संख्या-पी.सी.एच.-एच.ए.(1)11/2010-।.-हिमाचल प्रदेश पंचायती राज (जिला परिषद्‌ में पंचायत सहायकों की नियुक्ति और सेवा शर्तें) द्वितीय संशोधन नियम, 2015 का प्रारूप, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (1994 का अधिनियम संख्यांक 4) की धारा 186 के उपबन्धों के अधीन यथा अपेक्षित के अनुसार इस विभाग की समसंख्यक अधिसूचना तारीख 21 फरवरी, 2015 द्वारा राजपत्र, हिमाचल प्रदेश में तारीख 23 फरवरी, 2015 को जनसाधारण से आक्षेप और सुझाव आमन्त्रित करने के लिए प्रकाशित किया गया था ;

और नियत अवधि के दौरान प्राप्त किए गए आक्षेप (आक्षेपों)/सुझाव (सुझावों) पर राज्य सरकार द्वारा, समयक्‌ रूप से विचार किया गया ;

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (1994 का अधिनियम संख्यांक 4) की धारा 186 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, अधिसूचना संख्या पीसीएच-एचए (1) 11/2010-I, तारीख 16 जुलाई, 2014 द्वारा अधिसूचित और तारीख 22 जुलाई, 2014 को राजपत्र, हिमाचल प्रदेश में प्रकाशित हिमाचल प्रदेश पंचायती राज (जिला परिषद्‌ में पंचायत सहायकों की नियुक्ति और सेवा शर्तें) नियम, 2014 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः-

नियम

1. संक्षिप्त नाम और प्रारम्भ.-(i) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश पंचायती राज (जिला परिषद्‌ में पंचायत सहायकों की नियुक्ति और सेवा शर्तें) संशोधन नियम, 2015 है।

(ii) ये नियम इनके राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगें। 182 राजपत्र, हिमाचल प्रदेश, 8 अप्रैल, 2015/18 चैत्र, 1937 2. नियम 8 का संशोधन.-हिमाचल प्रदेश पंचायती राज (जिला परिषद्‌ में पंचायत सहायकों की नियुक्ति और सेवा शर्तें) नियम, 2014 के नियम 8 के खण्ड (IV) के स्थान पर निम्नलिखित खण्ड रखा जाएगा, अर्थात्‌ः-

''(IV) चयन प्रक्रियाः

(क) जिलावार संवर्ग के लिए आवेदन आमंत्रित करने हेतु प्रक्रिया ऐसी होगी, जैसी सरकार द्वारा विनिश्चित की जाए;

(ख) सम्बद्ध जिला परिषद्‌ का मुख्य कार्यकारी अधिकारी, सम्बद्ध भर्ती प्राधिकरण के समक्ष अध्यपेक्षा रखेगा, जैसी सरकार द्वारा रिक्त पदों को भरने के लिए विनिश्चित की जाए;

(ग) चयन उप-खण्ड (ख) के अधीन यथा विनिश्चित अभिकरण द्वारा संचालित की जाने वाली लिखित परीक्षा और साक्षात्कार/मौखिक परीक्षा में प्राप्त अंकों के आधार पर किया जाएगा। ऐसा अभिकरण, कुल 100 अंकों में से साक्षात्कार/मौखिक परीक्षा के साथ-साथ, दस जमा दो स्तर के गणित, अंग्रेजी, हिन्दी और सामान्य ज्ञान के विषयों से समाविष्ट लिखित परीक्षा संचालित करेगा, जिन्हें निम्नलिखित रीति में विभाजित किया जाएगाः-

(क) गणित = 25 अंक।

(ख) हिन्दी = 25 अंक।

(ग) सामान्य ज्ञान = 25 अंक।

(घ) अंग्रेजी = 10 अंक।

(ङ) साक्षातकार/मौखिक परीक्षा = 15 अंक।

(घ) उक्त अभिकरण, लिखित परीक्षा में बनाई गई मैरिट के आधार पर, एक रिक्ति के विरूद्ध पांच सफल अभ्यर्थियों को साक्षात्कार के लिए बुलाएगा।

(ङ) पद पर नियुक्ति के लिए अंतिम चयन, भर्ती अभिकरण द्वारा संचालित साक्षात्कार/मौखिक परीक्षा के आधार पर किया जा सकेगा।

(च) उक्त अभिकरण, लिखित परीक्षा और साक्षात्कार/मौखिक परीक्षा में बनाई गई मैरिट के आधार पर, अन्तिम रूप से चयनित अभ्यर्थियों की सूची को सम्बद्ध जिला परिषद्‌ के मुख्य कार्यकारी अधिकारी को भेजेगा।''।

PCH-HA-(1)11/2010-I.—Whereas, the draft Himachal Pradesh Panchayati Raj (Appointment and Conditions of Service of Panchayat Sahayaks in Zila Parishads) Second Amendment Rules, 2015 were published in the Rajpatra, Himachal Pradesh dated 23rd February, 2015 for inviting objections and suggestions from the general public, vide this department notification of even number dated 21st February, 2015 as required under the provisions of section 186 of the Himachal Pradesh Panchayati Raj Act, 1994 (Act No. 4 of 1994);

And whereas, the objection(s)/suggestion(s) received during the stipulated period have been duly considered by the State Government;

Now, therefore, in exercise of the powers conferred by section 186 of the Himachal Pradesh Panchayati Raj Act, 1994 (Act No. 4 of 1994), the Governor of Himachal Pradesh is pleased to make the following rules further to amend the Himachal Pradesh Panchayati Raj (Appointment and Conditions of Service of Panchayat Sahayaks in Zila Parishads) Rules, 2014, notified vide notification No.PCH-HA(1)11/2010-I, dated 16th July, 2014 and published in the Rajpatra of Himachal Pradesh dated 22nd July, 2014, namely :—

RULES

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Panchayati Raj (Appointment and Conditions of Service of Panchayat Sahayaks in Zila Parishads) Amendment Rules, 2015.

(2) They shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Amendment of rule 8.—In rule 8 of the Himachal Pradesh Panchayati Raj (Appointment and Conditions of Service of Panchayat Sahayaks in Zila Parishads) Rules, 2014, for clause (IV), the following clause shall be substituted, namely:-

"(IV) SELECTION PROCESS:

(a) the procedure for inviting applications for district-wise cadre shall be such as may be decided by the Government;

(b) the Chief Executive Officer of the Zila Parishad concerned will place the requisition with the concerned recruiting agency as may be decided by the Government for filling the vacant posts;

(c) the selection shall be made on the basis of the marks obtained in the written test and interview/ viva-voce to be conducted by the agency as decided under sub- clause (b). Such agency shall conduct the written test consisting of the subjects of Mathematics, English, Hindi and General Knowledge of 10+2 standard alongwith interview/ viva-voce test out of the total 100 marks, which shall be divided in the following manner:-

(a) Mathematics = 25 Marks. (b) Hindi = 25 Marks. (c) General Knowledge = 25 Marks. (d) English = 10 marks.

(d) the said agency shall call five successful candidates for interview against one vacancy on the basis of merit worked out in the written test.

(e) final selection for appointment to the post may be made on the basis of interview/ viva- voce tests conducted by the recruiting agency.

(f) The said agency shall furnish list of finally selected candidates on the basis of merit worked out in the written test and interview/ viva-voce to the Chief Executive Officer of the concerned Zila Parishad.".
