संख्याः श्रम (ए) 4-8/2006-पार्ट फाईल.-हिमाचल प्रदेश के राज्यपाल की यह राय है कि न्यूनतम मजदूरी अधिनियम, 1948 (1948 का 11) की धारा 2 (छ) द्वारा यथा अपेक्षित के अनुसार अनुसूची में और अनुसूचित नियोजनों को जोड़ा जाये ।

18-राजपत्र/2015-28-04-2015 (539) 540 राजपत्र, हिमाचल प्रदेश, 28 अप्रैल, 2015/8 वैशाख, 1937 और नियोजन, उनमें कामगारों के वर्गीकरण सहित, जिन्हें अनुसूची के भाग-1 में जोडा जा सकेगा इस प्रकार हैः-(1) हाइड्रो विद्युत परियोजनाएं (2) फार्मास्यूटिकल उद्योग (3) अस्पताल, नर्सिंग होम और क्लीनिक (4) घरेलू कामगार (5) सफाई कर्मचारी नियोजन (6) सुरक्षा सेवाएं (7) मन्दिर और धार्मिक स्थान/धर्मशालाएं (8) टोल टेक्स बैरिअरों में कार्यरत कामगार ।

अतः, हिमाचल प्रदेश के राज्यपाल न्यूनतम मजदूरी अधिनियम, 1948 (1948 का 11) की धारा 27 के अधीन उनमें निहित शक्तियों का प्रयोग करते हुए, इस अधिसूचना से संलग्न ब्यौरों के अनुसार अनुसूची में उपरोक्त वर्णित अनुसूचित नियोजनों को जोड़े जाने हेतु प्रस्ताव को प्रकाशित करते हैं ।

इस अधिसूचना से संभाव्य प्रभावित होने वाले व्यक्ति/(यों)के अनुसूची में जोड़े जाने वाले प्रस्तावित नये अनुसूचित नियोजनों की बाबत यदि कोई आक्षेप (पोंं) या सुझाव (वोंं) हैं/हों तो वह/वे उसे/उन्हें राजपत्र, हिमाचल प्रदेश में इस अधिसूचना के प्रकाशन की तारीख से तीन मास की अवधि के भीतर, प्रधान सचिव (श्रम एंव रोजगार), हिमाचल प्रदेश सरकार को भेज सकेगा/सकेंगे ।

उपर्युक्त नियत अवधि के भीतर प्राप्त हुए आक्षेप (पों) या सुझाव (वोंं), यदि कोई है/हों पर अंतिम अधिसूचना जारी करने से पूर्व विचार किया जाएगा ।

4. उच्च कशलः--सुपरवाईजर, अधीक्षक, स्टेनो ग्राफर, एकाउन्टेन्ट, अकुशल/ अर्द्ध- कुशल/कुशल/उच्च-कुशल की परिभाशा इस प्रकार होगीः--

(1) अकुशलः--अकुशल कर्मचारी वह कर्मचारी है जो ऐसे कार्य करता है जिसमें सामान्य कर्तव्यों के अनुपालन अन्तर्वलित है जिसमें कम अनुभव या कोई स्वतन्त्र निर्णय या पूर्व अनुभव की बहुत आवश्यकता नहीं पड़ती, यद्यपि व्यवसायिक परिस्थितियों से परिचित होना आवश्यक है। उस के कार्य शारीरिक परिश्रम (प्रयास) के अलावा उसे विभिन्न वस्तुओं या माल से भी परिचित होना आपेक्षित है ।

(2) अर्द्ध-कुशलः अर्द्ध-कुशल कर्मकार वह कर्मकार है जो सामान्यतः रोजमर्रा का निश्चित स्वरूप का काम करता हो जिसमें कि उससे निर्णय बुद्धि कुशलता की अपेक्षा न उचित निवर्हन के कार्य के लिए और जहां महत्वपूर्ण निर्णय अन्य द्वारा किया जाता हो किन्तु उसे समुनुदंषित कर्तव्यों के या सम्बन्धित छोटे इस प्रकार उसका कार्य क्षेत्र सीमित रोजमर्रा के कार्यो के करने तक ही सीमित होगा ।

(3) कुशलः कुशल कर्मचारी वह कर्मचारी है जो विचारणीय स्वतन्त्रत निर्णयों का प्रयोग दक्षतापूर्ण कार्य करने में सक्षम हों और अपने कर्तव्यों का जिम्मेदारी से पालन कर सके। वह व्यवसाय, शिल्प या उद्योग जिसमें, वह नियोजित किया गया हो, का पूर्ण एवं विस्तृत ज्ञान रखता हो ।

(4) उच्च-कुशलः उच्च-कुशल कर्मकार वह कर्मकार है जो कार्य को दक्षतापूर्ण करने में सक्षम हो और जो कुषल कर्मचारियों के कार्य को दक्षतापूर्ण पर्यवेक्षण कर सके।

No. Shram (A) 4-8/2006-Part-File.—Whereas, the Governor, Himachal Pradesh is of the opinion that more Scheduled Employments may be added to the schedule as required by Section 2 (g) of the Minimum Wages Act, 1948 (11 of the 1948)

And whereas, Employments which may be added to part-I of the schedule alongwith categorization of workers therein, are: - (1) Hydro Power Projects (2) Pharmaceuticals Industries (3) Hospitals, Nursing Homes and Clinics (4) Domestic Workers (5) Safai Karamchari 544 राजपत्र, हिमाचल प्रदेश, 28 अप्रैल, 2015/8 वैशाख, 1937 Employment (6) Security Services (7) Temples and Religious Places/Dharamshalas (8) Workers working in Toll Tax Barriers.

Now, therefore, in exercise of the powers vested in him under Section 27 of the Minimum Wages Act, 1948 (11 of 1948 Act) the Governor of Himachal Pradesh is pleased to publish the proposal for adding the afore mentioned Scheduled Employments in the Schedule as per details appended to this notification.

If any persons (s) likely to be effected by this notification, has any Objection (s) Suggestion (s) with respect to be proposed new scheduled Employments to be added in the schedule. He/ They may prefer the same to the Pr. Secretary (Lab. & Emp.) to the Govt. of H.P. within a period of three months from the date of publication of this notification in the Rajpatra, Himachal Pradesh.

Objection (s) or Suggestion (s), if any received, within the above stipulated period shall be taken into consideration before issuing the final notification.

(i) Unskilled:—An unskilled employee is one who does operations that involve the performance of simple duties, which require the experience of little or no independent judgment or pervious experience although familiarity with the occupational environment is necessary. His work may thus require in addition to physical exertion familiarity with variety of articles or goods.

(ii) Semi-Skilled:— A Semi-Skilled worker is one who does work generally of defined routine nature wherein the major requirements not so much of the judgment, skill and but for proper discharge of duties assigned to him or relatively narrow job and where important decisions made by others. His work is thus limited to the performance of routine operations of limited scope.

(iii) Skilled-A skilled employee is one who is capable of working efficiently of exercising considerable independent judgment and of discharging his duties with responsibility. He must possess thorough and comprehensive knowledge of the trade, craft or industry in which he is employed.

(iv) Highly Skilled-A highly skilled worker is one who is capable of working efficiently and supervises efficiently the work of skilled employees.

No. EXN-F(10)-23/2014.—Whereas, the draft amendments in SCHEDULES 'A' and 'D' appended to the Himachal Pradesh Value Added Tax Act, 2005, (Act No.12 of 2005) were notified in accordance with the provisions of section 10 of the Act ibid for inviting objections and suggestions from the person(s) likely to be affected thereby, vide this department notification of even number dated 9.3.2015 and published in the Rajpatra (e-Gazette), Himachal Pradesh on 10.3.2015;

And whereas, no objection/suggestion has been received within the stipulated period in this behalf;

Now, therefore, the Governor of Himachal Pradesh, in exercise of the power vested in him under section 10 of the Himachal Pradesh Value Added Tax Act, 2005 (Act No.12 of 2005) is pleased to make the following amendments in SCHEDULES 'A' and 'D' appended to the Act ibid, with effect from 01-05-2015 namely:-

AMENDMENT

1. In SCHEDULE 'A' , Part-I, the existing entry at Sr. No.2 shall be deleted.

2. In SCHEDULE 'D', below item No.1 "Motor-spirit (Petrol including Aviation Turbine Fuel and Diesel)", the following new entry shall be inserted after at Sr. No.2, namely:-

"3. Aviation Turbine Fuel sold to scheduled airlines as defined under entry (iid) of section 14 of the Central Sales Tax Act,1956 (Act No. 74 of 1956) and non-scheduled airlines (other than Defence) carrying passengers. 1%.".

सं0पी0बी0डब्ल्यू0(बी0)एफ(5) 29/2014.-यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि हिमाचल प्रदेश सरकार को सरकारी व्यय पर सार्वजनिक प्रयोजन हेतु नामतः गांव टीहरा मौजा भलेठ, तहसील सुजानपुर, जिला हमीरपुर, हि0 प्र0 में सुजानपुर-चौरी-पटलान्दर सड़क के निर्माण हेतु भूमि अर्जित करनी अपेक्षित है, अतएव एतद्‌ द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है, उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है।

2. यह अधिसूचना ऐसे सभी व्यक्तियों को, जो इससे सम्बन्धित हो सकते हैं, की जानकारी के लिए भूमि अर्जन, पुनर्वास और पुर्नव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा-11 के उपबन्धों के अन्तर्गत जारी की जाती है।

3. पूर्वोक्त धारा द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राज्यपाल हिमाचल प्रदेश इस समय इस उपक्रम में कार्यरत सभी अधिकारियों उनके कर्मचारियों और श्रमिकों को इलाके की किसी भी भूमि में प्रवेश करने और सर्वेक्षण करने तथा उप धारा द्वारा अपेक्षित अथवा अनुमतः अन्य सभी कार्यो को करने के लिए सहर्ष प्राधिकार देते हैं।

4. कोई भी हितबद्व व्यक्ति जिसे उक्त परिक्षेत्र में कथित भूमि के अर्जन पर कोई आपति हो तो वह इस अधिसूचना के प्रकाशित होने के तीस दिन की अवधि के भीतर लिखित रुप में भू.अर्जन समाहर्ता, (म0क्षे0) लोक निर्माण विभाग मण्डी, के समक्ष अपनी आपति दायर कर सकता है।

Registration of Marriages Act, 1996 alongwith an affidavit stating therein that they have solemnized their marriage on 1-5-2013 at Kanol but has not been found entered in the records of the Registrar of Marriages i.e. Secretary, Gram Panchayat Karari, Tehsil Dharamshala;

And whereas, they have also stated that they were not aware of the laws of the registration of marriage with the Registrar of Marriages and now, therefore, necessary orders for the regis- tration of their marriage be passed so that their marriage is registered by the concerned authority.

Whereas Kanta Sharma w/o Shri Rajesh Sharma, r/o 7-Oak, North Oak, Sanjauli Shimla, Himachal Pradesh has preferred an application to the undersigned for the registration of name of563 राजपत्र, हिमाचल प्रदेश, 28 अप्रैल, 2015/8 वैशाख, 1937 her daughter namely Neha Sharma whose date of birth is 26-4-1989 in the record of Municipal Corporation, District Shimla (H.P.).

Therefore, by this proclamation, the general public is hereby informed that any person having any objection for the entry as to date of birth mentioned above, may submit his/her objection in writing in this court from one month from the publication of this proclamation failing which no objection will be entertained after expiry of date and will be decided accordingly.
