संख्याः ई.एक्स.एन.-एफ(10)-17/2014.-हिमाचल प्रदेश के राज्यपाल का समाधान हो गया है कि लोकहित में ऐसा करना आवश्यक और समीचीन है;

अतः हिमाचल प्रदेश के राज्यपाल अधिसूचना संख्याः ई.एक्स.एन.-एफ(1)-2/2004(i)तारीख 30-3-2005 के अधिक्रमण में, साधारण खण्ड अधिनियम, 1897 की धारा 21 के साथ पठित केन्द्रीय विक्रय कर अधिनियम, 1956 (1956 का अधिनियम संख्यांक 74) की धारा 8 की उपधारा(5) के खण्ड (ख) द्वारा प्रदत्त 32-राजपत्र/2015-16-05-2015 (765) 766 राजपत्र, हिमाचल प्रदेश, 16 मई, 2015/26 वैशाख, 1937 शक्तियों का प्रयोग करते हुए, निदेश देतें हैं कि प्रवर्ग 'सी' क्षेत्रों में अवस्थित किसी नई औद्योगिक इकाई को चलाने वाले व्यौहारियों द्वारा विनिर्मित माल के विक्रय पर पूर्वाेक्त अधिनियम के अधीन कर की छूट एतद्‌पश्चात्‌, सारणी के अनुसार और इस विभाग की अधिसूचना संख्या ई.एक्स.एन.-एफ.(10)-17/2014 तारीख 06-04-2015 में यथा विनिर्दिष्ट समस्त निबन्धनों और शर्तों के अध्यधीन अनुज्ञेय होगी ।

NOTIFICATION

Shimla-171002, the 15th May, 2015

No. EXN-F(10)-17/2014.—Whereas the Governor of Himachal Pradesh is satisfied that it is necessary and expedient to do so in the public interest;

Now, therefore, in exercise of powers conferred by clause (b) of subsection (5) of section 8 of the Central Sales Tax Act 1956 (Act No.74 of 1956) read with section 21 of the General clauses Act,1897, the Governor of Himachal Pradesh, in supersession of Notification No. EXN- F(1)2/2004(i) dated 30-3-2005 is pleased to direct that henceforth the tax exemption under the aforesaid Act on the sale of goods manufactured by the dealers running any new industrial unit located in category 'C' areas shall be admissible as per table and subject to all the terms and conditions as specified in this Department Notification No. EXN-F(10)-17/2014 dated 06-04-2015.

संख्या ई.एक्स.एन.-एफ(10)-8/2013-लूज़.-हिमाचल प्रदेश के राज्यपाल, केन्द्रीय विक्रय अधिनियम, 1956 (1956 का अधिनियम संख्यांक 74) की धारा 13 की उपधारा (3) और (4) द्वारा प्रदा शक्तियों का प्रयोग करते हुए, सैंट्रल सेल्स टैक्स (हिमाचल प्रदेश) रूल्ज,1970 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थातः-

1. स्ांक्षिप्त नाम और प्रारम्भ.-(1) इन नियमों का संक्षिप्त नाम सैंट्रल सेल्स टैक्स (हिमाचल प्रदेश) अमैंडमेंट रूल्ज, 2015 है ।

(2) ये नियम प्रथम अप्रैल,2015 को प्रवृत होंगें ।767 राजपत्र, हिमाचल प्रदेश, 16 मई, 2015/26 वैशाख, 1937 2. नियम 7 का संशोधन.-सैंट्रल सेल्स टैक्स (हिमाचल प्रदेश) रूल्ज,1970 के नियम 7 में,-(क) उप नियम (1) के स्थान पर निम्नलिखित उप नियम रखा जाएगा, अर्थातः-

"(1) Every dealer registered under this Act shall furnish a return in Form VAT-XV in such manner and within such time as specified under rule 40 of the Himachal Pradesh Value Added Tax Rules,2005. Before a registered dealer furnishes the return he shall pay the tax due under the Act according to such return within 30 days from the expiry of each month or quarter of a financial year, as the case may be. The return shall be accompanied with the Treasury/Bank receipt in token of the tax due having been paid."; और

(ख) उप नियम (1-क) के स्थान पर निम्नलिखित उप नियम रखा जाएगा, अर्थातः-

"(1-क) Notwithstanding anything contained in subrule (1), the returns shall be filed electronically in FORM-I, for returns upto to the financial year 2014-15 and in FORM VAT-XV for returns pertaining to the financial year 2015-16 and thereafter, by way of uploading all requisite information on the web-site of the Excise and Taxation Department.".

No. EXN-F(10)-8/2013-Loose.—In exercise of the powers conferred by sub-section (3) and (4) of section 13 of the Central Sales Tax Act,1956 (Act No.74 of 1956), the Governor of Himachal Pradesh is pleased to make the following rules further to amend the Himachal Pradesh Central Sales Tax(Himachal Pradesh) Rules,1970, namely:—

1. Short title and commencement.—(1) These rules may be called the Central Sales Tax Act (Himachal Pradesh) Amendment Rules,2015.

(2) They shall come into force on 1st day of April,2015. 2. Amendment of rule 7. In rule 7.— of the Central Sales Tax(Himachal Pradesh) Rules,1970,-

(a) for sub-rule(1), the following sub-rule shall be substituted, namely:-

"(1) Every dealer registered under this Act shall furnish a return in Form VAT-XV in such manner and within such time as specified under rule 40 of the Himachal Pradesh Value Added Tax Rules, 2005. संख्याः टी0सी0पी0-एफ(5)-7/2013.-हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम 1977 (1977 का अधिनियम संख्याक 12) की धारा 13 की उपधारा (2) के खण्ड (क) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, अधिसूचना संख्याःटी.सी.पी.-एफ(5)-7/2013 तारीख 15-1-2014 द्वारा गठित नादौन योजना क्षेत्र, तहसील नादौन, जिला हमीरपुर से निम्नलिखित राजस्व गॉंवों (हदवस्त संख्याओं) को अपवर्जित करते हैं, अर्थात्‌ः-

उत्तर : व्यास नदी और मान खडड के संगम बिन्दु से आरम्भ होकर व्यास नदी के साथ लगते मोहाल कोट हदबस्त संख्या 18/21, सेरी हदवस्त संख्या 19 और वेला हदवस्त संख्या 19/38 की उत्तरी सीमा के साथ-साथ मोहाल बेला की उत्तरी-पूर्वी सीमा के मिलन बिन्दु तक ।

No. TCP-F(5)-7/2015.—In exercise of powers conferred by sub-section (a) of sub-section (2) of section (13) of the Himachal Pradesh Town and Country Planning Act, 1977(Act No. 12 of 1977), the Governor of Himachal Pradesh is pleased to exclude the following revenue villages (Hadbast Nos) from the Nadaun Planning Area, Tehsil Nadaun, Distt. Hamirpur which was constituted vide Government Notification No. TCP-F(5)-7/2013 dated 15-1-2014, namely:-

Consequent upon such exclusion, the Governor of Himachal Pradesh is pleased to re-define the limits of the Nadaun Planning Area as under:—

NADAUN PLANNING AREA BOUNDARY

NORTH: Starting from the confluence point of Beas River and Man Khad along upstream of River Beas following the northern boundary of Mohal Kot Hadbast No. 18/21, Seri Hadbast No. 19, and Bela Hadbast No. 19/38 upto the northern-eastern boundary meeting point of Mohal Bela.

EAST: Starting from the meeting point of northern-eastern boundatry of Mohal Bela towards southern side following the eastern boundary of Mohal Bela Hadbast No. 19/38, Tillu Khas Hadbast No. 19/39, DPF Tillu Hadbast No. 19/39, Jalari Shounklan Hadbast No. 19/32, upto the meeting point of eastern-southern boundary of Mohal Jalari Shounklan.

SOUTH: Starting from the meeting point of eastern-southern boundary of Mohal Jalari Shounklan towards western side following the southern boundary of Mohal Jalari Shounklan Hadbast No. 19/32, upto NH.88 Dharmshala-Shimla then following the Nala boundary downstream passing between Mohal Harmandir Rukwalan Hadbast No. 19/37, then following the southern boundary of Mohal Harmandir Mandiala Hadbast No. 19/35, Mohal Bharmoti Kalan Hadbast No. 18/25 upto the meeting point of southern-western boundary of Mohal Bharmoti Kalan.

संख्याः टीसीपी-एफ (5)-1/2015.-हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977, (1977 का अधिनियम संख्यांक 12) की धारा 13 की उपधारा (1) के अधीन अधिसूचना संख्याः टी0सी0पी-एफ(5)-1/2015 तारीख 14-5-2015 द्वारा ''धौलाकुंआ-माजरा योजना क्षेत्र'' का गठन कर लिया गया है;

और उक्त योजना क्षेत्र के विद्यमान भू-उपयोग के मानचित्र (नक्शे) को पूर्वोक्त अधिनियम की धारा 15 (1) के अधीन यथा अपेक्षित के अनुसार अभी तक प्रकाशित नहीं किया गया है;

और हिमाचल प्रदेश के राज्यपाल का समाधान हो गया है कि पूर्वोक्त योजना क्षेत्र में, भू-उपयोग में परिवर्तन या उसपर किसी निर्माण संक्रिया से सतह या किसी भूमि या मिटटी पर हानिकारक अवरोध होने की सम्भावना है या मिटटी के संरक्षण, भूमि के खिसकने की रोकथाम या भूमि कटाव से संरक्षण हेतु हानिकारक समझा गया है और पूर्वोक्त अधिनियम के उपबन्धों के अनुसार उक्त क्षेत्र की योजना बनाना और विकास करना सम्भवतः कठिन हो गया है;

राजपत्र, हिमाचल प्रदेश, 16 मई, 2015/26 वैशाख, 1937 अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम 1977, (1977 का अधिनियम सख्यांक 12) की धारा 15 क की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, ''धौलाकुंआ-माजरा योजना क्षेत्र'' के विद्यमान भू-उपयोग मानचित्र (नक्शे) पर, इस अधिसूचना के राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से तीन वर्ष की अवधि के लिए रोक लगाते है।

No. TCP- F(5)-1/2015.—Whereas, "Dhaulkuan-Majra Planning Area" has been constituted under subsection (1) of Section 13 of the Himachal Pradesh Town and Country Planning Act, 1977 vide this Department Notification No. TCP-F(5)-1/2015 Dated 14.5.2015.

And whereas existing land use map of the said Planning Area has not yet been published as required under sub-section (1) of Section-15 of the aforesaid Act;

And whereas the Governor of Himachal Pradesh is satisfied that in the aforesaid Planning Area the change of land use or any building operation therein is likely to cause injurious disturbance of the surface or any land or soil, or is considered detrimental to the preservation of soil, prevention of land slips or protection against erosion and is likely to make it difficult to plan and develop the said area in accordance with the provisions of the aforesaid Act;

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 15-A of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor of Himachal Pradesh is pleased to freeze the existing land use map of the "Dhaulkuan-Majra Planning Area" for a period of three years from the date of publication of this Notification in the Official Gazette, Himachal Pradesh.

संख्याः यू0 डी0-ए (1)-2/2014.-हिमाचल प्रदेश के राज्यपाल, प्रस्तावित करते हैं कि संलग्न अनुसूची में यथा विनिर्दिष्ट क्षेत्रों को, हिमाचल प्रदेश नगरपालिका अधिनियम, 1994 की धारा 4 के अधीनए निरमण्ड, जिला कुल्लू, हिमाचल प्रदेश को नगर पंचायत के रूप में वर्गीकृत किए जाने हेतु उक्त क्षेत्र के बेहतर विकास और सुव्यवस्थित व्यवस्था के लिएए पूर्वोक्त अधिनियम की धारा 3 की उपधारा (2) के अधीन नगरपालिका गठित किए जाने के आशय से, नगरपालिका क्षेत्र के रूप में घोषित किया जाना चाहिए। उक्त अनुसूची में विनिर्दिष्ट क्षेत्र के निवासियों से नगर पंचायत निरमण्ड, जिला कुल्लू, की प्रस्तावित घोषणा के सम्बन्ध में अपने-अपने आक्षेप/सुझाव, यदि कोई हों, प्रस्तुत करने की एतद्‌ द्वारा अपेक्षा की जाती है और ऐसे आक्षेप/सुझाव, इस अधिसूचना के राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से छह सप्ताह की अवधि के भीतर, उपायुक्त, कुल्लू के माध्यम से अतिरिक्त मुख्य सचिव (शहरी विकास), हिमाचल प्रदेश सरकार को लिखित में प्रस्तुत किए जाने चाहिए।

उपरोक्त नियत अवधि के अवसान के पश्चात्‌ कोई भी आक्षेप, जो भी होंए स्वीकार नहीं किए जाएंगे।

No. UD-A(1)-2/2014.—The Governor of Himachal Pradesh is pleased to propose that the areas as specified in the Schedule enclosed, should be declared as municipal area under section 4 of the Himachal Pradesh Municipal Act, 1994 in order to constitute a municipality under sub-section (2) of section 3 of the Act ibid to be classified as Nagar Panchayat at Nirmand, District Kullu, H.P. for better development and improved arrangement in the said area.

PUBLIC NOTICE

Whereas the above named applicants have made an application under section 8(4) of the H. P. Registration of Marriages Act, 1996 alongwith an affidavit stating therein that they have solemnized their marriage on 17-10-2010 at Haripurl but has not been found entered in the records of the Executive Officer, Municipal Council Dharamshala;

And whereas, they have also stated that they were not aware of the laws of the registration of marriage with the Registrar of Marriages and now, therefore, necessary orders for the regis- tration of their marriage be passed so that their marriage is registered by the concerned authority.

Now, therefore, objections are invited from the general public that if anyone has any objection regarding the registration of the marriage of the above named applicants, then they should appear before the court of undersigned on 29-5-2015 at Tehsil Office Dharamshala at 2.00 P.M. either personally or through their authorized agent.

In the event of their failure to do so, orders shall be passed ex parte against the respondents for the registration of marriage without affording any further opportunity of being heard.
