HIMACHAL PRADESH ELECTRICITY REGULATORY COMMISSION, SHIMLA

NOTIFICATION

Shimla, the 11th May, 2015

No. HPERC/419.—WHEREAS the Himachal Pradesh Electricity Regulatory Commission (hereinafter referred as "the Commission" ) notified the Himachal Pradesh Electricity Regulatory Commission (Recovery of Expenditure for Supply of Electricity) Regulations, 2012, which were published in the Rajpatra, Himachal Pradesh, dated 23rd May, 2012 (hereinafter called "the said Regulations)";

28-राजपत्र/2015-12-05-2015 (739) 740 राजपत्र, हिमाचल प्रदेश, 12 मई, 2015/22 वैशाख, 1937 AND WHEREAS during the interaction with the field officers of the distribution licensee in the State, it is brought out that the Government Departments/Corporations/PSUs/CPSUs are experiencing difficulty in getting frequent approvals for deposit of requisite amount for getting electric connection from the licensee;

AND WHEREAS to address the such complexity, the Commission, recognizes the need for amendment in the relevant regulations of the said Regulations;

NOW, THEREFORE, in exercise of the powers conferred by section 46, read with section 181, of the Electricity Act,2003 (36 of 2003), read with section 21 of the General Clauses Act,1897 (10 of 1897), and all other powers enabling it in this behalf, the Commission proposes to make the following draft regulations further to amend the Himachal Pradesh Electricity Regulatory Commission (Recovery of Expenditure for Supply of Electricity) Regulations, 2012, and as required by sub-section (3) of section 181 of the said Act and rule 3 of the Electricity (Procedure for Previous Publication) Rules, 2005, the said draft regulations are hereby published for the information of all the persons likely to be affected thereby; and notice is hereby given that the said draft regulations will be taken into consideration after the expiry of thirty days from the date of their publication in the Rajpatra, Himachal Pradesh, together with any objections or suggestions which may within the aforesaid period be received in respect thereto.

DRAFT REGULATIONS

1. Short title and commencement.— (1) These regulations may be called the Himachal Pradesh Electricity Regulatory Commission (Recovery of Expenditure for Supply of Electricity) (First Amendment) Regulations, 2015.

(2) These regulations shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Regulation 5.— In sub-regulation (2) of regulation 5 of the Himachal Pradesh Electricity Regulatory Commission (Recovery of Expenditure for Supply of Electricity) Regulations, 2012.

(a) The following first proviso shall be inserted; namely:—

"Provided that in case of the Central and State Government/Government Agencies, if the applicant is willing to deposit in advance the entire estimated/actual cost of works including the service line, before the actual commencement of works required to be executed for supply of power and such estimated cost is more than the normative Infra Development Charges (IDC) and cost of service line, the applicant shall not be required to make the separate payment of IDC under these regulations and charges towards advance cost share for getting Power Availability Certificate (PAC) under Himachal Pradesh Electricity Supply Code, 2009"; and

(b) In the existing first proviso, for the word "Provided" the words "Provided further" shall be substituted.
