संख्याः श्रम (ए) 4-1/2014-बी.ओ.सी.डब्ल्यू.--हिमाचल प्रदेश की राज्यपाल, भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा शर्त विनियमन) अधिनियम, 1996 की धारा 62 द्वारा प्रदत शक्तियों का प्रयोग करते हुए, विशेषज्ञता समिति से परामर्श के पश्चात्‌, इस विभाग की अधिसूचना संख्याः श्रम (ए)4-6/2007-बी. ओ. सी. डब्ल्यू तारीख 4 दिसम्बर, 2008, द्वारा अधिसूचित और राजपत्र, हिमाचल प्रदेश में 101-राजपत्र/2014-19-8-2014 (2707) 2708 राजपत्र, हिमाचल प्रदेश, 19 अगस्त, 2014/28 श्रावण, 1936 तारीख 8 दिसम्बर, 2008 को प्रकाशित हिमाचल प्रदेश भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा शर्तें विनियमन) नियम, 2008 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्‌ :-

1. संक्षिप्त नाम.--इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा शर्तें विनियमन) संशोधन नियम, 2014 है।

2. नियम 277 का संशोधन.--हिमाचल प्रदेश भवन एवं अन्य सन्निर्माण कर्मकार तथा सेवा शर्ते विनियमन) नियम, 2008 (जिन्हें इसके पश्चात्‌ 'उक्त नियम' कहा गया है) के नियम 277 में "5,000/-रूपए" अंकाें और शब्दों के स्थान पर "10,000/-रूपए" शब्द और अंक रखे जाएंगे।

3. नियम 278 का संशोधन.--उक्त नियमों के नियम 278 में,--

(क) विद्यमान शीर्षक के स्थान पर निम्नलिखित शीर्षक रखा जाएगा; अर्थात्‌ :-

"हिताधिकारी के नामनिर्देशितियों, आश्रितों को मृत्यु-प्रसुविधा।"।

(ख) उप-नियम (1) के स्थान पर निम्नलिखित उप-नियम रखा जाएगा, अर्थात्‌ः-

"(1) बोर्ड, दुर्घटना के कारण हुई मृत्यु की दशा में केवल ` 1,00,000/- (एक लाख रूपए केवल) की रकम और प्राकृतिक कारणों से या किसी अन्य कारण से, जो उपरोक्त के अन्तर्गत नहीं आता है, से हुई मृत्यु की दशा में ` 50,000/- (पचास हजार रूपए केवल) निधि के मृतक सदस्य के नामनिर्देशिती या आश्रितों को मन्जूर कर सकेगा।"। 4. नियम 280 का संशोधन.--'उक्त नियमों' के नियम 280 के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्‌ः--

"280 हिताधिकारियों के लिए चिकित्सा सहायता.--बोर्ड, हिताधिकारियों और उनके आश्रितों को सरकारी अस्पतालों, औषधालयों और सरकार द्वारा अनुमोदित अन्य अस्पतालों से, चिकित्सा बिलों को प्रस्तुत करने पर प्रतिवर्ष, बाह्य चिकित्सा उपचार के लिए ` 10,000/- (दस हजार रूपए केवल) और अन्तरंग चिकित्सा प्रतिपूर्ति के लिए उपचार के लिए ` 30,000/- (तीस हजार रूपए केवल) की चिकित्सा प्रतिपूर्ति के लिए विाीय सहायता मंजूर कर सकेगा। और हिताधिकारी, ऐसी चिकित्सा प्रतिपूर्तिं के लिए वॉछित दस्तावेजों के साथ प्ररूप संख्या XLII पर आवेदन सचिव या प्राधिकृत अधिकारी को प्रस्तुत करेगा।"।

5. नियम 282 का संशोधन.--'उक्त नियमों' के नियम 282 के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्‌ः-

"282 शादी के लिए विाीय सहायता.--हिताधिकारी, सदस्यता के दो मास पूर्ण हो जाने के पश्चात्‌ अपनी शादी के लिए ` 25,000/-(पच्चीस हजार रूपए केवल) की विाीय सहायता और अपने दो बच्चों की शादी के लिए प्रत्येक को ` 25,000/-(पच्चीस हजार रूपए केवल) की विाीय सहायता प्राप्त करने हेतु पात्र होगा। हिताधिकारी ऐसी सहायता के लिए सचिव या प्राधिकृत अधिकारी को अपेक्षित दस्तावेजों के साथ प्ररूप संख्याः XLIV में आवेदन सचिव या प्राधिकृत अधिकारी को प्रस्तुत करेगा।"।

6. नियम 283 (ख) का संशोधन.--'उक्त नियमों' के नियम 283 (ख) के स्थान पर निम्नलिखित नियम रखा जाएगा। अर्थात्‌ः-

"283 (ख) महिला हिताधिकारियों के लिए साईकिल.--महिला हिताधिकारी को, सदस्यता के दो मास पूर्ण करने के पश्चात्‌, नियन्त्रक, भण्डार, हिमाचल प्रदेश द्वारा अनुमोदित दर संविदा पर2709 राजपत्र, हिमाचल प्रदेश, 19 अगस्त, 2014/28 श्रावण, 1936 बोर्ड द्वारा केवल एक बार एक साईकिल प्रदान की जा सकेगी और यह सहायता परिवार में केवल एक महिला हिताधिकारी को दी जाएगी। ऐसी महिला हिताधिकारी जिन्हाेंने ` 3,000/- (तीन हजार रूपए केवल) की ऐसी वाहन सहायता पहले प्राप्त की है, इस सहायता को प्राप्त करने के लिए पात्र नहीं होगी । उक्त हिताधिकारी द्वारा इस सहायता के लिए प्ररूप संख्याः XLVIII में, अपेक्षित दस्तावेजों के साथ आवेदन, सचिव या प्राधिकृत अधिकारी को प्रस्तुत किया जाएगा।"।

7. नियम 283 (ग) का संशोधन.--'उक्त नियमों' के नियम 283 (ग) के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्‌ः-

"283 (ग) चार बर्तनों के साथ इंडक्शन हीटर या सोलर कुकर.--बोर्ड, हिताधिकारी या उसके परिवार को एक बार, नियन्त्रक, भण्डार, हिमाचल प्रदेश द्वारा अनुमोदित दर संविदा के माध्यम से चार विनिर्दिष्ट बर्तनों के साथ एक इंडक्शन हीटर या हिमऊर्जा के माध्यम से एक सोलर कुकर उपलब्ध करवा सकेगा। हिताधिकारी द्वारा इस सहायता के लिए अपेक्षित दस्तावेजों के साथ, आवेदन प्ररूप XLVIII पर सचिव या प्राधिकृत अधिकारी को प्रस्तुत किया जाएगा।"। 8. नियम 283 (घ) का संशोधन.--'उक्त नियमों' के नियम 283 (घ) के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्‌ः--

"283 (घ) हिताधिकारी, उसके पति/पत्नी उसके दो बच्चों के लिए कौशल विकास भाा.--(1) बोर्ड, हिताधिकारी, उसके पति/पत्नी, उसके दो बच्चों तक कौशल विकास कोर्स करने के लिए ` 1500/- (एक हजार पांच सौ रूपए केवल) प्रतिमास की दर से कोर्स की अवधि के दौरान कौशल विकास भाा उपलब्ध करवा सकेगा।

(2) बोर्ड, सचिव या बोर्ड के प्राधिकृत अधिकारी को अपेक्षित दस्तावेज प्रस्तुत करने के अध्यधीन, संस्थान की अपेक्षाओं के अनुसार कुल फीस, बोर्डिंंग और लॉजिंग प्रभारों को संदा करने पर राज्य में या भारत में किसी सरकारी संस्थान से आवासीय कौशल विकास कोर्स कराने की व्यवस्था कर सकेगा।

(3) ऐसे कौशल विकास कोर्स के लिए न्यूनतम और अधिकतम आयु हिताधिकारी और उसके पति/पत्नी की दशा में 18 से 35 वर्ष और बच्चों की दशा में 15 से 35 वर्ष होगी। आयु को, शैक्षिक अर्हता प्रमाण-पत्रों से या अन्य दस्तावेजों जैसे कि आधार कार्ड, मतदाता पहचान पत्र, जन्म प्रमाण पत्र, स्कूल छोड़ने का प्रमाण-पत्र, चालन अनुज्ञप्ति से सत्यापित किया जाएगा। (4) हिताधिकारी, पति/पत्नी और उसके बच्चे किसी मान्यता प्राप्त संस्थान से अपने कौशल की अभिवृद्धि (अपगे्रडेशन) के लिए न्यूनतम 15 दिन की अवधि के और अधिकतम 3 वर्ष की अवधि के लिए कौशल विकास कोर्स कर सकेगें :

परन्तु हिताधिकारी को वर्ष में किसी भवन या अन्य सन्निर्माण संर्कम में कम से कम 90 दिन के लिए कार्य करना होगा और इस प्रभाव का प्रमाण-पत्र वर्षानुवर्ष आधार पर सचिव या बोर्ड के प्राधिकृत अधिकारी को प्रस्तुत किया जाना अपेक्षित होगा।

(5) हिताधिकारी को, कौशल विकास भाा प्राप्त करने के लिए अपेक्षित दस्तावेजों सहित प्ररूप XLVII में सचिव या प्राधिकृत अधिकारी को आवेदन प्रस्तुत करना होगा।

(6) बोर्ड हिताधिकारियों को कौशल विकास के लिए अनुज्ञेय विाीय सहायता जमा अकुशल कर्मकार की न्यूनतम मजदूरी केवल उस संस्था से, जहां हिताधिकारी ऐसा प्रशिक्षण प्राप्त करेगा, प्रमाण-पत्र और अन्य अपेक्षित दस्तावेजों को पेश करने के अध्यधीन प्रदान करेगा।

(7) कौशल विकास भो की रकम कोर्स की अवधि के लिए अनुपाततः अनुज्ञेय होगी। 2710 राजपत्र, हिमाचल प्रदेश, 19 अगस्त, 2014/28 श्रावण, 1936 (8) यदि पति या पत्नी और बच्चों सहित हिताधिकारी झूठे दावे प्रस्तुत करता है, तो वह कौशल विकास भो की संपूर्ण रकम बोर्ड को, शास्ति ब्याज सहित एक मुश्त संदा करने के लिए दायी होगा और, वह निधि का सदस्य नहीं रहेगा।"।

9. नियम 283 (ङ) और नियम 283 (च) का अन्तःस्थापन.--उक्त नियमों के नियम 283 (घ) के पश्चात्‌ निम्नलिखित नए नियम अन्तःस्थापित किए जाएंगे अर्थात्‌ः-

"283 (ङ) सोलर लैम्प.--बोर्ड, हिताधिकारी को नियंत्रक, भंडार, हिमाचल प्रदेश द्वारा अनुमोदित दर संविदा पर, एक मुश्त प्रोत्साहन के रूप में एक सोलर लैम्प प्रदान कर सकेगा। हिताधिकारी द्वारा इस सहायता हेतु आवेदन, अपेक्षित दस्तावेजों सहित प्ररूप संख्या XLVIII में सचिव या बोर्ड के प्राधिकृत अधिकारी को प्रस्तुत किया जाएगा।

283 (च) महिला हिताधिकारी के लिए वाशिंग मशीन.--बोर्ड महिला हिताधिकारी को नियंत्रक, भंडार हिमाचल प्रदेश द्वारा अनुमोदित दर संविदा पर, एक मुश्त प्रोत्साहन के रूप में एक वाशिंग मशीन प्रदान कर सकेगा। यह प्रसुविधा प्रति कुटुंब/परिवार केवल एक बार प्रदान की जाएगी। हिताधिकारी द्वारा इस सहायता के लिए आवेदन अपेक्षित दस्तावेजों सहित प्ररूप संख्या XLVIII में सचिव या बोर्ड के प्राधिकृत अधिकारी को प्रस्तुत किया जाएगा।"

10. प्ररूप XLVII और प्ररूप XLVIII का जोड़ना.--उक्त नियमों से संलग्न प्ररूप XLVI के पश्चात्‌, निम्नलिखित नए प्ररूप जोड़ जाएंगे, अर्थात्‌ः-

(i) "प्ररूप XLVII

NOTIFICATION

Shimla-171002, the 14th August, 2014

No. Shram (A) 4-1/14-BOCW.—In exercise of powers conferred by section 62 of the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act,1996, the Governor of Himachal Pradesh, after consultation with the Expert Committee, is pleased to make the following rules further to amend the Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules,2008, notified vide this Department's notification No. Shram (A) 4-6/2007-BOCW dated 4th December, 2008 and published in Rajpatra Himachal Pradesh on dated 8th December, 2008, namely :—

1. Short title.—These rules may be called the Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Amendment Rules, 2014.

2. Amendment of rule 277.—In rule 277 of the Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 2008 (hereinafter referred to as the 'said rules'), for the words, figures and signs "` 5000/- (Rupees five thousand only)", the words, figures and signs "` 10,000/- (Rupees ten thousand only) shall be substituted.

3. Amendment of rule 278.—In rule 278 of the said rules,—

(a) for the existing heading, the following heading shall be substituted, namely:—

" Death benefit to the nominees, dependents of the beneficiary.";

(b) for sub-rule(1) the following sub-rule shall be substituted, namely:—

" (1) the Board may sanction an amount of ` 1,00,000/- (Rupees one lac only) in the event of accidental death and ` 50,000/-(Rupees fifty thousand only) in the event of natural death or death caused by any other reason not covered under the above to the nominee or dependents of the deceased member of the fund.".

4. Amendment of rule 280.—For rule 280 of the 'said rules, the following rule shall be substituted, namely:—

"280 Medical Assistance to the Beneficiaries.—The Board may annually sanction a financial assistance for medical reimbursement to beneficiary and his dependents, upto ` 10,000/- (Rupees ten thousand only) for out-door medical treatment and upto ` 30,000/- (Rupees thirty thousand rupees only) for in-door medical treatment, on production of medical bills from government hospitals, dispensaries and other hospitals approved by the Government.The beneficiary shall submit the application for such medical reimbursement to the Secretary or the authorized officer in form No: XLII alongwith requisite documents.".

5. Amendment of rule 282.—For rule 282 of the 'said rules' the following shall be substituted, namely:—

"282 Financial Assistance for marriage.—The beneficiary after completion of two months of the membership shall be eligible to get financial assistance of ` 25,000/- (Rupees twenty five thousand only) for his marriage and ` 25,000/- (Rupees twenty five thousand only) each for the marriage of two children only. The beneficiary shall submit the application for such assistance to the Secretary or the authorized officer in form No. XLIV alongwith requisite documents.".

6. Amendment of rule 283 (B).—For rule 283 (B) of the 'said rules' the following shall be substituted, namely:—

"283 (B) Bicycle to the female beneficiaries.—The female beneficiary after completion of two months of the membership may be provided a bicycle only once by the Board on rate contract approved by the Controller of Stores, Himachal Pradesh and this assistance will be provided to one female beneficiary in the family. Those female beneficiaries who have already availed such conveyance assistance of ` 3,000/- (Rupees three thousand only) shall not be eligible for getting this assistance. The application for this assistance shall be submitted by the said beneficiary to the Secretary or authorized officer in form No. XLVIII alognwith requisite documents.".

7. Amendment of rule 283(C).—For rule 283(C) of the 'said rules,' the following rule shall be substituted, namely :—

"283 (C) Induction heater with four utensils or Solar cooker.—The Board may provide one induction heater alongwith four specific utensils through rate contract approved by the Controller of Stores, Himachal Pradesh or one solar cooker through Himurja to a beneficiary or his family once. The application for this assistance shall be submitted by the beneficiary to the Secretary or authorized officer of the Board in Form No. XLVIII alongwith requisite documents." .

8. Amendment of rule 283(D).—For rule 283(D) of the 'said rules' the following rule shall be substituted, namely :—

"283(D)Skill Development Allowance to the beneficiary, spouse and two children.—(1) The Board may provide Skill Development Allowance for undertaking the skill development course to beneficiary, the spouse and upto two children at the rate of ` 1500/- (Rupees one thousand five hundred only) per month upto the duration of course.

(2) The Board may provide the residential Skill Development course from any Government institution in the State or within India by paying total fee, boarding and lodging charges, as per institutional requirement subject to production of requisite documents to the Secretary or authorized officer of the Board.

(3) For such Skill Development course minimum and maximum age limit for beneficiary and the spouse shall be between 18 to 35 years and for children between 15 to 35 years, which shall be verified from educational qualification certificates or the other documents viz-a-viz Adhaar Card, Voters ID Card, Birth Certificate, School Leaving Certificate, Driving License.

(4) The beneficiary, spouse and children may undertake skill development course for upgradation of their skill from any recognized institution for a minimum period of 15 days and maximum period of 3 years:

Provided that the beneficiary shall have to work atleast for 90 days in any building or other construction work in a year and certificate to this effect shall be required to be submitted to the Secretary or authorized officer of the Board on yearly basis.

(5) In order to avail Skill Development Allowance, the beneficiary shall have to submit application to the Secretary or authorized officer in Form No. XLVII alongwith the requisite documents.

(6) The Board may provide the admissible financial assistance for skill development plus minimum wages of unskilled worker to the beneficiaries only subject to production of certificate and other requisite documents from the institution where the beneficiary will undergo such training.

(7) The amount of Skill Development Allowance shall be admissible proportionately to the duration of course.

(8) In case the beneficiary including spouse and children prefer false claims, he shall be liable to pay whole amount of Skill Development Allowance in lump sum to the Board alongwith penal interest and he shall be ceased to be the member of the fund.".

9. Insertion of rules, 283-(E) and rule 283-(F).—After rule 283(D) of the 'said rules', the following new rules shall be inserted, namely:—

"283 (E) Solar lamp.—The Board may provide one Solar lamp as a one time incentive, on rate contract approved by the Controller of Stores, Himachal Pradesh, to the beneficiary. The application for this assistance shall be submitted by the beneficiary to the Secretary or authorized officer of the Board in form No. XLVIII alongwith requisite documents.

283(F)Washing Machine for female beneficiary.—The Board may provide one washing machine to female beneficiary as a onetime incentive on rate contract approved by the Controller of Stores, Himachal Pradesh. This benefit will be provided only once per family. The application for this assistance shall be submitted by the beneficiary to the Secretary or authorized officer of the Board in form No. XLVIII alongwith requisite documents.".

10. Addition of Forms XLVII and XLVIII.—After form XLVI appended to the said rules, the following new forms shall be added, namely:—

(i) "Form XLVII [See rule-283(D)]
