संख्याः ई0एक्स0एन0-एफ (10)-17/2014.-हिमाचल प्रदेश के राज्यपाल का समाधान हो गया है कि लोकहित में ऐसा करना आवश्यक और समीचीन है;

अतः हिमाचल प्रदेश के राज्यपाल, इस विभाग की अधिसूचना संख्याः ई0एक्स0एन0-एफ(11)-5/2004 तारीख 19-01-2006 के अधिक्रमण में, हिमाचल प्रदेश मूल्य परिवर्धित कर अधिनियम, 2005 की धारा 62 की उपधारा (5) के प्रथम परन्तुक के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए, निदेश देते हैं कि प्रवर्ग 'इ' श्रेत्रों 5-राजपत्र/2015-7-04-2015 (145) 146 राजपत्र, हिमाचल प्रदेश, 7 अप्रैल, 2015/17 चैत्र, 1937 में अवस्थित किसी नई औद्योगिक इकाई को चलाने वाले व्यौहारियों द्वारा विनिर्मित माल के विक्रय पर पूर्वोक्त अधिनियम की धारा 6 के अधीन कर की छूट एतत्‌पश्चात्‌ निम्नलिखित विनिर्दिष्ट सारणी और शर्तों के अध्यधीन अनुज्ञेय होगीः-

मूल्य परिवर्धित कर/केन्द्रीय विक्रय कर प्रोत्साहनों की मात्रा

पात्रता की शर्तें

1. प्रोत्साहन की मात्रा छूट की अवधि में संदेय मूल्य परिवर्धित कर और केन्द्रीय विक्रय कर पर उपलब्ध होगी;

2. "नियत पूंजी निवेश (एफ.सी.आई.)" से भवन, संयन्त्र और मशीनरी पर उपगत निवेश अभिप्रेत होगा ;

3. प्रोत्साहनों की उपलब्धता या तो लागू मात्रा की समाप्ति पर या पात्र अवधि के पूर्ण होने पर, जो भी पूर्वतर हो, बंद हो जाएगी ;

4. वित्तीय संस्था/ बैंक की मूल्यांकन परियोजना रिपोर्ट में यथा प्रतिबिम्बित वास्तविक नियत पूंजी निवेश (एफ.सी.आई.) के चार्टड अकाउंटेंट द्वारा सत्यापित किया जाएगा ;

5. यदि प्रोत्साहनों को प्राप्त करने के प्रयोजन के लिए कोई मिथ्या घोषणा की गई है या यदि इकाई पात्र नहीं पाई गई है तो इस प्रकार प्राप्त किए गए प्रोत्साहनों की रकम ब्याज और शास्ति सहित वसूल किए जाने के लिए दायी होगी ;

6. पात्र ईकाई ने महाप्रबन्धक, जिला उद्योग केन्द्र, उद्योग विभाग, हिमाचल प्रदेश, जहां औद्योगिक इकाई रजिस्ट्रीकृत है या अन्य मामलें में निदेशक उद्योग, हिमाचल प्रदेश या इस निमिा उसके द्वारा लिखित में सम्यक्‌ रूप से उसके नाम निर्देशिती से इस अधिसूचना से संलग्न उपाबन्ध 'अ' में यथा विहित प्ररूप ''ओ'' में प्रमाण पत्र अभिप्राप्त कर लिया है। और उस प्रमाण पत्र को निर्धारण प्राधिकारी को इस अधिसूचना से उपाबन्ध 'अ' के रूप में संलग्न प्ररूप 'उ' में प्रमाण पत्र प्रदान करने के लिए प्रस्तुत कर दिया है ;

7. ये प्रोत्साहन केवल इकाई के वाणिज्यिक उत्पादन प्रारम्भ करने के पश्चात्‌ ही आरम्भ होंगे ;

8. भारत सरकार देश भर में एक समान माल और सेवा कर (जी. एस. टी.) की व्यवस्था के पुरःस्थापन की प्रक्रिया में है। इस दशा में इस प्रकार की दी गई या प्राप्त की जा रही प्रसुविधाएं इसे जी.एस.टी. व्यवस्था के अनुरूप लाने के लिए, राज्य सरकार द्वारा उपान्तरण/णों के अध्यधीन होंगी ;

9. समस्त माल व्यौहारियों (विनिर्माताओं) द्वारा न केवल स्वयं विनिर्मित किया जाएगा किन्तु विक्रीत भी किया जाएगा और यह सम्बद्ध औद्योगिक इकाइयों द्वारा हिमाचल प्रदेश में पुनः विक्रय के लिए क्रीत या प्राप्त तैयार माल के लिए खुला (विवृत) नहीं होगा ;

10. इकाई, विक्रय के लिए माल के विनिर्माण हेतु हिमाचल प्रदेश मूल्य परिवर्धित कर अधिनियम, 2005 के अधीन व्यौहारी के रूप में रजिस्ट्रीकृत होनी चाहिए ;

11. इकाई (रजिस्ट्रीकृत व्यौहारी) हिमाचल प्रदेश मूल्य परिवर्धित कर अधिनियम, 2005, केन्द्रीय विक्रय कर अधिनियम,1956 और उक्त अधिनियमों के अधीन जारी, स्कीम, यदि कोई बनाई गई है सहित, नियमों, अधिसूचना और आदेशों के उपबन्धों का अनुपालन करेगी;

12. इकाई प्रवर्ग 'इ' क्षेत्र में अवस्थित है और इसकी कुल जनशक्ति नियोजन का कम से कम 70 प्रतिशत नियोजन स्थायी हिमाचलियों में से करती है। इस शर्त के किसी उल्लंघन की दशा में, किसी भी समय सम्बद्ध औद्योगिक इकाई द्वारा इस अवधि के दौरान और कोई छूट उसे अनुज्ञेय नहीं होगी और ऐसी दशा में ऐसी इकाई द्वारा पहले से ही प्राप्त समस्त प्रोत्साहन वसूल किए जाएंगे तथा ऐसी इकाई अधिनियम के अधीन कार्रवाई के लिए दायी होगी ;

13. कोई व्यौहारी जो हिमाचल प्रदेश साधारण विक्रय कर अधिनियम, 1968 की धारा 42 के अधीन जारी अधिसूचना संख्याः ई0 एक्स0 एन0-एफ(1)-2/2004(1) तारीख 30.03.2005 और हिमाचल प्रदेश मूल्य परिवर्धित कर अधिनियम, 2005, की अधिसूचना संख्याः ई0एक्स0एन0-एफ(11)-5/2004 तारीख 19.01.2006 के अधीन छूट की प्रसुविधा का लाभ ले रहा था और जो इस अधिसूचना के प्रारम्भ की तारीख पर ऐसी छूट के लिए लगातार पात्र रहा होता, को उपरोक्त अधिसूचनाओं के अधीन लागू शर्तों के अनुसार अनवसित अवधि के लिए विनिर्मित माल के क्रय पर कर के संदाय से छूट की प्रसुविधा जारी रहेगी;

14. इकाई को इस अधिसूचना से यथा संलग्न उपाबंध-'आ' में निर्धारण प्राधिकारी द्वारा प्ररूप 'उ' में प्रमाण-पत्र अवश्य प्रदान किया गया हो;

15. प्ररूप-'उ' में प्रमाण पत्र प्रचालन में है और उसे विहित प्राधिकारी द्वारा वापस या रदद्‌ नहीं किया गया है, या किसी अपीली, पुनरीक्षण या अन्य कार्यवाहियों में बातिल या रदद्‌ नहीं किया गया है। स्पष्टीकरण-I.—उपरोक्त शर्त संख्या 12 के अधीन विनिर्दिष्ट नियोजन शर्त कर मुक्त औद्योगिक क्षेत्र में कहीं पर अवस्थित केवल एक कर्मचारी को नियोजित करने वाली नई औद्योगिक ईकाइयों और इकाई जिसमें जो स्वनियोजित उद्यम है जहां स्वामी इकाई जनशक्ति के नियोजन के बिना चला रहा है को लागू नहीं होगी:

स्पष्टीकरण-II.—इस अधिसूचना के प्रयोजनों के लिए,-

(i) इस अधिसूचना से संलग्न उपाबन्ध 'इ' में यथा विनिर्दिष्ट ''प्रवर्ग 'इ' क्षेत्र'' से सक्षम प्राधिकरण द्वारा अधिसूचित समस्त जनजातीय क्षेत्र अभिप्रेत हैं और इसके अन्तर्गत 2004 में हिमाचल प्रदेश में औद्योगिक ईकाईयों के लिए प्रोत्साहनों, रियायतों और प्रसुविधाएं प्रदान करने से सम्बन्धित नियमों में इस प्रवर्ग के अधीन वर्णित समस्त जनजातीय विकास खण्ड और विकास खण्ड सम्मिलित हैं;

(ii) ''नई औद्योगिक इकाई'' से हिमाचल प्रदेश में अवस्थित कोई औद्योगिक इकाई जिसमें इस अधिसूचना की तारीख को वाणिज्यिक उत्पादन प्रारंभ कर दिया था/प्रांरभ करती है, जो भी पश्चात्‌वर्ती हो, अभिप्रेत है किन्तु इसमें कोई नई औद्योगिक इकाई, जो विद्यमान औद्योगिक इकाई के पुनः स्थापन, इसके स्वामित्व में केवल परिवर्तन, इसके विधान में परिवर्तन, इसके पुनः निर्माण या इसके पुनः प्रचलन के परिणामस्वरूप बनाई गई है, सम्मिलित नहीं होगी; और

(iii) इकाई नकारात्मक सूची में सम्मिलित नहीं की गई है। पर ''नकारात्मक सूची'' का वही अर्थ होगा जो इस विभाग की अधिसूचना संख्याः ई0एक्स0एन0-एफ(1)-2/2004 (iii) तारीख 30 मार्च 2005 में इसका है।148 राजपत्र, हिमाचल प्रदेश, 7 अप्रैल, 2015/17 चैत्र, 1937 उपाबन्ध-'अ'

6. व्यौहारी, किए गए सीमित नियत पूंजी निवेश (एफ.सी.आई.) और निम्न विनिर्दिष्ट वैट तथा सी.

एस.टी. के संदाय या सात वर्ष की अवधि के लिए (जो भी पूर्वतर हो) आंशिक छूट का हकदार है, क्योंकि व्यौहारी की औद्योगिक इकाई प्रवर्ग-'इ' क्षेत्रों में अवस्थित है।

वैट/सी.एस.टी. प्रोत्साहन की प्रमात्रा

वैट/सी.एस.टी. प्रोत्साहनों की प्रमात्रा उपर्युक्त है। उपरोक्त खाली स्तम्भ में यथा लागू अनिवार्य प्रविष्टि करें।

EXCISE AND TAXATION DEPARTMENT

NOTIFICATION

Shimla-2, the 06th April, 2015

No. EXN-F(10)-17/2014.—Whereas the Governor of Himachal Pradesh is satisfied that it is necessary and expedient so to do in the public interest;

Now, therefore, in exercise of the powers conferred under first proviso to subsection (5) of section 62 of the Himachal Pradesh Value Added Tax Act, 2005, the Governor of Himachal Pradesh, in supersession of Notification No. EXN-F(11)-5/2004, dated 19.01.2006, is pleased to direct that henceforth the tax exemption under section 6 of the aforesaid Act on the sale of goods manufactured by the dealers running any new industrial unit located in category 'C' areas shall be admissible as per table and subject to the conditions specified below:-

Quantum of Value Added Tax and Central Sales Tax incentives

Conditions of eligibility

1. Quantum of the incentive would be available on the Value Added Tax and Central Sales Tax payable in the period of exemption;

2. Fixed Capital Investment (FCI) shall mean the investment incurred on Building, Plant and Machinery;

3. The availment of incentives shall cease either on the exhaustion of the applicable quantum or on the completion of the eligible period, whichever is earlier;

4. The actual Fixed Capital Investment (FCI) as reflected in the Financial Institution/Bank Appraisal Project Report shall have to be certified by a Chartered Accountant;

5. If any false declaration is given for the purpose of availing incentives or if the unit is found not eligible, the amount of incentives so availed shall be liable to be recovered along with interest and penalty;

6. The eligible unit has obtained a certificate in Form 'I' as prescribed at Annexure 'A' appended to this notification from the General Manager, District Industries Centre of the Department of industries, Himachal Pradesh where the industrial unit is registered or in other case from the Director of Industries, Himachal Pradesh or his nominee duly authorized, in writing, in this behalf, and has furnished the same certificate to the Assessing152 राजपत्र, हिमाचल प्रदेश, 7 अप्रैल, 2015/17 चैत्र, 1937 Authority for the grant of the certificate in Form 'E' appended as Annexure 'A' to this notification;

7. These incentives shall commence only after the unit commences commercial production;

8. Government of India is in the process of introducing a uniform Goods and Services Tax (GST) regime throughout the country. In this event the benefits so granted or being availed shall be subject to modification/s by the State Government to bring it in conformity with the GST regime;

9. All the goods should not only be manufactured but also sold by the dealers (manufacturers) themselves and it shall not be open for finished goods purchased or acquired by concerned industrial units for re-sale in Himachal Pradesh;

10. The unit must have been registered as a dealer under the Himachal Pradesh Value Added Tax Act, 2005, for manufacture of goods for sale;

11. The unit (registered dealer) shall comply with the provisions of the Himachal Pradesh Value Added Tax Act, 2005, the Central Sales Tax Act, 1956, and the rules, including the scheme, if any made, the notification, and orders issued, under the said Acts ;

12. The unit is located in the Category 'C' areas and employs at least 70 percent of its total manpower employment from amongst the bonafide Himachalis. In case of any violation of this condition at any point of time during this period by the concerned Industrial Unit, no further exemption shall be admissible to it and in such an event all incentives already availed by such unit shall be recovered and such unit shall be liable for action under the Act;

13. Any dealer who was enjoying the benefit of exemption under Notification No. EXNF(1)2/2004(i), dated 30.03.2005 issued under section 42 of the Himachal Pradesh General Sales Tax Act, 1968 and Notification No. EXN-F(11)-5/2004 dated 19.01.2006 of the Himachal Pradesh Value Added Tax Act, 2005, and who would have continued to be eligible for such exemption on the date of the commencement of this notification shall continue to avail the benefit of the exemption from payment of tax on the sale of manufactured goods for the unexpired period as per conditions applicable under the above said notification;

14. The unit must have been granted the certificate in Form 'E' by the Assessing Authority as appended to this notification as Annexure 'B';

15. The certificate in Form 'E' is continue to be operative and has not been withdrawn or cancelled by the prescribed authority or is not annulled or quashed in any appellate, revisional or other proceedings.

Explanation I.—The employment condition specified under condition No.12 above shall not be applicable to new industrial units employing only one employee located anywhere in the tax free industrial zone and the units which are self-employed ventures where the owner is running the unit without employing any manpower:

(i) "Category 'C' areas" as specified in Annexure 'C' appended to this notification means all tribal areas notified by the competent authority and includes all Tribal Development Blocks and Development Blocks mentioned under this category in the Rules Regarding Grant of Incentives, Concessions and Facilities to Industrial units in H.P. 2004;

(ii) 'New industrial unit' means an industrial unit located in Himachal Pradesh which commenced/ commences commercial production on or from the date of this notification, whichever is later, but shall not include any industrial unit which is formed as a result of re-establishment, mere change of ownership, change in the constitution, re-structuring or revival of an existing industrial unit; and

(iii) The unit has not been included in the negative list. The expression 'negative list' shall have the same meaning as assigned to it by this Department Notification No.EXN- F(1)2/2004 (iii) dated 30th March, 2005.

उपरोक्त मुकद्दमा उनवान वाला में आम जनता व हर आम/खास को बजरिया इश्तहार सूचित किया जाता है कि श्री परमजीत सिंह पुत्र श्री निर्मल सिंह, निवासी ग्राम हरीपुर सण्डोली, तहसील बद्‌दी, जिला सोलन (हि0 प्र0) वादी ने इस अदालत में अपने लड़के के नाम के इन्द्राज बारे जिसका विवरण निम्न प्रकार से हैः-

उक्त की जन्म तिथि का ग्राम पंचायत/नगर परिषद्‌ हरीपुर सण्डोली, तहसील बद्‌दी के रिकॉर्ड में इन्द्राज करवाने हेतु इस न्यायालय में प्रार्थना-पत्र जेर धारा 13(3) जन्म एवं मृत्यु अधिनियम, 1969 के अन्तर्गत अपने ब्यान हल्फिया सहित प्रस्तुत किया है। यदि किसी को उपरोक्त की जन्म तिथि को पंजीकृत होने बारे कोई एतराज हो तो वह दिनांक 25-4-2015 को या इससे पूर्व अपना एतराज लिखित या मौखिक रूप से इस अदालत में पेश कर सकता है अन्यथा मुताबिक आवेदन के साथ संलग्न ब्यान हल्फिया के आधार पर जन्म तिथि पंजीकृत किये जाने बारे आदेश पारित कर दिये जायेंगे तथा बाद गुजरने मियाद कोई भी एतराज काबले समायत न होगा।

Shri Sant Ram s/o Shri Ram Lal, r/o House No. 1101 Gandhi Chowk Kalka, District Panchkula, Haryana has moved an application before the undersigned under Section 13(3) of Birth & Death Registration Act, 1969 alongwith affidavits and other documents stating therein that his son namely Medhansh Pasi born on 10-11-2009 at Pumposh Nursing Home, Parwanoo, Tehsil Kasauli, District Solan (H.P.) but his date of birth could not be entered in the record of M.C. Parwanoo, Tehsil Kasauli within stipulated period. Hence he prayed for passing necessary orders to the C.E.O.-cum-Registrar, Birth & Death Registration, M.C. Parwanoo, Tehsil Kasauli, for entering the same in the births records.

Therefore, by this proclamation the general public is hereby informed that any person having any objection for the registration of delayed date of birth of Medhansh Pasi son of Shri Sant Ram may submit their objections in writing in this court on or before 23-4-2015 at 10.00 A.M. failing which no objection will be entertained after expiry of date.
