अधिसूचना

सं. 56/2015 (i) रा.दल.अनु.-III.--निर्वाचन प्रतीक (आरक्षण तथा आबंटन) आदेश, 1968, 1968 के पैरा 17 के उप पैरा 2 के अनुसरण में, भारत निर्वाचन आयोग, अपनी अधिसूचना सं. 56/2015/रा.दल.अनु. -II, तारीख 13-01-2015 में एतद्‌द्वारा निम्नलिखित संशोधन करता हैं, अर्थात :--

1. उक्त अधिसूचना से संलग्न सारणी-II (राज्यीय दल) में--

(i) सिक्किम राज्य के संबंध में क्रम सं0 20 पर विद्यमान, 'सिक्किम क्रांतिकारी मोचो', से सम्बन्धित कॉलम नंबर 4 में विद्यमान प्रविष्टि को, प्रविष्टि 'अेबल लैंप के साथ प्रतिस्थापित किया जाएगा । 2. उक्त अधिसूचना से संलग्न सारणी-III (रजिस्ट्री—त अमान्यता प्राप्त दल) में--

(i) स्तम्भ 1, 2 व 3 के अन्तर्गत क्रम सं. 1737 पर विद्यमान प्रविष्टियों के पश्चात्‌ निम्नलिखित प्रविष्टियां क्रमशः अन्तःस्थापित की जाएंगी--

(ii) क्र.सं. 597 अर्थात्‌ 'गुजरात परिवर्तन पार्टी' से संबंधित स्तम्भ 1,2 व 3 पर विद्यमान प्रविष्टियों को विलोपित किया जाएगा।

(iii) क्रम सं. 1079 के सामने स्तम्भ 2 पर विद्यमान प्रविष्टियाें को, प्रविष्टियों 'नवोदयम पार्टी, से प्रतिस्थापित किया जाएगा।

(iv) क्रम सं. 1301 के सामने स्तम्भ 2 पर विद्यमान प्रविष्टियाें को, प्रविष्टियों 'राष्ट्रीय जन-जगरण मोर्चा, से प्रतिस्थापित किया जाएगा।

(v) क्रम सं. 373 के सामने 'भारतीय सर्वोदय क्रांति पार्टी' के संबंध में स्तम्भ 3 पर विद्यमान प्रविष्टियाें को, प्रविष्टियों '113, मलिकपुर, जी.टी.बी. नगर, दिल्ली-110009' से प्रतिस्थापित किया जाएगा।

(vi) क्रम सं. 83 के सामने 'अखिल भारतीय आमजन पार्टी' के संबंध में स्तम्भ 3 पर विद्यमान प्रविष्टियाें को, प्रविष्टियों 'मुकाम, पोस्ट-लाइपुरा, गांव-गगवाना, जिना-अजमेर, राजस्थान-305023' से प्रतिस्थापित किया जाएगा।

(vii) क्रम सं. 750 के सामने 'जनराज्य पार्टी' के संबंध में स्तम्भ 3 पर विद्यमान प्रविष्टियाें को, प्रविष्टियों '110/F/10A/1A/, गांव-कन्हाईपुर, धूमनगंज, इलाहाबाद-211001, उत्तर प्रदेश' से प्रतिस्थापित किया जाएगा।

(viii) क्रम सं. 229 के सामने 'बहुजन समाज पार्टी (अम्बेडकर)' के संबंध में स्तम्भ 3 पर विद्यमान प्रविष्टियाें को, प्रविष्टियों 'म.सं.-B-33/103, मोहल्ला-शहरियान, कपूरथला, पंजाब' से प्रतिस्थापित किया जाएगा।

3. उक्त अधिसूचना से संलग्न सारणी-IV (मुक्त प्रतीकों की सूची) में.--

(i) क्रम सं. 3 पर विद्यमान प्रविष्टि को, प्रविष्टियों 'ऑटो-रिक्शा' (आंध्र प्रदेश एवं तेलंगाना राज्यों को छोड़कर सभी राज्यों और संघ राज्य क्षेत्रों में)' से प्रतिस्थापित किया जाएगा।

(ii) क्रम सं. 46 पर विद्यमान प्रविष्टि को, प्रविष्टियों 'टोप' (आंध्र प्रदेश एवं तेलंगाना राज्यों को छोड़कर सभी राज्यों और संघ राज्य क्षेत्रों में)' से प्रतिस्थापित किया जाएगा। 1738 राजपत्र, हिमाचल प्रदेश, 04 जुलाई, 2015/13 आषाढ़, 1937 (iii) क्रम सं. 51 एवं 52 पर विद्यमान प्रविष्टियों अर्थात्‌ 'केतली' एवं 'लेडी पर्स', को विलोपित किया जाएगा।

(iv) क्रम सं. 75 पर विद्यमान प्रविष्टि अर्थात्‌ 'टेवल लैम्प', को विलोपित किया जाएगा।

NOTIFICATION

No. 56/2015 (I)/PPS-III.—In pursuance of sub-paragraph (2) of paragraph 17 of the Election Symbols (Reservation & Allotment) Order, 1968, the Election Commission of India hereby makes the following amendments to its Notification No. 56/2015/PPS-II, dated 13.01.2015, namely:—

1. In Table II (State Parties), appended to the said Notification—

(i) Against Sl. No. 20 in respect of the State of Sikkim, the existing entry under column No. 4 related to 'Sikkim Krantikari Morcha', shall be substituted with the entry 'Table Lamp'.

2. In Table III (Registered un-recognised parties), appended to the said Notification- (ii) After the existing entries at Sl. No. 1737, the following entries shall be inserted under Column Nos. 1, 2 & 3, respectively: —

(ii) Entries under column 1, 2 and 3, pertaining to 'Gujarat Parivartan party' mentioned at Sl. No. 597 shall be deleted.

(iii) Against Sl. No. 1079 the existing entries under column 2 shall be substituted by the entries 'Navodayam Party'.

(iv) Against Sl. No. 1301 the existing entries under column 2 shall be substituted by the entries 'Rashtriya Jan-Jagran Morcha'.

(v) Against Sl. No. 373 in respect of 'Bharatiya Sarvodaya Kranti Party', the existing entries under column 3 shall be substituted by the entries '113, Malikpur, G.T.B. Nagar, Delhi-110009'.

(vii) Against Sl. No. 750 in respect of 'Jan Raajya Party', the existing entries under column 3 shall be substituted by the entries '110/F/10A/1A, Kanahipur Village, Dhoomangunj, Allahabad-211001, Uttar Pradesh'.

(viii) Against Sl. No. 229 in respect of 'Bahujan Samaj Party (Ambedkar)', the existing entries under column 3 shall be substituted by the entries 'H.No.- B-33/103, Mohalla Shehrian, Kapurthala, Punjab'.

3. In Table IV (List of Free Symbols), appended to the said Notification-

(i) The existing entry at Sl. No. 3 shall be substituted by the entries 'Auto-Rickshaw (In all States and Union Territories except in the States of Andhra Pradesh and Telangana)'.

(iii) The existing entry at Sl. No. 46 shall be substituted by the entries 'Hat (In all States and Union Territories except in the States of Andhra Pradesh and Telangana)'.

(iv) The existing entries at Sl. No. 51 and 52 i.e. 'Kettle' and 'Lady Purse' shall be deleted.

(v) The existing entry at Sl. No. 75 i.e. 'Table Lamp' shall be deleted

No. 100/HP-HP/1/2013:—Whereas, the Election Commission is satisfied that the contesting candidate specified in column (4) of the Table below at the Bye-election to the Lok Sabha in Himachal Pradesh, 2013 as specified in Column (2) held from the constituency specified 1744 राजपत्र, हिमाचल प्रदेश, 04 जुलाई, 2015/13 आषाढ़, 1937 in column (3) against his/her name, has failed to lodge the account required by law of his/her election expenses as shown in column (5) of the said Table as required by the Representation of the People Act, 1951 and Rules and Order made there under;

And Whereas, the said candidates have either not furnished any reason or explanation for the said failure even after due notice and the Election Commission is thus satisfied that they have no good reason or justification for the said failure;

Now, therefore, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission hereby declares the persons specified in column (4) of the table below to be disqualified for being chosen as, and for being, a member of either House of the Parliament or of the Legislative Assembly or Legislative Council of a State for a period of three years from the date of this order:—

संख्या ई.एक्स.एन.-एफ(10)-2/2015-लूज़.--हिमाचल प्रदेश के राज्यपाल, राजपत्र, हिमाचल प्रदेश में 6 जून 2015 को यथा प्रकाशित इस विभाग की अधिसूचना संख्या ई.एक्स.एन.-एफ(10)-2/2015-लूज तारीख 3 जून,2015 के आंशिक उपांतरण में और हिमाचल प्रदेश मूल्य परिवर्धित कर अधिनियम, 2005 (2005 का अधिनियम संख्यांक 12) की धारा 63 द्वारा प्रदा शक्तियों का प्रयोग करते हुए उक्त अधिसूचना की क्रम संख्या 8 (नियम 64 का संशोधन) को निम्नलिखित रीति में प्रतिस्थापित करते हैं जिसे राजपत्र में उक्त अधिसूचना के प्रकाशन की तारीख से इस प्रकार पढ़ा जाएगा :-

8. ''नियम 64 का संशोधन.--उक्त नियमों के नियम 64 में, सिवाए परन्तुक के, उप-नियम(2) के स्थान पर निम्नलिखित उप-नियम रखा जाएगा, अर्थात्‌ः-

(2) धारा 21 की उप-धारा (1)के प्रयोजन हेतु विवरणी-

(i) सही मानी जाएगी, यदि इसका पाठ, व्यौहारी द्वारा वार्षिक विवरणी सहित दाखिल किए गए तुलन-पत्र/लाभ और हानि लेखा/व्यापार लेखा के अनुरूप हों और इस पाठ को आगामी1747 राजपत्र, हिमाचल प्रदेश, 04 जुलाई, 2015/13 आषाढ़, 1937 वित्तीय वर्ष की 20 मार्च तक अभिलेख में उपलब्ध तत्प्रतिकूल किसी प्रतिकूल सूचना द्वारा अधिक्षिप्त नहीं किया जा सकता है; और

(ii) विशिष्टतया सारवान रूप में सम्पूर्ण मानी जाएगी यदि इसमें दी जाने वाली अपेक्षित समस्त सूचना अन्तर्विष्ट है, अंकगणितीय रूप से सही है और यथालागू केन्द्रीय विक्रय कर अधिनियम, 1956 या हिमाचल प्रदेश मूल्य परिवर्धित कर अधिनियम, 2005 के अधीन यथा विहित वैधानिक (कानूनी) प्ररूपों इसके साथ संलग्न है या विहित सूचियों, दस्तावेजों और विवरणियों के अनुसार देय कर की संदाय के सबूत व्यौहारी द्वारा सम्यक्‌ रूप से हस्ताक्षरित हैः।''

CORRIGENDUM

Shimla-2, the 3rd July, 2015

No. EXN-F(10)-2/2015-Loose.—In partial modification of this Department Notification No.EXNF ( 10)-2/2015-Loose dated 3rd June,2015 as published in Rajptra Himachal Pradesh on 6.6.2015, and in exercise of the powers conferred by section 63 of the Himachal Pradesh Value Added Tax Act,2005 (Act No.12 of 2005) the Governor of Himachal Pradesh hereby substitute Sr.No.8 (Amendment of rule 64) of the said notification in the following manner which shall be read as such from the date of publication of the said notification in the official Gazzette:—

8. "Amendment of rule 64.—In rule 64 of the said rules, for sub-rule(2), except proviso, the following sub-rule shall be substituted, namely:—

(2) For the purpose of sub-section(1) of section 21 a return shall be deemed to be—

(i) correct, if its versions conforms to the balance sheet/profit and loss account/trading account filed by the dealer along-with annual return and this version cannot be impeached by any adverse information, to the contrary, available on record till 20th March of the following financial year; and

(ii) complete, in material particulars, if it contains the entire information required to be furnished therein, is correct arithmetically and is accompanied by the statutory forms as prescribed under the Central Sales Tax Act,1956 or the Himachal Pradesh Value Added Tax Act, 2005 as applicable or prescribed lists, documents and proof of payments of the full amount of tax due according to the returns and is duly signed by the dealer:.''.

इससे पहले कि उपरोक्त वर्णित वसीयत को पंजीकृत किया जाए, आम जनता एवं मृतक श्री छोटा राम के बारसान को इस इश्तहार के माध्यम से सूचित किया जाता है कि अगर इस वसीयत को पंजीकृत करने में उन्हें किसी प्रकार का कोई एतराज हो तो वह असालतन या वकालतन दिनांक 29-7-2015 या इससे पहले अदालत में हाजिर आकर अपना उजर एतराज प्रस्तुत कर सकते हैं। अगर निर्धारित तिथि को कोई उजर/एतराज प्रस्तुत नहीं होता है तो वसीयत को पंजीकृत कर दिया जाएगा।
