No. MPP-F(2)-53/2002-XIII.—In pursuance of the CMM decision regarding sale of power available to Govt. Himachal Pradesh on account of equity participation in Nathpa Jhakri Hydro Power Station (NJHPS) to HPSEB Ltd. taken vide item No. 9 on 04-01-2014, the Governor, Himachal Pradesh is pleased to notify the reallocation of 22% power available to Govt. of Himachal Pradesh on account of equity participation in Nathpa Jhakri Hydro Power Station to Himachal Pradesh State Electricity Board Limited (HPSEB Ltd.) for the entire useful life of the project for making its long term power planning and to provide uninterrupted power supply to the consumers throughout the year as per the terms and in the manner prescribed below:-

1. Nathpa Jhakri Hydro Power Station with an installed capacity of 1500 MW has been executed as a Joint Sector Project in the State of Himachal Pradesh with equity participation of 75% and 25% by Govt. of India and Govt. of Himachal Pradesh respectively. Accordingly, Govt. of Himachal Pradesh has an entitlement of 330 MW corresponding to 25% equity contribution in the project. Transmission system associated with the project is being maintained and operated by PGCIL(CTU) and in turn Long Term Open Access (LTOA) charges, as approved by the CERC in line with the tariff regulations notified by it, are being borne by the Govt. of Himachal Pradesh.

2. The 22% Govt. of Himachal Pradesh equity power in NJHPS is reallocated to HPSEB Ltd. for the entire useful life of the project at CERC determined rate only and no trader will be involved. The CTU/STU Transmission Charges and losses as applicable and associated other charges shall be to the account of HPSEB Ltd.

3. HPSEB Ltd. shall surrender the equal quantum of Govt. of Himachal Pradesh free power entitlement for FY 2013-14 and entire free power quantum hence onwards in respect of Central Sector Projects. HPSEB Ltd. shall be availing free power entitlement of Govt. of Himachal Pradesh in respect of Chamera-I, Chamera-II, Chamera-III and Bairasuit HEPs of NHPC only for the remaining period of FY 2013-14 i.e. 01-12-2013 to 31-03-2014.

4. HPSEB Ltd. shall continue to avail free power entitlement of Govt. of Himachal Pradesh in respect of projects directly connected with HPSEB Ltd., system for all times to come.

5. That the above proposal for surrendering of entire quantum of Govt. of HP free power entitlement shall be subject to the demand of the State as well as outage of plant, if any i.e. under such constraints of abrupt increase in demand of the State and in the event of failure of plant, in the public interest, HPSEB Ltd. may also avail free power entitlement against surrendered quantum to the extent of requirement, if possible. However, in case Govt. of HP power is already being tied up then HPSEB Ltd will have no right to claim it.

6. The Scheduling and Despatch of the power shall be coordinated with NRLDC as per the relevant provisions of IEGC and framework of Availability Based Tariff (ABT) read with the decisions of Northern Regional Load Despatch Centre (NRLDC) and the Northern Regional Power Committee (NRPC), if any. Any instruction(s) issued/to be2794 राजपत्र, हिमाचल प्रदेश, 26 अगस्त, 2014/4 भाद्रपद, 1936 issued by the Central Electricity Regulatory Commission (CERC/Himachal Pradesh State Electricity Regulatory Commission (HPERC) and/or under any other statutory provisions shall also apply to Scheduling and Despatch of power. SLDC shall intimate entitlement to HPSEB Ltd. based on the capacity allocation and on receipt of HP drawal schedule from NRLDC shall compile and issue drawal schedule to HPSEB Ltd. The surplus power shall be sold outside the state or to any other utilities by the HPSEB Ltd in case of non-absorption by it.

7. HPSEB Ltd. shall pay all the dues directly to SJVN Ltd and PGCIL as per CERC regulations and subsequent amendments/revisions for utilizing this power. HPSEB Ltd. must also complete all formalities if any with the Generator/Transmission Licensee in view of Power Purchase Agreement executed between SJVN Ltd and Govt. of HP and make timely payments to SJVN Ltd and PGCIL in order to avoid regulation of this power.

8. The State Government by issue of separate order may amend this reallocation and make such provision as may appear to be necessary for removing the difficulties arising in context to the consumer demand across the state in a judicious manner.

This proposed amendment is hereby published in the Official Gazette of Himachal Pradesh for information of the general public and Notice is hereby given that the provisions of the aforesaid proposed amendment will be taken into consideration.

18.7.6. The area starting from the Prini Nallah in North alongwith boundary of Kullu Valley Planning Area and upto Urbanisable boundary of Manali Agglomeration in South and then following left bank of river Beas in the West and upto meeting point of Prini Nallah with river Beas in the East containing village Suru will be out of the perview of the provision of Draft Development Plan for Manali Agglomeration as well as Kullu Valley Planning Area.
