सं0पर(एपी-बी)ए(1)-1/2013.-हिमाचल प्रदेश के राज्यपाल, प्रशासनिक अधिकरण अधिनियम, 1985 (1985 का अधिनियम संख्यांक 13) की धारा 36 के खण्ड (ख) के साथ पठित धारा 13 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित नियम बनाते है, अर्थातः-

14-राजपत्र/2015-23-04-2015 (431) 432 राजपत्र, हिमाचल प्रदेश, 23 अप्रैल, 2015/3 वैशाख, 1937 1. संक्षिप्त नाम और प्रारम्भ.-(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश प्रशासनिक अधिकरण कर्मचारिवृन्द (सेवा की शर्तें) नियम, 2015 है ।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. परिभाषा.-इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो, -

"अधिकरण" से हिमाचल प्रदेश प्रशासनिक अधिकरण अभिप्रेत है ।

3. अधिकरण का कर्मचारिवृन्द.-अधिकरण के अधिकारियों और अन्य कर्मचारियों का प्रकार ओर प्रवर्ग तथा उनसे सम्बद्ध वेतनमान ऐसे होंगे जैसे इन नियमों से संलग्न अनुसूची में विनिर्दिष्ट हैं। 4. सेवा की शर्तें.-अधिकरण के अधिकारियों और अन्य कर्मचारियों की वेतन, भाों, छुट्‌टी, भविष्य निधि, अधिवर्षिता की आयु, पेन्शन और सेवानिवृाि प्रसुविधाओं, चिकित्सा सुविधाओं तथा सेवा की अन्य शर्तों के विषयों में सेवा की शर्तों को ऐसे नियमों और विनियमों के अनुसार विनियमित किया जाएगा जो उन स्थानों पर तैनात तत्समान वेतनमान वालेयथास्थिति, वर्ग-I, वर्ग-II, वर्ग-III, तथा वर्ग-IV से सम्बन्धित अधिकारियों और कर्मचारियों को तत्समय लागू हैं ।

No.Per(AP.B)A(1)-1/2013.—In exercise of the powers conferred by section 13 read with clause (b) of section 36 of the Administrative Tribunals Act, 1985 (13 of 1985), the Governor of Himachal Pradesh is pleased to make the following rules, namely:-

1. Short title and commencement.—(1) These rules may be called the Himachal radesh Administrative Tribunal Staff (Conditions of Service) Rules, 2015.

(2) They shall come into force from the date of publication in Rajpatra, Himachal Pradesh.

2. Definition.— In these rules, unless the context otherwise requires'-

"Tribunal" means the Himachal Pradesh Administrative Tribunal.

3. Staff of the Tribunal.—The nature and categories of the officers and other employees of the Tribunal and the scale of pay attached thereto shall be as specified in the Schedule appended to these rules.

4. Conditions of Service.—The conditions of service of the officers and other employees of the Tribunal in the matters of Pay, Allowances, Leave, Provident Fund, age of superannuation, pension and retirement benefits, medical facilities and other conditions of service, shall be regulated in accordance with such rules and regulations as are for the time being applicable to officers, and employees belonging to Class-I, Class-II, Class-III and Class-IV, as the case may be, of the corresponding scales of pay stationed at those places.

Indian Forest Service Officers of Himachal Pradesh Cadre

1.3 The Board shall consist of the following in respect of Indian Forest Service officers of Himachal Pradesh cadre:—

1. Chief Secretary Chairman

2. Additional Chief Secretary or Pr.Secretary Member

3. Principal Secretary or Secretary, Department of Personnel Member Secretary 4. Addl. Chief Secretary or Principal Secretary or Secretary, Forest Member

5. Principal Chief Conservator of Forest Member

2. Postings –

2.1 All appointments of cadre officers shall be made on the recommendations of the Board by the State Government:

Provided that the State Government may transfer a cadre officer for the purpose of filling leave vacancies or for making temporary arrangements for a period not exceeding three months, delegate its power to Chief Secretary or Pr. Secretary, Personnel.

2.2 A cadre officer, appointed to any ex-cadre post shall hold office for at least two years unless in the meantime he or she has been promoted, retired or sent on deputation outside the State or training exceeding two months.

2.3 The State Government may transfer a cadre officer before the minimum specified period on the recommendation of the Board :

Provided that the Competent Authority may reject the recommendations of the Board by recording the reasons thereof.

3. Functions of the Board –

(a) The Board shall make recommendations for all appointments of cadre officers.

(b) The Board shall examine the cases of Officers who are proposed to be transferred before completion of minimum tenure as specified under sub-rule (3) and (4) of rule 7 of the Indian Administrative Service (Cadre) Rules, 1954, the Indian Police Service (Cadre) Rules, 1954 and the Indian Forest Service (Cadre) Rules, 1966.

(c) The Board may consider for transfer before the tenure fixed under subrule (3) and (4) of rule 7 of the Indian Administrative Service (Cadre) Rules, 1954, the Indian Police Service (Cadre) Rules, 1954 and the Indian Forest Service (Cadre) Rules, 1966 based on such circumstances regarding as it thinks fit.

438 राजपत्र, हिमाचल प्रदेश, 23 अप्रैल, 2015/3 वैशाख, 1937 (d) The Board may recommend to the Competent Authority the names of officers for transfer before completion of minimum tenure with reasons to be recorded in writing.

4. Procedure :

(a) The Board shall seek detailed justification from the concerned Administrative Department for the transfer of an officer before the specified tenure.

(b) The Board shall ---

(i) consider the report of Administrative Department along with any other inputs it may have from other reliable sources;

(ii) obtain the comments or views of the officer proposed to be transferred regarding the circumstances presented to it in justification of the proposal;

(iii) not make recommendation for premature transfer of cadre officers unless it has been satisfied itself of the reasons for such premature transfer.

(c) The Board shall submit a quarterly report in such Form as it thinks fit to the State Government clearly stating the details of the officers recommended to be transferred before the minimum specified tenure and the reasons therefor:

Provided that the Competent Authority may reject the recommendations of the Board for the reasons to be recorded in writing.

संख्याःटी.एस.एम-एफ(6)-3/2001-II.-हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश पर्यटन विकास और रजिस्ट्रीकरण अधिनियम, 2002 की धारा 64 की उपधारा (2) के खण्ड (च) और (छ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए इस विभाग की अधिसूचना संख्या टी.एस.एम.-एफ(6)-3/2001 तारीख 21 जुलाई, 2004 द्वारा राजपत्र हिमाचल प्रदेश में तारीख 24 जुलाई, 2004 को प्रकाशित हिमाचल प्रदेश वायु क्रीड़ा (एअरो स्पोर्टस) नियम, 2004 में और संशोधन करने के लिए निम्नलिखित नियम बनाने का प्रस्ताव करते हैं और इन्हें तद्‌द्वारा सम्भाव्य प्रभावित होने वाले व्यक्तियों की सूचना के लिए राजपत्र, हिमाचल प्रदेश में एतद्‌द्वारा प्रकाशित किया जाता है ;

प्रस्तावित संशोधनों की वाबत, किसी हितबद्ध व्यक्ति को यदि कोई आक्षेप (पों) / सुझाव (वों) है / हैं तो वह उसे / उन्हें राजपत्र, हिमाचल प्रदेश में उक्त प्रारूप नियमों के प्रकाशन की तारीख से तीस दिन439 राजपत्र, हिमाचल प्रदेश, 23 अप्रैल, 2015/3 वैशाख, 1937 की अवधि के भीतर अतिरिक्त मुख्य सचिव (पर्यटन एवं नागरिक उड्‌डयन) हिमाचल प्रदेश सरकार या निदेशक, पर्यटन एवं नागरिक उड्‌डयन को भेज सकेगा ;

उपरोक्त विनिर्दिष्ट अवधि के भीतर प्राप्त हुए आक्षेप (पों) /सुझाव (वों), यदि कोई हैं / हों, पर राज्य सरकार द्वारा प्रारूप नियमों को अन्तिम रूप देने से पूर्व विचार किया जाएगा, अर्थात्‌ :-

प्रारूप नियम

1. संक्षिप्त नाम और प्रारम्भ.-(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश वायु क्रीड़ा (एअरो स्पोर्टस) संशोधन नियम, 2015 हैं।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होगें।

2. नियम 2 का संशोधन.-हिमाचल प्रदेश वायु क्रीड़ा (एअरो स्पोर्टस) नियम, 2004 (जिन्हें इसमें इसके पश्चात्‌ 'उक्त नियम' कहा गया है) के नियम 2 में , -

(i) खण्ड (ख) के स्थान पर निम्नलिखित खण्ड रखा जाएगा, अर्थात्‌ः-

"(ख) "संगम" से, हिमाचल प्रदेश सहकारी सोसाइटी अधिनियम, 1968 या हिमाचल प्रदेश सोसाइटी रजिस्ट्रीकरण अधिनियम, 2006 के अधीन रजिस्ट्रीकृत सोसाइटी अभिप्रेत है।" ;

(ii) खण्ड (ड.) के स्थान पर निम्नलिखित खण्ड रखा जाएगा, अर्थातः-

"(ड.) "ऑपरेटर" से साहसिक खेल-कूद ऑपरेटर अभिप्रेत है, जो इस रूप में वाणिज्यक आधार पर अर्थात्‌ प्रशिक्षण, मनोरंजन या क्रीड़ा के प्रयोजन के लिए वायु क्रीड़ा के कार्यान्वयन के लिए या नियोजन या नियोजन की प्रस्थापना करने के लिए अधिनियम के अधीन रजिस्ट्रीकृत है।" ; और

(iii) खण्ड (ञ) का लोप किया जाएगा।

3. नियम 3 का संशोधन.-उक्त नियमों के नियम 3 के उप नियम (3) के स्थान पर निम्नलिखित उप-नियम रखा जाएगा, अर्थात :-

"(3) यथास्थिति उन ऑपरेटर (रों) या संगमों जिनके पास ऐसे रजिस्ट्रीकरण से पूर्व स्थानीय कार्यालय हैं, को हिमाचल प्रदेश पर्यटन विभाग के पास रजिस्ट्रीकृत किया जाएगा।

4. नियम 4 का संशोधन.-उक्त नियमों के नियम 4 में, -

(क) उप-नियम (1) में, "100" अंकों के स्थान पर "2000" अंक रखे जाएगें ; और

(ख) उप-नियम (2) में, "एक वर्ष" शब्दोेंं के स्थान पर "तीन वर्ष" शब्द रखें जाएगें । 5. नियम 5 का प्रतिस्थापन.-उक्त नियमों के नियम 5 के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्‌ :-

"5. पायलट /गाइड/ अनुदेशक/टैनडम पाइलट का रजिस्ट्रीकरण और अर्हताएं.-वायु क्रीड़ा प्रचालन में पाइलट/गाइड/ अनुदेशक /टैनडम पाइलट के रूप में भाग लेने के लिए आशयित कोई वयक्ति, यथास्थिति, जिला पर्यटन विकास अधिकारी/ सहायक पर्यटन विकास अधिकारी के पक्ष में संदेय 500/-रूपए के बैंक मांगदेय ड्राफ्ट सहित आवेदन,यथास्थिति, सम्बद्ध जिला440 राजपत्र, हिमाचल प्रदेश, 23 अप्रैल, 2015/3 वैशाख, 1937 पर्यटन विकास अधिकारी या सहायक पर्यटन विकास अधिकारी को करेगा, जो अपना समाधान होने पर, कि रजिस्ट्रीकरण के लिए आवेदन करने वाला व्यक्ति, तकनीकी समिति के अनुमोदन सहित रजिस्ट्रीकरण के लिए अपेक्षित अर्हताओं और स्तरमानों को पूर्ण करता है, रजिस्ट्रीकरण के लिए आवेदन करने वाले व्यक्ति को प्रमाणपत्र जारी करेगा। इस प्रकार जारी प्रमाण-पत्र तीन वर्ष की अवधि के लिए विधिमान्य होगा।"।

6. नियम 7 का संशोधन.-उक्त नियमों के नियम 7 में, -

(i) खण्ड (घ) में, "11" अंक के स्थान पर "15" अंक रखा जाएगा। ; और

(ii) खण्ड (ड.) में, "को अधिसूचित" शब्दों के स्थान पर "की पहचान" शब्द रखें जाएगें। 7. नियम 9 का संशोधन.-उक्त नियमों के नियम 9 के उप-नियम (3) में, "जनरल" शब्द के स्थान पर "ग्लोबल" रखा जाएगा।

8. नियम 11 का संशोधन.-उक्त नियमों के नियम 11 में , -

(क) खण्ड (झ) के स्थान पर निम्नलिखित खण्ड रखा जाएगा, अर्थात्‌ :-

"(झ) उसने प्रत्येक एयर राफ्ट की लॉगबुक बनाई हो, जो उनके द्वारा प्रयोग, निरीक्षण, मुरम्मत और किए गए सुरक्षा उपायों का अभिलेख होगी और लॉगबुक को पक्ष के लिए डयूटी पर संगम के सदस्य द्वारा प्रति-हस्ताक्षरित किया जाएगा और निरीक्षण प्राधिकारी भी निरीक्षण की तारीख पर लॉगबुक को प्रति-हस्ताक्षरित करेगा तथा अपनी टिप्पणियां अभिलिखित करेगा। " ; और

(ख) खण्ड (झ) में "विमान" शब्द के स्थान पर "एयर राफ्ट" शब्द रखे जाएंगे।

9. नियम 17 का संशोधन.-उक्त नियमों के नियम 17 के खण्ड (क) में, "विमान (एअर क्राफ्ट)" शब्दों और कोष्ठक के स्थान "एअर राफ्ट" शब्द रखे जाएंगे।

TOURISM AND CIVIL AVIATION DEPARTMENT

NOTIFICATION

Shimla-2, the 22nd April, 2015

No.Tsm-F(6)-3/2001-II In exercise of powers conferred by clauses (f) and (g) of subsection (2) of section 64 of the Himachal Pradesh Tourism Development and Registration Act, 2002, the Governor, Himachal Pradesh proposes to make the following rules further to amend the Himachal Pradesh Aero Sports Rules, 2004 published in the Rajpatra Himachal Pradesh, on 24th July, 2004441 राजपत्र, हिमाचल प्रदेश, 23 अप्रैल, 2015/3 वैशाख, 1937 vide this Department notification No. Tsm-F(6)-3/2001 dated 21st July 2004 and the same are hereby published in the Rajpatra, Himachal Pradesh for the information of the persons likely to be effected thereby;

Any interested person, who has an objection(s)/suggestion(s) with regard to the proposed amendments, may send the same to the Additional Chief Secretary (Tourism and Civil Aviation) to the Govt. of Himachal Pradesh or Director, Tourism and Civil Aviation within a period of thirty days from the date of publication of the said draft rules in the Rajpatra, Himachal Pradesh;

The objection(s)/suggestion(s) if any, received within the period specified above shall be taken into consideration by the State Government before finalizing the draft rules, namely:-

DRAFT RULES

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Aero Sports (Amendment) Rules, 2015.

(2) They shall come into force from the date of publication in Rajpatra, Himachal Pradesh.

2. Amendment of rule 2.—In rule 2 of the Himachal Pradesh Aero Sports Rules, 2004 (hereinafter referred to as the 'said rules'),-

(i) for clause (b), the following clause shall be substituted, namely:-

"(b) Association" means a society registered under the Himachal Pradesh Co- operative Societies Act, 1968 or the Himachal Pradesh Societies Registration Act, 2006." ;

(ii) for clause (e), the following shall be substituted, namely:-

"(e) Operator" means an Adventure Sports Operator who is registered as such under the Act for carrying out or engaged in or offering to engage the Aero sports on commercial basis i.e. for the purpose of training, recreation or sport." ; and (iii) clause (j) shall be omitted.

3. Amendment of rule 3.—In rule 3 of the said rules, for sub-rule(3), the following sub- rule shall be substituted, namely :-

"(3) The operator (s) or associations, as the case may be, shall be registered with the Tourism Department, Himachal Pradesh who have local office prior to such registration."

4. Amendment of rule 4.—In rule 4 of the said rules,-

(a) in sub-rule (1), for the figure "100", the figure "2000" shall be substituted ; and (b) in sub-rule (2), for the words "one year", the words "three years" shall be substituted.

442 राजपत्र, हिमाचल प्रदेश, 23 अप्रैल, 2015/3 वैशाख, 1937 5. Substitution of rule 5.—For rule 5 of the said rules, the following rule shall be substituted, namely :-

"5. Registration and Qualifications of Pilot / Guide/ Instructor / tandem Pilot.- A person intending to participate in an aero sports operation as a pilot/guide/ instructor /tandem pilot shall apply to the concerned District Tourism Development Officer or Assistant Tourism Development Officer, as the case may be, in an application alongwith a Bank demand draft of Rs.500/- payable in favour of District Tourism Development Officer/ Assistant Tourism Development Officer, as the case may be, who on being satisfied that the person applying for registration fulfils the requisite qualifications and standard for registration with the approval of Technical Committee shall issue a certificate to the person applying for registration. The certificate so issued shall be valid for a period of three years."

6. Amendment of rule 7.— In rule 7 of the said rules,-

(i) in clause (d), for the figure "11", the figure "15" shall be substituted. ; and (ii) in clause (e), for the word "notify", the word "identify" shall be substituted.

7. Amendment of rule 9.—In rule 9 of the said rules, in sub-rule (3), for the word "General", the word "Global" shall be substituted.

8. Amendment of rule 11.— In rule 11 of the said rules,-

(a) for clause (i), the following clause shall be substituted, namely :-

"(i) he maintains a log book of each air raft, which shall be a record of usage, inspection, repairs and safety measures to be undertaken by them and the log book shall be countersigned by the member of the association on duty for the fortnight and the inspecting authorities shall also countersign the log book on the date of the visit and record his remarks." ; and

(b) in clause (j), for the word "aircraft", the word "air raft" shall be substituted.

9. Amendment of rule 12.— In rule 12 of the said rules, in sub-rule(4), for the word "ad- hearing", the word "adhering" shall be substituted.

10. Amendment of rule 17.—In rule 17 of the said rules, in clause (a), for the word "aircraft", the word "air raft" shall be substituted.
