No. MPP F(1) 2/2005-IX.—In supersession to this department Notification No. MPP F(1)2/2005-VII dated 28.07.2012 the Governor of Himachal Pradesh is pleased to notify the amendments in State ydro Power Policy 2006 to the following extent:--

1. "The Developers implementing Hydro Electric Projects, are permitted to transfer the ownership by way of selling/transfer equity stakes of Principle Promoter beyond 51% after allowing stabilization period of 6 months from the date of achieving Commercial Operation of the Project.

The Principal Promoters are also allowed to sell/transfer their equity beyond 51% during the implementation period of the Project in the name of any third party which is competent enough to develop the Project in a better manner and possesses resources higher than the existing allotted Companies who have shown their inabilities to go ahead with the implementation of the Project due to various constraints including lack of finances for the Project implementation, subject to fulfillment of the following terms and conditions:

i. Provided that a detailed proposal showing competency in terms of Financial & Technical credential of the New Entity willing to acquire the Project, is submitted for consideration of the Government by either of the parties, alongwith firm letter of consent and valid resolutions duly passed by the Board of Directors of both the Companies, stating that all liabilities & responsibilities assigned in favour of the allottee Company shall be acceptable to the new entity.

ii. Provided that an undertaking to the effect that all liabilities as well as payments due in favour of the original allottee Company are duly accepted by the new entity.

iii. Provided that the new entity should possess adequate financial as well as technical competences in such a manner that the credentials of the new entity should meet the strengths required for prequalification as per the allotment terms and conditions.

In lieu of allowing change/transfer of equity of Principal Promoters, a fee @ Rs. 50,000/- per MW subject to maximum of Rs. 50 lakh is to be deposited at the time of signing Tripartite Agreement for transfer of Project along with all liabilities/responsibilities in the name of new entity.

The above provisions will be applicable to Projects of all sizes.

This shall come into force from the date of its publication in the Himachal Pradesh Rajpatra.

No. MPP-F (10)24/2011-III.— In partial modification to this department Notification No. MPP- F(10) 24/2011, dated 5th October, 2011 and subsequent modifications carried out thereafter from time to time, regarding revised guidelines for management of Local Area Development Fund (LADF), the Governor, Himachal Pradesh is pleased to make the following amendments in the Revised Guidelines for Management of Local Area Development Fund (LADF) in respect of Hydro Electric Projects, reads as under:--

1.2 (a) Additional 1% (one percent) Free Power after commissioning of hydro power projects shall be earmarked for the LADF to provide a regular stream of revenue for income1115 राजपत्र, हिमाचल प्रदेश, 4 जून, 2015/14 ज्येष्ठ, 1937 generation on a sustained and continuous bases and this fund would be available in the form of an annuity over the entire life of the project. The revenue to be generated out of sale of 1% Additional Free Power on account of LADF shall be disbursed amongst the beneficiary families in the following proportion in line with the notification dated 11.07.2013.

i. 50% of the total amount of LADF to be divided to all families in PAA equally subject to BPL families getting higher amount as per the policy notified on 05.10.2011.

ii. Balance 50% of the total amount of LADF to be divided between the families in the ratio of the land acquired in their respective Panchayat subject to BPL families getting higher amount as per the policy notified on 05.10.2011.

6.2 The LADF will be administered by a committee called the Local Area Development Committee (LADC) which will be constituted for each Project separately, immediately after signing of the Implementation Agreement. All the LADCs constituted within the District shall function under the overall super intendance and control of the Local MLA/ Deputy Commissioner. The LADCs for various sizes of projects will be as under:--

6.2.1 District Level LADC for projects in District Kinnaur:

6.2.7 The cheque signing authority in all the cases shall be Member Secretary only. Other terms & conditions will remain the same.

6.2.8 In case any project lies in more than one District, there shall be a separate LADC for each district.

6.2.9 The above proposal will entail separate LADC for each project in each district enabling better targeting and execution of schemes.

6.2.10 Local MLA shall be an invitee to every meeting of all such Local Area Development Committees, where local MLA is not a Chairman of LADC.

Other terms and conditions notified vide Notification No. MPP-F(10)24/2011, dated 5th October, 2011 and further amended from time to time, shall remain unchanged.

No. GAD-C(PA)4-2/2003-II.—In exercise of the powers conferred by section 15 read with sections 8 and 9 of the Salaries and Allowances of Ministers (Himachal Pradesh) Act, 2000 (Act No. 11 of 2000), the Governor, Himachal Pradesh is pleased to make the following rules further to amend the Himachal Pradesh Ministers Advance for Motor Car and House Building Rules, 2000, notified vide this department Notification No. GAD-C(PA)4-1/95-II dated 31.10.2000 and published in the Rajpatra, Himachal Pradesh (Extra-Ordinary) dated 18.11.2000, namely:-- 1. Short title.— These rules may be called the Himachal Pradesh Ministers Advance for Motor Car and House Building (Amendment) Rules, 2015.

2. Amendment of rule 4.— In rule 4 of the Himachal Pradesh Ministers Advance for Motor Car and House Building Rules, 2000 (hereinafter referred to as the "said rules"), for the words "twenty lacs" wherever these occur, the words "fifty lacs" shall be substituted.

3. Amendment of rule 13.— In rule 13 of the said rules, for the words "twenty lacs" wherever these occur, the words "fifty lacs" shall be substituted.

1. Short title.— These rules may be called the Himachal Pradesh Ministers Travelling Allowance (Amendment) Rules, 2015.

2. Amendment of rule 4.— In rule 4 of the Himachal Pradesh Ministers Travelling Allowance Rules, 2000 (hereinafter referred to as the "said rules"), in sub-rule (1), in clause (a), for the word "thirteen", the word "fifteen" shall be substituted.

No. EDN-A-Kha(3)28/2007.—Shri Kamal Kishore Handa Principal (College Cadre), Class-I (Gazetted) posted at Directorate of Higher Education has requested on 08.05.2015 for premature retirement due to personal reasons in relaxation of the rules through Directorate of Higher Education.

The date of birth of the said officer is 04.01.1958. He joined Government service on 26th August, 1983 as Lecturer (College Cadre) and 12th January, 2007 as Principal (College Cadre). The Governor, Himachal Pradesh, is accordingly pleased to order the pre-mature retirement of Shri Kamal Kishore Handa Principal (College Cadre), Class-I (Gazetted) working at Directorate of Higher Education as per his request, by invoking the provisions laid down under the H.P. Civil Services (Pre-mature retirement) Rules, 1976 and relaxing the notice of three months period for such retirement from service as per rules, subject to the condition that all the outstanding amount recoverable from him will be deducted from the dues payable to him, if any, w.e.f. 31st May, 2015(A.N.), after completion of 31 years 09 months 6 days Government Service.

Short Title & Commencement.—(1) These Rules may be called the Himachal Pradesh Legislative Assembly Members (Motor car and House Building Advance) (1st Amendment) Rule, 2015.

(2) These Rules shall come into force from the date of publication in Rajpatra.

(2) These Rules shall come into force from the date of publication in Rajpatra.

Amendment of Rule-4.—(3) In Rule 4 of the Himachal Pradesh Legislative Assembly Ex. Members (House Building and Motor Car Advance) Rules, 2005 for the words "Rupees Five Lacs" appearing in this rule, the word "Rupees Fifteen Lacs" shall be substituted; and (ii) Provided that 2nd loan amounting to "Rupees ten Lacs" shall only be sanctioned in respect of those Ex. MLAs who have already repaid the whole amount of 1st loan together with interest.

Amendment of Rule-10.—(4) In Rule 10 of the Himachal Pradesh Legislative Assembly Ex. Members (House Building and Motor Car Advance) Rules, 2005 for the words "Rupees Five Lacs" appearing in this rule, the word "Rupees Fifteen Lacs" shall be substituted ; and (ii) Provided that 2nd loan amounting to "Rupees ten Lacs" shall only be sanctioned in respect of those Ex. 4. नियम-5 का संशोधन.--(4) हिमाचल प्रदेश विधान सभा भूतपूर्व सदस्यों के (रेल/वायु/बस द्वारा मुफ्त पारगमन) नियम, 2003 के नियम 5 में आए शब्द ''किसी बस (साधारण/डीलक्स)'' के स्थान पर शब्द ''हिमाचल प्रदेश पथ परिवहन निगम की सभी बसें और वोल्वों बसें'' रखे जाएंगे ।

Amendment of Rule-5.—(4) In Rule 5 of the Himachal Pradesh Legislative Assembly Ex. Members (Free travel facilities by Rail/Air/Bus) Rules, 2003, for the words by "any 1126 राजपत्र, हिमाचल प्रदेश, 4 जून, 2015/14 ज्येष्ठ, 1937 Bus(Ordinary or Deluxe)" appearing in this rule, the word "all buses of HRTC and Volvo buses" shall be substituted.
