संख्याःएस0एम0एस0-1/2014-15-आर0डी0डी0.--हिमाचल प्रदेश की राज्यपाल, महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गारंटी अधिनियम, 2005 (2005 का अधिनियम संख्याक 42) की धारा 32 की उप धारा 2 (ख) और धारा 7 की उप धारा (6) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, पूर्वोक्त अधिनियम के उपबन्धों को कार्यान्वित करने के लिए निम्नलिखित नियम बनाने का प्रस्ताव करती है तथा इन्हें जनसाधारण की सूचना हेतु राजपत्र, हिमाचल प्रदेश में एतदद्वारा प्रकाशित किया जाता है;

इन प्रारूप नियमों से संभाव्य प्रभावित होने वाला कोई व्यक्ति यदि उक्त प्रारूप नियमों की बावत कोई आक्षेप या सुझाव देना चाहें, तो वह उसे/उन्हें प्रारूप नियमों के राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से तीस दिन की अवधि के भीतर, विशेष सचिव (ग्रामीण विकास), हिमाचल प्रदेश सरकार, एस0डी0ए0 काम्पलैक्स, ब्लॉक न0 27, कसुम्पटी, शिमला-171009 को भेज सकेगा;

उपरोक्त विनिर्दिष्ट अवधि के भीतर प्राप्त आक्षेप(पों) या सुझाव(वों) यदि कोई है/हों, पर इन नियमों को अंतिम रूप देने से पूर्व राज्य सरकार द्वारा विचार किया जाएगा, अर्थात :-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गारंटी, हिमाचल प्रदेश (बेरोज़गारी भत्ता संदाय) नियम, 2014 है।

(2) ये नियम राजपत्र में इनके अंतिम प्रकाशन की तारीख से प्रवृत्त होंगे।

2. परिभाषाएं--(1) इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो;

(क) "अधिनियम" से महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गारंटी अधिनियम, 2005 अभिप्रेत है;

(ख) "स्कीम" से हिमाचल प्रदेश रूरल इमप्लॉइमैन्ट गारंटी स्कीम, 2006 अभिपे्रत है; और (ग) कार्यक्रम अधिकारी, जिला कार्यक्रम समन्वयक और राज्य आयुक्त से, अधिनियम/स्कीम/ नियमों के अधीन उक्त पदों के कर्तव्यों और कृत्यों का निर्वहन करने वाले राज्य सरकार द्वारा इस रूप में अधिसूचित अधिकारी अभिप्रेत हैं।

(2) उन समस्त शब्दों और पदों के जो इन नियमों में प्रयुक्त हैं किन्तु परिभाषित नहीं हैं, क्रमशः वही अर्थ होंगे जो अधिनियम में हैं।

3. बेरोज़गारी भत्ते का हकदार.--महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गारंटी अधिनियम के अधीन बेरोज़गारी भत्ता वह होगा जो अधिनियम की धारा 7 की उपधारा (1) में परिभाषित है। यदि स्कीम के अधीन नियोजन हेतु आवेदक को नियोजन प्राप्त करने हेतु दिये गये आवेदन की प्राप्ति के या उस तारीख से जिसको नियोजन चाहा गया है अग्रिम आवेदन की दशा में इनमें से जो भी पश्चात्‌वर्ती हों, पन्द्रह दिन के भीतर ऐसा नियोजन उपलब्ध नहीं कराया जाता है तो वह बेरोज़गारी भत्ते का हकदार होगा।

4. बेरोज़गारी भत्ते की दर.--बेरोज़गारी भत्ता, महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गारंटी अधिनियम के अधीन वित्तीय वर्ष के दौरान पहले तीस दिनों के लिए अधिसूचित मज़दूरी दर के एक चौथाई दर के बराबर और अधिनियम की धारा 7 की उपधारा (2) के उपबन्धों के अनुसार वित्तीय वर्ष की शेष अवधि के लिए महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गारंटी अधिनियम के अधीन अधिसूचित मज़दूरी दर के आधे के बराबर संदेय होगा।1867 राजपत्र, हिमाचल प्रदेश, 17 जुलाई, 2014/26 आषाढ़, 1936 5. बेरोज़गारी भत्ते का दावा करने के लिए अनिवार्य शर्तें.--(1) आवेदक, "रजिस्ट्रीकरण" और रोज़गार के रजिस्टर में रजिस्ट्रीकृत किया जाएगा और गृहस्थी (हाउस-होल्ड) जॉब-कार्ड धारित करेगा तथा आवेदक की जॉब कार्ड में वैयक्तिक संख्या द्वारा पहचान हो सकेगी।

(2) आवेदक कार्य के लिए आवेदन करेगा और आवेदन को "जॉब/रोज़गार रजिस्टर" में रजिस्ट्रीकृत किया जाएगा।

6. दावा दायर करने के लिए प्रक्रिया.--"बेरोज़गार भत्ते का दावा करने वाला व्यक्ति महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गारंटी अधिनियम की धारा 7 की उपधारा (1) के अधीन बेरोज़गारी भत्ते को प्राप्त करने हेतु हकदार होने के पश्चात्‌ किसी भी समय पंचायत सचिव को आवेदन करेगा।"

7. दावा को सत्यापित करने के लिए प्रक्रिया.--(1) पंचायत सचिव, आवेदन की प्राप्ति पर, दावों की आवश्यक जांच करेगा और यदि उसका समाधान हो जाता है कि आवेदक स्कीम के अधीन रोज़गार हेतु रजिस्ट्रीकृत है तथा यदि बेरोज़गारी भत्ते संदाय हेतु हकदार है, तो वह अपनी टिप्पणियों सहित आवेदन को कार्यक्रम अधिकारी को अग्रेषित करेगा।

(2) कार्यक्रम अधिकारी मामले की जांच करेगा और बेरोज़गारी भत्ते के संदाय के लिए दावे पर विनिश्चय करेगा। वह, वास्तविक कार्य दिवसों जिसके लिए बेरोज़गारी भत्ता संदेय है, को उपदर्शित करते हुए आदेश जारी करेगा।

(3) यदि कार्यक्रम अधिकारी, बेरोज़गारी भत्ते के दावे/मांग को नामंजूर करता है तो वह उसको अस्वीकृत करने के कारणों को अभिलिखित करेगा तथा उसे पंचायत सचिव के माध्यम से लिखित में आवेदक को सूचित करेगा ।

8. बेरोज़गारी भत्ते के संदाय के लिए प्रक्रिया.--(1) कार्यक्रम अधिकारी बेरोज़गारी भत्ता का संदाय सम्बन्द्ध पंचायत के पंचायत सचिव के माध्यम से करेगा।

(2) संदाय, यदि अनुमोदित है, तो इलैक्ट्रॉनिकली/पाने वाले के खाते में देय चैक के माध्यम से किया जाएगा।

(3) बेरोज़गारी भत्ते का प्रत्येक संदाय, उस तारीख से, जिसको वह महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गारंटी अधिनियम की धारा 7 की उपधारा (5) के अनुसार संदाय के लिए देय हो जाता है, पन्द्रह दिन के अपश्चात्‌ किया जाएगा या प्रस्थावित किया जाएगा।

(4) कार्यक्रम अधिकारी, राज्य सरकार द्वारा इस परियोजन के लिए निश्चित की गई रकम से अपेक्षित लाभों की पूर्ति करेगा ।

(5) पंचायत द्वारा किये गये बेरोज़गारी भत्ते के संदाय से सम्बन्धित मासिक विवरणियां ग्राम पंचायत, कार्यक्रम अधिकारी को प्रस्तुत करेगी।

9. अपील.--(1) यदि आवेदक का नियम 7 के उपनियम (2) और (3) के अधीन जारी आदेश से समाधान नहीं होता है, तो वह कार्यक्रम अधिकारी के आदेश के विरूद्ध आदेश की प्राप्ति की तारीख से तीस दिन की अवधि के भीतर जिला कार्यक्रम समन्वयक को अपील दायर कर सकेगा।

(2) यदि आवेदक का जिला कार्यक्रम समन्वयक द्वारा जारी आदेश से समाधान नहीं होता है, तो वह आदेश की प्राप्ति की तारीख से तीस दिन के भीतर राज्य आयुक्त को अपील दायर कर सकेगा, जो अपील दायर करने की तारीख से एक मास की अवधि के भीतर अपील का निपटारा करेगा तथा उस पर उसका विनिश्चिय अंतिम होगा ।

Shimla-9, the 15th July, 2014

No. SMS-1/2014-15-RDD.—In exercise of the powers conferred by sub-section 2(b) of section 32 and sub- section (6) of section 7 of the Mahatma Gandhi National Rural Employment Guarantee Act, 2005 (Act No. 42 of 2005), the Governor, Himachal Pradesh proposes to make the following rules for carry out the provisions of the act ibid and the same are hereby published in the Rajpatra, Himachal Pradesh, for information of the general public;

If any person, likely to be affected by these draft rules has any objection(s)or suggestion(s) to make with regard to the said rules, he may send the same to the Special Secretary (Rural Development) to the Government of Himachal Pradesh, SDA Complex, Block No. 27, Kasumpti, Shimla-171009, within a period of thirty days from the date of publication of the draft rules in the Rajpatra, Himachal Pradesh;

The objection(s) or suggestion (s) if any, received within the period specified above shall be taken into consideration by the State Government before finalizing these rules, namely :-

Draft Rules

1. Short title and commencement.—(1) These rules may be called the Mahatma Gandhi National Rural Employment Guarantee Himachal Pradesh ( Payment of Unemployment Allowance) Rules, 2014.

(2) They shall come into force from the date of their final publication in the Official Gazette.

2. Definitions.—(1) In these rules unless the context otherwise requires;

(a) "Act" means the Mahatma Gandhi National Rural Employment Guarantee Act, 2005;

(b) "Scheme" means the Himachal Pradesh Rural Employment Guarantee Scheme, 2006; and

(c) Programme Officer, District Programme Coordinator and State Commissioner mean the officers notified as such by the State Government to discharge the duties and functions of the said posts under the Act/ Scheme/Rules.

(2) All other words and expressions used but not defined in these rules shall have the same meaning respectively as assigned to them under the Act.

3. Entitlement of unemployment allowance.—Unemployment allowance under Mahatma Gandhi National Rural Employment Guarantee Act, shall be as defined sub-section (1) of section 7 of Act whereby if any applicant for employment under the scheme is not provided such employment within fifteen days of receipt of his application seeking employment, or from the date on which the employment has been sought in the case of an advance application, whichever is later, he shall be entitled to a Unemployment Allowance.

4. Rate of unemployment allowance.—Unemployment Allowance shall be payable at the rate equal to oneforth of the wage rate notified under Mahatma Gandhi National Rural Employment Guarantee Act, for the first thirty days during the financial year and equal to half of the wage rate notified under Mahatma Gandhi National Rural Employment Guarantee Act for the remaining period of the financial year in accordance with the provisions of sub-section (2) of section 7 of Act.

5. Essential conditions for claiming Unemployment Allowance.—(1) The applicant shall be registered in the "Register of Registration and Employment" and the Household shall possess a Job-card and the applicant shall be identifiable by an individual number in the job card.

(2) The applicant shall apply for work and the application be registered in the "Job/Employment Register".

6. Procedure for filing a claim.—(1) "A person claiming Un-employment Allowance shall apply to the Panchayat Secretary any time after he becomes entitled to receive the Un- employment Allowance under Section 7 (1) of MGNREGA".

7. Procedure for verification of claim.—(1) On receipt of the application, the Panchayat Secretary shall make necessary enquiries of claims and if he is satisfied that the applicant is registered for employment under the Scheme and if entitled for payment of unemployment allowance, he shall forward the application to the Programme Officer along with his remarks.

(2) The Programme Officer shall enquire into the matter and decide on the claim for payment of Unemployment Allowance. He shall issue an order indicating the actual days for which Unemployment Allowance is payable.

(3) If the Programme Officer rejects the claim/ demand for Unemployment Allowance, he shall record the reasons for rejecting the same and intimate the same to the applicant in writing through the Panchayat Secretary.

8. Proceedure for payment of Unemployment Allowance.—(1). The Programme Officer shall make payment of unemployment allowance through the Panchayat Secretary of the concerned Panchayat.

(2) "Payment shall be made electronically / through an account payee cheque if payment is approved".

(3) "Every payment of Un-employment Allowance shall be made or offered not later than 15 days from the date on which it became due for payment in accordance with Section 7 (5) of MGNREGA".

(4) The Programme Officer shall meet the required expanses from the amount earmarked for the purpose by the State Government.

(5) The Gram Panchayat shall submit monthly statements to the Programme Officer regarding the payment of Unemployment Allowance made by the Panchayat.

9. Appeal. —(1) In case the applicant is not satisfied with the order issued under sub- rules (2) and (3), of rule 7, he may file an appeal against the order of the Programme officer to the District Programme Coordinator within thirty days from the date of receipt of the order.

(2) In case, the applicant is not satisfied with the order issued by the District Programme Coordinator he may file an appeal to the State Commissioner within thirty days from the date of receipt of order, who shall dispose off the appeal within a period of one month from the date of filing of appeal and his decision thereon shall be final.

इन प्रारूप नियमों से संभाव्य प्रभावित होने वाला कोई व्यक्ति, यदि इन प्रारूप नियमों की बावत कोई आक्षेप या सुझाव देना चाहें, तो वह उसे/उन्हें, प्रारूप नियमों के राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से तीस दिन की अवधि के भीतर, विशेष सचिव(ग्रामीण विकास), हिमाचल प्रदेश सरकार, एस0डी0ए0 काम्पलैक्स, ब्लॉक न0 27, कसुम्पटी, शिमला-171009 को भेज सकेगा;

उपरोक्त विनिर्दिष्ट अवधि के भीतर प्राप्त आक्षेप (पों) या सुझाव(वों) यदि कोई हों, पर इन नियमों को अंतिम रूप देने से पूर्व राज्य सरकार द्वारा विचार किया जाएगा, अर्थात :--

प्रारूप नियम

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम महात्मा गांधी राष्ट्रीय ग्रामीण रोजग़ार गारंटी स्कीम, हिमाचल प्रदेश (पारदर्शिता, शिकायत निवारण और सामाजिक संपरीक्षा) संशोधन नियम, 2014 है।

(2) ये नियम राजपत्र में इनके अंतिम प्रकाशन की तारीख से प्रवृत्त होंगे।

2. नियम 1 का संशोधन.--राष्ट्रीय ग्रामीण रोज़गार गारंटी स्कीम, हिमाचल प्रदेश(पारदर्शिता, शिकायत निवारण और सामाजिक संपरीक्षा) नियम, 2009 (जिन्हें इसमें इसके पश्चात्‌ उक्त नियम कहा गया है) के नियम 1 म,ें "राष्ट्रीय ग्रामीण" शब्दों से पूर्व "महात्मा गांधी" शब्द अंतःस्थापित किए जाएंगे और कोष्ठक में आए शब्दों "और सामाजिक संपरीक्षा" को लोप किया जाएगा।

3. निमय 2 का संशोधन.--उक्त नियमों के नियम 2 के खण्ड (क) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात :-

"(क) "अधिनियम" स,े महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गारंटी अधिनियम, 2005 (2005 का केन्द्रीय अधिनियम संख्यांक 42) अभिप्रेत है।"

4. अध्याय 1 का संशोधन.--उक्त नियमों के अध्याय 1 में,

(क) शीर्षक म,ें "राष्ट्रीय ग्रामीण रोजग़ार" शब्दों से पूर्व, "महात्मा गांधी" शब्द अंतःस्थापित किए जाएंगे;

(ख) इन नियमों के राजभाषा पाठ में, "राष्ट्रीय ग्रामीण रोज़गार गांरटी स्कीम" शब्दों के स्थान पर "महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गांरटी स्कीम" शब्द रखे जाएंगे;

(ग) इन नियमों के राजभाषा पाठ मेें नियम 5 म,ें "राष्ट्रीय ग्रामीण रोज़गार गांरटी स्कीम" शब्दों के स्थान पर "महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गांरटी स्कीम" शब्द रखे जाएंगे।

5. अध्याय 2 का संशोधन.--उक्त नियमों के अध्याय 2 म,ें

(क) इन नियमों के राजभाषा पाठ में नियम 6 में, "राष्ट्रीय ग्रामीण रोज़गार गांरटी स्कीम" के स्थान पर "महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गांरटी स्कीम" शब्द रखे जाएंगे;

(ख) इन नियमों के राजभाषा पाठ में नियम 7 के उप-नियम (1) म,ें "राष्ट्रीय ग्रामीण रोज़गार गांरटी स्कीम" शब्दों के स्थान पर "महात्मा गांधी राष्ट्रीय ग्रामीण रोज़गार गांरटी स्कीम" शब्द रखे जाएंगे;

(ग) नियम 9 आरै 10 में "(नरेगा)" कोष्ठक और संक्षेपाक्षर जहां-जहां ये आते हैं का लोप किया जाएगा।

6. अध्याय 3 का लोप.--उक्त नियमों के अध्याय 3 का लोप किया जाएगा।

Amendment of rule 1.—In rule 1 of the National Rural Employment Guarantee Scheme, Himachal Pradesh (Transparency, Grievance Redressal and Social Audit) Rules, 2009 (hereinafter referred to as the said rules), after the word "the" and before the words, "National Rural" the words, "Mahatma Gandhi" shall be inserted and words "Social Audit" in the bracket shall be deleted.

3. Amendment of rule 2.— In rule 2 of the said rules, for clause (a) the following shall be substituted, namely :—

"(a) Act means the Mahatma Gandhi National Rural Employment Guarantee Act, 2005 (Act No. 42 of 2005)".

4. Amendment of Chapter 1.—In chapter 1 of the said rules,

(a) in the heading, after the words, "General Transparency of" and before the words, "National Rural Employment Guarantee Act," the words, "Mahatma Gandhi" shall be inserted;

(b) in the Authoritative English text of these rules for the words, "National Rural Employment Scheme", the words, "Mahatma Gandhi National Rural Employment Guarantee Scheme" shall be substituted;

(c) in the Authoritative English text of these rules in rule 5, for the abbreviation "NREGS", "the Mahatma Gandhi National Rural Employment Guarantee Scheme" words shall be substituted.

5. Amendment of Chapter 2.—In chapter 2 of the said rules,

(a) in the Authoritative English text of these rules in rule 6, for the abbreviation, "NREGS", "the Mahatma Gandhi National Rural Employment Guarantee Scheme" words shall be substituted.

(b) in the Authoritative English text of these rules in sub rule (1) of rule 7, for the abbreviation "NREGS" "the Mahatma Gandhi National Rural Employment Guarantee Scheme" words shall be substituted.

(c) in rule 9 and 10, the bracket and abbreviation "(NREGA)" wherever occur shall be deleted.

6. Omission of Chapter 3.—Chapter 3 of the said rules, shall be omitted.

The Council will consider all the issues pertaining to Road Transport and Road Safety within the State. The Council will be an Advisory Body and will meet periodically or atleast twice in a year and will su;bmit its recommendations to State Government. No. TPT-B(6)-1/2001-I.—Sh. Radhey Shyam Chaudhry, Assistant Commissioner (Technical) Department of Transport has given notice dated 26-06-2014 to this department seeking pre-mature retirement from the Govt. Service under Rule 3(2) of the H.P. Civil Services (Premature retirement) Rules, 1926.

The notice of premature retirement given by Sh. Radhey Shyam Chaudhry Assistant Commissioner (Technical) Department of Transport has been considered by the Government. Now, therefore, in exercise of powers conferred under the sub-rule-3(3) (b) of Rule ibid, the Governor Himachal Pradesh is pleased to accept the notice of premature retirement of Sh. Radhey Shyam Chaudhry, Assistant Commisioner (Technical) and order that he shall retire from Government service with immediate effect subject to condition that Govt. servant shall not apply commutation of a part of his pension before expiry of the period of notice of three months.
