Shimla, the 10th July, 2014

No. /HIM/TP/PJT/AZR/ Nalagarh /2013/Vol-III/ 4249-4399.— In exercise of the powers conferred under sub-section (1) of Section-19 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), amendment is proposed to be carried out in the Development Plan for Nalagarh Planning Area notified vide Notification No HIM/TP/PJT/Nalagarh/93/Volume-I 73-राजपत्र/2014-11-7-2014 (1755)1756 राजपत्र, हिमाचल प्रदेश, 11 जुलाई, 2014/20 आषाढ़, 1936 dated 25-9-2000, as per Annexure-A, which is hereby published and the Notice is given that a copy of the said proposed amendment is available for inspection at the following offices during the office hours:—

This proposed amendment is hereby published in the Official Gazette of Himachal Pradesh for information of the general public and Notice is hereby given that the provisions of the aforesaid proposed amendment will be taken into consideration.

Annexure-A

Amendment in Chapter 7

In Chapter 7 of the Development Plan for Nalagarh Planning Area, Regulation 7.4.3 as amended vide Govt. Notification No. TCP-A(3)-2/2004 dated 10.8.2004 shall be substituted as under:—

7.4.3 Industrial Use

For Industrial Use / activities, following Regulations shall be applicable:—

7.4.3.1 Minimum area of plot:

Note.—(i) Minimum width of path/road abutting one side of plot shall be 5.00 Metres.

(ii) Service area required for pharmaceutical units or such type of Industries under requirement of Goods Manufacturing Practice (G.M.P) shall not be included for calculation of FAR, provided it is only used for utilities and services but not in any case for production.

(iii) For ancillary uses like security post/room shall be allowed in set-back area i.e. one wall shared with the boundary wall and shall be counted in the Floor Area Ratio (FAR).

7.4.3.4 Construction of Cellar :

(a) Construction of cellar shall not be counted as a storey.

(b) The cellar is to be constructed within the prescribed set backs and prescribed building lines and subject to maximum coverage on floor i.e. entrance floor and may be put for following uses:—

(i) Storage of household or other goods of ordinarily combustible material.

(ii) Strong rooms, bank cellars etc.

(iii) Air conditioning equipment and other machines used for services and utilities of the building and

(vi) Parking spaces.

(c) The cellar shall have following requirements:-

(i) All the walls shall be kept dead and below the natural ground level except the portion kept for ventilation purpose.

(ii) Every cellar shall be, in every part, at least 2.40 Metres in height from the floor to the underside of the roof slab or ceiling.

(iii) Adequate ventilation shall be provided for the cellar. Any deficiency in ventilation requirements may be met by providing mechanical ventilation in the form of blowers, exhaust fans and air conditioning system etc.

(iv) The minimum height of the ceiling of any cellar shall be 0.90 Metre and the maximum 1.20 Metre above the average surrounding ground level.

(v) Adequate arrangements shall be made such that surface drainage does not enter the cellar.

(vi) The walls and floors of the cellar shall be watertight and be so designed that the effects of the surrounding soil and moisture if any, are taken into account in design and adequate damp proofing treatment is given.

(vii) The access to the cellar shall be separate from the main and alternative staircase providing access and exit from higher floor.

Where the staircase is continuous in the case of buildings served by more than one staircase, the same shall be enclosed type, serving as a fire separation from the cellar floor and higher floors. Open ramps shall be permitted, if they are constructed within the building line subject to the provision of clause (v) above.

(viii) In case partition in the cellars is allowed by the Authority, no compartment shall be less than 50.00 M² in area and each compartment shall have proper ventilation provision. The cellar partition shall however, conform to the norms laid down by the Fire Services.

(ix) In no circumstances, construction of Toilet, Bath, Kitchen etc. shall be allowed in the cellar.

In Chapter 7 of the Development Plan for Nahan Planning Area, Regulation 7.4.3 as amended vide Govt. Notification No. TCP-A (3)-2/2004 dated 10.08.2004 shall be substituted as under:—

7.4.3 Industrial Use

For Industrial Use / activities, following Regulations shall be applicable:-

7.4.3.1 Minimum area of plot:-

(a) For small scale industry shall be 250 M²

(b) For services/light scale industry shall be 501 M² to 1000 M².

(c) For medium scale industry shall be 1001 M²1764 राजपत्र, हिमाचल प्रदेश, 11 जुलाई, 2014/20 आषाढ़, 1936 (d) For large and heavy scale industry shall be above 5000 M². (e) The plot area as mentioned in clauses (a) to (d) above would not be applicable in the cases where the sub-division of land has taken effect before the commencement of the Development Plan for Nahan Planning Area.

(f) The plot area as mentioned under clauses (a) to (d) above would not be applicable for the individual plots, if any, created/allotted by the Himachal Pradesh Industries Department and Himachal Pradesh State Industrial Development Corporation (HPSIDC) or any other Authority prior to coming into force of the Development Plan for Nahan Planning Area.

(g) The layout and design of industrial area, if any, shall be as per requirement of the Industry and shall be got approved from the Director.

7.4.3.2 Height of floor/storey:

The minimum floor/ storey height of industrial building shall be 3.00 Metres and sloping roof height shall be in accordance with volume of the structure. In case of roof trusses, height of building should be adjusted/relaxed accordingly.

अतः इस सन्दर्भ में आम जनता को सूचित किया जाता है कि उपरोक्त वर्णित विवाह का इन्द्राज रजिस्ट्रार विवाह स्थानीय पंजीकरण, ऊना, तहसील व जिला ऊना, हिमाचल प्रदेश में दर्ज करवाने बारे किसी को एतराज हो तो वह दिनांक 26-7-2014 को इस न्यायालय में उपस्थित होकर प्रस्तुत कर सकता है अन्यथा इसके बाद उक्त वर्णित विवाह के पंजीकरण हेतु आगामी कार्यवाही अमल में लाई जाएगी। इसके बाद कोई भी एतराज काबिले समायत न होगा।

अतः इस सन्दर्भ में आम जनता को सूचित किया जाता है कि उपरोक्त वर्णित विवाह का इन्द्राज रजिस्ट्रार विवाह स्थानीय पंजीकरण, भटोली, तहसील व जिला ऊना, हिमाचल प्रदेश में दर्ज करवाने बारे किसी को एतराज हो तो वह दिनांक 28-7-2014 को इस न्यायालय में उपस्थित होकर प्रस्तुत कर सकता है अन्यथा इसके बाद उक्त वर्णित विवाह के पंजीकरण हेतु आगामी कार्यवाही अमल में लाई जाएगी। इसके बाद कोई भी एतराज काबिले समायत न होगा।

उपरोक्त विषय में श्री जसवन्त सिंह पुत्र श्री सुच्चा सिंह, जाति जट, गांव व डा0 देहलां, तहसील व जिला ऊना, हिमाचल प्रदेश ने इस न्यायालय में इस आशय के साथ दो आवेदन प्रस्तुत किये हैं कि उसका वास्तविक नाम जसवन्त सिंह है, लेकिन राजस्व अभिलेख गांव बहडाला लामियां तथा देहलां उपरली में सुरजीत सिंह से इन्द्राज हुआ है, जो कि गलत है।

इस सम्बन्ध में हर आम व खास को सूचित किया जाता है कि यदि उक्त वर्णित गांव बहडाला लामियां तथा देहलां उपरली, तहसील व जिला ऊना (हि0 प्र0) के राजस्व अभिलेख में नाम की दरुस्ती होने से किसी व्यक्ति को कोई एतराज हो तो वह अपना एतराज इस न्यायालय में दिनांक 25-7-2014 को असालतन या वकालतन कर सकता है। इस तिथि के पश्चात्‌ कोई भी एतराज काबले समायत नहीं होगा तथा इसकी दरुस्ती राजस्व अभिलेख में करने बारे कार्यवाही अमल में लाई जाएगी।
