Dated, the 19th November, 2014

No. SEC-16-1/2011-2835-57.—Whereas the District Election Officer (Panchayat)-cum- Deputy Commissioner, Mandi vide its letter No. PCN-MND(by-election)-2014-269-70 dated 17/11/2014 has informed that the elector roll of Ward No. 3 Gumma-II of Gram Panchayat Gumma Development Block Drang at Padhar is in draft stage. Earlier the Commission received an e-mail on 15/11/2014 at 3:57 pm (after the last date and time of nomination) from the Block Development 166-राजपत्र/2014-19-11-2014 (4263) 4264 राजपत्र, हिमाचल प्रदेश, 19 नवम्बर, 2014/28 कार्तिक, 1936 Officer, Drang requesting to amend the elector roll of Ward No.3 Gumma-II. The 15-11-2014 was the last date for filing of nominations. The Himachal Pradesh Panchayati Raj (Election) Rule, 1994 vide its last proviso of Rule 24 (3) provides that no amendment or transposition or deletion of any entry shall be made on or after the last date fixed for filing of nomination papers;

The State Election Commission notified the special summary revision of elector rolls vide its notification No. SEC.16-1/2011-1735-64 dated 28/10/2014 and the manner of such revision vide its order No. SEC.16-1/2011-1627-1733 dated 28/10/2014;

The Commission had directed vide point No. (i) of letter No. SEC.16-1/2011-1627-1733 dated 28/10/2014 referred to above that the existing electoral roll (finally notified ) shall be made available for inspection of the general public at the Head Quarter of the Gram Panchayat concerned;

In view of above facts, it is evident that the procedure prescribed by the Commission has not been complied with letter and spirit, and the election process has been vitiated by the inaction of field machinery;

Therefore, the State Election Commission, Himachal Pradesh, in exercise of the powers vested in it under Section 160 of the Himachal Pradesh Panchayati Raj Act, 1994 read with Rule, 32 (5) of the Himachal Pradesh (Election) Rules, 1994 hereby directs to invalidate all the proceedings undertaken for the conduct of by-election for a Member from Ward No. 3 Gumma-II of Gram Panchayat, Gumma Development Block Paddar District Mandi and orders that the proceedings shall start de-novo as and when notified by the Commission.

उनवान मुकद्दमा : हि0 प्र0 शादी पंजीकरण अधिनियम 1996 की धारा 8(4) के तहत शादी का पंजीकरण। प्रार्थी श्री उधम सिंह पुत्र श्री पंजू राम, निवासी गांव राम नगर, डा0 वारी कलां, तहसील खुण्डियां, जिला कांगड़ा (हि0 प्र0) ने स्वयं उपस्थित होकर प्रार्थना-पत्र प्रस्तुत किया है कि उसके लड़के श्री सतपाल की शादी दिनांक 13-12-2006 को श्रीमती सुभद्रा देवी पुत्री श्री हीरा लाल, वासी महाल नुनहालकड, डा0 नौरा, तहसील पालमपुर, जिला कांगड़ा (हि0 प्र0) के साथ हिन्दू रीति-रिवाज के साथ हुई थी, परन्तु कानून की जानकारी न होने के कारण शादी का पंजीकरण ग्राम पंचायत वारी कलां, तहसील खुण्डियां, जिला कांगड़ा (हि0 प्र0) के अभिलेख में दर्ज न हो सका है। अतः इनकी शादी का पंजीकरण ग्राम पंचायत वारी कलां के अभिलेख में दर्ज किया जाये।4265 राजपत्र, हिमाचल प्रदेश, 19 नवम्बर, 2014/28 कार्तिक, 1936 अतः सर्वसाधारण को सुनवाई हेतु बजरिया इश्तहार व मुस्त्री मुनादी द्वारा सूचित किया जाता है कि इस सम्बन्ध में किसी प्रकार का उजर/एतराज हो तो वह दिनांक 20-11-2014 को असालतन व वकालतन पेश होकर अपना एतराज दर्ज करवा सकता है। उसके उपरान्त कोई भी उजर/एतराज जेर समायत न होगा तथा श्री उधम सिंह के लड़के श्री सतपाल पुत्र श्री उधम सिंह व श्रीमती सुभद्रा देवी पुत्री श्री हीरा लाल की शादी का पंजीकरण ग्राम पंचायत वारी कलां, तहसील खुण्डियां, जिला कांगड़ा (हि0 प्र0) के अभिलेख में दर्ज करने के आदेश पारित कर दिये जायेंगे।

अतः इस इश्तहार राजपत्र के द्वारा सर्वसाधारण को सूचित किया जाता है कि उक्त नाम की दरुस्ती करने बारे किसी भी व्यक्ति को कोई एतराज हो तो वह असालतन या वकालतन दिनांक 28-11-2014 को प्रातः 10.00 बजे अदालत हजा में उपस्थित होकर अपना एतराज पेश कर सकता है। कोई एतराज पेश न होने की सूरत में नाम दरुस्ती के आदेश पारित कर दिये जाएंगे।
