No. HHC/Rules/RTI/2013.—In exercise of the powers conferred under Section 28 read with Section 2(e)(iii) of the Right to Information Act, 2005 (22 of 2005), Hon'ble the Chief Justice 75-राजपत्र/2015-16-07-2015 (2335) 2336 राजपत्र, हिमाचल प्रदेश, 16 जुलाई, 2015/25 आषाढ़, 1937 of the High Court of Himachal Pradesh, is pleased to make the following amendment in "The High Court of Himachal Pradesh Right to Information, Rules, 2013".

1. Short title.—These Rules shall be called "The High Court of Himachal Pradesh Right to Information (1st amendment-2015) Rules, 2013".

2. Commencement.—They shall come into force with immediate effect.

Amendment(s).—Rule 5 (1)(a) & (b) of "The High Court of Himachal Pradesh Right to Information Rules 2013" shall be substituted as follows:—

Charging of fee.—(1) The following fee shall be payable by the person seeking information:—

(a) An application fee of Rs. 10/- to be deposited as per rule 4(1) at the time of making application to the State Public Information Officer or the State Assistant Public Information Officer.

(b) The State Public Information Officer shall charge the fee for the supply of sought for information at the following rates :—

(i) Where the information is available in the form of a priced publication On printed price.

(ii) For other than priced publication

(a) Rs. 2/-per page. (b) Actual charge or cost price of a copy in larger size paper. (c) Actual cost or price for sample or models.

(iii) Where information is available in electronic form and is to be supplied in electronic form e.g. floopy, CD etc.

Rs. 25/- per C.D.

(iv) Information relating to tenders documents/ bids/quotations/business contract

Rs. 100/-per application

Amendment.—Existing Rule 6(2) of "The High Court of Himachal Pradesh Right to Information Rules, 2013" shall stand deleted. Consequently, Rule 6(3) and 6(4) shall be re- numbered as Rule 6(2)&6(3).

संख्याः कूप0ए0(3)-1/2014.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से अधिसूचना2337 राजपत्र, हिमाचल प्रदेश, 16 जुलाई, 2015/25 आषाढ़, 1937 संख्याः कूप0बी0; (1)-2/99 तारीख 15-1-2008 द्वारा अधिसूचित हिमाचल प्रदेश सहकारिता विभाग निरीक्षक/निरीक्षक (संपरीक्षा) सहकारी सभाएं (वर्ग-III, अराजपत्रित) भर्ती और प्रोन्नति नियम, 2007 का और संशोधन करने के लिए निम्नलिखित नियम बनाते है; अर्थातः-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश सहकारिता विभाग, निरीक्षक/निरीक्षक (संपरीक्षा) सहकारी सभाएं, (वर्ग-III अराजपत्रित) भर्ती और प्रोन्नति (द्वितीय संशोधन) नियम, 2015 है।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत होंगे । 2. उपाबन्ध ''क'' का संशोधन.--हिमाचल प्रदेश सहकारिता विभाग निरीक्षक/निरीक्षक (संपरीक्षा) सहकारी सभाएं (वर्ग-III अराजपत्रित) भर्ती और प्रोन्नति नियम, 2007 के उपाबन्ध-क में; स्तम्भ संख्या 15-क के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थातः-

इन नियमों में किसी बात के होते हुए भी पद पर संविदात्मक नियुक्तियां नीचे दिए गये निबन्धनों और शर्तों के अध्यधीन की जाएगीः

I. संकल्पनाः

(क) इस पॉलिसी के अधीन सहकारिता विभाग में निरीक्षक/निरीक्षक (संपरीक्षा) सहकारी सभाएं, को संविदा के आधार पर प्रारम्भ में एक वर्ष के लिए लगाया जाएगा, जिसे वर्षानुवर्ष आधार पर बढ़ाया जा सकेगा;

परन्तु संविदा अवधि को वर्षानुवर्ष आधार पर बढ़ाने के लिए सम्बद्ध विभागाध्यक्ष यह प्रमाण-पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण, वर्ष के दौरान संतोषजनक रहा है और केवल तभी उसकी संविदा की अवधि विस्तारित/नवीकृत की जाएगी। (ख) पद का हिमाचल प्रदेश लोक सेवा आयोग शिमला के कार्यक्षेत्र में आना.--रजिस्ट्रार सहकारी सभाएं हिमाचल प्रदेश रिक्त पदों को संविदा आधार पर भरने के लिए सरकार का अनुमोदन प्राप्त करने के पश्चात अध्यपेक्षा को सम्बद्ध भर्ती अधिकरण अर्थात ''हिमाचल प्रदेश लोक सेवा आयोग शिमला'' के समक्ष रखेगा।

(ग) चयन इन नियमों में विहित पात्रता शर्तों के अनुसार किया जाएगा।

(II) संविदात्मक उपलब्धियांः

संविदा के आधार पर नियुक्त व्यक्ति को 13,900 रूपए की दर से समेकित नियत संविदात्मक रकम (जो पे बैण्ड के न्यूनतम जमा ग्रेड पे के बराबर होगी) प्रतिमास संदत की जाएगी। यदि संविदा में एक वर्ष से अधिक की बढ़ौतरी की जाती है तो पश्चात्‌वर्ती वर्ष/वर्षों के लिए संविदात्मक उपलब्धियों में 417/-रूपए (पद के पे बैण्ड का न्यूनतम जमा ग्रेड पे की तीन प्रतिशत) की रकम वार्षिक वृद्धि के रूप में अनुज्ञात की जाएगी।

(III) नियुक्ति और अनुशासन प्राधिकारीः

रजिस्ट्रार सहकारी सभाएं, हिमाचल प्रदेश नियुक्ति और अनुशासन प्राधिकारी होगा।

(IV) चयन प्रक्रियाः

''संविदा नियुक्ति की दशा में पद पर नियुक्ति के लिए चयन मौखिक परीक्षा के आधार पर किया जाएगा। यदि आवश्यक या समीचीन समझा जाए, तो लिखित परीक्षा या व्यावहारिक परीक्षा के आधार2338 राजपत्र, हिमाचल प्रदेश, 16 जुलाई, 2015/25 आषाढ़, 1937 पर किया जाएगा, जिसका स्तर/पाठ्‌यक्रम आदि सम्बद्ध भर्ती अभिकरण, अर्थात हिमाचल प्रदेश लोक सेवा आयोग, शिमला द्वारा अवधारित किया जाएगा।''

(V) संविदात्मक नियुक्ति व्यक्तियों के लिए चयन समितिः

''जैसी सम्बन्धित भर्ती अधिकरण अर्थात हिमाचल प्रदेश लोक सेवा आयोग, षिमला द्वारा गठित की जाए।''

(VI) करारः

अभ्यर्थी को, चयन के प्श्चात्‌ इन नियमों से संलग्न उपाबन्ध- 'ख' के अनुसार करार हस्ताक्षरित करना होगा।

(VII) निबन्धन और शर्तेंः

(क) ''संविदा पर नियुक्त व्यक्ति को 13,900/-रूपये (जो पे बैण्ड के न्यूनतम जमा ग्रेड पे के बराबर होगी)। की नियत संविदात्मक रकम 13,900/-रूपये प्रति मास संदत्त की जाएगी। संविदा पर नियुक्त व्यक्ति आगे बढ़ाए गए पश्चात्‌वर्ती वर्ष/वर्षों के लिए संविदात्मक उपलब्धियों में 417/- रूपए (पे बैण्ड का न्यूनतम जमा ग्रेड पे का तीन प्रतिशत), की रकम की वृद्धि का हकदार होगा और कोई अन्य सहबद्ध प्रसुविधाएं जैसे वरिष्ठ/चयन वेतनमान आदि नहीं दिया जाएगा।'' (ख) संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अस्थायी आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्यपालन/आचरण ठीक नहीं पाया जाता है तो नियुक्ति समाप्त की जाने के लिए दायी होगी।

(ग) ''संविदा पर नियुक्त व्यक्ति एक मास की सेवा पूरी करने के पश्चात एक दिन के आकस्मिक अवकाश का हकदार होगा। तथापि संविदा पर नियुक्त कर्मचारी सोलह सप्ताह के प्रसूति अवकाश, दस दिन के चिकित्सा अवकाश और 5 दिन के विशेष अवकाश के लिए भी हकदार होगा/होगी। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी आदि के लिए हकदार नहीं होगा/ होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगाः

परन्तु अनुपभुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा।''

(घ) नियन्त्रक अधिकारी के अनुमोदन के बिना कर्तव्य से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यावसान (समापन) हो जाएगा। तथापि आपवादिक मामलों में जहां पर चिकित्सा आधार पर कर्तव्य (डयूटी) से अनधिकृत अनुपस्थिति के हालात संविदा पर नियुक्त व्यक्ति के नियन्त्रण से बाहर हों, तो नियमितीकरण के मामले में विचार करते समय ऐसी अवधि अपवर्जित नहीं की जाएगी, परन्तु पदधारी को इस बाबत समय पर नियन्त्रण अधिकारी को सूचित करना होगा। तथापि संविदा पर नियुक्त व्यक्ति कर्तव्य से अनुपस्थिति की ऐसी अवधि के लिए संविदात्मक रकम का हकदार नहीं होगा;

परन्त उसे सरकार के प्रचलित अनुदेशों के अनुसार चिकित्सा अधिकारी द्वारा जारी बीमारी/आरोग्य प्रमाण-पत्र प्रस्तुत करना होगा।

(ङ) संविदा के आधार पर नियुक्त कोई कर्मचारी, जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया है आवश्यकता के आधार पर स्थानान्तरण हेतु पात्र होगा जहां कही भी प्रशासनिक कारणों से अपेक्षित हो।2339 राजपत्र, हिमाचल प्रदेश, 16 जुलाई, 2015/25 आषाढ़, 1937 (च) चयनित अभ्यर्थी को सरकारी/रजिस्ट्रीकृत चिकित्सा व्यवसायी से अपना आरोग्य प्रमाण-पत्र प्रस्तुत करना होगा। बारह सप्ताह से अधिक समय से गर्भवती महिलाएं प्रसव होने तक, अस्थायी तौर पर अनुपयुक्त बनी रहेंगी। ऐसे महिला अभ्यर्थी का किसी प्राधिकृत चिकित्सा अधिकारी/व्यवसायी द्वारा उपयुक्तता के लिए पुनः परीक्षण किया जाएगा।

(छ) संविदा पर नियुक्त व्यक्ति का यदि अपने पदीय कर्तव्यों के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी पद के वेतनमान के न्यूनतम पर नियमित प्रतिस्थानी पदधारी हो लागू है, यात्रा भत्ते/दैनिक भत्ते का हकदार होगा।

(ज) नियमित कर्मचारियों की दशा में यथालागू सेवा नियमों के उपबंध जैसे एफ.आर.एस.आर, छुट्‌टी नियम, साधारण भविष्य निधि नियम, पेंशन नियम तथा आचरण नियम आदि, संविदा पर नियुक्त व्यक्तियों की दशा में लागू नहीं होंगे। वे इस स्तम्भ में यथावर्णित उपलब्धियों आदि के लिए हकदार होंगे ।

3. उपाबन्ध-''ख'' का संशोधन.--हिमाचल प्रदेश सहकारिता विभाग निरीक्षक/निरीक्षक (संपरीक्षा), सहकारी सभाएं (वर्ग-III, अराजपत्रित) भर्ती और प्रोन्नति नियम, 2007 के उपाबन्ध ''ख'' में; क्रम संख्या 4 और 5 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थातः-

''4. संविदा पर नियुक्त व्यक्ति एक मास की सेवा पूरी करने के पश्चात एक दिन के आकस्मिक अवकाश का हकदार होगा। तथापि, संविदा पर नियुक्त कर्मचारी सोलह सप्ताह के प्रसूति अवकाश, दस दिन के चिकित्सा अवकाश और 5 दिन के विशेष अवकाश के लिए भी हकदार होगा/होगी। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी आदि के लिए हकदार नहीं होगा/ होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय किसी अन्य प्रकार का कोई अवकाश अनुज्ञात नहीं होगाः

परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार चिकित्सा अधिकारी द्वारा जारी बीमारी/आरोग्य प्रमाण-पत्र प्रस्तुत करना होगा।''

No. Coop. A(3)-1/2014.—In exercise of the powers conferred by proviso to Article 309 of the constitution of India, the Governor, Himachal Pradesh in consultation with the H.P. Public 2340 राजपत्र, हिमाचल प्रदेश, 16 जुलाई, 2015/25 आषाढ़, 1937 Service Commission, is pleased to make the following rules further to amend the Himachal Pradesh Co-operation Department Inspector/Inspector (Audit) Cooperative Societies Class-III, (Non- Gazetted) Recruitment and Promotion Rules,2007 notified vide notification No. Coop. B (1)-2/99 dated 15-01-2008, namely:—

1. Short title and Commencement.—(1) These rules may be called the Himachal Pradesh Co-operation Department Inspector/Inspector (Audit) Cooperative Societies, (Class-III, Non-Gazetted) Recruitment and Promotion (2nd Amendment) Rules, 2015.

(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Annexure-"A".—In Annexure-A to the Himachal Pradesh Co- operation Department Inspector/Inspector (Audit) Cooperative Societies (Class-III, Non-Gazetted) Recruitment and Promotion Rules, 2007—

(a) For the existing provisions against Col.No.15-A, the following shall be substituted, namely:—

Notwithstanding anything contained in these rules, contract appointments to

the post will be made subject to the terms and conditions given below:—

(I) CONCEPT:

(a) Under this policy, the Inspector/Inspector (Audit) Cooperative Societies in the Cooperation Department will be engaged on contract basis initially for one year which may be extendable on year to year basis.

Provided that the extension/ renewal of contract period on year to year basis the concerned HOD shall issue a certificate that the service and conduct of the contract appointee is satisfactory during the year and only then his period of contract is to be renewed/extended.

(a) POST FALLS WITHIN THE PURVIEW OF HPPSC:

The Registrar, Cooperative Societies, H.P. after obtaining the approval of the Government to fill up the posts on contract basis will place the requisition with the concerned recruiting agency i.e. "Himachal Pradesh Public Service Commission Shimla".

(II) CONTRACTUAL EMOLUMENTS:

"The contractual appointee will be paid fixed contractual amount @Rs.13900/-per month(which shall be equal to minimum of the pay band + Grade Pay). An amount @ Rs.417/- (3% of the minimum of the pay band + Grade pay of the post) as annual increase in contractual emoluments for the subsequent year(s) will be allowed if contract is extended beyond one year".

(III) APPOINTING/DISCIPLINARY AUTHORITY:

Registrar, Cooperative Societies will be appointing and disciplinary authority.

(IV) SELECTION PROCESS:

Selection for appointment to the post in the case of contract appointment will be made on the basis of viva-voce test or if considered necessary or expedient by a written test or practical test the standard/syllabus etc. of which will be determined by the concerned recruiting agency i.e. "Himachal Pradesh Public Service Commission, Shimla;".

(V) COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS:

As may be constituted by the concerned recruiting agency i.e. "Himachal Pradesh Public Service Commission Shimla from time to time".

(VI) AGREEMENT:

After selection of a candidate he/she shall sign an agreement as per Annexure-B appended to these rules.

(VII) TERMS AND CONDITIONS:

(a) The Contractual appointee will be paid fixed contractual amount @Rs.13900/-per month(which shall be equal to minimum of the pay band + Grade Pay). The contract appointee will be entitled for increase in contractual amount @ Rs.417/- (3% of the minimum of the pay band + Grade pay of the post ) for further extended years. And no other allied benefits such as senior/selection scales etc. will be given.

(b) The service of the contract appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not found satisfactory.

(c) Contract appointee will be entitled for one day's casual leave after putting one month service. However, the contract appointee will also be entitled for 16 weeks maternity leave and 10 days medical leave and 5 days special leave. He/She shall not be entitled for medical reimbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee.

Provided that the un-availed casual leave, medical leave and special leave can be accumulated upto the calendar year and will not be carried forward for the next calendar year.

(d) Unauthorized absence from the duty without the approval of the Controlling Officer shall automatically lead to the termination of the contract. However, in exceptional cases where the circumstances for un-authorized absence from duty were beyond his/her control on medical grounds, such period shall not be excluded while considering his/her case for regularization but the incumbent shall have to intimate the controlling authority in this regard well in time. However, the contract appointee shall not be entitled for contractual amount for this period of absence from duty.

Provided that he/she shall submit the certificate of illness/fitness issued by the Medical Officer, as per prevailing instructions of the Government.

2342 राजपत्र, हिमाचल प्रदेश, 16 जुलाई, 2015/25 आषाढ़, 1937 (e) An official appointed on contract basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative grounds.

(f) Selected candidate will have to submit a certificate of his/her fitness from a Government/Registered Medical Practitioner. In case of women candidates pregnancy beyond twelve weeks will stand her temporarily unfit till the confinement is over. The women candidate will be re-examined for fitness from an authorized medical officer/practitioner.

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection with his/her official duties at the same rate as applicable to regular counterpart at the minimum of pay scale.

(h) Provisions of service rules like FR,SR, Leave Rules, GPF Rules, Pension Rules & conduct Rules etc. as are applicable in case of regular employees will not be applicable in case of contract appointees. They will be entitled for emoluments etc. as detailed in this column.

3. Amendment of Annexure-"B".—In Annexure-"B" to the Himachal Pradesh Co- operation Department Inspector/ Inspector (Audit) Cooperative Societies(Class-III, Non-Gazetted Recruitment and Promotion Rules, 2007;

(a) For the existing provisions against Sr.No.4 & 5, the following shall be substituted, namely:—

"4 Contract appointee will be entitled for one day's casual leave after putting one month service. However, the contract appointee will also be entitled for 16 weeks maternity leave and 10 days medical leave and 5 days special leave. He/She shall not be entitled for medical re-imbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee;".

Provided that the un-availed casual leave, medical leave and special leave can be accumulated upto the Calendar Year and will not be carried forward for the next Calendar Year.

संख्या कोप-ए (3)-1/99 भाग-5.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश सहकारी सोसाइटी अधिनियम, 1968 (1969 का अधिनियम संख्याक 3) की धारा 109 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्या 5-3/69 कोप (एस) तारीख 15-5-1971 द्वारा अधिसूचित और राजपत्र, हिमाचल प्रदेश में तारीख 25 मई, 1971 को प्रकाशित दी हिमाचल प्रदेश कोऑप्रेटिव सोसाइटीज रूल्ज, 1971 का और संशोधन करने के लिये निम्नलिखित नियम बनाने का प्रस्ताव करते हैं और अब इन्हें जनसाधारण की सूचना के लिए राजपत्र, हिमाचल प्रदेश (असाधारण) में एतद्‌द्वारा प्रकाशित किया जाता है;

इन प्रारूप नियमों से सम्भाव्य प्रभावित होने वाला किसी व्यक्ति को उक्त प्रारूप नियमों की बावत, यदि कोई आक्षेप या सुझाव है/हैं तो वह उसे /उन्हें उक्त नियमों के राजपत्र, हिमाचल प्रदेश मेें प्रकाशन की तारीख से तीस दिन की अवधि के भीतर, मुख्य सचिव (सहकारिता) हिमाचल प्रदेश सरकार, शिमला को भेज सकेगा;

नियत अवधि के भीतर प्राप्त हुए आक्षेप (पों) या सुझाव (वों), यदि कोई है/हैं, पर सरकार द्वारा इन प्रारूप नियमों को अंतिम रूप देने से पूर्व विचाार किया जाएगा, अर्थात्‌ः-

प्रारूप नियम

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम दी हिमाचल प्रदेश कोऑप्रेटिव सोसाइटीज (संशोधन) नियम, 2015 है ।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगें।

2. नियम 56 का संशोधन.--दी हिमाचल प्रदेश कोऑप्रेटिव सोसाइटीज रूल्ज, 1971 के नियम 56 के उप-नियम (3) के स्थान पर निम्नलिखित उप-नियम रखा जाएगा, अर्थात्‌ः-

"(3) No Primary society shall employ a salaried officer or servant with total monthly emoluments exceeding rupees five thousand and no secondary or apex society shall employ a salaried officer or servant with total monthly emoluments exceeding rupees eight thousand without the prior permission of the Registrar. The promotion of any employee to a higher post shall be deemed to be an appointment under this sub-rule:

Provided that a co-operative society in which operating expenses, excluding the amount of depreciation, exceed its income in the financial year, such society shall not employ any salaried officer or servant in the next succeeding financial year without the prior permission of the Registrar:

Provided further that no co-operative society shall employ salaried officer or servant exceeding the cadre strength, if any, fixed by the Registrar by a special or general order:

Provided further that a co-operative society shall not fill more than ten vacancies in a financial year under this sub-rule without prior permission of the Registrar".

No. Coop.A(3)-1/99-Vol-V.—In exercise of the powers conferred by section 109 of the Himachal Pradesh Co-operative Societies Act, 1968 (Act No. 3 of 1969), the Governor of Himachal Pradesh proposes to make the following rules further to amend the Himachal Pradesh Co-operative Societies Rules, 1971 vide this Department's notification No. 5-3/69-Coop(S), dated 15.5.1971 and published in Rajpatra, Himachal Pradesh on 25th May, 1971 and now the same are hereby published in Rajpatra, Himachal Pradesh (Extra- Ordinary) for the information of General Public;

If any person likely to be affected by these draft rules has any objection(s) or suggestion(s) to be made with regard to the said draft rules he may send the same to the Chief Secretary (Co- operation) to the Government of Himachal Pradesh, Shimla within a period of 30 days from the date of publication of the said rules in Rajpatra Himachal Pradesh;

The objection(s) or suggestion(s), if any, received, within the stipulated period shall be considered by the State Government before finalizing the draft rules, namely:—

1. Short title and Commencement.—(1) These rules may be called the Himachal Pradesh Cooperative Societies (Amendment) Rules, 2015.

(2) These shall come into force from the date of publication in Rajpatra, Himachal Pradesh.

2. Amendment of rule 56.—In rule 56 of the Himachal Pradesh Cooperative Societies Rules, 1971, for sub-rule (3), the following sub rule shall be substituted, namely:—

(2) ये रेगुलेशन राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. रेगुलेशन 5 का संशोधन.--हिमाचल प्रदेश पब्लिक सर्विस कमीशन (मैम्बरज़) रेगुलेशन, 1974 के विद्यमान रेगुलेशन 5 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

"5. The Chairman and Members appointed to Commission shall receive pay and allowances as admissible to the Chief Secretary and Principal Secretary respectively under the State Government from time to time."

3. रेगुलेशन 9 का संशोधन.--हिमाचल प्रदेश पब्लिक सर्विस कमीशन (मैम्बरज़) रेगुलेशन, 1974 के विद्यमान रेगुलेशन 9(2) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

"(2) Notwithstanding anything contained in these regulations the Chairman of H.P. Public Service Commission shall be entitled to receive a fixed basic pay of R 80,000/- plus other admissible allowances at par with the Chief Secretary and Members of the Commission shall be entitled to the pay scale of R 67000-79000 (No Grade Pay):

Provided that if the Chairman or a Member, at the time of appointment as such is a person retired from Government, a local Body, a University or any other Body wholly or substantially owned or controlled by the Government and was drawing pay more than the maximum of the pay scales of Chairman and Member in that case the last pay drawn by them shall be taken into consideration for fixation of pay subject to the condition that pay plus gross pension shall not exceed R 80,000/- per month.".
