is paid or is payable and also include a tenant;

(k) "Plastic" means material which contain as an essential ingredient a high polymer and which at some stage in its processing into finished products can be shaped by flow;

(l) "Plastic waste" means any plastic product such as carry bags, pouches or multilayered packing, which have been discarded after use or after their intended life is over;

(m) "Registration" means registration of units manufacturing or recycling carry bags made of virgin or recycled plastics with the concerned State Pollution Control Board or Pollution Control Committee, as the case may be, within the jurisdiction of the Municipality;

(n) "Rule" means the rules made under the H.P. Municipal Act, 1994, (13 of 1994) and Environment (Protection) Act, 1986 (29 of 1986);

(o) "Section" means section of the Act;

(p) "Virgin Plastic" means plastic material which has not been subjected to use earlier and has also not been blended with scrap or waste;

(q) "Waste management" means the scientific reduction, re-use, recovery, recycling, composting or disposal of plastic waste;

(r) "Waste pickers" means individuals or groups of individuals engaged in the collection of plastic waste.

(2) All other words and expressions used in these Bye-laws, but not defined, shall have the same meaning as are assigned them in the Act or Rules framed thereunder.

3. Prescribed Authority:-- for enforcement of the provisions of these Bye-laws relating to the use, collection, segregation, transportation and disposal of post consumer plastic waste shall be the concerned municipality and its authorized officer/official, as the case may be.

4. Generation of Plastic Waste:--(1) The Municipality may assess the quantum of post consumer plastic waste generated through delineating high, mid and low waste generating areas within its jurisdiction and conducting waste audit in the manner as provided under Bye-Laws 9.

(2) The Municipality may ask manufacturers, distributors and other person who produce or handle commodities for plastic quantum within its jurisdiction and also with respect to type, size, labeling and composition of packaging.

5. Segregation of Plastic Waste:--(1) Municipality shall ensure post consumer plastic waste through primary or secondary segregation from the waste stream.

(2) No owner or occupier of any premises shall keep or allow to be kept staking or deposits of post consumer plastic waste which is likely to occasion a nuisance or is likely to be dangerous to health and environment.

6. Plastic Waste Management Centers (PWMC):--(1) Municipality shall be responsible for setting up, operationalisation and co-ordination of the plastic waste management system ensuring collection, storage, transportation, treatment, disposal and for performing the associated functions, namely:-The Municipality shall establish a plastic waste management centre (PWMC) headed by its Executive Officer. The plastic waste management centre within the municipality will ensure that post consumer plastic waste is recovered from the waste stream.

(2) The PWMC shall ensure the identification and involvement of the waste pickers, agencies working in waste management sector and formalization of the informal post consumer plastic waste collection units within jurisdiction of the Municipality.

(3) The PWMC shall register and grant authorization to such informal post consumer plastic waste collection units within the Municipality in the format as prescribed by the municipality from time to time.

(4) The registration granted under these bye laws shall be valid for a period of one year, unless revoked suspended or cancelled; and registration shall not be revoked suspended or cancelled without providing the registered plastic waste unit an opportunity for explanation to the authority

(5) The PWMC may also establish plastic waste collection units in Municipality jurisdiction involving plastic bulk generators

(6) The PWMC may ensure such unit's channelization to authorized recyclers

(7) The PWMC shall create awareness among all stakeholders about their responsibilities and ill effects of plastic waste;

7. Plastic Waste Recycling and Recovery:--The plastic waste management shall be as under:--

(1) Recycling, recovery or disposal of post consumer plastic waste shall be carried out as per the rules, regulations and standards stipulated by the Central Government from time to time;

(2) Recycling of plastics shall be carried out in accordance with the Indian standard: IS 14534:

1998 titled as Guidelines for Recycling of Plastics, as amended from time to time;

(3) Recyclers shall ensure that recycling facilities are in accordance with the Indian Standard: IS 14534: 1998 titled as Guidelines for Recycling of Plastic and in compliance with the rules under the Environment (Protection) Act, 1986, as amended from time to time;

(4) The Municipality shall ensure that the residues generated from recycling processes are disposed off in compliance with Schedule II (Management of Municipal Solid Wastes) and Schedule III (Specifications for Landfill Sites) of the Municipal Solid Wastes (Management and Handling) Rules, 2000 made under the Environment (Protection) Act, 1986, as amended from time to time.

8. Prohibition on Littering and Burning of Plastic Waste:--(1) No owner or occupier shall dispose-off any post consumer plastic waste to run down or to be thrown into any drain sink or any other place within municipal area except in such a manner as shall prevent any avoidable nuisance.

(2) No owner or occupier of any premises shall deposite post consumer plastic waste in any street, on the verandha of any building, any unoccupied ground along side, on the bank of a water course, any dustbin, vehicle and vessel not intended for the removal of the same.

(3) No owner or occupier of any premises shall burn the post consumer plastic waste (4) If any corporate body, firm or other association of individuals committing offence under this section; every person who, at the time of the commission of the offence, was incharge of the conduct of the corporate body shall be deemed to be guilty.

9. Waste Audit:--(i) The Municipality shall manage the plastic waste by undertaking waste audit in the beginning of the year.

(ii) The results of the waste audit shall be compiled and sent to the HP State Pollution Control Board / State Government.

10. Extended Producer's Responsibility.—The Municipality may ask the manufactures, either collectively or individually in line with the principle of Extended Producer's Responsibility (EPR) involving such manufactures, registered within its jurisdiction and brand owners with registered offices within its jurisdiction to provide the required finance to establish such collection centers.

11. Sustainable Use of Plastic Waste.--The Municipality shall encourage the use of plastic waste by adopting suitable technology such as road construction, co-incineration etc. The municipality or the operator intending to use such technology shall ensure the compliance with the prescribed standards including pollution norms prescribed by the competent authority in this regard.

12. Penalty.—Whosoever contravenes the provision of these Bye-laws shall be penalize as provided under the Act and the prescribed authority may request the competent authority to withdraw registration/recognition, if any, granted in his favour.

No. STE-E(3)-17/2012.—Whereas the Hon'ble High Court of Himachal Pradesh vide judgment dated 01.06.2012 (daily order) in CWP Nos. 7949/2011 and 7951 titled as Desh Raj V/s State of HP & others and Yog Raj V/s State of H.P & Others respectively has directed the State1065 राजपत्र, हिमाचल प्रदेश, 7 जून, 2014/17 ज्येष्ठ, 1936 Government to consider the existing guidelines for setting up of Stone Crushing Units in Himachal Pradesh, afresh.

Now in supersession of this Department Notification No. STE-E(4)-1/2003 dated 29.04.2003 and amendments carried out therein from time to time regarding setting up of Stone Crushing Units in the State of Himachal Pradesh and in exercise of the powers conferred by the Section 5 of the Environment (Protection) Act, 1986, read with the Government of India, Ministry of Environment & Forests, Department of Environment, Forest and Wildlife notification No. S.O. 152(E), dated 10th February, 1988 and in pursuance of the provisions of section 7 of the said Act, and rule 4 of the Environment (Protection), Rules, 1986 and directions of Hon'ble High Court of HP issued in CWP No. 7949/2011 and CWP No. 7951/2011, the Governor, Himachal Pradesh is pleased to notify the following guidelines/directions for all stone crushing units (hereafter referred to as the Unit) so as to exercise greater control and vigil over the stone crushing operations to save the environment and ecology of the State, with immediate effect, namely:--

1. Site Suitablility

1.1 Norms: Taking into consideration the hill topography, availability of less land and requirement to maintain the fragile ecology of the hills, the units shall be set up keeping in view the following criteria, namely:--

1.2 Notes:

1.2.1 All distances shall be measured as crow flies from the highest node of the crusher conveyor belt to the outer periphery of the revenue unit or the municipal limits or the periphery of the feature concerned.

1.2.2 In the guidelines distances are relaxable in the case of any natural barrier between the site of the Unit and any of the features indicated in the guidelines Natural barrier may be defined as "any natural physical entity except any kind of River/Khad/Natural Stream/Tree Canopy which obstructs the physical view and /or prevents the movement of Air and Noise so as to keep Air and Noise Pollution within prescribed limits".

The Government may relax the guidelines for a limited period in specific cases wherein setting up of stone crushing unit is necessary in public interest but it is not practically feasible to adhere to any or all of the guidelines, provided that such relaxation will be considered only on the recommendation of the Joint Inspection Committee as proposed in Para 1.3.2.

1.2.3 In case of Shimla Town the sitting norms shall be as per the directions of the Hon'ble High Court of Himachal Pradesh dated 26.07.1993 in CWP No. 51 of 1993 titled as "Court on its own motion versus State of Himachal Pradesh & Others".

1.3 Joint Inspection Committee for site appraisal:

1.3.1 The Unit shall apply /obtain "Provisional Registration" from the Department of Industries for obtaining pre-production clearances from other Government Departments.

1.3.2 The site for setting up the Unit shall be appraised and approved by the Joint Inspection Committee consisting of the following:--1067 राजपत्र, हिमाचल प्रदेश, 7 जून, 2014/17 ज्येष्ठ, 1936 1. Sub-Divisional Officer(Civil) concerned Chairman 2. Divisional Forest Officer or his representative Member 3. Representative of HP State Pollution Control Board. Member 4. Executive Engineer, HPPWD or his representative Member 5. Executive Engineer, IPH Department or his representative Member 6. Representative of Department of Tourism Member 7. Surveyor Member 8. Geologist or Mining Officer Member Secretary

1.3.3 The Committee constituted in Para 1.3.2 is in supersession of the Industries Department Notification No. Udyog I (Chh) 4-1/85-II dated 26.04.1993 and 24.12.1998. The approval of the Committee shall be the basis for issue of clearance and approval including those of the Himachal Pradesh State Electricity Board Ltd., Himachal Pradesh State Pollution Control Board and permanent registration with the Department of Industries.

2. Emission Norms and Pollution Control Measures:

2.1 Standards

2.1.1 The suspended particulate matter measured between 3 meters and 10 meters from any process equipment of a unit shall not exceed 600 micrograms per cubic meter.

2.1.2 The suspended particulate matter contribution value at a distance of 40 meters from a controlled isolation as well as from a unit located in a cluster shall be less than 600 mg/Nm3. The measurements are to be conducted at least twice a month for all the 12 months in a year.

2.1.3 The noise levels (leq.) shall be maintained within the standards for noise as specified in Schedule -III, of the Environment (Protection) Rules, 1986.

2.2 Pollution Control Measures:

2.2.1 Every Unit shall provide a wind breaking wall along with suitable enclosure to ensure adequate dust containment.

2.2.2 Every Unit shall have a dust suppression system with water spray and sprinkling system.

2.2.3 Dust extraction and collection system shall be provided at crusher and transfer points in every Unit.

2.2.4 Every Unit shall have adequate water supply along with at least two days water storage facility for running pollution control equipments.

2.2.5 Facility for regular cleaning and wetting of the ground shall be provided.

2.2.6 Trees of suitable species shall be planted to develop a green belt within and along the boundary of the premises.

2.2.7 Every Unit shall have a separate energy meters for pollution control devices wherever the energy is consumed for operating them and record thereof shall be1068 राजपत्र, हिमाचल प्रदेश, 7 जून, 2014/17 ज्येष्ठ, 1936 maintained and made available to the Himachal Pradesh State Environment Protection and Pollution Control Board (hereinafter referred to as State Board) whenever demanded.

3. Procedure for establishment and operation to be followed by the State Board:

3.1.1 The State Board shall issue conditional "Consent to Establish" to the unit only after the Joint Inspection Committee has recommended the case and the unit agrees to fulfill the Pollution Control measures given in para-2.1 and 2.2.

3.1.2 The State Board shall issue "Consent to Operate" only if the unit has taken measures to comply with the conditions given in the "Consent to Establish".

3.1.3 Every unit shall get - monitoring for Air and Noise conducted regularly and submit the reports to the State Pollution Control Board.

3.1.4 The State Board shall be the Authority to ensure the compliance of the Pollution Control measures given on these guidelines/directions and shall do the necessary monitoring of the unit as per schedule of monitoring approved by the State Board/Department of Science & Technology, Himachal Pradesh, Shimla.

3.1.5 Every unit shall follow any other direction(s) issued by the State Government from time to time.

विनोद कुमार पुत्र श्री प्रेम सिंह, निवासी नेपाल हाल निवासी अलेऊ, डाकघर मनाली, तहसील मनाली, जिला कुल्लू, हि0 प्र0 ने इस न्यायालय में आवेदन-पत्र मय शपथ-पत्र गुजारा है कि उसके पुत्र सफल का जन्म दिनांक 23-2-2011 को हुआ है परन्तु उसकी जन्म तिथि ग्राम पंचायत वशिष्ट के रिकॉर्ड में दर्ज नहीं की गई है, जिसे अब दर्ज करवाने के आदेश सादर फरमाए जावें।

अतः सर्वसाधारण को इस इश्तहार द्वारा सूचित किया जाता है कि यदि किसी व्यक्ति को सफल की जन्म तिथि दर्ज करवाने बारे आपत्ति हो तो वह दिनांक 25-6-2014 को या इससे पूर्व अदालत हजा में अपनी आपत्ति दर्ज करवा सकता है। इसके उपरान्त कोई भी उजर व एतराज मान्य न होगा तथा नियमानुसार जन्म तिथि दर्ज करवाने के आदेश पारित कर दिए जाएंगे।

इस कार्यालय में श्री भोेगेश्वर शर्मा पुत्र श्री गुलाबा राम, निवासी व फाटी निरमण्ड, तहसील निरमण्ड, जिला कुल्लू, हि0 प्र0 ने उक्त अधिनियम के अन्तर्गत प्रार्थना-पत्र गुजार कर निवेदन किया है कि उसके पुत्रों प्रशांत शर्मा की जन्म तिथि 1-6-1985 व निशान्त शर्मा की जन्म तिथि 12-3-1987 है उसके पुत्रों की जन्म तिथियां अज्ञानता व इलाका में न रहने के कारण निश्चित समय में ग्राम पंचायत निरमण्ड में दर्ज नहीं कर सका है। इस बारे उसने अपना व अपनी पत्नी का ब्यान हल्फिया भी प्रस्तुत किया है। रजिस्टर जन्म व मृत्यु ग्राम पंचायत निरमण्ड में प्रपत्र संख्या 10 पर अपना अप्राण्यता प्रमाण पत्र संलग्न किया है। सायल ने ग्राम पंचायत निरमण्ड, जिला कुल्लू, हि0 प्र0 में अपने पुत्रों की जन्म तिथि दर्ज करने का अनुरोध कर रखा है।1089 राजपत्र, हिमाचल प्रदेश, 7 जून, 2014/17 ज्येष्ठ, 1936 इस इश्तहार द्वारा आम जनता को सूचित किया जाता है कि यदि किसी व्यक्ति को प्रशान्त शर्मा व निशान्त शर्मा, गाव व डा0 निरमण्ड, तहसील निरमण्ड, जिला कुल्लू, हि0 प्र0 की जन्म तिथियां ग्राम पंचायत निरमण्ड, तहसील निरमण्ड, जिला कुल्लू, हि0 प्र0 में दर्ज कराने के लिए एतराज हो तो वह दिनांक 25-6-2014 को हमारे कार्यालय में हाजिर होकर लिखित व मौखिक पेश करे। उक्त तारीख के बाद कोई भी एतराज मान्य नहीं होगा और समझा जायेगा कि उक्त प्रशान्त शर्मा व निशान्त शर्मा की जन्म तिथियां ग्राम पंचायत निरमण्ड में दर्ज कराने बारे किसी को कोई एतराज नहीं है तथा सचिव, ग्राम पंचायत निरमण्ड को जन्म तिथियां दर्ज करने के आदेश पारित किया जाएगा।

Krishangarh, Tehsil Kasauli, District Solan, Himachal Pradesh has moved an application before the undersigned under section 13 (3) of Birth and Death Registration Act, 1969 alongwith affidavits and other documents stating therein that his brother namely Arun Sharma born on 18-4-1980 at Village Krishangarh, Tehsil Kasauli, District Solan, Himachal Pradesh but his date of birth could not be registered in the records of Gram Panchayat Krishangarh, Tehsil Kasauli, within stipulated period. Hence he prayed for passing necessary orders to the Secretary-cum-Registrar, Birth and Death Registration, Gram Panchayat Krishangarh, Tehsil Kasauli, for entering the same in the birth and death records.

अतः इस सम्बन्ध में सर्वसाधारण को सूचित किया जाता है कि प्रार्थी की शादी के पंजीकरण बारे यदि किसी व्यक्ति को कोई उजर या एतराज हो तो वह दिनांक 20-6-2014 से पूर्व असालतन या वकालतन इस अदालत में हाजिर आकर अपने उजर/एतराज पेश कर सकता/सकती है। हाजिर न आने की सूरत में नियमानुसार शादी पंजीकरण के आदेश पारित कर दिए जाएंगे।
