No. Home-B (B)-2-1/97 Part I.—The Governor, Himachal Pradesh is pleased to appoint following advocates as Deputy Advocate General on tenure basis in the office of Advocate General, Himachal Pradesh to be deployed exclusively in the HP Administrative Tribunal at the pleasure of the State Government from the dates of their assuming office:—

The terms & conditions of the appointment are as under:—

1. They will be paid retainer-ship fee, on monthly basis as per terms and conditions laid down in Government Notification No. Home-B(B)-2-1/97 dated 11/08/2010.

State Government.

3. Their services being purely on tenure basis and can be terminated at any time without any notice and without assigning any reasons.

4. They will do all criminal, quasi criminal court cases entrusted to them by the Advocate General, H.P., H.P. Government and Legal Remembrancer and no payment will be given for this purpose.

5. In the matter of leave and traveling allowance they will be governed by the Rules as applicable to the State Government employees.

6. Their services will be purely on tenure basis and as such they will not be entitled to any other service benefits viz pension, gratuity and encashment of leave etc. The above terms and conditions can further be revised and amended as per requirement from time to time.

Subject.— Regarding sending of criminal cases in the light of instructions issued dated 15-01-2015.

Sir,

In continuation to this department letter of even number dated 15.01.2015 on the subject cited above, I am directed to say that as per the aforesaid instructions only such cases may be sent to the State Govt. for further decision which are appealable before the Hon'ble High Court. However, it is being observed that the District Magistrates are also submitting/forwarding such cases which are not appealable before the Hon'ble High Court for following reasons:—

(a) Cases where the sole accused has died, admittedly in such cases no appeal lies.

748 राजपत्र, हिमाचल प्रदेश, 14 मई, 2015/24 वैशाख, 1937 (b) Cases where the convict has been convicted and given maximum Sentence and fine as per the provisions of the Act. e.g.where the convict has been punished under section 283 Cr.P.C. and he has paid maximum fine of Rs.200/- in the case, no further appeal lies.

(c) Cases which are appealable before the Court of Sessions being cognizable and non- bail-able.

(d) Cases where the accused has been declared as proclaimed offender. In such cases, the proceedings are kept pending against the accused. As and when the accused is arrested, the proceedings pending against him are re-opened. As such no appeals lies in these cases.

(e) Cases under section 321 Cr. P.C. which have been withdrawn with consent of the State Govt.

(f) Cases under section 320 Cr. P.C. which have been compounded with the consent of the Court between the complainant and the accused party.

In this back drop of the matter, you are therefore requested not to send such type of cases to the Government in which no appeal lies to the Hon'ble High Court of H.P. and as such, you are authorized to take decision at your own level to close such cases.

These instructions may be followed in letter and spirit.

श्री शमशेर सिंह पुत्र श्री चेत राम, गांव रतोली, डाकघर उदयपुर, उप-तहसील उदयपुर, जिला लाहौल-स्पिति, हिमाचल प्रदेश ने इस कार्यालय में एक प्रार्थना-पत्र प्रस्तुत किया है जिसमें श्री चेत राम पुत्र श्री शिवदयाल, गांव रतोली, डाकघर उदयपुर, उप-तहसील उदयपुर, जिला लाहौल-स्पिति, हिमाचल प्रदेश 13-10-2007 में रतोली झूला पार करते समय दरिया चनाब में बह गया है जिसकी लाश आज दिनांक तक बरामद न होने का उल्लेख किया गया है तथा इस प्रार्थना-पत्र के आधार पर थाना प्रभारी उदयपुर के माध्यम से भी मौका छानबीन लापता होने वारा कराया गया । चेत राम पुत्र शिवदयाल गांव रतोली की लाश बरामद न होने तथा उन्हें तलाशने के हर सम्भव प्रयास किये जाने तथा व्यर्थ होने सम्बन्धी शपथ-पत्र भी प्रस्तुत की है । अब शमशेर सिंह पुत्र चेत राम, गांव रतोली को यकीन हो गया है कि उनके पिता सहदेव पुत्र कर्म दास अब जीवित नहीं है जिनके मकफूद-उल-खबरी का इन्तकाल अपने पक्ष में दर्ज व तस्दीक करवाना चाहते है, जिसके कारण ग्राम पंचायत उदयपुर, उप-तहसील उदयपुर के जन्म एवं मृत्यु रजिस्टर में मृत्यु तिथि की प्रविष्टि करना आवश्यक हो चुका है ताकि चेत राम पुत्र शिवदयाल गांव रतोली की विरासत उतराधिकारियों के नाम तस्दीक की जा सके ।

अतः इस इश्तहार द्वारा आम जनता को सूचित किया जाता है कि श्री चेत राम पुत्र शिवदयाल की मृत्यु तिथि रजिस्टर में दर्ज इन्द्राज करवाने तथा उनकी उत्तराधिकार नामांतरण उनके उत्तराधिकारियों के नाम तस्दीक करने बारे कोई उजर या एतराज हो तो दिनांक 17-5-2015 को इस न्यायालय में प्रातः 11.00 बजे असालतन या वकालतन या स्वयं उपस्थित हो कर अपनी आपत्ति या एतराज प्रस्तुत कर सकता है । अन्यथा एकतरफा कार्यवाही अमल में लाई जाएगी ।
